The laws establishing the depository library system are amongthe oldest right to know statutes passed by the U.S. Congress. Innearly 1,400 congressionally designated libraries throughout theUnited States, the public has access to information about its Gov-ernment. The depository libraries in accepting this designationpledge themselves to provide free public access to all Governmentdocuments entrusted to them.
The members of the Joint Committee on Printing enthusiastical-ly support this program and encourage all citizens to avail them-selves of the wealth of information made available through the de-pository libraries. To aid all interested persons in the use of deposi-tory libraries, the Joint Committee periodically publishes a com-mittee print providing the addresses and telephone numbers of alllibraries in the system. GOVERNMENT DEPOSITORY LIBRARIES
Section I.Overview
AUTHORIZATION
To help fulfill its responsibility to inform the public on thepolicies and programs of the Federal Government, Congress es-tablished the Depository Library Program. This program isbased upon three principles: 1) with certain specified exceptions,all government publications shall be made available to deposito-ry libraries; 2) depository libraries shall be located in each Stateand congressional district in order to make government publica-tions widely available; and 3) these government publicationsshall be available for the free use of the general public.
Chapter 19 of title 44 of the U.S. Code is the authority forthe establishment and operation of the depository program. Per-tinent sections of t: .le 44 and the U.S. Statutes at Large affect-ing this program are reprinted in Section II of this publication.
TYPES OF LIBRARIES DESIGNATED
The provisions of title 44 provide authorization for the follow-ing libraries to be designated as depositories:2 libraries for each congressional district to be designated by the Repre-

In several instances, there are three or more depository li-braries in the same congressional district, all designated by Rep-resentatives, due to redistricting after each decennial census. Asof June 1984, 1,385 libraries have accepted designation as de,positories.
Before an additional depository may be designated in a con-gressional district or Puerto Rico by a Representative or theResident Commissioner, a certified statement justifying the needfor an additional depository must be provided by the head ofthe library to be designated. This justification must be signedby the head of every existing depository within the congression-al district or Puerto Rico, or by the head of the library author-ity of the State or Puerto Rico. A similar justification is re-quired in the case of a senatorial designation when the Senatoror his predecessor has already designated an existing depository.
REGIONAL DEPOSITORIES
The 1962 amendments to the law provided for the designationof not more than two libraries in each State and the Common-wealth of Puerto Rico to be regional depositories. Such designa-tions may be made by the Senators from he States and theResident Commissioner of Puerto Rico.
Libraries designated to be regional depositories must alreadybe designated depositories.
Designation as a regional depository requires prior approval ofthe head of the library authority of the State or the Common-wealth of Puerto Rico.
Regionals assume the responsibility of retaining depositorymaterial permanently and of providing inter-library loan andreference service in the region served. Regionals also provide as-sistance to selective depositories in the disposal of unwantedmaterial. Regionals are encouraged to add the unwanted materi-al to their own collections so citizens will be able to access acopy of all Federal publications in the libraries in their ownregion.
DISCONTINUANCE OF DEPOSITORY DESIGNATION
Once a library has been designated a depository, it cannot bedropped from the program and another library designated in itsplace upon the election of a new Member of Congress. It re-mains a depository until it ceases to exist or vacates the privi-lege at its own request (sec. 5, Sundry Civil Act, approved June23, 1913, 38 Stat. 75, as amended). It can, however be removedfrom depository status by the Superintendent of Documents forfailure to abide by the laws governing the depository program
U.S.C. 1910, Oct. 22, 1968, 82 Stat. 1286).
GOVERNMENT PUBLICATION SELECTION PROCEDURES
Depository libraries are authorized to receive "Governmentpublications except those determined by their issuing compo-nents to be required for official use only, or for strictly admin-istrative or operational purposes which have no public interestor educational value, and publications classified for reasons of

national security." Section 1903 of title 44 provides exemptionsfor "so called cooperative publications which must necessarily besold in order to be self-sustaining." These are primarily certainpublications of the Library of Congress ani the National Tech-nical Information Service.
A list of the series and groups of Government publicationsavailable for distribution is furnished to all depositories fortheir use in making selections. This list of classes is revised asnew series are published by existing agencies, or new agenciesare established in order to permit depositories to select fromthe new material. A library number is assigned to each libraryby the Superintendent of Documents at the Government Print-ing Office so that the selecting library will receive the publica-tions chosen.
Publications are supplied to libraries in both paper and micro-form formats. The possibility of supplying information in elec-tronic format is being explored by the Joint Committee onPrinting.
The annual appropriations act for the Government PrintingOffice beginning with July 1, 1922, provides that no part of thesum appropriated shall be used to supply depository librarieswith any publications not requested by such libraries, and thatsuch request must be made in advance of printing.
DISPOSAL OF GOVERNMENT PUBLICATIONS BY DEPOSITORIES
The law requires that the publications received by the deposi-tory libraries be retained permanently. "Depository libraries notserved by a regional depository library, or that are regional de-pository libraries themselves shall retain Government publica-tions permanently in either printed form or in microfacsimileform, except superseded publications or those issued later inbound form which may be discarded as authorized by the Su-perintendent of Documents."
Libraries served by a regional depository may withdraw fromcirculation publications retained for a period of at least fiveyears after securing permission from the regional library andafter "offering them to other depository libraries within theirarea and then to other libraries".
Depository libraries within executive departments and inoe-pendent agencies of the Federal Government are authorized todispose of unwanted Government publications after first offeringthem to the Library of Congress and the National Archives.
Depository libraries at State Appellate Courts may dispose ofunwanted Government publications after offering them to thedesignated regional depository. If the State is not served by adesignated regional depository, publications should be offered tothe State Librarian.
HISTORY OF EARLY LEGISLATION
Before the establishment of designated depositories, or anysystematic methods for the distributiol of public documents,special acts were passed at various times providing for theprinting of a sufficient number of copies of the public journalsof the Senate and House of Representatives for distribution to

the executives of the several States and each branch of theState and territorial legislatures. Provision woo also made attimes for supplying these journals, the acts, and sometimes thedocuments and reports, to each university and college incorpo-rated in each State, as well as to the incorporated historical so-cieties throughout the country.
During the 13th Congress, second session, December 27, 1812,a resolution was adopted embodying these provisions which hadpreviously been covered by special legislation. The resolutionprovided for the distribution of the 13th Congress documents, aswell as for "every future Congress". The printing of documentsfor public distribution was limited to 200 copies over the"usual" number, and of course this was more than sufficient forthe needs of that early day.
By joint resolutions approved July 20, 1840, and April 30,1844, the number of copies of journals and documents printedwas increased.
A resolution of January 28, 1857, as amended by resolution ofMarch 20, 1858, set up the framework of the present depositorylibrary system. By these provisions, the journals and documentswhich up to that time were deposited in the Library of Con-gress for distribution by the Librarian, and 250 copies of thosedelivered to the Department of State for distribution by thatDepartment to colleges and other literary institutions, weretransferred to the jurisdiction of the Secretary of the liiterior"for distribution to such colleges, public libraries, atheneums,literary and scientific institutions, and boards of trade or publicassociations as may be designated to him by the Representativein Congress from each congressional district and by the Dele-gate from each Territory in the United States."
The following February, at the second session, 35th Congress(Feb. 5, 1859), an act was passed providing for "keeping, anddistributing all public documents" (11 Stat 379). This actcharged the Secretary of the Interior with "receiving, arranging,safekeeping, and distribution" of public documents "of everynature," already or hereafter directed by law to be printed orpurchased for the use of the Government, "except such as arefor the special use of Congress or the executive departments." Italso empowered him to remove from the Congressional Libraryand other places all accumulations of books, journals, etc., andappropriated $22,000 for the purpose. He was directed by theact to keep accurate statistics of the receipt and distribution ofall books.
Section 5 of this act further amended the resolution of Janu-ary 28, 1857, by providing for the designation of a library byeach of the Senators, and directing that the distribution shouldbe made first to !Rich States as had not yet been covered bydistribution, and that in the future the distribution should bekept equal in each congressional district and territory.
All books, maps, charts, etc., heretofore deposited in the De-partment of State were also turned ever to the Secretary of theInterior.
On March 2, 1861, "An Act providing for keeping and distrib-uting all Public Documents, and for other purposes" was passed.The first section of the 1861 law gave the Secretary of the Inte-

rior the right to decide which libraries would receive documentswhen there were insufficient copies for all libraries designatedby Members of Congress.
This law also provided that libraries receiving documentsfrom the 2nd session of the 35th Congress would be the sameones which received documents from the 1st session. The lawcontinued "and in all cases hereafter the selection of an institu-tion to receive the documents ordered to be published or pro-cured at the first session of any Congress shall control the doc-uments of the entire Congress, unless another designation bemade before any distribution has taken place under the selec-tion first made."
Upon the basis of these acts, the Revised Statutes were com-piled, and chapter 7, sections 497 to 511, pages 82 to 85, containall operative provisions reenacted at that time and supersedingall fot mer enactments.
No legislation can be found prior to that contained in theGeneral Printing Act of January 12, 1895, affecting the Stateand territorial libraries, and it is thought that it became cus-tomary to send documents regularly to these libraries, underthe discretionary powers vested in the Secretary of the Interior.This would account for their appearance on the depository listmany years prior to 1895.

Chapter 19DEPOSITORY LIBRARY PROGRAM
01901. Definition of government publication"Government publication" as used in this chapter, means informational matter
which is published as an individual document at Government expense, or as re-quired by law.
01902. Availability of Government publications through Superintendent of Doc-uments; lists of publications not ordered from Government PrintingOffice
Government publications, except those determined by their issuing componentsto be required for official use only for strictly administrative or operational pur-poses which have no public interest or educational value and publications classi-fied for reasons of national security, shall be made available to depository li-braries through the facilities of the Superintendent of Documents for public in-formation. Each component of the Government shall furnish the Superintendentof Documents a list of such publications it issued during the previous month,that were obtained from sources other than the Government Printing Office,01903. Distribution of publications to depositories; notice to Government com-
ponents; cost of printing and bindingUpon request of the Saparintendent of Documents, components of the Govern-
ment ordering the printing of publications shall either increase or decrease thenumber of copies of publications furnished for distribution to designated deposi-tory libraries and State libraries so that the number of copies delivered to thesoTintendent of Documents is equal to the number of libraries on the list.The number thus delivered may not be restricted by any statutory limitation inforce on August 9, 1962. Copies of publications furnished the Superintendent ofDocuments for distribution to designated depository libraries shall include
the journals of the Senate and House of Representatives;all publications, not confidential in character, printed upon the requisition
of a congressional committee;Senate and House public bills and resolutions; andreports on private bills, concurrent or simple resolutions;
but not so-called cooperative publications which must necessarily be sold inorder to be self - sustaining.
The Superintendent of Documents shall currently inform the components ofthe Government ordering printing of publications as to the nur fiber of copies oftheir publications required for distribution to depository libraries. The cost ofprinting and binding those publications distributed to depository libraries ob-tained elsewhere than from the Government Printing Office, shall be borne bycomponents of the Government responsible for their issuance; those requisitionedfrom the Government Printing Office shall be charged to appropriations provid-ed the Sup ,ntendent of Documents for that purpose.

# 1904. Classified list of Government publications for selection by depositoriesThe Superintendent of Documents shall currently issue a classified list of Gov-
ernment publications in suitable form, containing annotations of contents andlisted by item identification numbers to facilitate the selection of only thosepublications needed by depository libraries. The selected publications shall bedistributed to depository libraries in accordance with regulations of the Superin-tendent of Documents, as long as they fulfill the conditions provided by law.# 1905. Distribution to depositories; designation of additional libraries; justifica-
tion; authorization for certain designationsThe Government publications selected from lists prepared by the Superintend-
ent of Documents, and when requested from him, shall be distributed to deposi-tor:. libraries specifically designated by law and to libraries designated by Sena-tors, Representatives, and the Resident Commissioner from Puerto Rico, by theCommissioner of the District of Columbia, and by the Governors of Guam,American Samoa, and the Virgin Islands, respectively. Additional librarieswithin areas served by Repie..entatives or the Resident Commissioner fromPuerto Rico, may be designated by them to receive Government publications tothe extent that the total number of libraries designated by them does notexceed two within each area. Not more than two additional libraries within aState may be designated by each Senator from the State. Before an additionallibrary within a State, congressional district or the Commonwealth of PuertoRico is designated as a depository for Government publications, the head of thatlibrary shall furnish his Senator, Representative, or the Resident Commissionerfrom Puerto Rico, as the case may be, with justification of the necessity for theadditional designation. The justification, which shall also include a certificationas to the need for the additional depository library designation, shall be signedby the head of every existing depository library within the congressional districtor the Commonwealth of Puerto Rico or by the head of the library authority ofthe State or the Commonwealth of Puerto Rico, within which the additional de-pository library is to be located. The justification for additional depository li-brary designations shall be transmitted to the Superintendent of Documents bythe Senator, Representative, or the Resident Commissioner from Puerto Rico, asthe case may be. The Commissioner of the District of Columbia may designatetwo depository libraries in the District of Columbia, the Governor of Guam andthe Governor of American Samoa may each designate one depository library inGuam and American Samoa, respectively, and the Governor of the Virgin Is-lands may designate one depository library on the island of Saint Thomas andone on the island of Saint Croix.# 1906. Land-grant colleges constituted depositories
Land-grant colleges are constituted depositories to receive Government publica-tions subject to the depository laws.# 1907. Libraries of executive departments, service academies, and independent
agencies constituted depositories; certifications of need; disposal ofunwanted publications
The libraries of the executive departments of the United States Military Acad-emy, of the United States Naval Academy, of the United States Air Force Acad-emy, of the United States Coast Guard Academy, and of the United States Mer-chant Marine Academy are designated depositories of Government publications.A depository library within each independent agency may be designateduponcertification of needby the head of the independent agency to the Superin-tendent of Documents. Additional depository libraries within executive depart-ments and independent agencies may be designated to receive Government pub-lications to the extent that the number so designated does not exceed thenumber of major bureaus or divisions of the departments and independent agen-cies. These designations may be made only after certification by the head ofeach executive department or independent agency to the Superintendent of Doc-uments as to the justifiable need for additional depository libraries. Depositorylibraries within executive departments and independent agencies may dispose ofunwanted Government publications after first offering them to the Library ofCongress and the Archivist of the United States.# 1908. American Antiquarian Society to receive certain publications
One copy of the public journals of the Senate and of the House of Represent-atives, and of the documents published under the orders of the Senate andHouse of Representatives, respectively, shall be transmitted to the Executive ofthe Commonwealth of Massachusetts for the use and benefit of the AmericanAntiquarian Society of the Commonwealth.

Only a library able to provide custody and service for depository materialsand located in an area where it can best serve the public need, and within anarea not already adequately served by existing depository libraries may be des-igneted by Senators, Representatives, the Resident Commissioner from PuertoRico, the Commissioner of the District of Columbia, or the Governors of Guam,American Samoa, or the Virgin Islands as a depository of Government publica-tions. The designated depository libraries shall report to al Superintendent ofDocuments at least every two years concerning their conditi
The Superintendent of Documents shall make firsthand investigation of condi-tions for which need is indicated and include the results of investigations in hisannual report. When he ascertains that the number of books in a depositorylibrary 'is below ten thousand, other than Government publications, or it hasceased to be maintained so as to be accessible t) the public, or that the Govern-ment publications which have been furnished the library have not been properlymaintained, he shall delete the library from the list of depository libraries ifthe library fails to correct the unsatisfactory conditin;) within six months. TheRepresentative or the Resident Commissioner from Puerto Rico in whose areathe library is located or the Senator who made the designation, or a successorof the Senator, and, in the case of a library in the District of Columbia, theCommissioner of the District of Columbia, and, in the case of a library inGuam, American Samoa, or the Virgin Islands, the Governor, shall be notifiedand shall then be authorized to designate another library within the areaserved by him, which shall meet the conditions here; i required, but which maynot be in excess of the number of depository librari ,s authorized by law withinthe State, district, territory, or the Commonwealth of Puerto Rico, as the casemay be.
§ 1910. Designations of replacement depositories; limitations on numbers; condi-tions
The designation of a library to replace a depository library, other than a de-pository library specifically designated by law, may be made only within thelimitations on total numbers specified by section 1905 of this title, and onlywhen the library to be replaced ceases to exist, or when the library voluntarilyrelinquishes its depository status, or when the Superintendent of Documents de-termines that it no longer fulfills the conditions provided by law for depositorylibraries.
91911. Free use of Government publications in depositories; disposal of unwanted publications
Depository libraries shat! make Government publications available for the freeuse of the general public, and may dispose of them after retention for fiveyears under section 1912 of this title, if the depository library is served by aregional depository library. 'repository libraries not served by a regional deposi-tory library, or that are regional depository libraries themselves, shall retainGovernment publications permanently in either printed form or in microfacsi-mile form, except superseded publications or those issued later in bound formwhich may be discarded as authorized by the Superinterdent of Documents.ti 1912. Designationof regional depository libraries may be made by a Senator or the Resident Com-missioner from Puerto Rico within the areas served by them, after approval bythe head of the library authority of the State 0- the Commonwealth of PuertoRico, as the case may be, who shall first ascertal.1 from the head of the libraryto be so designated that the library will, in addition to fulfilling the require-ments fr, depository libraries, retain at least one copy of all Government publi-cations either in printed or microfacsinate form (except those authorized to bediscarded by the Superintendent of Documents); and within the region servedwill provide interlibrary loan, reference service, and assistant' for depository li-braries in the disposal of unwanted Government publications. The agreement tofunction as a regional depository library shall be transmitted to the Superin-tendent of Documents by the Senator or the Resident Commissioner fromPuerto Rico when the designation is made.
The libraries designated as regional depositories may permit depository librar-ies, within the areas served by them, to dispose of Government publications

which they have retained for five years after first offering them to other deposi-tory libraries within their area, then to other libraries.91913. Appropriations for supplying depository libraries; restriction
Appropriations available for the Office of Superintendent of Documents maynot be used to supply depository libraries documents, books, or other printedmatter not requested by them, and their requests shall be subject to approvalby the Superintendent of Documents.91914. The Public Printer, with the approval of the Joint Committee on Printing, asprovided by section 103 of this title, may use any measures he congiders neces-sary for the economical and practical implementation of this chapter.91915. Highest State appellate court libraries as depository libraries
Upon the request of the highest appellate court of a State, the Public Printeris authorized to designate the library of that court as a depository library. Theprovisions of section 1911 of this title shall not apply to any library so designat-ed.

(a) Upon the request of any accredited law school, the Public Printer shalldesignate the library of such law school as a depository library. The PublicPrinter may not make such designation unless he determiws that the libraryinvolved meets the requirements of this cnapter, other than those requirementsof the first undesignated paragraph of section 1909 of this title which relate tothe location of such library.
(b) For purposes of this section, the term "accredited law school" means anylaw school which is accredited by a nationally recognized accrediting agency orassociation approved by the Commissioner of Education for such purpose or ac-credited by the highest appellate court of the State in which the law school islocated.

(c) Of the number printed, the Public Printer shall bind sufficient numberof copies for distribution as follows:
Or the Ilouse documents and reports, boundto the Senate library, fifteencopies; to the Library of Congress, not to exceed one hundred and fifty copies,as provided by section 17B of this title; to the House of Representatives library,fifteen copies; to the Superintendent of Documents, as many copies as are re-quired for distribution to the State libraries and designated depositories.
Of the Senate documents and reports, boundto the Senate library, fifteencopies, to the Library of Congress, copies as provided by sections 1718 and 1719of this title; to the House of Representatives library, fifteen copies; to the Su-perintendent of Documents, as many copies as may be required for distributionto State libraries and designated depositories. In binding documents the PublicPrinter shall give precedence to those that are to be distributed to libraries andto designated depositories. But a State that may prefer to have its documents inunbound form, may do so by notifying the Superintendent of Documents to thateffect prior to the co"vening of each Congress.

11719. Classification and numbering of publications ordered printed by Con-gress; designation of publications of departments; printing of commit-tee hearings
Publications ordered printed by Congress, or either House, shall be in fourseries, namely:
one series of reports made by the committees of the Senate, to be knownas Senate reports;
one series of reports made by the committees of the House of Representa-tives, to be known as House reports;
one series of documents other than reports of committees, the orders forprinting which originate in the Senate, to be known as Senate documents,and
one series of documents other than committee reports, the orders forprinting, which originate in the House of Representatives, to be known asHouse documents.
The publications in each series shall be consecutively numbered, the numbersin each series continuing in unbroken sequence throughout the entire term of aCongress, but these provisions do not apply to the documents printed for theuse of the Senate in executive session. Of the "usual number", the copies whichare intended for distribution to State libraries and other designated depositoriesof annual or serial publications originating in or prepared by an executive de-partment, bureau, office, commission, or board may not be numbered in the document or report series of either House of Congress, but shall be designated bytitle and bound as provided by section 738 of this title; and the departmentaledition, if any, shall be printed concurrently with the "usual number". Hearingsof committees may be printed as congressional documents only when specificallyordered by Congress or either House.
738. Binding of publications for distribution to librariesThe Public Printer shall supply the Superintendent of Documents with suffi-
cient copies of publications distributed in unbound form to be bound and distrib-uted to the State libraries and other designated depositories for their permanentfiles. Every publication of sufficient size on any one subject shall be bound sepa-rately and receive the title suggested by the subject of the volume and theothers shall be distributed in unbound form as soon as printed. Thc library edi-tion as well as all other bound sets of congressional numbered documents andreports shall be arranged in volumes and bound in the manner directed by theJoint Committee on Printing.

Ap-proximately one-third of the Senators in each class depending on when their term of office expires asgiven in the table of Senators, sections 800 to 899 of the Senate Manual. The law now in force limitsthe number of depository designations for the Senators of either class in a State to two.Senatorial vacancies within the States are listed at the end of the State listing. Representatives vacan-cies are listed at the beginning of the Congressional District.The date which immediately follows the library designations is the year in which the library became aDepository Library, although in some instances the name of the library may have been changed sincethis designation. Where our records do not indicate when a library became a depository, the word "un-known" appears instead of the date.
