Plaintiff hereby move the Court pursuant to Federal Rule of Civil procedure 34
and 37 for an order compelling the following Federal Agencies, in their capacity,
to produce documents responsive to Plaintiffs Request for Production of
Docum ents and Electronically Stored Inform ation, including, but not lim ited to
a11 documents listed in Apendix A to this motion. CEthe listed documents'') :

Defendants have argued that Plaintiff was retum ed to the Federal Prison by the

M iami CCM Director Carlos Rodriguez, and that the Plaintiff hearings were
conducted according to the requirem ent and regulations of the the Federal
Bureau of Prisons and the Department of Justice. CtThe CCC Contractor, provider
of Home Confinement, shall develop a system for handling violations of program
nzles which m eets the ''due process'' criteria of W olff v. M cDonald, and includes
provisions for dealing with minor infractions of program rtzles for prisoners in
Home Confinement'' (Dept, of Justice) ttFedel'al Btlreau Of Prisons Program
Statement Number: 7320.01)) However, even when requested by the Plaintiff, no
documents have ever been produced by the Deftndants to sustain such claims,
and the Plaintiff does not rem ember of such hearings held in his presence, as the
Defendants are trying now to shift the blame on the Federal Agencies. Defendants
statements cannot be documented by any BOP, US M arshal, USPO, CCM M iami, US
Probation Offke, Community Sanction Center, or any federal authority.
Plaintiff propounded its M otion to Compel First Request for Production of
Documents on August 39, 20 l l and and the second M otion to Com pel the
Production of Documents on September 16, 201 1. After Defendant produced 45
pages of responsive docllm ents, lt become apparent that numerous responsive
documents had not been m oduced by Defendants.
Plaintiffthen attempted to contact a11 Federal Agencies involved in the handling
of the Plaintiff, in order o obtain copies of the documents entered in the SENTRY
SYSTEM before and after his return to the Federal prison. His requests were
ignored and he was even told to ççforget about this incident, put it behind you,
and get on with yom life.'' lt was a rather good idea for these Federal agencies to
cover the unwanted incident which has occurred at Dismas Charities and

obviously involved al1 of them.
The procedure to remove a prisoner / resident from home confnement and send
him back to the Federal Prison, requires strict guidelines dictated by the
Federal Bureau of Prisons and the Department of Justice. As such, a11 hearings
and events regarding the prisoner M UST be entered in the SENTRY SYSTEM
before the hearings that should take place in the presence of the prisoner, and
after the prisoner was taken back to the Fedel'al Prison. The Plaintiff is not
obligated by any means to cite any of these regulations, because the Contractor
and the District Court should be well aware of those strict regulations and
procedures.

provider of Home Confinement, shall develop a system for handling violations of

Also see Prisons Rules.'' 28 C.F.R. j 54l .10(a). Section 541.13 delineates the vadous
types of prohibited acts and groups them into categories based upon the seriousness of
the infraction. See 28 C.F.R. j 541.13, Table 3. The ''Disciplinary Severity Scale'' then
describes the types of authorized sanctions that ofticials have discretion to impose
based upon the category into which the prohibited act falls. See 28 C.F.R. j 541.13,
Tables 3-6. The regulations also set forth detailed procedural guidelines that
institutional staff must follow when bringing disciplinmy action against an
inmate. See 28 C.F.R.jj 541-14-541.19

As a last resort, Plaintiff filed a Subpoena to each one of these Federal Agencies
in an attempt to bring the t1-:1t.11 to the surface. However he fears that his request
will be again ignored by those interested to cover the % th of this incident.

ARGUM EIT
It is well established that a party is obligated to produce al1 documents tha are (i)
in a party's possession, custody or control and (ii) relevant to any party's claims
or defenses, so long as it is ttreasonably calculated to lead the discovery of
admissible evidence.'' Fed. R. Cov. P. Rule 26(b)(1). Moreover, if a disclosing
party leams that its responses are incomplete or incorrect, Rule 26(e)(1)b
requires the party to supplement and correct such responses in a timely mnnner
. See, e.g. , Beller v. United States, 221 F.R.D. 696, 701 (D.N.M. 200) (%ç A party is
under a duty to supplement at appropriate intervals any disclosues made if it
leams that in some material respect the information previously disclosed was
incomplete or incorrect-').In this case,despite Defendant's repeated agreement
that the listed documents are responsive and shoud be therefore produced, the
deadline for production has passed without Defendants providing a single
supplementing document to their original deticient production. See, e.g. Arthur v.
Atkinson Freight Lines Corp., l64 F.R.D. l9, 20 (S.D.N.Y. 1995) CW party may not
free itself of the burden to fully comply with the rules of Discovery by attempting
to place a hetofore linrecognized duty of repeated request for information on its
adversary-'').

CONCLUSION
For the reasons set forth above, Plaintiff respectfully requests this Court to issue an
Order compelling the production of documents and things as requested in Plaintiff
Request For Production Of Docum ents And Eleckonically Stored lnform ation.
W HEREFORE, Plaintiffs, would respectfully request that this Court order M iami
FDC, US M arshal Services, CCM M iami, US probation Oftke, and Federal Bureau
of Prisons, within ten (10) days to produce the files that are responsive to discovery
requests subm itted in this cause.
