• Article 3 Definitions : For the purpose of this directive the following definitions shall apply a. Electrical & Electronic equipment means
equipment which is dependent on electronic currents or electromagnetic fields falling under the categories set out in Annexure 1A to Directive 2002/96/EC (WEEE) and designed for use with a voltage rating not exceeding 1000 volts for alternating current and 1500 volts for direct current.
b. ‘Producer’ means any person who, irrespective of the selling technique used, including by means of distance communication according to Directive 97/7/EC of the European Parliament and of the Council of 20 May 1997 on the protection of consumers in respect of distance contracts
i) Manufactures and sells electrical and
electronic equipment under his own brand; ii) Resells under his own brand equipment
produced by other suppliers, a reseller not being regarded as the‘producer’ if the brand of the producer appears on the equipment, as provided for in subpoint (i); or
iii) Imports or exports electrical and electronic equipment on a professional basis into a Member State.
Whoever exclusively provides financing under or pursuant to any finance agreement shall not be deemed a ‘producer’ unless he also acts as a producer within the meaning of subpoints (i) to (iii).

RULES PROCEDURAL REQUIREMENTS STATUS RESP CROSS REFERENCE
• Article 14 When making and using packaging for EIPs, the producers and importers of EIPs shall use nontoxic, nonhazardous, degradable, and recyclable materials in accordance with State standards or industry standards for the control of the toxic and hazardous substances or elements in EIPs. The producers and importers of EIPs shall mark the names of packaging materials on the packaging of EIPs; in the event that it is impossible to make such marking due to limitations in size and external surface [area], [such information] shall be placed in the product instructions. The styles and methods prescribed in the preceding clause for marking the term of environmental use shall be centrally specified by the Ministry of Information Industry in consultation with competent State authorities. The styles and methods shall meet State standards or industry standards for the control of toxic and hazardous substances or elements in EIPs.

• Article 18 The Ministry of Information Industry shall prepare and revise the Catalogue for priority control of pollution by EIPs in consultation with the Development and Reform Commission, the Ministry of Commerce, the General Administration of Customs, the State Administration of Industry and Commerce, the State Administration for Quality Supervision, Inspection and Quarantine, and the State Environmental Protection Administration. The Catalogue for priority control of pollution by EIPs shall consist of categories of EIPs, the category of toxic and hazardous substances or elements restricted for use, and the timeline for the restriction. The Catalogue shall be amended annually according to actual conditions and the demands made by levels of technological development.

• Article 19 The CNCA shall, based on the relevant laws, carry out compulsory certification administration of the EIPs incorporated into the Catalogue for priority control of pollution by EIP. Imported EIPs are subject to port authentication and arrival inspections by the port inspection and quarantine authorities based on the relevant laws. Customs authorities will release imported products [into China] based on the Release of Goods Certificate issued by the port inspection and quarantine authorities.

The unit shall ensure that hazardous wastes are handled and stored in such manner that it does not in anyway contaminate the environment and have no adverse impact on the air, soil and water including groundwater. Comprehensive safety measures such as safety mask, goggles, hand-gloves, gum-boots etc. should be provided for handling of wastes to the trained staff (trained specifically for this job). The Unit must take precautions to prevent accidental ignition or reaction of ignitable or reactive wastes. The unit shall submit an environmental management plan and in case of occurrence of an accident, complete details in Form-5 must be sent to Delhi Pollution Control Committee along with details of imitative and remedial measures taken. Such event shall simultaneously be reported to concern Police Station, Health Department. Department of Explosives, Inspectorate of Factories and local bodies. The unit shall ensure that all the personnel involved in the generation and management of hazardous wastes are able to respond effectively to emergencies and all required safety measures will be taken

The occupier shall furnish information regarding the waste to the person who transports. treats, stores or disposes off his waste. The occupier shall prepare six copies of manifest in Form-9. One copy (white) shall be forwarded to the Delhi Pollution Control Committee and incase the hazardous waste is likely to be transported through any transit state an additional copy shall be prepared and sent to the concerned State Pollution Control Board/Committee before the waste is handed over to the transporter. Also, the unit shall obtain 'No Objection Certificate' from the State Pollution Control Board/Committee where the disposal facility is existing.

21.
Units generating non-ferrous metal waste specified in Schedule-4 or generating used oil! or waste oil (waste oil meeting the specifications laid down in Schedule-6) of 10 tones or' more per annum shall sell or auction the waste to a re-refiner or recycler registered with Central Pollution Control Board, as the case may be. Any waste oil which does not meet the specifications laid down in Schedule-6 shall not be auctioned or sold but shall be disposed off in hazardous wastes incinerator installed with air pollution control devices and meeting emission standards. Further, waste shall not be allowed to be stored for more than 90 days. A record of auction and sale of such waste shall be maintained and made available to Committee for inspections. Also, annual returns of auction and sale shall be sent to Delhi Pollution Control Committee by 31st day of January every year in Form-13.

If the licensing authority calls upon the holder of a license by a notice in writing to execute any repairs in the licensed premises which are, in the opinion of such authority, necessary for the safety of the premises, the holder of the license shall execute the repairs which such period as may be specified in the notice.

Every vessel before being repaired or exhumed shall be made free of compressed gas and thoroughly cleaned. When a vessel is opened for cleaning or repairs, no lamp of any description either ordinary or electric, electric cables or fans and no articles, appliances or equipment capable of igniting flammable vapours shall be brought near the vessel.

No person shall cause to repair or repair either by the use of fire, welding, hot riveting or brazing any vessel used for the storage of flammable gas unless it has been thoroughly cleaned and gas -free or otherwise prepared for safely carrying out such hot work and certified, in writing, by a competent person, to have been so prepared. Where the vessel has been certified as gas -free, the certificate shall be preserved by the licensee for a period of not less than three months and produced to the Chief Controller, on demand.

12. No person shall enter any vessel used for the storage of a toxic or corrosive gas unless he is adequately protected by means of clothing, gas masks and such other protective equipment.

Where different types of gas cylinders are stored in the same shed, cylinders may be grouped together depending on the nature of the gas contained therein e.g. flammable gas cyl -inders shall be separated from cylinders containing oxidizing gases by an intervening space of one meter or by a fire resisting partition wall in between them and cylinders containing toxic gases shall be segregated from the cylinders containing non-toxic gases by a suitable partition wall.

Environment Protection Agency) List of Hazardous Substances. In order to decide whether a specific material listed above is hazardous or not, following points to be taken into consideration:
(i) If a component of the waste appears in one of the five risk classes listed above (A, B, C, D or E) and the
concentration of the component is equal to or more than the limit for the relevant risks class, the material is then classified as hazardous waste.
(ii) If a chemical compound containing a hazardous constituent is present in the waste, the concentration limit does not apply to the compound, but only to the hazardous constituent itself.
(iii) If multiple hazardous constituents from the same class are present in the waste, the concentrat ions are added together.
(iv) If multiple hazardous constituents from different classes are present in the waste, the lowest concentration limit corresponding to the constituent(s) applies.
(v) For substances in water solution, the concentration limit for dry matter must be used. If the dry matter content is less than 0.1% by weight, the concentration limit, reduced by a factor of one thousand, applies to the solution.
