have been elected as Members of the European Parliament.

Declaration by the Presidency on behalf of the European Union on the establishment of anindependent electoral commission in Burundi

Brussels, 6 September 2004

The European Union welcomes the establishment by the Burundese Government, after the approval given byNational Assembly and Senate, of an independent Electoral Commission which will play the leading role inthe organization of local, regional, parliamentary and presidential elections. The EU considers theestablishment of the Commission as a major step in the implementation of the Arusha peace process. Itscreation makes it possible to proceed with the adoption of a new constitution and electoral laws. The EU alsowelcomes the law that creates the Truth and Reconciliation Commission. This Commission can be seen as amajor instrument for reconciliation and durable peace as contained in the Arusha Peace Agreement. The EUurges all parties to adopt this law on the basis of the largest possible consensus.

The EU exhorts the Burundian Government, National Assembly, Senate and all political parties to takewithout delay all steps necessary for the organization of the elections, in line with the agenda set by theRegional Initiative at its meeting on August 6, and to engage in the power sharing agreement reached underthe auspices of Vice President of South Africa, Jacob Zuma, as facilitator of the Regional Initiative. The EUfurthermore urges all parties to reach a consensus on the principles of power sharing, so as to allow theNational Assembly to adopt the new Constitution within the deadline set by the Regional Initiative. The EUwould like to congratulate South African president Thabo Mbeki on his efforts during the negotiations inPretoria.The EU reiterates its willingness to assist Burundi in the organization of free and fair elections and to reach alasting solution to the conflicts that have destabilized o the country over the past decades. In this regard, itunderlines the need to proceed swiftly with demobilization of armed groups in the country, and with thereform of the security sector to ensure long-term peace and stability.

Declaration by the Presidency on behalf of the European Union on the outcome of the appeal by DatukSeri Anwar Ibrahim

Brussels, 15 September 2004

Declaration by the Presidency on behalf of the European Union on the outcome of the appeal by Datuk SeriAnwar Ibrahim against his conviction on 8 August 2000.

The European Union welcomes the decision of the Federal Court of Malaysia to acquit Datuk Seri AnwarIbrahim, the former Deputy Prime Minister of Malaysia, of the conviction and sentence imposed on him on8th August 2000.

At the various stages of the judicial process against Datum Seri Anwar Ibrahim, the EU has monitored thecase closely and has consistently expressed deep concern about their fairness. The European Union istherefore satisfied with the decision of the Federal Court of Malaysia to overturn his 8 August 2000 decision.The decision reveals the deepening of the rule of law in Malaysia.

The EU will continue to closely monitor the appeal process concerning his 14 April 1999 conviction.

Declaration by the Presidency on behalf of the European Union on AlbaniaBrussels, 14 September 2004

Albania's rapprochement to Euro-Atlantic structures depends primarily on the country's reform progress. Ashas been stated on previous occasions, the European Union fully supports this ambitious objective, andcontinues to give Albania considerable concrete assistance to realise the necessary reforms.

Therefore, it is of great concern to note that insufficient progress is being made in reform implementation,and particularly in areas that are vital for Albania's future and its successful integration: the pace of reform inAlbania in general and electoral reform, and the fight against organised crime and corruption in particular.Other areas of concern remain the rule of law and the respect of human rights and minorities, in particular inthe fields of education, property and access to media.

As the recent helicopter incident in Lazarat on August 18th has shown, the fight against organised crime andcorruption is a crucial area where substantial progress needs to be made if integration is to be sustained.Recent events have shown that drug trafficking and trafficking and smuggling in human beings remain issuesof serious concern. As has been said repeatedly, Albania needs to prove that it can enforce the rule of law ina fair and equitable manner, throughout its territory; that its state structures are free from the influence ofcriminal elements; and that crime is effectively tackled, for the benefit of the citizens of Albania and othercountries who suffer the consequences of this dreadful problem. The current situation shows that progresstowards Europe is still not sufficient. Moreover, it is a matter of grave concern that some politicians haveused this issue as a means to further narrow political interests.

The general elections due to be held in 2005 must prove Albania's readiness to make further progress alongthe path of Euro-Atlantic integration. The European Union expects that the forthcoming general electionswill fully comply with international standards and be conducted in a transparent manner in the whole ofAlbania.

Several recommendations have been submitted by the OSCE, ODIHR and the Council of Europe (VeniceCommission) in the past months. With the full support of the European Union, the OSCE Presence inAlbania has worked hard with political actors to try to secure agreement on a package, which could put theserecommendations into effect. The European Union is disturbed to note that this work is not processing at anadequate pace. The lists of voters are a major concern. A considerable amount of complex preparatory workneeds to be done in improving the lists, which will take months. The European Union expects all politicalactors to use the first weeks of this parliamentary session to co-operate in achieving this objective. AllAlbanian politicians have a shared responsibility to properly prepare and conduct these elections. Failure onthis crucial issue would be a serious setback for the development of the relationship between Albania and theEuropean Union.

This declaration is one of a number of similar messages that have been conveyed to Albanian politicalleaders over the past few months. A prompt and constructive reaction is needed. Albania's rapprochement tothe European Union asks for a full commitment by all Albanian political forces. Should the lack of a generaland shared political will continue to hamper a real reform process, the conclusion of a Stabilisation andAssociation Agreement could only be further delayed.

The EU welcomes the fact that elections were conducted in a generally peaceful environment and that votingproceeded smoothly. This is in no small part due to the commendable behaviour of voters and polling staff,the efforts of civil society organisations to provide civic education and the manner in which private mediagenerally provided reasonably balanced coverage of the elections.

Nevertheless the EU notes that the elections fell short of international standards in a number of key areas.The overall process failed to provide a level playing field for political contestants, the voter registrationprocess was unsatisfactory and the tabulation of results seriously lacked transparency.

Furthermore, the EU notes that the overall performance of the Malawi Electoral Commission wasdisappointing. It however welcomes the fact that domestic pressure has resulted in momentum for change atthe Commission, which the EU hopes will translate into a wide-ranging reform of its composition andprocedures.

The EU urges the Malawian Authorities to take appropriate steps to improve the framework for elections andto demonstrate sufficient political will to ensure that the next elections are conducted in line withinternational standards, such as the SADC Guidelines and Principles Governing Democratic Elections.

Declaration by the Presidency on behalf of the European Union regardingthe Gongadze case in Ukraine

Brussels, 16 September 2004

On the fourth anniversary of his disappearance and murder of the journalist Georgiy Gongadze, the EuropeanUnion wishes to express once again its concern at the lack of progress with the investigation into thecircumstances of his death.

In the four years since Gongadze�s death there have been a number of other physical attacks on andsuspicious deaths of journalists, putting into question the security and safety for media professionals. TheEuropean Union wishes to express its concern about the effect this may have on journalists� activities.

The EU therefore calls on the Ukrainian authorities to do their utmost to find the perpetrators of these crimes,and bring them to justice.

Declaration by the Presidency on behalf of the European Unionon the visit of the envoys of the Dalai Lama to China

Brussels, 17 September 2004

The European Union welcomes the fact that the representatives of the Dalai Lama are at present visitingChina for the third time, since resumption of the contacts in September 2002.

The EU has been looking forward to a third visit and hopes that it will encourage the start of meaningful anddirect dialogue between Beijing and the Dalai Lama�s representatives, leading to a peaceful and sustainablesolution for Tibet.

The EU will follow this visit with great interest.

The EU reaffirms its full support for the peace process between Ethiopia and Eritrea and expresses itsconcern about the continuing stalemate. Both Ethiopia and Eritrea need peace and stability to focus on theserious challenges facing their countries and the EU urges both countries to take a more constructive stand.

The EU recognizes that in the current situation, the continued presence of the United Nations Mission inEthiopia and Eritrea (UNMEE) is essential for stability in the region and welcomes UN resolutionS/RES/1560, extending the UNMEE mandate for a further six months. The EU fully supports the proposedrationalisation of the mission and has full confidence that the Secretary General of the United Nations willensure that UNMEE will maintain its current level of effectiveness.

Declaration by the Presidency on behalf of the European Union on the adoption ofUN SC Resolution 1564 on Sudan

The European Union welcomes the adoption by the United Nations Security Council of Resolution 1564.Resolution 1564 is an important contribution to the urgently required increased pressure on the Governmentof Sudan, the Justice and Equality Movement, the Sudanese Liberation Army/Movement and the SudanesePeople�s Liberation Movement to reach a political solution to the conflicts in Sudan as a matter of immediatepriority.

The European Union fully supports the appeal made by the Security Council on the Government of Sudan tomeet its obligations towards all Sudanese and the international community. The European Union also callson the other parties to the conflicts to fully comply with their international obligations. The European Unionjoins the Security Council in deploring the recent cease fire violations and stresses the urgency of ending theclimate of impunity in Darfur by bringing to justice those responsible, including members of the populardefence forces and Janjaweed militia.

The European Union also welcomes the Council�s preparedness to consider taking additional measures ascontemplated in Article 41 of the Charter of the United Nations, should the Government of Sudan fail tocomply fully with resolution 1556 (2004) of this resolution.

The European Union attaches great importance to the establishment of an international commission ofinquiry to immediately investigate all reports of violations of international humanitarian law and humanrights law in Darfur by all parties, to determine whether acts of genocide have occurred and to identify theperpetrators of such violations with a view to having them brought to justice.

The leadership of the African Union in the solution of the conflict in Darfur is fully recognised by theEuropean Union. The EU will continue to provide the AU with full support for its mission in Darfur.

The European Union regards Ukraine as a key neighbour and strategic partner, which is also a major playerin regional and global security. The Union remains supportive of Ukraine�s pursuit of democratisation andeconomic reform. It acknowledges Ukraine�s European aspirations and welcomes Ukraine�s pro-Europeanchoice.

The EU appeals to the Ukrainian leadership to ensure all necessary conditions for holding free and fairpresidential elections this fall in line with its international commitments as enshrined by the Council ofEurope and the OSCE.

Considering the conditions under which the campaign has taken place so far, the EU reiterates the paramountimportance of independence of the media and freedom of expression for a fair and transparent campaign.

This implies equal and impartial access to the mass media, the absence of registration and licensingprocedures according to political criteria, as well as the cessation to cut-offs for private television channelsdue to �technical reasons�. This also implies unbiased coverage of candidate�s positions in the media, inparticular by the state-owned nation-wide TV channels, and the absence of any interference from theauthorities, including by sending instructions or indications to the media (so-called �temnyky�).

This furthermore implies neutrality of all state officials and state bodies towards all candidates, including byabstaining from harassment of specific candidates and media outlets.

Finally, the European Union urges Ukraine to enable domestic observers, including non-partisan observers,to monitor the elections. The EU welcomes the invitation for international observers. EU member states arewilling to contribute appropriately.

Declaration by the Presidency on behalf of the European Union onthe Parliamentary elections in the Republic of Kazakhstan

Brussels, 8 October 2004

The European Union takes note of the Parliamentary elections in the Republic of Kazakhstan, which wereheld on 19 September 2004 with a second round on 3 October 2004.

The European Union acknowledges the Statement of Preliminary Findings and Conclusions of theInternational Election Observation Mission (IEOM) led by OSCE/ODIHR and welcomes someimprovements made since the last elections. These include improvements on the election law, providing forincreased transparency of the overall election process. The European Union also welcomes otherdevelopments on party registration and domestic observers, as noted in the IEOM report.

The European Union also notes, however, the IEOM's conclusion that in many respects the election processfell short of OSCE commitments and other international standards for democratic elections. Some of theproblems communicated before the elections to the authorities of Kazakhstan were indeed witnessed in thepre-election period and on the day itself. These included the non-transparent introduction of electronic votingand strong media bias in coverage of the campaign.

Other problems also affected in a negative way voter confidence in the election process. For example, therewere difficulties with aspects of the functioning of the Central Election Committee, the composition ofelection commissions, the system for handling complaints and the inaccuracy of voter registration.

The European Union also notes that protocols remained unavailable in many polling stations. In this context,the European Union calls on the Kazakhstani authorities to fully investigate the serious allegations made bypolitical parties that the elections were in a number of places marred by fraudulent actions.

Furthermore, the European Union remains concerned that two prominent opposition leaders, Mr GalymzhanZhakianov and Mr Bulat Abilov, could not run for office.

The European Union encourages the authorities of Kazakhstan to continue their efforts further to improve theframework for elections and to take the necessary steps to ensure that the next elections fully meetinternational standards. The European Union stands ready to offer its assistance in this respect, incooperation with the OSCE.

Declaration by the Presidency on behalf of the European Union on BelarusBrussels, 27 September 2004

The European Union is seriously concerned that Belarus has still not undertaken a full and credible andindependent investigation into the possible involvement of three Belarusian officials in the disappearancesand subsequent deaths of three Belarusian opposition leaders and one journalist in the years 1999-2000. Thiswas detailed in the Pourgourides report of the Parliamentary Assembly of the Council of Europe, adopted on28 April 2004.

In a declaration of 14 May 2004 the European Union called for a independent investigation to be openedunder a neutral investigator. Pending such investigation, the EU has also questioned whether the personsagainst whom these serious allegations were put forward, should remain in their current positions ofauthority.

The EU has received no official reaction by Belarusian authorities to its declaration, and is not aware of anyindependent and impartial investigation by the Belarusian authorities. Those persons who according to thePourgourides report carried the main responsibility for the disappearances, and those who have failed tolaunch an investigation into these disappearances, have remained in their positions or have moved to otherimportant positions of authority.

In view of the apparent obstruction of justice and the absence of an investigation as requested, the EuropeanUnion has decided today to restrict admission to its territory of those high officials who are consideredprimarily responsible for failing to initiate such an investigation and prosecution of the alleged crimes, aswell as those who are considered by the Pourgourides report key actors in the disappearances and subsequentcover-up.

Furthermore, the EU considers the presence of those persons at public meetings at the EU institutions or inits member states inappropriate.

The EU reserves the right to consider additional measures at a later date.

The EU will review its position in the light of future developments, taking into account the willingness of therelevant Belarusian authorities to have the disappearances fully and transparently investigated, and thoseresponsible for such crimes brought to justice.

In this context, the EU calls once more on the Belarusian authorities, including on the President of theRepublic of Belarus, to undertake the actions as requested by the EU.

Declaration by the Presidency on behalf of the European Union on the Statement of theRwandan Government to the Parliamentary Report on Genocidal Ideology

Brussels, 6 October 2004

The EU has taken note of the recent public statement by the Government of Rwanda on the parliamentaryreport into "Genocidal Ideology" and welcomes the announcement of a further, thorough investigation by thecompetent authorities. It calls upon these authorities to complete these investigations as expeditiously aspossible.

The EU regrets that the Government of Rwanda has not unequivocally stated that those mentioned in theparliamentary report are presumed innocent until the contrary is proven. Individuals have been publiclyaccused on the basis of information that is insufficiently substantiated. The report therefore has anintimidating impact.

The parliamentary report shows many hurdles remain on the way to unity and genuine reconciliation.Wounds caused by genocide and civil war are still fresh. The EU concurs with the report's conclusion that

The EU is however concerned at the liberal use of the terms 'ideology of genocide' and 'divisionism' and inthis regard would impress upon the government the need to clarify the definition of these terms and how theyrelate to the laws on discrimination and sectarianism and to the freedom of speech in general.

Freedom of expression, freedom of association and freedom of the press are the basis of a democratic andinclusive state. The EU urges the Government to open up political space and to allow the expression ofdifferent views and perspectives.

Declaration by the presidency on behalf of the european union to mark the second world dayagainst the death penaltyBrussels, 10 October 2004

On the occasion of the second World Day Against the Death Penalty, the EU reiterates its longstandingprincipled position against the death penalty.

The EU considers that the abolition of the death penalty contributes to the enhancement of human dignityand the progressive development of human rights. The European Union finds this form of punishment crueland inhuman. The death penalty provides no added value in terms of deterrence and any miscarriage ofjustice would be irreversible.

Consequently, the death penalty is abolished in all European Union countries. But the reasons for doingaway with this form of penalty apply to every person in any part of the world. Universal abolition of thedeath penalty, in times of peace and war, is thus a strongly held policy view agreed by all EU members.

The EU calls on all countries that have not yet abolished the death penalty to do so, and in the meantimeintroduce a moratorium as a first step towards abolition. The EU welcomes the global trend towards abolitionand the fact that the international community has excluded the use of the death penalty in establishinginternational tribunals and the International Criminal Court, which are competent for the most heinouscrimes such as genocide and crimes against humanity.

In countries that maintain the death penalty, the EU urges its progressive restriction in scope and respect forthe minimum standards found in international human rights instruments. In particular, the EU appeals to allstates not to impose the death penalty on juvenile offenders or the mentally ill.

The election of the President is a milestone in thepeace and reconciliation process, paving the way for the establishment of a Transitional FederalGovernment.

The European Union congratulates the new Somali President Abdullahi Yusuf Ahmed with his election.Furthermore, the European Union recognises the important role played by Somali leaders in the TransitionalFederal Assembly in safeguarding the democratic principles of the election process.

Declaration by the Presidency on behalf of the European Union commemoratingthe terrorist attacks of 11 September 2001

Brussels, 11 September 2004

Three years after the terrorist attacks of 11 September 2001 in the United States, the European Unioncommemorates the victims and reiterates its condemnation of all forms of terrorism in the strongest possibleterms.

Unfortunately, since that day the world has witnessed an increase of ruthless and cruel attacks on innocentcivilians. The taking hostage of children and parents in Russia, kidnappings and killings in Iraq andAfghanistan and indiscriminate bomb attacks in Madrid, Istanbul and Jakarta are only some of the recentterrorist atrocities that have shocked the world. The European Union mourns the victims of terrorism andoffers its condolences to their families.

Religious and political leaders across the world are united in their conviction that no religious or politicalgoals can ever justify acts of terrorism. Citizens of all countries loathe terrorism; they deserve that effectiveaction be taken to counter this scourge.

The international community must increase its efforts to combat terrorism. For the European Union the fightis a top priority. The Union and its Member States are collectively investing heavily in the efforts aimed atpreventing and countering terrorism. They are determined to continue to do so. The European Union standsready to work together with all partners in this most important undertaking.

3. The European Council notes that the Commission is going to draw up a "roadmap" to strengthen andimplement the Lisbon Strategy. The EESC would argue that the "new style" Lisbon process should borrowfrom the successful methods of "Europe '92". Yet there are constant shortcomings in implementation. The Action Plan is just the starting point of an ongoing, long-term process. This process will only succeed ifit connects horizontally across a broad range of policy areas, and vertically among policy-makers at manylevels. The Action Plan and other related forthcoming Commission initiatives must trigger a positiveresponse from these policy-makers. The Committee calls particularly on other Commission Directorates-General and Member State authorities to play an active role. Incorporating the "think small first" approachinto the European Union's policy-making process would represent the single most significant contribution byEU institutions to promoting greater entrepreneurial activity across Europe.

European policy makers also need to find ways of "de-dramatising" entrepreneurship in terms of superficialperceptions. Specific groups such as young people but also older people need to be encouraged to seriouslyconsider entrepreneurial activities as a realistic and positive career option.

a) the inclusion of a key action in this field in the seventh Framework Programme for Research; and

b) flanking measures to create a sound basis for timely policy planning, decision-making and action atboth European and national level.

Inter alia, the following flanking measures are deemed necessary to ensure compliance with Article 25 of theFundamental Rights Charter, which guarantees all older EU citizens the right to live in dignity and toparticipate actively as citizens and in decision-making processes:

- the establishment of a joint European observatory to build a European Agency on Ageing and adatabase to generate, concentrate and disseminate knowledge to improve the open method ofcoordination and draw practical policy conclusions; and

- the establishment of an "Ageing Society" category in the EESC.

The Role of Women's Organisations as Non-State Actors in Implementing the CotonouAgreement

� Key points:In June 2000, the Cotonou Agreement was signed between the European Union and the ACP countries. Thisagreement introduced a participatory approach to development cooperation by recognising the importantcontribution of non-state actors and involving them in the definition of national development strategies.

The objective of this opinion is to highlight the specific contribution that women's organisations can maketowards development strategies in ACP countries, and to explore how to strengthen their contribution.

Based on the evidence compiled in various regional seminars and forums, it would appear that theinvolvement of women�s associations, organisations and NGOs in the framing of national strategies was verylimited. There is a large discrepancy between the intentions stated in the Cotonou Agreement and theirimplementation. Furthermore, few measures appear to have been taken to facilitate women�s participation.

If the European Union really wants to have a positive impact on the living conditions of women and poorpeople, there is a need for greater clarity and determination in defining the aims and objectives of support forwomen and of the steps that need taking.

The objective is to create the basic conditions that would enable women to become truly involved, valued,and supported, so that they achieve equality with men for the development of their countries.

Among the recommendations proposed are the following:

- the Delegations of the European Commission should be mandated to promote mainstreaming ofgender issues;

- an analysis of the existing situation relating to the status of women's organisations in ACP countriesshould be carried out;

- national strategy documents should include positive measures for women's organisations;- a specific budget for women's civil society organisations should be created;- fast track channels for access to funding by women's organisations should be introduced;- women's organisations should be equally represented at seminars organised by the EESC;- a conference on promoting the role of women as actors in the development process should be

organised by the EESC in the foreseeable future.

� Key points:This own-initiative EESC opinion proposes that mechanisms and instruments to conserve and develop peri-urban agricultural areas should be promoted. The EESC says that the first essential instrument must besocial, political and administrative recognition of these peri-urban areas and their key role in the relationshipbetween city and country. To ensure that such areas are given recognition across Europe, the EESC proposesthat a boost should be given to European action on peri-urban agricultural areas. Such action must recognisethe values and roles of such areas and prepare the way for each country to draw up specific legislation ontheir protection and development, based on common fundamental criteria. In the EESC's view, the dynamicand sustainable development of peri-urban agriculture and the areas in which it is practised can only beensured by allowing local authorities to play a key role. Moreover, in view of the precarious situation facingperi-urban agricultural areas and European peri-urban agriculture as a whole, the EESC believes it isessential to establish a European observatory for peri-urban agriculture that not only has a Europeanperspective on peri-urban agricultural areas and the agricultural activity practised in them, but also acts as areference centre for monitoring, analysing and raising awareness of the situation of peri-urban agriculture inEurope and a place where local and regional authorities and different European bodies can come together todiscuss this issue, proposing initiatives for the conservation and development of these peri-urban areas andtheir agriculture.
