The Departmental Enquiry against PC-3963,Shri Ranganath A. Naik (Deserter) of CID Centre,Margao has been ordered vide No. DE 2/2007/4285//2007 dated 16-05-2007 by the Superintendent ofPolice CID, Panaji.
Police Sub-Inspector Shri Govind Bhandari ofTourist Police Unit, Panaji than and now CID CrimeBranch Dona-Paula has been appointed as anEnquiry Officer vide No. DE-2/2007/12026/2007dated 21-11-2007.
Assistant Police Sub-Inspector Shri UttukuryBalaswamy attached to Petition Cell PHQ, Panajihas been appointed as presenting Officer vide OrderDE No. 2/2007/11426/2007 dated 2-11-2009.
The delinquent PC-3963, Shri Ranganath A. Naik(Deserter) than attached to CID, Centre Margao hasbeen given an opportunity to have his Friend Officerin Departmental Enquiry to assist him in theproceeding at the time of Preliminary statementrecorded on 10-12-2007 as he has stated that hewill defend through his Friend Officer. Accordinglyhis request was accepted on his consent.

The delinquent issued with the chargememorandum vide No. DE-2/07/4285/2007 dated16-05-2007 and order No. DE No. 2/07/12026/07dated 21-11-07.

The charge framed against PC-3963, RanganathA. Naik (Deserter) of CID Centre, Margao as.
That the said PC-3963, Ranganath A. Naik(Deserter) of CID Centre, Margao behaved in amanner unbecoming of Government Servant,especially a member of the disciplined force thathe had remained absent from duty with effect from23-08-2006 without leave, thereby commenting theoffence of desertion as defined under rule 22 of theGoa Police Subordinate Service (Discipline andAppeal) Rule of 1975 as amended from time to time.He was therefore declared as deserter under thesaid Rules vide order No. DE/Deserter-3/2006/10124//2006 dated 31-10-2006 with effect from i.e. oncompletion of 21 days of absence without leave.
The Enquiry Authority received DepartmentalEnquiry Papers through Police Sub-InspectorShri Fakira J. Powar, CID Centre, Vasco vide hisletter No. CID/SB/ASC/656/2007, dated 04-12-2007as directed by Superintendant of Police CID Panajivide his Order No. DE-2/2007/12026/2007 dated21-11-2007.
Accordingly I sent a Note letter to the delinquentPC-3963, Shri Ranganath A. Naik (Deserter) videNo. PI/TPU/5679/2007 dated 04-12-2007 throughIncharge of CID Centre, Margao requesting to thesaid delinquent to appear before Enquiry Authorityfor Preliminary Statement and to collect all theD. E. papers from Presenting Officer on 10-12-2007sharp 10.00 hrs. at Tourist Police Unit, PattoPanaji-Goa.
The delinquent PC-3963 Ranganath A. Naik(Deserter) appeared before Enquiry Authority on10-12-2007 at 10.00 hrs. recorded his PreliminaryStatement and he collected all papers throughpresenting Officer Shri Uttukury Balaswamy ASI,Petition Cell PHQ, Panaji.
After collecting all the papers and recordingPreliminary Statement he had promised to appearfor next date along with his Friend Officer//Defence Assistance with certificate saying that heis not possessing more than two D. E. includingpresent D. E.
But he did not remained present nor anyintimation is given about his defence Officer. I havesent him following letter with request to appear forD. E. along with his Defence Assistance/FriendOfficer on 18-01-2008 at 10.00 hrs.
1) PI/TPU/5702/2007 dated 10-12-2007,
2) PI/TPU/5732/2007 dated 17-12-2007, called on28-12-2007, not appeared.
3) PI/TPU/234/2008 dated 07-01-2008, called on18-01-2008, not appeared.
The delinquent did not care nor bothered aboutthe request of Enquiry Authority, sometime thedelinquents wife Smt. Beena Ranganath Naikrefused even to except letter/Note sent by us. Thisregard please see the letter sent by Incharge ofCID/Centre Margao placed on record along withhis remark/endorsement on it. 1) Vide No. CID/SB//MRG/2300/2007 dated 26-12-2007 and 2) No. CID//SB/MRG/77/2008 dated 10-01-2008.

Further I submit that the delinquent PC-3963,Ranganath A. Naik (Deserter) has given followingopportunities to appear before Inquiring Officer forhis defence along with his Friend Officer.
1) No. PI/CID/CB/907/2008 dated 14-04-2008, toappear on dated 26-04-2008 at 10.00 hrs. Letterserved remained absent.
2) No. PI/CID/CB/1983/2008 dated 04-07-2008, toappear on dated 14-07-2008 at 10.00 hrs. Letterserved remained absent.
3) No. PI/CID/CB/1262/2008 dated 22-07-2008, toappear on dated 04-08-2008 at 10.00 hrs. Letterserved remained absent.
4) No. PI/CID/CB/1679/2008 dated 17-04-2009, toappear on dated 04-05-2009 at 10.00 hrs. Letterserved remained absent.
In the Notice sent vide Sr. No. 1 No. PI/CID/CB//1983/2008 dated 04-07-2008 and 2) No. PI/CID/CB//1262/2008 dated 12-07-2008 have stated that incase delinquent PC-3963 Ranganath A. Naik hasremained absent on given date ex-part Inquiry willbe conducted. The delinquent PC-3963, RanganathA. Naik also requested to produced MedicalCertificate on regular basis (for every month) fromconcerned Medical Officer saying he is not fit togive Statement before Inquiry Officer so thatEnquiry Officer could take next steps, butdelinquent PC-3963 has failed to produce the same.He has not produced an Medical Certificate after22-08-2008 till date (30-07-2009).
Whenever the delinquent PC-3963 Ranganath A.Naik was called for Departmental Enquiry his wifeMrs. Beena Ranganath A. Naik made a writtenrequest to the Enquiry Officer to postpone the dateas her husband PC-3963, Ranganath A. Naik(Deserter) is under treatment and after his fullyrecovered he will remained present before InquiringAuthority for Enquiry.
The letters sent by Mrs. Beena R. Naik requestingto postpone the dates are placed on records asshown below:
1) Dated – 26-06-2009,
2) Dated – 22-08-2008,
3) Dated – 27-07-2008,
4) Dated – 19-04-2008,
5) Dated – 15-01-2008,
6) Dated – 05-01-2008.
On these requesting letters, it seems that thedelinquent PC-3963, Ranganath A. Naik has no anyinterest to appear for Departmental Enquiry nor hewant to justify his absent period. Because he hasno any genuine ground or no any proper base forhis defence.
Hence discussed with Presenting OfficerShri U. Balaswamy ASI, Petition Cell PHQ, Panajiwho is also agreed not to give any more opportunityto the said delinquent and in this situation theInquiry Officer is compelled to conduct ex-parteEnquiry against delinquent PC-3963, Ranganath A.Naik. So also Superiors are pressing to dispose itfast by using all means as per Law and Rules of theland.
Such circumstances Inquiring Officer iscompelled to conduct ex-parte Enquiry and calledthe witness mentioned in the Annexure-IV1) Shri Madhukar K. Bayenkar s/o Keshav PSI,CID/SB Centre, Margao who was Incharge of thesaid Unit then, and recorded his statement(Examined) on behalf of the prosecution asprosecution witness No. 1. Contents of his statementare run as under:-
I say that in the year 2006 to 2008 I was attachedat CID Special Branch Margao Unit and functioningas a Incharge of said Units. Shri Ranganath A. NaikPC-3963, was also working under me at said Unit.
It is fact that PC-3963, Ranganath A. Naik hadgone for 30 days Earned Leave w.e.f. 22-06-2006 to21-07-2006 and 02 days P. L. from 22-07-2006 to23-07-2006. But instead of reporting for duty he hassent a sick note stating that he is sick and unableto attend for his duty.
This regard I have submitted report to theDy. Supdt. of Police, CID/SB, Panaji-Goa, videNo. CID/SB/Mar/1219/2006 dated 24-07-06, statingthat the sick certificate will be submitted alongwith fitness certificate. Copy of report was alsosubmitted to the Supdt. of Police South, MargaoGoa for information as a usual practice. The copy ofsaid report is marked as ‘Exhibit-A’ and taken onthe record and report.
Sick note submitted by Ranganath A. Naik(Ex-PC-3963) is marked ‘Exhibit-B’ and taken onthe record.
I further submit that in continuation of letterNo. CID/SB/Mar/1219/2006 dated 24-07-06 I furthersubmitted my report vide No. CID/SB/1228/06 dated

25-07-07 that a original certificate which isproduced by wife of said PC-3963, Ranganath A.Naik issued by Medical Officer Dr. Amit D.Kudchadkar and countersigned by Dr. EdwardD’mello, Sr. Physician of Hospicio Hospital, Margaowho gave him 30 days rest w.e.f. 24-7-06 copy ofwhich is marked as ‘Exhibit-C’ and taken on therecord.
On 02-08-06 I received a memo from SP, South,Margao-Goa vide No. SP(S)/ESTT/PC-3963/2269/06dt. 02-08-06, directing me to sent PC-3963,Ranganth A. Naik to Goa Medical College forsecond medical opinion under intimation to him.Accordingly I informed Ranganath A. Naik, PC-3963vide note No. PSI/CID/SB/MAR/1285/06 dated02-08-06 under the intimation to SP (South) andDy SP (SB) Panaji. Both the letters marked as‘Exhibit-D & E’ respectively and taken on the record.
On 06-08-06 received memo from SP(South) videhis No. SP(S)/ESTT/PF/PC-3963/2422/06 dated16-08-06 asking me that whether PC-3963,Ranganath A. Naik has approached Goa MedicalCollege Bambolim for second medical opinion orotherwise. A detailed report be submitted.Meanwhile Mrs. Beena Naik who is w/o RanganathA. Naik PC-3963 sent a letter saying her husbandis seriously ill and under ayurvedic treatment andwas taken outside Goa by her relatives fortreatment. After his full recovery he willimmediately report for duty. Both the letters markedas ‘Exhibit-F & G’ respectively and taken on therecord.
Further I submit that the letter dtd. 14-08-06 sentby Mrs. Beena Naik submitted to the SP, (South)Margao vide No. CID/SB/MRG/1365/06 dated18-08-06, so far PC-3963, Ranganath A. Naik had notunderwent second medical opinion at G.M.C.Bambolim through this office. The same letter ismarked ‘Exhibit-H’ and taken on the record.
On 29-8-06 received memo vide No. SP(S)/ESTT//PF/PC-3963/06 dated 29-8-06 asking me to visithouse of said PC- and verify in detailed of hissickness and place of taking the treatment. Saidletter is marked as ‘Exhibit-I’ and taken on therecord.
On 24-8-06 I submit a report to the SP (South)Margao vide No. CID/SB/MARG/1401/06 dated24-8-06 giving details about his sickness medicalcertificate and intimation/instructions given by thesuperiors in time to time. I also submitted that
PC-3963, Ranganath Naik has not report for dutytill date as he was supposed to resume for dutyon 24-6-06 copy of report also submitted Dy SP CIDsame is marked as ‘Exhibit-J’ and taken on record.
On 07-09-2006 vide letter No. CID/SB/MARG//1474/06 I submitted report to SP (South) Margaosaying that Mrs. Beena informed her husband issuffering from typhoid so he lost her weight andher relatives refer him for treatment outside of Goasomewhere at Karwar. She is not aware exact placeof treatment. Said letter is taken on record andmarked as ‘Exhibit-K’.
The SP(South) Margao directed me to contactthe relative of said PC and ascertain hiswhereabouts and furnish his medical certificateswithin a week, failing which absent report shouldsubmitted considering as unauthorized absent. Sothat he will be declared as deserter from serviceunder rule 22 of Goa Police Subordinate Service(D&AO Rules, 1975 vide his letter No. SP (S)/ESTT//PF/PC-3963/2732/06 dated 18-9-06 which is markedas ‘Exhibit-L’ and taken on record.
The instruction mentioned in memo No. SP (S)//ESTT/PF/PC-3963/06 dated 18-9-06 has beeninformed to Mrs. Beena and intimated to the SPvide office letter CID/SB/MARG/1549/06 dated25-9-06 and copy of the Dy SP SB Panaji. The saidletter is marked as ‘Exhibit M’ and taken on record.
I know that the said PC-3963, Ranganath A. Naikhas been declared as deserter vide orderNo. DE/Deserter-3/2006/10124/06 dated 31-10-06 bySP CID, Panaji as official intimation was sent to CIDCentre, Margao for information, I being anIncharge of the unit. This letter is taken on recordas ‘Exhibit-N’.
Finally I say that number of opportunities weregiven to PC-3963, Ranganath Naik to answer theinstructions in time to time and produce therelevant/certificate to his sickness to regularizedhis sick period.
Opportunity given for delinquent to cross.
Delinquent PC-3963, Ranganath A. Naik wasrequested to appear for hearing vide NoteNo. PI/CID/CB/1697/2009 dated 17-04-2009, on04-05-2009 at 10.30 hrs. at CID Crime Branch,Dona-Paula Sharp. Note is served to Mrs. BeenaNaik who is w/o Ranganath Naik. But he remainedabsent.

Delinquent PC-3963, Ranganath A. Naik is notappeared. However, Mrs. Beena R. Naik w/o said PCsent a written letter dt. 29-04-2009 saying that herhusband Ranganath A. Naik is not sounds well butimproving from his illness and he is still underMedical treatment. Xerox copy certificate isenclosed. Same is enclosed as ‘Exhibit-O’ and takenon the record.
Since the reason given by Mrs. Beena Naikand PC-3963, Ranganath A. Naik are not validand reasonable. So ex-parte D. E. Enquiry has beenconducted. This regard the delinquent and his wifewere informed well in advance on several occasions.
Witness mentioned in the Annexure IVnamely:-
2) Dr. Amit D. Kudchadkar, M.B.B.S. (Goa) FamilyPhysician GMC Registered No. 1476 was summonedVide this P. S. Letter No. PI/CID/CB/4555/2009 dated09-07-2009 through Police Inspector, AgassaimPolice Station. But Agassaim Police stated thatEnquiry is conducted at given address but medicalofficer is not found GMC Bambolim, or hiswhereabouts is not known so far.
3) Dr. Edward D’mello, Sr. Physician, HospicioMargao was present on 10-01-2009 before EnquiryOfficer and showed him medical certificate issuedon 24-07-2006 by Dr. Amit D. Kudchadkar, familyPhysician and countersigned by Dr. Edward D’melloon 25-07-2006.
On observation said medical certificateDr. Edward D’mello stated that after expiry of periodof rest, patient (Ranganath A. Naik) is deemed tohave recover and fit enough to give statement.
4) Dr. Magno A. C. Pereira, Sapana Chambers,were also summoned vide letter Nos. PI/CID/CB//4556/2009 dated 09-07-2009, No. PI/CID/CB/4839//2009 dated 28-07-2009. And letter No. PI/CID/CB//4925/2009 dated 05-09-2009. But he has notattended nor he has given any reason even letterswere duly served.
The presenting Officer Shri U. Balaswamy PetitionCell, PHQ, Panaji argued that delinquent PC-3963Ranganath A. Naik was given sufficientopportunities to present his defence through hisAssistance Officer/Friend Officer after recording hispreliminary statement. But he is not bothered toattend for Enquiry.
Every occasion he has sent written Note throughhis wife Mrs. Beena Ranganath A. Naik to the
Inquiry Authority to postpone the date withoutvalid reason pretending that he is sick and undertreatment. After fully recovered he will attendbefore Enquiry Authority.
In the written Note medical certificate submittedby him does not speak anything that delinquent isnot able to give his statement before InquiringOfficer. So request of the delinquent PC-3963,Ranganath A. Naik could not be consider in anycircumstances to postpone the Department Enquiryand ex-parte enquiry could be considered anddispose the case on merit bases.
Presenting Officer further submitted thatdelinquent PC-3963, Ranganath A. Naik remainedunauthorized absent for a period beyond 21 daysand all charges framed against him are provedbeyond any doubt and he should be deservedexemplary punishment to reform him as a lesson toother staff of Police Department.
Hence Enquiry Officer has no any otheralternatives. So considered the say of PresentingOfficer.
Findings of the Enquiry Officer
PC-3963, Ranganath A. Naik (Deserter) of CIDCentre, Margao was granted 30 days Earned Leavew.e.f. 22-06-2006 to 21-07-2006 and 2 days permissionon 22-07-2006 and 23-06-2006 vide Dy. SP, CID,SB, Panaji Order No. Dy. SP/SB/261/2006 dated21-06-2006. The said PC was supposed to report forduty on 24-07-2006 but he reported sick and thesame was intimated by him to PSI, CID Centre,Margao, vide his application dated 24-07-2006.Medical Certificate dated 24-07-2006 froma Private Practitioner, Dr. Amit D. Kudchadkarduly countersigned, by Dr. Edward D’Mello,Sr. Physician, Hospital, Margao recommending restfor 30 days was submitted by Deserter PCs wife on24-07-2006 further, SP (South) vide his memoNo. SP(S)/Estt./PC-3963/2269/2006 dated 02-08-2006had directed PSI, CID, Centre, Margao, to refer thesaid Deserter PC to G.M.C. for second medicalopinion which was conveyed to the PC vide NoteNo. PSI/CID/SB/MRG/1285/2006 dated 02-08-2006with direction to furnish medical certificateaccordingly. Since no reply was received from theDeserter PC, SP/South again reminded PSI, CIDCentre Margao. Who informed vide his letterNo. CID/SB/MARG/1365/2006 dated 18-08-2006, thatthe said PC had not approached G.M.C., Bambolimfor second opinion and forwarded an intimationdated 14-08-2006 from the deserter PCs wife that

her husband was seriously ill and under AyurvedicMedical treatment for which he was taken outsideGoa by her relatives and that after his full recovery,he will resume for duty. A memo bearingNo. SP(S)/Estt./P.F./PC-3963/2557/2006 dated29-08-2006 was sent to PSI, CID, Margao to verifythe details of the Deserter PCs sickness andplace where he was taken for treatment outsideGoa. Accordingly, PSI, CID, Margao informed on07-09-2006 that initially the PC was suffering fromtyphoid and therefore taken at medical treatmentto Karwar. SP/South, vide his memo No. SP(S)/Estt.//PF/PC/3963/2732/2006 dated 18-09-2006, haddirected PSI, CID, Margao, to instruct the saiddeserter PCs wife to contact her relatives toascertain whereabouts of her husband and also tofurnish medical certificates justifying theunauthorized absence w.e.f. 23-08-2006, within aweek failing which he will be declared a deserterfrom service, under Rule 22 of the Goa PoliceSubordinate service (Discipline & Appeal) Rules,1975, PSI, CID Centre, Margao who intimated thesame to the deserter PCs wife on 25-09-2006. Sinceno reply was received either from the said deserterPC or from his wife, a detailed report bearingNo. SP(S)/Estt./PF/PC/3963/3036/2006 dated16-10-2006 was submitted by SP (South) to declaresaid PC as deserter an subsequent disciplinaryaction. The said PC was, therefore, declared aDeserter for his unauthorized absence from dutyw.e.f. 23-08-2006 and his name was struck off, fromthe active rolls of Police Personnel of theDepartment w.e.f. 13-09-2006 under Rule 22 of theGoa Police Subordinate service (Discipline andAppeal) Rules, 1975 as amended from time to time,vide Order No. DE/Deserter-3/2006/10124/2006 dated31-10-2006.
NOW QUESTIONS BEFORE THE ENQUIRYAUTHORITY ARE:
1) Whether delinquent PC-3963, Ranganath A.Naik has given sufficient opportunities for hisdefence?
Ans. Yes - Positive.
2) Whether delinquent PC-3963, Ranganath A.Naik request for postpone the dates on everyappointment are genuine/justifiable?
Ans. No - Negative.
3) Whether delinquent PC-3963, Ranganath A.Naik has remained unauthorized absent beyond 21days?
Ans. Yes - Positive.
4) Whether Charges levied against delinquentPC-3963, Ranganath A. Naik are proved beyonddoubt?
Ans. Yes - Positive. (Opportunities given to thedelinquent/charged officer for his defence has beenrejected remaining absent).

CONCLUSION:
After careful study of the evidence on the reportit is found that delinquent PC-3963, Ranganath A.Naik (Deserter) CID, Centre, Margao have given morethan sufficient opportunities to defend his casebeginning from 10-12-2007 till 03-08-2009 but hehas not bothered to face/appear for enquiry beforethe Inquiring Officer nor he has given any soundreason for remaining absent. This attitude ofdelinquent PC-3963, Ranganath A. Naik (deserter)does not come under disciplinary force being amember of a Police Force. Even then he was givenample opportunities from 10th December, 2007 to3rd August, 2009.
Under the above circumstances it seems thatthe said delinquent PC-3963, Ranganath A. Naik(deserter) is having bad attitude towards hissuperior officer’s order, instructions and guidelinesgiven to him time to time. This has been, he himselfproved his behaviour as, “HE BEHAVED IN MANNERUNBECOMING OF GOVERNMENT SERVANTSPECIALLY OF A MEMBER OF A DISCIPLINEFORCE, THAT HE REMAINED ABSENT FROM HISDUTY W.E.F. 23-08-2006 WITHOUT LEAVE.”Therefore he has committed an offence of desertionis proved beyond any doubt.
Therefore Enquiry Authority holds that thecharges framed in Articles -I against the delinquentPC-3963, Ranganath A. Naik (Deserter) are proved.
