Meaning of “Issue or Grant of a Building Permit”

• Issue of a Deemed Building Permit by an Architect on Record of the MCD or a grant of a Municipal Building Permit by the Commissioner shall mean an acceptance by the Corporation that the design and specifications of the proposed building, for which Building Permit has been issued or granted, conforms to these Building Byelaws, and, that the person holding the Building Permit may undertake construction of the proposed building.

It does not constitute acceptance of correctness, confirmation, approval or endorsement of:

(a) Title, ownership, and easement rights of the plot on which the building is proposed

(b) Workmanship, soundness of material and structural safety of the proposed building.

and shall not bind or render the MCD liable in any way in regard to (a) and (b) above.

• Any building undertaken without an issue or a grant of a Building Permit, or undertaken after a Building Permit has lapsed, or, after a Building Permit has been revoked, shall be deemed to be an Unauthorized Building.

• Lift(s) shall be provided in all buildings having a habitable floor at a height above 13.5 m from the plinth level.

• Lifts and escalators shall also meet fire prevention and safety requirements.

•On the roof (terrace) of a building and the remaining area of the plot.•Rain water shall not be discharged onto a street at a height > 1.0 m from the level of the street. •The manner of channelling rain water discharge from a plot to a public storm water drain, if available, shall be determined by the Corporation. 45 cm.

•Mandatory for all buildings for plot sizes >= 100 sq. m.• The system of storm water drainage and storage in reservoirs and recharge should conform to specifications published by the Central Ground Water Authority.

Pollution Control

•Air PollutionAll buildings shall conform to provisions of Air Pollution Control Act, 1981.

•Water PollutionAll buildings shall conform to provisions of Water (Prevention and Control of Pollution) Act, 1974.

•Noise PollutionAll buildings shall maintain ambient air quality standards in respect of noise, as prescribed in the Noise Pollution (Regulation and Control) Rules, 2000.

GUIDELINES FOR ALLOWING MIXED LAND USE, NAMELY, NURSING HOMES, GUEST HOUSES AND BANKS IN

RESIDENTIAL AREAS.

• Allows above in residential plots of minimum size 209 sqm facing roads of minimum width 18 mts

• 9 mts. in special areas and 13.5 mts. in rehabilitation colonies

• The maximum plot size for the above mentioned activities will be 1000 sqm.

• All parking requirements of plot size over 250 sqm is to be provided within the plot. In case of smaller plots, land in the vicinity will be identified and common parking areas developed.

GUIDELINES FOR ALLOWING MIXED LAND USE, NAMELY, NURSING HOMES, GUEST HOUSES AND BANKS IN

RESIDENTIAL AREAS.

• Nursing Homes, on payment of a fee, should link up their disposal of waste with MCD/NDMC, to ensure hygienic disposal.

• No commercial activity in the form of canteen or restaurant will be permitted. Catering will be allowed only for the residents of the Guest Houses/Nursing Homes.

• To avoid chances of recycling of syringes, needles, plastics, the Nursing Homes must ensure that these are destroyed before disposal.
