A professor stood before his philosophy class and began filling a large, empty jar with golf balls. When he couldn’t get any more into the jar, he asked his students if the jar was full. They agreed that it was. But then the professor picked up a box of pebbles and poured them into the jar. He shook the jar lightly. The pebbles rolled into the open areas between the golf balls. He asked the students again if the jar was full. More cautiously, they said that it seemed to be. He next picked up a box of sand and poured it into the jar. Of course, the sand filled up the space between the golf balls and the pebbles. He asked once more if the jar was full. Now, the class warily said "yes." The professor then took two cans of beer from under the table and poured them into the jar, somehow finding their way into the jar. The students laughed. "Now," he said, "recognize that this jar represents your life. The golf balls are the important things – your family, your health, your friends, your passions – things that if everything else was lost and only they remained, your life would still be full. Think before you speak.

We’ve all spoken in haste and repented at leisure. My Bubbi used to say “You are King over all your words until you let them out of your mouth.” I knew some-one who had a large fish he had caught

mounted on his wall with a plaque beneath it that read: “If I had kept my mouth shut, I wouldn’t be here.”

The news has been full of stories lately about folks who have re-gretted things they’ve said, or done, that were, perhaps, not very well thought out. This has been a historical problem as well.

“You won’t have Nixon to kick around anymore—because, gentle-men, this is my last news conference.” (Richard M. Nixon after los-ing the 1962 California gubernatorial election, Nov 7, 1962).

“I have no political ambitions for myself or my children.” Joseph P. Kennedy, 1926.

Re-order your priorities.

The Honorable Gerald Bruce Lee (Ret.) admirably served for nineteen years on the bench of the U.S. District Court for the Eastern District of Virginia. Prior to his appointment to the federal judiciary, Judge Lee served for over six years as a judge for the Fairfax Circuit Court, and before that, he was a trial lawyer representing individuals and businesses in complex civil disputes. the other things that matter like your job, your house, your car, your assets. The sand is ev-erything else, the small stuff. If you put the sand in first, there will be no room for the pebbles or the golf balls. The same goes for life. If you spend all your time and energy on the small stuff, you will never have room for the things that are import-ant to you. Pay attention to the critical things: Love your fami-ly. Play with your children. Get medical checkups. Appreciate the joys in your life. Take care of the golf balls and the pebbles first, the things that really mat-ter. Set your priorities. There will be room for the sand."

“What about the beer?” one student asked. The professor smiled. "Well, it just goes to show you that no matter how full your life may seem, there's always room for a couple of beers."

Read more and dust less. Ad-mire the view and don’t fuss about the weeds in the garden. Spend more time with fam-ily and less working. Savor life, don’t endure it. Live in the moment and cherish it. Don’t “save” anything. Use the good china and crystal for every pos-sible occasion. Dress up if you feel like it. If it's worth seeing or hearing or doing, see and hear and do it now. Call former friends and mend fences. Go out for your favorite meal. Write that letter. Tell your family how much you love them and do it often. Add laughter and lus-ter today. Don’t take today for granted. Every morning when you open your eyes, tell your-self that it’s a special day. Every day, every minute, every breath truly is a gift from God.

Watch your finances.

We now are able to spend money effortlessly, without even think-ing about it. Salaries are paid by direct deposit. When we shop, most of us use credit cards rath-er than cash. Our bills are au-tomatically deducted from our bank accounts or charged to our credit cards, which are in turn automatically deducted from

our bank accounts. EZ Pass pays our tolls without us ever touch-ing our wallets. We buy on-line with Paypal or credit cards. We seldom write checks to send in the mail. It hardly ever feels like we’re really spending money. But we are. Make sure you do at least a monthly review of your finances. Look over your cred-it card and bank statements carefully. Create a budget and monitor your spending. Save for your kids’ education, your retirement, rainy days, fun ad-ventures and vacations.

Be considerate of others.

Have you said “hi” to your mail deliverer? The store cashier? Do you know their names or anything about them? Wheth-er in this season of Good Will towards Men and Women, or throughout the year, appreci-ate others. Be kind. You never know what burdens the peo-ple around you carry. Tip your server and others who make your life a bit easier.

Give unselfishly.

We as lawyers have been giv-en a lot. Give back. Volunteer through BAMC with our char-itable organization partners. Donate what you can to those less fortunate.

Take care of yourself.

Decide when you get up each day what that day will be like. Keep your life in balance, with a mixture of work, family, friends, spirituality, play, service, etc. No-tice and applaud all of your suc-cesses. Forgive yourself. Be pa-tient with others. Stay mindful in the moment. Do something special for yourself each day. Meditate. Get a yearly physical. Exercise. Eat healthier. Drink more water. Embrace change. Look for opportunity in every challenge you face. Laugh. Sur-round yourself with positive, loving people. Listen to music.

satisfied by a statement, dec-laration, verification, or certifi-cate, in writing, subscribed and certified or declared to be true under penalties of perjury.” (50 USC 3931(b)(4)).

The Act does not state how long a given affidavit is valid or when an affidavit becomes stale. Often printouts from the Department of Defense website can confirm a persons status. As you can see from the excerpt above, it is not manda-tory that the DOD website be the source of the facts regard-ing a person’s military status.

Members of the bar have ex-pressed concern regarding differing interpretations and applications of the military af-fidavit requirement. In an ef-fort to apply the act consistent-ly and uniformly the following parameters are considered suf-ficient to comply with the letter and spirit of the SCRA:

1. Affidavit must be in writ-ing/under oath.

2 Affidavit may only predate the trial/judgment date by 6 months to be considered current.

3. DOD printout may ac-company affidavit if plaintiff chooses to include it.

4. Sworn affidavit referring to a DOD printout obviates the need to attach the actual DOD printout

I hope this will ensure consis-tency and predictability in the entry of default judgments in small and large claims, civil motions, municipal infractions, and landlord-tenant matters.

CIVIL MOTIONS AND CONTINUANCES Attaching a proposed order

to any civil motion (or opposi-tion) is a tremendous help. As I am sure you know, the District Court is a high-volume court. On any given day a judge may have upwards of 50 civil files for chambers rulings. These files are separate from criminal, traffic, DV motions, L&T writs of restitution, and the assigned courtroom docket. We do not have chambers days or a duty judge. A proposed order, even if amended by the court, is likely to be more legible than a hand-written ruling.

When parties are seeking a continuance of a civil case, it is important that the motion contain at least 3 proposed fu-ture trial date. District Court Administrative Regulation XI.D states:

“Unless otherwise agreed by the clerk, all request for post-ponements should be accom-panied by three (3) proposed dates when the attorneys and parties are available. Counsel should attempt to contact opposing counsel, if possible, to clear dates acceptable to both attorneys and parties.”

Having proposed dates, already cleared with counsel and the parties, facilitates much more efficient rescheduling of post-poned cases. It is time-con-suming and difficult for the civil clerks to serve as the scheduling intermediary. Large claims are tried every Wednes-day. Small claims are tried on Thursdays in Rockville and Fridays in Silver Spring. Dock-ets are set for 8:30 am and are scheduled for all day.

First of all, I wish you happy holidays. I am writing this col-umn to get you thinking about change you might begin in January. If you wait until January to decide on and institute change in January, it won’t begin until February or March.

I’ve mentioned previously that January is a great time to in-stitute change as there are very few holidays between Janu-ary 2nd and the summer. Positive changes made in January are more likely to become permanent because of that unin-terrupted time.

Step 1: Pick the area you want to change. It could be increas-ing revenue by marketing, improved billing processes, in-creasing your billing rates, or increasing billable hour goals. Or you could try to solve a practice problem through better accountability, better customer service, shifting or adding a practice area, improving collections, meeting deadlines, im-proving work product, reducing stress, improving follow-up, improving staff morale, or teambuilding.

Brainstorming tends to be the best way to choose the most important goal. I’ve found that it’s important to get wins early before my coaching clients take on the bigger and more difficult goals.

Step 2: List the steps necessary to achieve the goal you choose. Break these into small steps. The smaller the steps, the more likely you will get them done. Here I brainstorm with clients about which steps will work best. We combine my experience with each client’s knowledge of their firm’s capabilities to come up with a plan.

Step 3: Just do it. Put each step on the calendar and attack them one by one. I provide accountability to make sure that we achieve each step, and then we work through the obsta-cles that come up because change is hard.

An example of a positive change that a client recently made: holding each attorney and paralegal accountable for meeting their stated daily billable hour goals. First, we changed time reporting to daily and then required each professional to in-put billable hours each day. Once we had that in place, we saw results quickly: billable hours were recorded more ac-curately, bills went out faster, recording hours changed from a twice per month burden to a manageable daily task, and we almost immediately saw increased income. While this didn’t work perfectly at first, it never does! Once everyone understood the importance of making the change and saw the drive from the top to get it done, it happened.

PRELIMINARY INQUIRIES:Beginning January 7, 2019, Commissioners will resume handling Preliminary Inquiries in DUI Cases on Mondays and Tuesdays at 9:00 a.m. in Rock-ville District Court, Courtroom 513.

This will free up judges to handle serious traffic cases on Mondays and Tuesdays, begin-ning on January 7 and 8, 2019. These new dockets will be held in Courtroom 612, and will be kept light because the actual judge in 612 will be handling bonds in Rockville 513 at 1:00 p.m.

Any member who is con-cerned about these issues should address comments or emails to the co-chairs, Reg-inald W. Bours, III, and Rich-ard London, as this will be a continuing discussion at our meetings.

EXTREME RISK PROTECTIVE ORDERS [ERPO] – HB 1302 PUBLIC SAFETY ARTICLE 5-601, ET. SEQ.Judge Mitchell reported that about 70-75 petitions have been filed statewide since Oc-tober 1, 2018, when the statute was effective. Most petitioners have been police officers, and in Montgomery County, the County Attorney’s Office will be entering an appearance on their behalf.

One problem is that the stat-ute does not authorize parties entering into a consent order and District Court judges are

required to make findings on the record.

Another one that could occur is that the Court is concerned what will happen if any re-spondents are juveniles, who would not be legally competent to represent themselves but must come to District Court in ERPO case. District Court has no authority to appoint coun-sel, or to determine a child to be CINA.

OTHER ISSUES DISCUSSED: Judge Mitchell indicated she has received concerns ex-pressed by defense lawyers that criminal defendants with outstanding warrants are being arrested in court, prior to com-pletion of their already pend-ing case. It was believed that officers who do not want to wait for an afternoon trial were using the outstanding charge to obtain a de-facto continu-ance (in lieu of waiting for the trial that is scheduled that day). County police liaison officer advised that this is not a proce-dure that they should be using.

(Continued from page 13) (TCJA) of 2017 and applies to tax years 2018-2025.  In sum-mary, it provides a 20% de-duction for non-C corporation qualified business income sub-ject to limitations and phase-out.  There are two steps to cal-culating this deduction.  First, determine taxable income and business income without cap-ital gains and losses.  Then take 20% of these two sets of income.  If the taxpayers' income is under $315,000 for married filing jointly tax re-turns or $157,500 for other tax returns, the deduction is the lesser of these two 20% calcu-lations.  

Section 199A is one of the most important tax law changes from the TCJA and all non-C corporation business owners should speak with their tax professionals soon for 2019 tax planning.  Certain steps may need to be taken by business owners to ensure their max-imum tax deductions under this new tax law.

cuit Court to middle school stu-dents and occasionally to other groups. Students spend the morning participating in a mock trial and seeing courtroom pre-sentations. Students have an opportunity to speak with the Honorable Robert A. Greenberg or other members of the bench, see a canine demonstration, vis-it the lock-up, hear a presenta-tion by the Deputy Sheriff, and visit an actual courtroom in ses-sion to watch part of a trial.

The Montgomery County Bar Foundation Pro Bono Program seeks volunteers – whether ex-perienced or newly barred attor-neys – to join our panel. There are many county residents that are in great need of pro bono services. Your call to volunteer will make a difference to those without resources.

The Pro Bono Program pro-vides two ways for county res-idents to receive FREE LEGAL SERVICES in civil cases – at a le-gal advice clinic or through the client intake line for referral to an attorney volunteer for direct representation. The legal advice clinics operate in five locations across the county (SEE BOX BELOW) and provide residents the opportunity to walk-in and

meet with an attorney volun-teer without scheduling an appointment. Eligible clients present their legal problems to an attorney and receive free immediate legal advice and/or referral to a non-profit or gov-ernment social service agency that may be helpful. The cli-ent intake line operates out of the main office where the staff screens calls from potential clients. The Pro Bono Program staff conducts all screenings over the phone only. Cases re-ferred to attorney volunteers include family law, debt collec-tion, bankruptcy, limited em-ployment, limited immigration, wills and power of attorney.

The Pro Bono Program pro-vides FREE LEGAL TRAINING to attorney volunteers. The Rita Rosenkrantz Family Law Train-ing seminar will take place in April, 2019, with registration opening in January. The Pro Bono Resource Center (PBRC) also offers FREE LE-GAL TRAINING to attorneys in exchange for a pro bono

commitment in several areas including Immigration and Bankruptcy. Check the PBRC website, www.probonomd.org, for details.

The Pro Bono Program staff works daily to meet the chal-lenges of connecting client and attorney. ITC and developed the legal analysis that became the basis for the successful petition for certiorari in the landmark Su-preme Court arbitration case Stolt-Nielsen v. Animalfeeds.
