462708 Fee:$O.OO P DAWSON CTY, MT Rec/Filed 1 Shirley Kreiman, Clk & Rcdr RETURN TO: FILED RESOLUTION 2017-33 RESOLUTION OF INTENTION TO CREATE RURAL SPECIAL IMPROVEMENT DISTRICT FORTY-SEVEN WHEREAS, the Commissioners were notified by a group of residents in the River Road Subdivision that would like a piping system to transport Buffalo Rapids Irrigation Water to their property, and WHEREAS, an information meeting was organized and held by the residents on May 15, 2017. A vote was taken by the group of citizens present and mailed to those not present. The vote was tallied on June 13, 2017 with Sixty-Three 63% in favor of forming a Special Improvement District to fund such pipeline. Fifteen 15% were against, and Twenty-Two percent 22% abstained from voting, and WHEREAS, the commissioners recognize there is significant public interest to form such district, and WHEREAS, MCA 7-12-2102, 2103 authorizes the Board of County Commissioners to create such District; THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DAWSON COUNTY, MONTANA: That it is the intention of the Board of County Commissioners of Dawson County, Montana, to create A) Rural Special Improvement District #47, River Road Irrigation Pipeline District B) That the boundary lines of said RSID District #47 is shown on attached Exhibit 1 and described on attached Schedule A. C) The general character of the improvements to be made will provide for a pipeline system of approximately 18,000 lineal feet of pipeline, which would replace the open ditches that are owned by the residents. D) That the name of the engineers in charge of the work of said Improvement District is Great West Engineering, Inc. and estimates the cost of the project to be $626,400, which is exclusive of operation, maintenance, repair and preservation costs. E) The cost of the improvements will be assessed per lot pursuant to MCA 7-12-2151(1)(d). If an increase occurs in the number of benefited lots, tracts, or parcels within the boundaries of the district during the term of the bonded indebtedness, the assessment per lot, tract, or parcel then in the district will be recalculated as provided in MCA 7-12-2151(4). F) That exempt lots are described within the boundary lines of the RSID District #47 as shown on attached Exhibit 1 and described on attached Schedule A. G) At the time and place specified in the notice of passage of this resolution, the Board of County Commissioners of Dawson County, Montana will hear and pass upon all protests that may be made against the acquisition and construction of improvements relating to said properties, of the establishment of assessment rates for the construction of said pipeline against the creation of the Rural Special Improvement District to be assessed for such costs, for the thirty (30) days from the date of first publication of the passage of this resolution, Page 1 Resolution #2017-33
