    n 3-8-02, officers from the State Police searched Mr. Komisarjevsky's residence based on information receiveith regard to his invo!vement in area Burglaries. During the search, several stolen items were recovered and Momisarjevsky stated that he had he broke into a house in Cheshire located on Glenbrook Drive, on the morning-2-02. He stated that he entered the residence by reaching through an unlocked window and unlocking a reaoor. He stated that he stole $40.00 in cash from a wallet that was on a kitchen counter, a yellow canvas bag frome living room, which contained a paint ball gun, helmet, and assorted paint ball paraphernalia and a laptoomputer located near the rear door that he entered. Following his statement, the subject brought the officers to hedroom, where he pointed out a yellow canvas bag containing the paint ball gun, helmet, and assortedaraphernalia. The items were photographed and seized as evidence. It was determined that a resident olenbrook Drive in Cheshire had reported on 3-2-02, that her home had been burglarized while they were sleeping.he items reported stolen matched the items recovered at the defendant's house :and the complainant valued thlen property at $3,650.00.

    n 8-15-02 Joshua Komisarjevsky pled guilty to Burglary 2nd Degree and Larceny 3r~.Degree.

    CTIM'S ATTITUDEi's writer spoke to the victim in the instant offense. She stated that her ex-husband's laptop computer, some cashd her son's paint ball equipment were stolen. She stated "we were home and slept through the whole thing." Shated that they have moved since then and the children have been a little weirded out by the whole thing. Sheated that her 11-year-o!d son slept on her bedroom floor for months afterwards, She stated that the (defendant)ust be pretty smart, so he should be using his brains for something else." She indicated that she is fine with thefendant receiving 5 years in jail.

    n 3-8-02, officers from the State Police searched Mr. Komisarjevsky's residence, based on information receivedth regard to his involvement in area Burglaries. During the search, several stolen items were recovered and Mrmisarjevsky stated that he had he broke into a house in Cheshire located on Cornwall Ave, during the summer o01. On 3-10-02 Mr. Komisarjevsky gave a sworn written statement detailing the burglary at Cornwall Ave in

    heshire. He stated that he remembered breaking into this home in June or July of 2001, during the night, througn unlocked door. He stated that he took a purse from the home, removed a one hundred-dollar bill from the pursnd left the purse in the back yard of the home. On 3-19-02, officers responded to the residence on Cornwall Avnd spoke to the homeowner. She stated that she was missing a purse last summer, but she thought it had beetolen from her car. She stated that the purse contained personal papers, and a single one hundred-dollar bill, Aat point she made a formal complaint and stated that the purse was never recovered.

    ) ..On 8-15-02 Joshua Komisarjevsky pled guilty to Burglary 2nd Degree and Larceny 6th Degree.

    ATTITUDE(2)his writer spoke to the victim in the instant offense. She stated that she had just bought the purse for $44.00 andne hundred-dollar bill was in (t at the time. She stated that she is a Correctional Officer, who is out of workecause of an assault on the job and indicated that the loss is a lot to her. She stated that she thought her pursas stolen out of her car. and she is glad that she did not come into contact with the defendant. She stated that shd phone numbers of friends in Jamaica, in her purse that were not recovered, but has no additional loss. Shported that she is fine with the defendant receiving 5 years in jail.

    FENSE (3)CR02211363Sn 3-8-02, officers from the State Police searched Mr. Komisarjevsky's residence, based on information receivedith regard to his involvement in area burglaries. During the search, several stolen items were recovered and Mrmisarjevsky stated that he had he broke into a house in Cheshire located on Lanyon Drive, during the summer o01. He stated that he broke into the home in June or July of 2001, at approximately 1700 hours, by prying openndow screen and entering through this window. He stated that he took a prescription for Percoset and thirty orty dollars in cash. He stated that the people living in the home probably never reported the theft. On 3-21-02 theficer contacted the residents of the home, who stated that she felt something was odd about a window screen thas torn in the rear bonus room, but she did not know that someone broke into her home. She stated that theescription was not missed, because it was for an old injury. At that time, she filed a formal complaint with thelice department.

    n 3-8-02, officers from the State Police searched Mr. Komisarjevsky's residence, based on information receiveith regard to his involvement in area burglaries. 'During the search, several stolen items were recovered and Momisarjevsky stated that he broke into a house in Cheshire, located on Stratton Drive during the summer of 2001e stated that he broke into this home late at night by cutting a screen, and that he took a purse from this homen 3-11-02 the officer researched a burglary that was reported to the Cheshire Police Department on June 1601, by the homeowner on Stratton Drive. The complainant reported that someone broke into her home overnighd stole a pocketbook. The complainant stated that a screen was cut and there was $25.00 in cash, along witedit cards, and personal papers in the purse.

    3-5-02, at 5:20 hours, officers from the Cheshire Police Department were dispatched to a residence on Northber Lane, on a report of a burglary. The residents of the home stated that between 1:00 hours and 5:00 hoursthat date, an unknown person entered their residence and stole a laptop computer, a wallet containing $30.00 insh, several major and department store credit cards, a palm pilot personal planner, which contained personal andsiness related information, and a blue folding chair, The victim stated that the computer had personal informationwell as information regarding patients that he works with, as he is a child psychologist. The victim's wife statedt her purse was missing, which had several credit cards and store credit cards in her wallet. Investigationtermined that there was no forced entry and the suspect entered and left through the same doors. On 3-5-02, aness called the police to report that he noticed a white pickup truck parked next to some bushes on Timber Lanery early in the moming and he found this to be suspicious in nature. Joshua Komisarjevski was being investigatedburglaries in the Cheshire area and gave a statement implicating himself in the instant offense. He stated that he

He stated that he went into the home through an unlocked rear sliding door, after observing a purs

    a window, He stated that he took the purse, removed $40.00 from it, and disposed of it in a garbage bag ahome. The officers retrieved the purse from the defendant's garbage, which contained a cell phone, credit cardd persona! papers, On 3-9-02 Komisarjevsky pointed out the above home as one he had burglarized on thrning of 3-5-02.

    CTIMfS ATTITUDEis writer spoke to the victim in the instant offense, She stated that the police still have all of the stolen items any keep telling her ,she will get them back soon. This writer informed the victim that she could get the items bacen the case was disposed of, She stated that she heard "through the grapevine" that the defendant comes fromice family and it breaks her heart. She stated "l hope he gets help for his drug problem and gets his life togetherope he gets a second chance and 5 years seems like a lot. I hope he turns his life around, whatever it takes. It't so sad."

    r. Komisarjevsky stated "the whole thing started off, because I got in debt with my drug dealer." He stated that hirlfriend was pregnant with his child and he began to break into houses in order to pay back his drug dealer. Htated that the police had evidence on him in 2 cases and added, "I told them about all of them (the other burglariesecause my daughter was going to be born in 1 week." He stated "the police told me if I told them all of themould be able to see my daughter born. They knew I wasn't gOing to be able to."

    ith regard to the victims, Mr. Komisarjevsky stated "I wish I could tell them I'm sorry. I can't even imagine hoolated .... 1 wish there was more I could do. I live with the fact that it was wrong every day. I keep hearing from th,rosecutor that I'm a wild animal. .. 1 'm not. I acted out of fear. I miss my daughter. I know I have to pay, but I ase Judge for some mercy. Mr. Komisarjevsky stated he is willing to participate in treatment while on Probation andded, "as a matter of fact I want to learn more about addiction. Right now drugs aren't a problem for me, butould love to learn more about addiction. l've come to the resolve that I might be doing a lot of time and I donant to waste that time. I'm going to use it to better myself."

    SOCIAL HISTORYoshua Komisarjevsky was born in Vernon, Connecticut on August 10, 1980. He reported that he was adopted beverly and Benedict Komisarjevsky when he was 2 years old, and he has no knowledge of his biological parentshe subject reported that he lived in Torrington until the age of 5, Cheshire until the age of 14, and New Hampshirntil the age of 20, when he returned to the Cheshire area. The subject stated that his mother is about 48 years ond his father is about 51 years old. They are still married and he added, "they're still so in love It makes me sicmetimes!" He does not believe that either parent has been arrested and reports no known substance abuse oenta! health issues in either parent.

    r ..Komisarjevsky reported that his mother was a homemaker for all of his childhood, who home schooled him ans sister. He stated that his father is an electrician who worked at Waterbury Rolling Mills for 12 years, beforcently quitting to work for a private company doing electrical wiring. Mr. Komisarjevsky stated that his relationshipith his parents was excellent, until he started drinking at the age of 14. He stated "14 was a rough year" and thatople, who he was close to died when he was 14 years old. He stated that he was also dating a girl at the timat was "a real rebel" against his parents' wishes and "she got me into all sorts of things." With regard to hlationship with his parents currently, he stated that his relationship with his parents has been "restored more thaner thought it could be. They are supportive .. I thought I burned my bridges with my parents a long time ago ane support I'm getting from them is unbelievable."

    r. Kornlsarjevsky stated that his parents had one biological child, his sister Naomi, who just turned 20 years old he reported that he and his sister have become very close in the past couple years. He stated that his sister iing well, with no known substance abuse or mental health issues, and to his knowledge has not been arrested.e subject stated "I have a lot of respect for my sister. She learned from my mistakes." He stated that she takesllege courses and works at a center for troubled youth.

    . Komisarjevsky indicated that he attended public schools until the 5th grade and began home schooling in the 6de. He stated that he has Attention Deficit Disorder as well as Dyslexia and Dysgraphia, where you writembers and letters backwards. He stated that the teachers used to stand him in front of the class and make fun oand he was placed in Special Education in Slh grade. He stated that it took him a long time to do his work and

    e teacher told him he was "slow" and he would "never amount to anything." He stated that his mom was ararian at the school and discovered how he was being treated and decided to home school him. The subjecalled doing well in his schooling at home, where he had bible study first thing in the morning for 45 minutes,

    by morning chores, and then about 7 hours of study time. Mr. Komisarjevsky stated that he was home

    chooled until the age of 15, and then began to study with an apprentice in New Hampshire, where he graduateith a vocational diploma in sign making/carpentry.

    r. Kornisarjevsky reported that his parents had foster children, from the time .he was 2, until the time he wasars old. When he was about 7/8 years old, he reported that he and his sister were sexually assaulted by onee foster children, who he thought was about 17years old. He stated that he never told anyone, but his sister tor mother and the children were removed from the home. The subject stated that the abuser also made thfendant watch, while he touched the subject's sister. He stated that the boy's name was Scott, but he does now if he was ever arrested or what became of him. The subject reported that he was also raped at the age of 1hen he ran away from home one night and was walking with friends in New Haven at 3 am. He stated that a cith 2 men in their thirties, pulled up to him as he sat on a curb. He stated that they pulled him into an alleywayhere one of the men forced himself sexually on the defendant. He stated that the police found him later that nigd brought him home, but he did not tell anyone about the rape. Mr. Komisarjevsky recalled that he was broughte hospital that night, because he was "out of touch with reality" and then transferred to Elmcrest Hospital, wherremained for 1 month. The subject reported that the staff at Elmcrest wanted him to take medication fopression, but his parents were against it, adding,"they saw my issues as a spiritual battle." He reported that hs picked up from Elmcrest by his mother and his sister and brought to New Hampshire, where he resided with hother and sister, until he was 17 years old. He stated that his father could not find work in New Hampshire anited on weekends. He stated that his mother and sister returned to Connecticut when he was 17 years old, but hmained with a "mentor" for 1 more year. At the age of 18 the subject reported that he entered the Army Reserved went to basic training in Missouri. He reported that he was stationed at Concord, New Hampshire, once hished the training, and his parents had a cottage that they allowed him to live in.

    e subject stated that he first drank alcoho! 2 weeks before his 14th birthday, and first smoked marijuana soon afte14th birthday. He reported that he used both substances regularly from the beginning and daily within 6 weeksstated that he ran away 3-4 times at the age of 14, and would usually be gone for a couple days, before he wand and returned to the home. Mr. Komisarjevsky stated that right before he moved to New Hampshire, he wanking on the weekends, but smoking marijuana daily. He stated "I was the life of the party. I guess I'm funnen I'm drunk," adding that he was never violent while intoxicated. The subject reported that he used marijuana 2times per week from the ages of 14-17, but did not drink that much alcohol at that age. He stated that he waan from the age of 17-18 and he entered the Army Reserves at the age of 18. Following the first 9 weeks osic training, he - was allowed to leave the base and stated that he began to drink alcohol again. He stated that he

    he subject stated that he had been dating a woman for 4 years and they became engaged before he left for basiaining. He returned to discover that she was seeing someone else and he was "emotionally devastated." H

    that he did not seek counsellng at that time, because, after his first counselor died at the age of 14, hfused to see anyone for treatment. Following the break up with his fiance, he reported that he moved to Northonway, New Hampshire and lived in an apartment on the Crannmore Ski Resort, where he also worked cleaningails for the entire ski season, before being laid off for the summer. A message was left with a representative from

    Ski Resort in an effort to verify employment, but she has not responded as of this writing. From the agef 19-20, while living on the ski resort, Mr. Komisarjevsky began using crystal rneth, smoking marijuana, andrinking heavily on a regular basis. The subject stated "a couple guys introduced me to crystal meth and "it turnedto a big mess." The subject stated that he once went 7 days without eating or sleeping due to his abuse of crystaeth. He reported that he tried heroin once and used cocaine on occasion. but marijuana, crystal meth and crankere his drugs of choice at that point. Mr. Komisarjevsky reported that he also experimented with LSD, mushrooms,

    K , Ecstasy. Opium, Oxicontin, Percoset, and Valium during that period of his life. The subject stated "at thaint my fiance was my life. I was a disaster. I had no fear of death. I didn't care." He stated that he may haveen trying to commit suicide subconsciously. He stated that he overdosed twice and woke up in the hospital one occasion, after ovsrdoslnq on crystal meth. At the age of 20, he moved out of the house on the ski resort andto a house in town with the guys from work. He reported that he lived with his co-workers for 3 months, until hescovered that one of his roommates was having an affair with his girlfriend at the time, and they had an altercatione indicated that he left and went on a 4-day binge and while he was gone, his roommate sold all of his belongingsd locked him out of the house. He stated that he called his parents. who told him to come home and stated, "ped in my truck and went home with the cloths on my back."

    r. Kornisarjevsky stated that he had long talks with his mother, however, his father and him were still not gettingng and his father was still disappointed in him. He stated that he "made the decision to put that (drug abuse)hind me" and began working for McDonald's Construction in Branford. He remained there for 9 months, before heit, because he wasn't getting along with the other employees. A representative from McDonald's Construction,icated that Mr. Komisarjevsky worked for the company from 8-4-98 through 12-31-98.     busing substances until the last month at Abchar, when he began to smoke marijuana again. Verification has beeequested from Abchar, but has not been received as of this writing. Subsequent to leaving his jab at Abchar, Mopmisarjevsky reported that he had a fight with his father over "something really dumb" and he "took off." Hoved in with a cocaine dealer and began to use cocaine heavily. He stated that he began dating his currenirlfriend, after one month of living with the cocaine dealer, and stated "right off the bat me and her clicked." Hndicated that she warned him she would leave him if he didn't stop using the drugs, so he stopped and moved iith an acquaintance, who was an Emergency Medical Technician (EMT).

    r. Komisarjevsky reported that he had earned an EMT certificate at the age of 19, while living in Newampshire, after passing a 2-month course. He stated that he had to intern in Connecticut for a period of timeefore he could be certified in Connecticut, so he began working 3rd shift for American Medical Response, whileorking full time during the day for Cheshire Tree. The subject stated that he had been dean for about 6 months,ut then began using cocaine again. He stated "I was really trying. I don't know why I slipped back into cocaine.as at a party and it was there. I don't know why I went back." He indicated that he couldn't get up for work oneay, because he had almost overdosed, and instead of calling his boss and reporting that he was ill, he just neverent back to work. Records from Cheshire Tree indicate that Mr. Komisarjevsky worked for the company from 8-21-1 through 11-17-02 and was "generaJly a safe and productive employee until just before he stopped coming to worknd was terminated." The subject reported that he also stopped working on the ambulance, moved in with hisirlfriend and continued to abuse cocaine. Since he was not working he was running a tab with his drug dealer andt one point owed him about $5000.00, which led to his commission of the burglaries and his subsequentcarceration. Up until his incarceration, the subject stated that he continued to smoke marijuana "all day long: Thebject reported that he has not used any drugs since his arrest, even though he has had the opportunity in jail. Thebject reported that he has never been the focus of substance abuse treatment.

He stated thhen the police came to his house with 2 warrants, "I gave myself up for everything ... 18 in all. [even wentto oneom the summer before." The subject stated that the State Trooper talked to the prosecutor about how cooperativee had been, but he was incarcerated anyway and missed his daughter's birth. He stated "my daughter is beautifuatching her grow up behind th e glass" ..the Judge let me hold her once for 5 minutes ... 1 broke down. My outlooUfe changed after I held my daught~r for the first time." The subject stated that he has a good relationship with haughter's mother and she visits twice a month with his daughter. He stated "I want to be a father .. I'm trying tetter myself and be mentally stronger."

He stated that he had a lot of trust problems, because of hiast, and he had just begun to trust the counselor when he died of a heart attack. The subject reported that he sawnother counselor around the age of 14, who said Mr. Komisarjevsky was "good as dead and better off dead" for hiarent's sake. At the age of 15, his father found him a placement in Vermont, at a faith-based program called Thold. He stated that he Jived there for 5 weeks, and was doing well, until he went home to Connecticut on a breaknd got in trouble for joy riding with a ski-doo. He stated that he brought It back, but the owners were waiting foim. He stated that his parents told The Fold and he wasn't allowed to return. Mr. Komisarjevsky stated, "as much

She stated that Elmcranted to medicate the subject and send him home, but her and her husband felt their son needed to be away frhe bad influences in the area and moved to New Hampshire. The subject's mother indicated that her son really thouge had made it after he finished basic training, but he returned home to a dear John letter and turned to drugs agaWith regard to her son's life in general, she stated that he has been struggling with depression and the addffects of the sexual assaults, which have lead to his abuse of substances and his current situation. She stated the does not feel that prison will help him and feels that he would be better off in a program. She reported that he sees his daughter on visiting days, but has only held her ome, in Court. She stated that her son calls daily and she and her husband visit him every weekend and are veupportive. She stated "the most important thing; is we'd like to see him get a program, so he can get the help

    oshua Komisarjevsky, age 22, stands before the Court having been convicted of 5 counts of Burglary 2nd Degree,ounts of Larceny 3rd Degree, 4 counts of Larceny 6th Degree, and one count of Burglary 3m Degree. Althoughas arrested in Virginia while accompanying a friend to sell drugs, and has been arrested in New Hampshire, tresent offenses encompass the bulk of his involvement with the criminal justice system. He has no prnvictions and was cooperative with the police in that he implicated himself in each burglary he had committede past 2 years: He began to .abuse substances at substances at the age of 14, and he has been the victimxual assault on 2 different occasions. However, in the commission of burglaries, he went into homes at nighile people were sleeping, which is an unspeakable violation to the victims. It is sad to this writer that the subjeas a newborn daughter who wiJf only know her father through the glass, for the first years of her tife. However, tbject must pay the price for his actions. He appears to be remorseful and devastated that he can not be with hughter, so he will hopefully use that motivation, to lead a productive life and not become involved in drugs agaihen he re-enters the community. It is this writer's recommendation that Mr. Komisarjevsky be sentenced tooderate period of incarceration, followed by a lengthy period of Probation. Conditions of Probation should includbstance abuse and mental health evaluations and treatment as deemed necessary- induding inpatient treatmenndom urines, full time verifiable employment, restitution to the victims, take all medications as prescribed, anpport all minor children in accordance with the child support guidelines.
