1 BE IT ENACTED BY THE PEOPLE OF GUAM:

2 Section 1. A new Subsection (d) is hereby added to §9303 of Article 3,

3 Chapter 9 of Title 5, Guam Code Annotated, to read:

4 "(d) After ninety (90) calendar days from the date of filing with the

5 Legislative Secretary, the Clerk of the Legislature shall transmit to the

1 Compiler of Laws and the government of Guam department, agency,

2 autonomous agency, office or instrumentality of record, notification of the

3 disposition of the rule( s ), regulation( s) or fee schedule( s) in accordance with

4 this Chapter."

2 Section 1. A new subsection (d) is hereby added to §9303 of Chapter 9, 5

4 "§9303. Adoption, Repeal, Recission, or Amendment of Rules and

5 Regulations: Circulation and Filing.

6 It shall be the duty of every agency which may have been or

7 hereafter may be clothed with or given any power or authority to make,

8 adopt, promulgate or enforce rules to:

9 (a) Prepare the rules in a form approved by the Attorney General

10 or other legal counsel of the agency, and where required by law,

11 approved by the Governor, and which will conform to a standard

12 system or code of rules adopted by the Legislative Secretary for the

13 guidance of all agencies.

14 (b) File the original approval copy and one ( 1) duplicate and one

15 (1) copy of the entire record of any public hearings on the rules

1 being filed with the Legislative Secretary of the Guam Legislature.

2 The Legislative Secretary shall maintain a permanent register of all

3 rules, which shall include a notation of the date of filing thereon,

4 and evidence of public hearing held by the agency.

5 (c) No rule shall be effective until after compliance with the

6 provisions of this Section and ninety (90) calendar days have

7 elapsed from the date of filing with the Legislative Secretary. The

8 Guam Legislature may approve, disapprove or amend any rule

9 within ninety (90) calendar days from the date of filing with the

10 Legislative Secretary.

11 (d) After ninety (90) calendar days from the date of filing with the

15 the rule(s), regulation(s) or fee schedule(s) adopted in acordane with this

BILL NO. 281-31 (COR) - "AN ACT TO ADD A NEW SUBSECTION (D) TO §9303 OF ARTICLE 3 CHAPTER 9 TITLE 5 OF THE GUAM CODE ANNOTATED RELATIVE TO THE TRANSMITTAL TO THE COMPILER OF LAWS THE ADOPTION, REPEAL, RECISSION OR AMENDMENT OF RULES AND REGULATIONS" was introduced by Senator Tina Mufia Barnes on August 5, 2011; and was subsequently referred to the Committee on Rules; Federal, Foreign & Micronesian Affairs; and Human and Natural Resources on the same day.

Senator Rory J. Respicio, Chairperson of the Committee on Rules; Federat Foreign &

Micronesian Affairs; and Human and Natural Resources convened a public hearing on Bill 281

on Friday, October 7, 2011 at 2:00 P.M. in the Legislature's Public Hearing Room to receive public testimony on the measure.

Public Notice Requirements In accordance with the Open Government Law, notices were disseminated to all senators and to all main media broadcasting outlets, first on September 30, 2011, and again on October 5, 2011.

II. SUMMARY OF TESTIMONY & DISCUSSION

Senator Respicio called the hearing to order at 2:00 PM and stated that notices were properly made in accordance with the Open Government Law.

He read into the record the sponsor statement (attached) on Bill 281 submitted by Senator Tina Muna Barnes. He then announced that although no one was present to testify on Bill 281, the Committee would continue to receive any written testimony submitted.

There being no further discussion, Senator Respicio adjourned the hearing on Bill 281 at 2:04
