Beth yw'r cynllun hwn?Nod y Cynllun Datgelu Trais Domestig ywcynnig dull ffurfiol o wneud ymholiadauynghylch eich partner os ydych yn poeni ygall fod wedi bod yn dreisgar yn ygorffennol. What is this scheme?The aim of the Domestic Violence DisclosureScheme (DVDS) is to give you a formalmechanism to make enquiries about yourpartner if you are worried that they mayhave been abusive in the past. It also allowsa person to enquire about an ex-partner, if concerned about their own safety, when no longer in the relationship.

If police checks show that your partner orex-partner has a record of abusive behaviour,or there is other information to indicate thatyou may be at risk from your partner, thepolice will consider sharing this informationwith you.

The scheme aims to help you to make amore informed decision on whether tocontinue a relationship, and provides furtherhelp and support to assist you when makingthat choice.

Who can ask for disclosure?A disclosure under this scheme is the sharing of specificinformation about your partner with either you or a thirdperson for the purposes of protecting you from domesticviolence.

● You can make an application about your partner or ex-partner if you have a concern that they may harm you.

● Any concerned third party, such as your parent,neighbour or friend can also make an application if theyare concerned about you.

● However, a third party person making an applicationwould not necessarily receive information about yourpartner or ex-partner. It may be more appropriate forsomeone else to receive the information, such as you, ora person that is in a position to protect you from theabuse.

● Information will only be given to someone who is in aposition to use the information to protect you from theabuse.

Step One:Initial contact with the policeWhen you contact the police, a police officer or a memberof police staff will take the details of what prompted yourenquiry and the nature of your relationship with yourpartner or ex-partner.They will ask you when and where it is safe to makecontact with you again.You will need to give your name, address and date of birth.At a later stage, you will need to provide proof of youridentity.The police will run some initial checks based on theinformation you have provided and conduct an initial riskassessment.The purpose of these initial checks is for the police toestablish if there are any immediate concerns.These checks will not be undertaken while you are present.If when speaking to the police you allege a crime againstyour partner or ex-partner – for example, you tell them thatyour partner or ex-partner has hit you, then the police mayinvestigate this as a crime and may arrest your partner.No disclosure of information will take place at this stageunless it is necessary to provide immediate protection toyou.

If the police believe that you are at risk and in need ofprotection from harm, they will take immediateaction.

Step two:Face-to-face meeting to complete the applicationDepending on the outcome of Step One, you may then berequired to participate in a face-to-face meeting with thepolice. This meeting will be to establish further detailsabout your application in order to assess any risk and foryou to provide proof of your identity. This should becompleted within 10 days of initial contact. Proof ofidentity should comprise of a photo ID and another form ofID (if photo ID is not available, the police will consider otherforms of ID).

The forms of ID that could be used are:

● your passport

● your bank statement

● your driving licence

● your birth certificate

● a household utility bill

The police will then use the meeting to gather moreinformation from you about the nature of the relationshipbetween you and your partner or ex-partner to help decidewhether you are at risk of domestic abuse.

The police may run checks and speak to other agenciesincluding the Prison Service, the Probation Service andSocial Services based on the information you give them.They will work as quickly as possible to complete thechecks but, depending on the circumstances, some checksmay take longer for the results to be received by the police.

It is envisaged that the maximum time that it will take tocomplete the whole process, including these checks, and thedisclosure of information if decided necessary, is 35 days.

Efallai y bydd yr heddlu yn cynnal gwiriadau ac yn siarad agasiantaethau eraill gan gynnwys y Gwasanaeth Carchardai, yGwasanaeth Prawf a'r Gwasanaethau Cymdeithasol ynseiliedig ar y wybodaeth rydych yn ei rhoi iddo. Bydd yngweithio mor gyflym â phosibl i gwblhau'r gwiriadau ond,yn dibynnu ar yr amgylchiadau, efallai y bydd yn cymrydmwy o amser i'r heddlu gael canlyniadau rhai gwiriadau.

Rhagwelir na fydd yn cymryd mwy na 35 diwrnod i

The police will act immediately if at any point theyconsider you to be at risk and in need of protectionfrom harm.

Step three:Multi-agency meeting to consider disclosureThe police will meet with other safeguarding agencies suchas the Probation Service, Prison Service, Social Services todiscuss:

● the information that youhave given them

● relevant informationfrom the agencies theyhave talked to

● any additionalinformation the policemay have received fromthe checks they haverun.

The multi-agency meeting will then decide whether anydisclosure is lawful, necessary and proportionate to protectyou from your partner or ex-partner. If they decide todisclose information, they will determine who shouldreceive the information and set up a safety plan tailored toyour needs, to provide you with help and support

Os bydd yn penderfynu datgelu gwybodaeth,bydd yn penderfynu pwy a ddylai gael y wybodaeth ac ynllunio cynllun diogelwch wedi'i deilwra at eich anghenion,er mwyn rhoi cymorth a chefnogaeth i chi.

Os bydd y gwiriadau yn dangos bod gan eich partner neueich cyn-bartner hanes o ymddygiad treisgar neu fodgwybodaeth arall sy'n awgrymu bod angen gwneuddatgeliad ar fyrder er mwyn atal trosedd arall, efallai y byddyr heddlu yn datgelu'r wybodaeth hon i chi neu unigolynsydd mewn sefyllfa well i'ch diogelu.

Caiff collfarnau blaenorol unigolyn eu trin yn gyfrinachol adim ond os yw'n gyfreithlon ac yn gymesur gwneud hynny,a bod angen gwneud y datgeliad ar fyrder er mwyn ataltrosedd arall y caiff y wybodaeth ei datgelu.

Os na fydd y gwiriadau yn dangos bod angen gwneuddatgeliad ar fyrder er mwyn atal trosedd arall, bydd yrheddlu yn dweud hynny wrthych. Un rheswm posibl droshyn yw nad oes gan eich partner neu eich cyn-bartner haneso droseddau treisgar neu nad oes unrhyw wybodaeth yncael ei dal sy'n awgrymu bod risg y bydd yn eich niweidio.Neu efallai fod rhywfaint o wybodaeth yn cael ei dal ameich partner neu eich cyn-bartner ond nad yw'n ddigon iddangos bod angen gwneud datgeliad ar fyrder.

Mae'n bosibl nad yw eich partner neu eich cyn-bartner ynhysbys i'r heddlu am droseddau treisgar neu nad oes digono wybodaeth i ddangos bod risg y bydd yn eich niweidioond ei fod yn ymddwyn mewn ffordd sy'n peri pryder. Osfelly, gall yr heddlu neu asiantaeth gymorth arall weithioi'ch diogelu drwy roi cyngor a chymorth.

Step Four:Potential disclosure What kind of information you might be given

If the checks show that your partner or ex-partner has arecord of abusive offending or there is other informationthat indicates there is a pressing need to make a disclosureto prevent further crime, the police may disclose thisinformation to you or to a person who is more able toprotect you.

A person’s previous convictions are treated as confidentialand the information will only be disclosed if it is lawful andproportionate, and there is a pressing need to make thedisclosure to prevent further crime.

If the checks do not show that there is a pressing need tomake a disclosure to prevent further crime, the police willtell you that. This may be because your partner or ex-partner does not have a record of abusive offences or thereis no information held to indicate they pose a risk of harmto you. Or it may be that some information is held on yourpartner or ex-partner but this is not sufficient todemonstrate a pressing need for disclosure.

It may be the case that your partner or ex-partner is notknown to the police for abusive offences or there isinsufficient information to indicate they pose a risk of harmto you but they are showing worrying behaviour. In thiscase, the police or other support agency can work toprotect you by providing advice and support.

Your Right to KnowUnder the Scheme, you may receive a disclosure even ifyou have not asked for one. That is because, if the policereceive information about your partner which theyconsider puts you at risk of harm from domestic abuse,then they may consider disclosing that information toyou or another person who they consider best placed toprotect you. The decision to disclose information whenyou have not asked for a disclosure will be made by themulti-agency meeting, and the disclosure will only bemade if it is lawful and proportionate, and there is apressing need to make the disclosure to preventfurther crime.

Important noteYou should be aware that police checks or any disclosuresmade are not a guarantee of safety. They will, however,make sure you are aware of what local and nationalsupport is available.After you are given information:

“Can I tell my family and friends about this? I really need to talk to someone.”If you receive a disclosure, it should be treated asconfidential. It is only being given to you so that you cantake steps to protect yourself. You must not share this information with anyone elseunless you have spoken to the police, or the person whogave you the information, and they have agreed with youthat it will be shared.

Gall yr heddlu roi gwybodaeth a chyngor i chi ar sut iddiogelu eich hun ac adnabod arwyddion cam-drindomestig. Hefyd, mae nifer o wasanaethau a sefydliadauarbenigol sy'n darparu gwybodaeth am gam-drin domestig,sut i'w adnabod a sut i weithio gyda'r awdurdodau ermwyn ymyrryd.

Subject to the condition that the information is keptconfidential, you can:

● use the information to keep yourself safe

● use the information to keep any children involved in thesituation safe

● ask what support is available

● ask for advice on how to keep yourself and others safe

The police may decide not to give you information if theythink that you will discuss it with others. However, thepolice will still take steps to protect you if you are at risk ofharm.

The police may take action against you if the information isdisclosed without their consent, which could include civil orcriminal proceedings.

You should be aware that it is an offence (under Section55 of the Data Protection Act 1998) for a person to‘knowingly or recklessly obtain or disclose personal datawithout the consent of the data controller’ which in thiscase is usually the police.

If no disclosure is made but you still have concernsand want further information about protectingyourself, there is action you can take to protectyourself in the future.

The police can provide you with information and advice onhow to protect yourself and how to recognise the warningsigns of domestic abuse. There are also a number ofspecialist services and organisations providing informationabout domestic abuse, how to spot it and how to workwith the authorities to intervene.

What is this scheme?The aim of this scheme is to give membersof the public a formal mechanism to makeenquires about an individual who they are ina relationship with, or who is in arelationship with someone they know, andthere is a concern that the individual mayhave a record of abuse.

If police checks show that the individual hasa record of abusive offending, or there isother information to indicate the person youknow is at risk, the police will considersharing this information with the person(s)best placed to protect the potential victim.

Your local police force will discuss yourconcerns with you and decide whether it isappropriate for you to be given moreinformation to help protect the person whois in the relationship with the individual youare concerned about.

The scheme aims to enable potential victimsto make an informed choice on whether tocontinue the relationship, and provides helpand support to assist the potential victimwhen making that informed choice.

Who can ask for disclosure?A disclosure under this scheme is the sharing of specificinformation about an individual with the person makingthe application or a third person for the purposes ofprotecting a potential victim from domestic violence.

● Anyone can make an application about an individualwho is or was in an intimate relationship with anotherperson, and where there is a concern that the individualmay harm or have harmed another person.

● Any concerned third party, such as a parent, neighbouror friend can make an application, not just the potentialvictim.

● A third party making an application would notnecessarily receive the information about the individualconcerned. It may be more appropriate for someoneelse to receive the information such as the potentialvictim or another person who is best placed to protectthe potential victim.

How do I make anapplication?It is important to remember that anyone can make anapplication to the police about an individual who is in anintimate relationship with another person, and there is aconcern that the individual may present a risk of harm totheir partner.

Step OneInitial contact with the policeWhen you contact the police, a police officer or a memberof police staff will take the details of what prompted yourenquiry and the nature of your relationship with thepotential victim and their partner.

They will ask you when and where it is safe to makecontact with you again.

You will need to give your name, address and date of birth.At a later stage, you will need to provide proof of youridentity.

The police will run some initial checks based on theinformation you have provided and conduct an initial riskassessment.

The purpose of these initial checks is for the police toestablish if there are any immediate concerns.

These checks will not be undertaken while you are present.

If speaking to the police you allege that a crime has takenplace – for example, if you say that you witnessed someonehit their partner, then the police may investigate this as acrime and may arrest the partner.

If the police believe that someone is at risk and inneed of protection from harm, they will takeimmediate action.

No disclosure of information will take place at this stageunless it is necessary for the immediate protection of thepotential victim.

Step two:Face-to-face meeting to complete the applicationDepending on the outcome of Step One, you may then berequired to participate in a face-to-face meeting with thepolice. This meeting will be to establish further detailsabout your application in order to assess any risk and foryou to provide proof of your identity. Proof of identityshould be completed within 10 days of initial contact. Thisshould comprise of a photo ID and another form of ID (ifphoto ID is not available, the police will consider otherforms of ID).

The forms of ID that could be used are:

● your passport● your bank statement ● your driving licence

● your birth certificate● a household utility bill

The police will use this meeting to gather more informationfrom you about the nature of the relationship between theperson you are concerned about and their partner or ex-partner. They may also ask for further information from youon why you have made an enquiry under this scheme.

The police may run checks and speak to other agenciesincluding the Prison Service, the Probation Service andSocial Services based on the information you give them.They will work as quickly as possible to complete thechecks but, depending on the circumstances, some checksmay take longer for the results to be received by the police.

It is envisaged that the maximum time that it will take tocomplete the whole process, including these checks and the

disclosure of information, if decided necessary, is 35 days.The police will act immediately if at any point they considerthe potential victim to be at risk and in need of protectionfrom harm.

Step three:Multi-agency meeting to consider disclosureThe police will meet with other safeguarding agencies(such as the Probation Service, Prison Service, SocialServices) to discuss:

● the information that youhave given them

● relevant informationfrom the agencies theyhave talked to

● any additionalinformation the policemay have received fromthe checks they haverun.

The multi-agency meeting will then decide whether anydisclosure is lawful, necessary and proportionate to protectyou from your partner or ex-partner. If they decide todisclose information, they will determine who shouldreceive the information and set up a safety plan tailored to your needs, to provide you with help and support

Step Four:Potential disclosure What kind of information you might be givenIf the checks show that the individual you are enquiringabout has a record for abusive offending or there is otherinformation that indicates there is a pressing need to makea disclosure to prevent further crime, the police maydisclose this to the person who is most able to protect thevictim.

It should be noted that details about a person’s previousconvictions are treated as confidential and information willonly be disclosed if it is lawful and proportionate, and thereis a pressing need to make the disclosure to prevent furthercrime.

If the checks do not show that there is a pressing need tomake a disclosure to prevent further crime, the police willtell you that. This may be because the individual does nothave a record of abusive offending or there is noinformation held to indicate they pose a risk of harm to thepotential victim. Or it may be that some information is heldon the individual but this is not sufficient to demonstrate apressing need for disclosure.

It may be the case that the individual you are asking aboutis not known to the police for abusive offences or there isinsufficient information that indicates they pose a risk ofharm to the potential victim, but they are showingworrying behaviour. In this case the police or other supportagency will work with you to protect the potential victimand can provide advice and support.

Your Right to KnowUnder the scheme, you may receive a disclosure even ifyou have not asked for one. That is because, if the policereceive information about the person you know whichthey consider puts that person at risk of harm of domesticabuse by their partner, then they may consider disclosingthat information if you are the best placed person toprotect the victim. The decision to disclose informationwhen you have not asked for a disclosure will be made bythe multi-agency meeting (described above), and thedisclosure will only be made if it is lawful andproportionate, and there is a pressing need to make thedisclosure to prevent further crime.

Important noteYou should be aware that police checks or any disclosuresmade are not a guarantee of safety. The police will give youadvice on how to protect the potential victim and how torecognise the warning signs of domestic abuse. They willalso make sure you are aware of what local and nationalsupport is available.After you are given information:

“Can I tell my family and friends about this? I really need to talk to someone.”If you receive a disclosure, it should be treated asconfidential. It is only being given to you so that you cantake steps to protect the potential victim. You must notshare this information with anyone else unless you havespoken to the police, or the person who gave you theinformation, and they have agreed with you that it will beshared.

Os na wneir unrhyw ddatgeliad ond bod gennychbryderon o hyd a'ch bod am gael rhagor o wybodaetham ddiogelu rhywun arall rhag cam-drin domestig, maecamau y gallwch eu cymryd i'ch diogelu ar gyfer y dyfodol.

Gall yr heddlu roi gwybodaeth a chyngor i chi ar sut iddiogelu rhywun arall rhag ymddygiad treisgar ac adnabodarwyddion cam-drin domestig. Hefyd, mae nifer owasanaethau a sefydliadau arbenigol sy'n darparugwybodaeth am gam-drin domestig, sut i'w adnabod a sut iweithio gyda'r awdurdodau er mwyn ymyrryd.

Subject to the condition that the information is keptconfidential, you can:

● use the information to keep the potential victim andyourself safe

● use the information to keep any children involved in thesituation safe

● ask what support is available● ask for advice on how to keep yourself and others safe

The police may decide not to give you information if theythink that you will discuss it with others. The police may takeaction against you if the information is disclosed without theirconsent, which could include civil or criminal proceedings.

You should be aware that it is an offence (under Section 55of the Data Protection Act 1998) for a person to‘knowingly or recklessly obtain or disclose personal datawithout the consent of the data controller’ which in this caseis usually the police.

If no disclosure is made but you still have concerns andwant further information about protecting someonefrom domestic abuse, there is action you can take forthe future.

The police can provide you with information and advice onhow to protect someone from violent behaviour and how torecognise the warning signs of domestic abuse. There are alsoa number of specialist services and organisations providinginformation about domestic abuse, how to spot it and how towork with the authorities to intervene.
