Dale Further to our discussion this afternoon attached please find the BC Provincial Government document “Flood Hazard Area Land Use Management Guideline” that was published as part of the transfer of regulation of development in flood prone areas to cities and mu nicipalities. This document pr ovides the “recommended minimum provincial requirements ”. Within the document I would like to draw your attention to the following sections which are relevant to the proposed development on the Salmon River delta and the issues raised in my 9 November 2010 letter to the City of Salmon Arm. Section 1.9 bullets 1 and 2 Section 2.0 historic context Section 3.0 paragraph 1 “engineering reports must be considered” Paragraph 4 floodplain setbacks and damage to neighbors Section 3.2 old channels Section 3.2.2 increased setback potential Section 3.2.7 engaging engineers Section 3.2.8 Meandering or Braided Streams and site specific engineering Section 5.4 Fill placement setback requirements and damage caused to neighbors Appendix A definitions of floodway and designated flood Having reviewed this information, it is my opinion that the City has not met these minimum requirements required to entertain a bylaw request to rezone the subject property. I would like to request that the City review this existing guideline and provide appropriat e advise to council regarding the lack of flood hazard and risk informatio n that was provided to council and the public during the first through third readings ofthe proposed bylaw that requests an amendment to the land use zoning for the subject site.
