INSTRUCTI ONS TO BIDDERS FOR ONLINE BID SUBMISSION
The High Court of Orissa invites online bid for Onsite Comprehensive Annual
Maintenance Contract (CAMC) of Servers, Server Peripherals, Computer Systems and
Other Computer peripherals of heterogeneous makes / models installed at Orissa High
Court, Cuttack, Residential Offices of Hon'ble Judges, Registrars, Secretaries, PAs and
Stenographers of the Court. The tender document has been published on the e-Tendering
System of Government of Orissa i.e. htto://tendersodisha.qov. in. The bidders are required
to submit soft copies of their bids electronically on the e-Tendering System of Government
of Odisha, using valid Digital Signature Certificates.
The detailed information useful for submitting Online bids on the e-Tendering

PREPARATION OF BIDS:-
1) Please go through the Tender advertisement and the Tender document carefully to
understand the documents required to be submitted as part of the bid. Please note
the number of covers in which the bid documents have to be submitted, the number
of documents - including the names and content of each of the document that need
to be submitted. Any deviations from these may lead to rejection of the bid.
2) Bidder, in advance, should get ready the bid documents to be submitted as indicated
in the Tender document / schedule and generally, they can be in PDF / XLS / RAR
formats. Scanned bid documents should be in readable format.
3) Bidder should take into account any corrigendum published on the Tender document
before submitting their bids.
SUBMISSION OF BIDS:-
1) Bidder should log into the site well in advance for bid submission so that he / she
upload the bid in time i.e. on or before the bid submission time. Bidder will be
responsible for any delay due to other issues.
2) The bidder has to digitally sign and upload the required bid documents one by one
as indicated in the Tender document.
3) Bidders have to select the payment option as "Offline" to pay the Tender Fee / EMD
as applicable and enter details of the instrument.
4) A standard BoQ format has been provided with the Tender document to be filled by
all the bidders. Bidders are requested to note that they should necessarily submit

their financial bids in the format provided and no other format is acceptable. Bidders
are required to download the BoQ file, open it and complete the cells with their
respective financial quotes and other details (such as name of the bidder). No other
cells should be changed. Once the details have been completed, the bidder should
save it and submit it online, without changing the filename. lf the BoQ file is found to
be modified by the bidder, the bid will be rejected.
5) The server time (which is displayed on the bidders' dashboard) will be considered as
the standard time for referencing the deadlines for submission of the bids by the
bidders, opening of bids etc. The bidders should follow this time during bid
submission.
6) The uploaded Tender documents become readable only after the Tender opening by
the authorized bid openers.
7) Upon the successful and timely submission of bids, the portal will give a successful
bid submission message & a bid summary will be displayed with the bid no. and the
date & time of submission of the bid with all other relevant details.
8) The bid summary has to be printed and kept as an acknowledgement of the
submission of the bid. This acknowledgement may be used as an entry pass for Bid
Opening Meetings.

1, INTRODUCTION
Orissa High Court, Cuttack invites online bids in two covers bid format (Technical
& Financial) from the professionally competent Registered Service Providers having
service centre at Cuttack / Bhubaneswar to provide Onsite Comprehensive Annual
Marntenance for Servers, Server Peripherals, Computer Systems and Other Computer
peripherals of heterogeneous makes / models installed in the High Court of Orissa,
Cuttack.
The tender document can be downloaded from the e-Procurement website of the
State Government http://wrryw.tendersodisha.qov. in till 5 P. M. of 18.07.20'16. The tender
must be submitted through online mode only at htt //www.tendersodi ov.rn. No
manual bid will be accepted.
The High Court in its discretion reserves the right to reject or accept all or any part
of the bid wholly or partly without assigning any reason thereof.
2. Nature of Work
Onsite Comprehensive Annual Maintenance Contract of Servers, Computer Systems,
Laser Printers, Dot Matrix Printers, Multi-f unctional Printers, Network Printers, Scanners,
500/600 VA UPS, Core Switches, LAN Switches and Other Computer peripherals of
heterogeneous makes / models and Computer Operating Systems and Software.
3. Place of Work
Servers, Computer Systems, Laser Printers, Dot Matrix Printers, Multi-functional Printers,
Network Printers, Scanners, 500/600 VA UPS, Core Switches and Other Computer
peripherals of heterogeneous makes / models and Computer Operating Systems and
Software installed at Orissa High Court, Cuttack, Residential Offices of Hon'ble Judges,
Registrars, Secretaries, PAs and Stenographers of the Court.
4. EligibilityCriteria
The bidder must submit the declaration in their letter head as per "Annexure-l:
Self Declaration Form".
Eligibility Criteria is given in the "Annexure - 2: Eligibility Criteria" and it must be
filled up.

Documentary evidence for compliance to each of the eligibility criteria must be
enclosed along with the bid together with the references as required in the
"Annexure - 2: Eligibility Criteria".
Relevant portions in the documents submitted in pursuance of eligibility criterion
mentioned above, shall be highlighted and all pages of the bid document should
be serially numbered.
lf the bid is not accompanied by all the above mentioned documents, the
same would be rejected.
Undertaking for subsequent submission of any of the above document will not be
entertained under any circumstances. However, the High Court reserves the right
to seek fresh set of documents or seek clarifications on the already submitted
documents.
5. Cost of Tender
The bidders are required to submit {2000/- (Rupees Two Thousand) only which is non-
refundable towards the Tender Cost in the form of Demand Draft drawn on any
Nationalised Bank / Scheduled Commercial Bank located in lndia in favour of "The
Registrar (Judicial), Orissa High Court, Cuttack" payable at Cuttack as per
"Annexure-2: Eligibility Criteria".
6. EARNEST MONEY DEPOSIT:-
Earnest Money Deposit (EMD) should be submitted as per "Annexure - 2:
Eligibility Criteria" by Offline mode.
Earnest Money Deposit (EMD) of the specified amount i.e. <50,000/- as given in
the "Annexure - 2: Eligibility Criteria" must be submitted in shape of Demand
Draft of any Scheduled Commercial Bank drawn in favour of the "Registrar
(Judicial), Orissa High Court, Cuttack" payable at Cuttack.
The Bidders who are registered for items mentioned in "Annexure - 4: Servers,
Computer Systems, Networking Equipments and Other Hardware
Equipments to be kept under Comprehensive Annual Maintenance" with
NSIC under Single Point Registration Scheme, may be considered for exemption
from furnishing the EMD by the Competent Authority. ln such cases, an attested
copy of the VALID Registration Certificate from NSIC must be furnished Mere

registration as a SSI Unit does not qualify the firm for exemption from furnishing
the EMD.
ln the absence of a valid certificate from the NSIC, such Tenders shall be rejected
straightway.
The Earnest Money Deposit (EMD), without any interest accrued will be refunded
as follows:
(i) ln the case of those Bidders who fail to qualify the eligibility criteria, and
whose technical bids do not qualify, the Earnest Money Deposit (EMD) will
be refunded without any interest accrued within one month of the award of
the contract.
(ii) ln the case of bidder whose bid is accepted for award of the contract, EMD
will be refunded on receipt of Performance Security in shape of Bank
Guarantee.
7. PerformanceSecurity
The successful bidder at the time of execution of agreement of annual maintenance
contract shall have to furnish an unconditional and irrevocable Performance Bank
Guarantee of an amount equal to 20o/o of the total order value of the contract drawn on
any scheduled Commercial Bank towards Performance Security in favour of "The
Registrar (Judicial), Orissa High Court, Guttack". The Bank Guarantee should be valid
up to 60 days beyond the date of completion of contract period.
8. Payment Terms
Payment towards the comprehensive annual maintenance contract shall be made
quarterly to the successful firm upon due discharge of maintenance services.
9. Penalty
(1) lf the stipulated uptime of Servers and the stipulated time for repair / replacement
of Computer Systems and other hardware is not adhered to, penalty as per the
following will be imposed on the firm and the same shall be deducted from the
amount of AMC.

(2) Penalty shall also be levied for the absence of Resident Maintenance Engineers
without informing to the Court / non-arrangement of alternate Resident
Maintenance Engineers in place of the engineer remaining on leave with proper
intimation to the Court at the rate of {5001 per day.
10. Financial Bid
(i) The Financial Bid should be submitted in the format as per the BoQ in the e-
Procurement Portal. Commercial Bid should not contain any conditions.
(ii) The scope of coverage of CAMC will be for the Computer hardware, software and
peripherals for all the items listed in Annexure.4. The rate quoted should also
cover the maintenance of Operating System and Softwares.
(iii) All the prices quoted shall be in lndian Rupees. The firm shall not make any
request for price escalation during subsistence of the contract. The prices quoted
by the firm should be inclusive of charges of onsite maintenance of equipments,

cost of resident engineers, preventive maintenance, corrective maintenance,
supply of parts / components to replace the defective parts and the applicable
taxes.
(1) The Court have a heterogeneous (make / model) set of Servers, Computer
Systems, Laser Printers, Dot Matrix Printers, Multi-functional Printers, Network
Printers, Scanners, 500/600 VA UPS, Core Switches and Other Computer
peripherals as per the Annexure-4. These computer peripherals will be covered
with Onsite Comprehensive Annual Maintenance Contract under which preventive
maintenance, corrective maintenance, replacement of parts, shifting of
components, surface cleaning of machines etc will have to be carried out. The firm
should undertake the upkeep and maintenance of the hardware installed at the
Court.
(2) The replacement of any part of the Computer / Peripherals, whenever required,
must be carried out by the vendor with new, standard and genuine parts of same
make, specification and warranty. ln case where parts are unserviceable and such
parts of the equipments need replacement, the firm shall replace such parts with
new ones promptly at no extra cost to the Court. The bidder should agree that all
the components of the equipments shall be covered under this CAMC contract and
hence fall under the replaceable category only.
(3) The contract shall be on comprehensive basis, inclusive of repairs and
replacement of spare parts without any extra payments.
(4) All the components of the Printers except the Printer Cartridge and toner Cartridge
and all the components excluding batteries in the UPSs shall be covered under the
Comprehensive Annual Maintenance Contract.
(5) All repair / replacement and servicing of the equipments will have to be carried out
in the premises of the Court. lf the fault is serious and requires the support of
Repair Centre, thereby necessitating shifting of the equipment, the vendor shall
arrange shifting / transportation, installation, re-installation, loading of software
packages (both the system and application software, if any) at no extra cost to the
Court and provide Standby equipment in place of the faulty equipment. Shifting of
equipment should be done as per the written order of the Registrar (Judicial),
Orissa High Court, Cuttack.
(6) The bidder shall have to provide sufficient Standby equipments to the Court in
order to prevent any dislocation in the Court work due to failure of any "Or,O."n,;o

(7) The firm shall maintain the equipment as per lVlanufacturer's Guidelines and shall
use standard OEM components for replacement. Until and unless written orders of
the Registrar (Judicial), Orissa High Court, Cuttack are conveyed, the original
specification / characteristics / features shall not be changed.
(8) The firm shall have to carry out preventive maintenance quarterly for all the
computer peripherals and submit the Preventive Maintenance Report to the
Authority each quarter. Further the vendor shall arrange for regular cleaning of
hardware using dry vacuum air brush and soft muslin clothes. A record of the
same shall be maintained and produced before the Authority each month.
(9) A Daily Log Book shall be maintained for all equipment covered under CAMC. The
Resident Maintenance Engineers shall maintain in the Log Book each incident of
malfunction, date / time of commencement of downtime and successful completion
of the repair / maintenance work, nature of repair work performed on the
equipment together with a description of the malfunction and the cause thereof.
Details of preventive maintenance activity shall also be recorded. The Log Book so
maintained must be counter signed by the Competent Authority after end of the
each day.
(10) The bidder shall ensure 99% Uptime for Server and 98% Uptime for PC and
Peripherals covered under the Comprehensrve AMC each month. lf during any
month, the vendor does not maintain the Uptime of the equipments, proportionate
maintenance charges as fixed by the competent authority shall be deducled from
the AMC amount.
(11) The firm shall ensure that all materials as well as information which may come into
its possession or knowledge in connection with this contract or the performance
thereof, whether confidential and proprietary data or not, whose disclosure to or
use by the third parties may cause damage or loss to the Court, shall at all times
be held in strictest confidence. The Court will take appropriate action against the
employees of the firm stationed in the Court in case of non-compliance of the
obligation of non-use and non-disclosure of confidential information of the Court.
(12) This office shall have the right to inspect company's site to assess infrastructure
before awarding the annual maintenance contract and it may reject in the event of
dissatisfaction of company's infrastructure or otherwise.
(13) The Court can terminate the agreement if the firm fails to carry out any of its
obligations / duties in terms of the agreement.
(14) ln case the contracting firm is not able to accept the contract after it is awarded or
if they are not able to do the work after accepting the contract, the money

deposited towards EMD would be forfeited and the firm will be debarred from any
further dealing with the Court.
(15) The bidder should visit the Court premises during working hour by taking prior
permission of the undersigned to ascertain the make / model and configuration
and year of production / installation of Servers / Computer Systems / Printers /
UPS and other peripherals before submitting their technical and financial bids.
(16) This tender is not transferable and under no circumstance the successful
bidder shall be allowed to sub-contract with any other person / party.
12. Deployment of Engineers
(1) The successful firm must deploy 3 (three) qualified and experienced Resident
Maintenance Engineers in the Court premises during working hours on all working
days, preferably one with exposure to Server Tuning and maintenance, though all
three are expected to have expertise on trouble shooting of PCs and Printers. The
Engineers should be self sufficient to troubleshoot / rectify the problems. However,
they may consult with the Experts at their Head Offices in case of major faults
which they are not able to rectify and make arrangement for rectification of the
same. The Resident Maintenance Engineers will be stationed at Cuttack. The
working hours for the Resident l\/aintenance Engineers will be from 9.30 A. M. to
6.30 P. M. on all working days i. e. from Monday to Saturday and on a call basis
on Sundays and other Holidays at no extra cost to the Court. However, under
special circumstances, the Resident Maintenance Engineers may be required to
attend to work for extended hours, be it working day or Sunday or Holiday as per
the prevailing situation at no extra cost to the Court.
The firm shall arrange alternate Resident Maintenance Engineer in case one
Engineer remains on leave.
The Resident Maintenance Engineer may remain on leave on proper intimation to
"The Registrar (Judicial), Orissa High Court, Cuttack" and to their Head Office and
after arrangement of an alternate Resident Maintenance Engineer in the Court.
The vendor should not rotate their engineers frequently. ln case of unavoidable
circumstances, the vendor should inform the Court in writing well in advance about
the change of Engineer.
The travelling expenses of engineers will be borne by the firm.
The firm shall ensure that character and antecedents of Engineers are good and
moral.

13. Agreement of Annual Maintenance Contract
The selected firm shall have to sign an Annual Maintenance Contract agreement
with the Court on Non-Judicial Stamp Paper of tl001 (Rupees Hundred) which will be
borne by the firm containing details of terms and conditions within a week after issue of
Work Order to begin Comprehensive AMC.
14. Validity of Annual Maintenance Contract
(a) The Annual Maintenance Contract will be initially for one year from the date of
award of contract and may be renewed for one year at the discretion of Customer
and based on satisfactory services provided by the firm. The rates quoted will
remain in force for the full period of contract. No demand for revision of rate on any
account shall be entertained during the contract period.
This agreement may also be terminated by Customer unilaterally forthwith if at any
time the firm fails to rectify the major pending complaints that have become due
and such failure continues for a period of more than 30 days alongwith penalty of
50% of the Bank Guarantee or Higher deposited by the firm.

(7) The firm will provide insurance cover to the Resident Maintenance Engineers
deployed at the Court. The Resident Maintenance Engineers or their legal heirs
shall not claim any insurance / job benefit from the Court in case they suffer any
loss or damage to their life or property while working in the Court premises.
(8) List of Resident Maintenance Engineers with qualification and experience should
be given as per Annexure-3:.
15. LEGALJURIDICATION:
All legal disputes are subject to the jurisdiction of Courts at Cuttack or Orissa High
Court, Cuttack.
