PROTOCOL ON BEEF

Article 1

. Within the limits referred to in Article 2, Norway agrees to eliminate allcustoms duties including ad valorem duties applicable to beef meat originating inBotswana or Namibia on entry into force of this Agreement.

Article 2

The elimination of customs duties provided for in Article 1 shall apply to thefollowing quantities (expressed in fresh, chilled or frozen, boneless and bone-in meat,whether as carcasses or as cuts) per calendar year.

DECLARATION BY NORWAY ON THE

GSP SYSTEM FOR AGRICULTURAL PRODUCTS

Recalling that Norway historically has improved market access for developingand Least Developing Countries (LDC), Norway will maintain its GSP-system for allSACU-countries, on an autonomous basis, in parallel to the Free Trade agreement forall agricultural products.

Norway commits to grant to Lesotho, Namibia and Botswana their existingGSP-preferences at least to 31 December 2007. After this date they will be treated asLeast Developing Countries (LDC) according to UN-list or to a decision taken by theNorwegian Parliament. If the authorization is prolonged by Norway, the application ofthe tariff benefits for the countries mentioned above will continue to apply.

If however, Norway should consider to reduce any existing trade benefitsgranted to Lesotho, Botswana and Namibia, or their GSP-status, there will be priorconsultations between the Parties concerned with a view to finding mutuallyacceptable solutions. If no mutually acceptable solution is found, the Parties mayinvoke Article 6 of the Agricultural Agreement between SACU and Norway.

Norway will, on an autonomous basis, maintain the threshold for invoking thesafeguard mechanism related to the GSP scheme for the duty free import of meat ofbovine animals (commodity number 02.01.3001, 02.01.3009, 02.02.3001 and02.02.3009 in the Norwegian Customs Tariff), originating in Botswana or Namibia, at2700 tons of fresh, chilled and frozen boneless meat. Imports exceeding the quantitymentioned for the products concerned will be subject to the rate of duty applicable forimports from ordinary GSP-countries.

In product sectors where the legislation relating to sanitary and phytosanitarymatters is hannonized between Norway and the EC, there are no additionalrequirements on products destined for the Norwegian market. However the EEA­Agreement contains a safety clause, according to which Norway may adopt differentmeasures based on its own risk assessment.

In products sectors where the legislation relating to sanitary and phytosanitarymatters is formally recognized to be equivalent between Norway and the EC, SACUMember States endeavour to take into account such equivalency when evaluating arequest for import approval in terms of the relevant domestic sanitary andphytosanitary legislation. This undertaking, however, should not be construed asgranting automatic approval when considering such an application and where suchequivalency exists. It needs to be considered on a case-by-case basis and the approachtaken might differ among SACU Member States, based on the relevant domesticregulatory environment.

Agricultural Agreement between the SACU States and Switzerland

ARTICLE 1

1. This Agreement on Trade in Agricultural Goods (hereinafter referred to as"this Agreement") between the Republic of Botswana, the Kingdom of Lesotho, theRepublic of Namibia, the Republic of South Africa and the Kingdom of Swaziland,together forming the Southern African Customs Union (hereinafter referred to jointlyas "SACU" or severally as "the SACU States"), and the Swiss Confederation(hereinafter referred to as "Switzerland"), hereinafter collectively referred to as "theParties", is concluded pursuant to and in conjunction with the Free Trade Agreementbetween the EFTA States and the SACU States (hereinafter referred to as "the FreeTrade Agreement"), signed on [... J, and in particular Article 6 thereof. ThisAgreement forms part of the instruments establishing the free trade area between theEFTA States and SACU.

2. This Agreement shall likewise apply to the Principality of Liechtenstein aslong as the Customs Union Treaty of 29 March 1923 between Switzerland and thePrincipality of Liechtenstein remains in force.

ARTICLE 2

I. SACU shall grant tariff concessions to agricultural products originating inSwitzerland as specified in Annex 1.

2. Switzerland shall grant tariff concessions to agricultural products originatingin SACU as specified in Annex 11. Furthermore, Switzerland continues granting to theSACU States, qualifying as Least Developed Countries (hereinafter referred to as"LDC") according to the list approved by the Economic and Social Council(ECOSOC) of the United Nations Conference on Trade and Development(UNCTAD), the tariff benefits of the Swiss Generalized Scheme of Preferences(hereinafter referred to as "the Swiss GSP"). This commitment is qualified as follows:The legal instrument by which the Swiss Federal Council is authorized by Parliamentto grant tariff preferences according to the Swiss GSP expires on 28 February 2007. Ifthis authorization is prolonged, the granting of the tariff benefits for LDC of the SwissGSP will continue to apply.'

ARTICLE 3

2. For the purpose of this Agreement, Article 3 of Annex V to the Free TradeAgreement shaH apply, mutatis mutandis, to SACU and Switzerland.

3. For the purpose of this Agreement, Article 34 of Annex V to the Free TradeAgreement shall not apply.

4. The preferential treatment granted by Switzerland to originating goods of LDCshall apply mutatis mutandis. However, in order for the LDC to obtain preferentialtreatment, the foHowing wording shall be inserted in Box 7 of the movementcertificate, or after the last sentence in the invoice declaration, as the case may be:"LDCfPMA: Art. 2.2 CH-SACU satisfied". In addition, cumulation within SACU isnot permitted.

ARTICLE 4

The foHowing provisions of the Free Trade Agreement shall apply, mutatismutandis, between Switzerland, on the one hand, and SACU or the SACU States, asthe case may be, on the other: Articles 4, 5, to II, 14, 19, 20, 21, 23, 25, 33(paragraphs I and 2), 35, 36 ,37 and 41 .

ARTICLE 5

I. The Parties shall not apply export subsidies, as defined in Article 9 of theWTO Agreement on Agriculture, in their trade on products subject to tariffconcessions in accordance with this Agreement.

2. The Parties shall not apply trade and production distorting domestic support,as defined in the WTO Agreement on Agriculture, in their trade on products subject totariff concessions in accordance with this Agreement.

3. The Parties shall provide in a transparent and expeditious manner thenecessary information to allow each other to monitor compliance with paragraphs Iand 2.

ARTICLE 6

SACU and Switzerland shall examine any difficulties that might arise in theirtrade in agricultural products and shaH endeavour to seek appropriate solutions.

1. SACU and Switzerland undertake to continue their efforts with a view tofurther liberalising their agricultural trade, within the framework of their respectiveagricultural policies.

2. The first review shall take place no later than three years after the entry intoforce of this Agreement, with further reviews to be detennined at the first review.

ARTICLE 8

1. This Agreement is subject to ratification, acceptance or approval inaccordance with the respective constitutional requirements of the Parties.

2. This Agreement shall enter into force on the same date as the Free TradeAgreement.

3. The Government of Switzerland shall act as Depositary. An original copy ofthis Agreement shall be lodged with the SACU Secretariat.

ARTICLE 9

This Agreement shall remain in force as long as the Parties to it remain Partiesto the Free Trade Agreement.

CUSTOMS DUTIES ON IMPORTS FROM SWITZERLAND INTO SACU

(Referred to in paragraph 1 of Article 2)

1. Article 9 of the Free Trade Agreement also applies to this Annex, mutatismutandis.

2. Customs duties on imports into SACU on products originating in Switzerlandlisted in Table 1 to this Annex categorized as list 0 and list 1 are eliminatedupon the entry into force of this Agreement.

3. Customs duties on imports into SACU on products originating in Switzerlandlisted in Table 1 to this Annex categorized as list 2 shall be graduallyeliminated in accordance with the following schedule:

• on the date of entry into force of this Agreement, each duty shall bereduced to 67per cent of the basic duty;

• one year after the date of entry into force of this Agreement, each dutyshall be reduced to 33 per cent of the basic duty;

• two years after the date of entry into force of this Agreement, theremaining duties shall be abolished.

4. Customs duties on imports into SACU on products originating in Switzerlandlisted in Table 1 to this Annex categorized as list 3 shall be graduallyeliminated in accordance with the following schedule:

• Two years after the date of entry into force of this Agreement, eachduty shall be reduced to 88 per cent of the basic duty;

• Three years after the date of entry into force of this Agreement, eachduty shall be reduced to 75 per cent of the basic duty;

• Four years after the date of entry into force of this Agreement, eachduty shall be reduced to 63 per cent of the basic duty;

• Five years after the entry into force of this Agreement, each duty shallbe reduced to 50 per cent of the basic duty;

• Six years after the entry into force of this Agreement, each duty shallbe reduced to 38 per cent of the basic duty;

• Seven years after the entry into force of this Agreement, each dutyshall be reduced to 25 per cent of the basic duty;

• Eight years after the entry into force of this Agreement, each duty shallbe reduced to 13 per cent of the basic duty; and

6. Customs duties on imports into SACU on products originating in Switzerlandlisted in Table I to this Annex categorized as list 5 shall be eliminated withinthe limits of an annual quota not exceeding 200 tons, provided that suchproducts are imported for direct consumption only. This quota will becomeeffective on I July 2007.

Global in this case implies that there is one quota for all products included in list 4.
