Planning Analysis
The applicants have submitted a conceptual pian showing the 11.2-acre parcel with the applicants’existing residence on Lot 2, from which Lot 1, consisting of 3 acres, will be created. Lot 1 will be fora family member. The plan indicates that a 20’ access easement will be extended from the private roadto Lot 2 along the western boundary, which both lots will use.
This application for AR-6 zoning for one additional lot is consistent with the Agricultural land usedesignation in the Comprehensive Plan and should not impact the existing rural residential character ofthe area. The proposed lots are similar in size to others in the area, and a tree preservation proffer hasbeen submitted to limit the clearing of large trees on the property.
Approval of this request could result in one additional dwelling unit. Schools affected are listedbelow:

Agency Analysis
There were no substantive comments from any of the reviewing agencies. The Historical Commissionreviewed this request and determined that the rezoning will not impact the nearby historic resourceknown as the Farrabee House.
Proffers
The applicant has submitted proffers that provide for substantial conformity to the conceptual plan,tree preservation, wetlands certification, a perenniality study and family division. Staff recommendsapproval of the proffers submitted on May 25, 2017.
The undersigned, Joy M. and Billy I. Goodman, Jr., owners of parcel designated GPIN 7759-88-2310,(“the Property”), voluntarily agree for themselves, their agents, personal representatives, successorsand assigns (collectively “the Property Owner”) that, in the event the Property is rezoned from A-i toAR-6, the development and use of the Property shall be subject to the following conditions:
1. Conceptual Plan. The property shall be divided in substantial conformity with the conceptualplan titled, “Goodman AR-6 Rezoning,” prepared by B.T. Goodman, Jr., dated March 30,2017.
2. Tree Preservation. Existing trees of 5 inch caliper or greater on the Property shall not beremoved with the exception of dead or diseased trees or parts thereof This shall not preventthe removal of trees necessary for the construction of improvements, driveways, drainfields, ordrainage facilities.
3. Wetlands Certification. The Owner agrees to submit a wetlands certification for the propertyto the Hanover County Department of Public Works for its review and approval prior to orconcurrent with the submission of an application for a Family Division. The Family Divisionshall not be approved unless the Department of Public Works approves the wetlandscertification.
4. Perenniality Study. The Owner agrees to submit a perenniality study for the property to theHanover County Department of Public Works for its review and approval prior to orconcurrent with the submission of an application for a Family Division. The Family Divisionshall not be approved unless the Department of Public Works approves the perenniality study.
5. Family Division. The Property shall only be divided for family, in accordance with Chapter25, Article II, Division 5, of the Hanover County Code. The family member to whom theproperty was sold or given shall hold title to and reside on the newly created lot for at leastthree (3) years following the issuance of a Certificate of Occupancy, unless the lot is thesubject of an involuntary transfer caused by foreclosure, death, judicial sale, condemnation, orbankruptcy.
