Curci v Guarnaccia Et Al ("Volare") termination rights dispute

Publisher is suing for declaratory judgment against the heirs of the song "Neu blu, diponto di blu," a song we know better as "Volare."
The heirs had served a notice of termination for the song under the United States Copyright Act, 17 USC 304(c), which applies to works before 1978.
The action does not seek to negate the termination entirely, but only to clarify that the publisher retains rights to derivative works, and that the termination only applies to the United States.
