INTRODUCTION The Land Department is committed to the principles of sustainable forest management and will manage the lands in our care in accordance with those principles. The Land Department, in cooperation with four other northern Minnesota counties, have developed and are in the process of implementing a sustainable forest management system (SFMS) that will help us achieve and be environmentally appropriate, socially beneficial and economically viable. Through our SFMS Crow Wing County commits to:

• Protect the integrity and longevity of forest lands under our management. • Comply with all applicable laws, regulations and voluntary guidelines. • Acquire and maintain third party certification to the Sustainable Forest

Management principles. • Plan and conduct forest management activities in a manner that:

Protects and maintains biodiversity across the forest ecosystem Prevents damage and protects forest health and productivity Minimizes chemical use Protects the integrity of riparian areas Minimizes aesthetic impact Protects threatened and endangered species and their habitat Conserves areas with special attributes such as cultural, ecological,

geological, economic or social attributes Promotes efficient utilization

• Promote and incorporate applied research and technology to improve sustainable forest management.

• Enhance public recreation values by providing opportunities for dispersed recreation on County lands.

• Provide public education on forest ecology, sustainable forest management and economic value of forests.

• Ensuring that the economic benefits and environmental integrity of the County's Natural Resources are available to both present and future generations.

TIMBER DEVELOPMENT FUND

M.S. 282.08 Sub (3) (a) - Any county board may annually by resolution set aside no more than 30 percent of the receipts remaining to be used for Timber Development on tax-forfeited land and dedicated memorial forests, to be expended under the supervision of the County Board. It shall be expended on Projects approved by the Commissioner of Natural Resources.

Distributed to counties managing forest lands through a county land department under the jurisdiction of a land commissioner appointed under M.S. 282.12. 76 Environmental Trust Fund Recap 12/31/07 In accordance with legislative action of 1998, the Counties and State were directed to pursue a land exchange whereby counties would trade away tax forfeited land abutting protected water in exchange for the states lakeshore lease lots within each respective county. Upon completion of the trade, the counties were required to make a direct sale of each lakeshore lot to the current lessee. Monies generated from the sales were deposited into a county environmental trust fund, the principle, of which, cannot be spent. The interest accrued on these monies can be spent for the improvement of natural resources. The spreadsheet below shows the status of this process as of 12/31/07.

In 2001, Crow Wing County purchased 1,520 acres of University of Minnesota lands in Timothy Township for a price of $611,883.00. A down

payment of $50,000.00 along with the first annual installment of $57,229.02 was paid out of the Grants Fund, to be paid back when funds are

available. The balance of $561,883.00 to be paid on Contract for Deed for 20 years with payments of $57,229.02 annually.

FOREST CERTIFICATION

On February 27, 2007, the Crow Wing County Board of Commissioners approved a Minnesota Counties Sustainable Forest Management Certification Cooperative Agreement between the Counties of Crow Wing, Carlton, Clearwater, Beltrami, Becker and Koochiching. The purpose of the Cooperative is to undertake joint initiatives to develop a Sustainable Forest Management System (SFMS) which ensures the long-term integrity of all the forest resources under county administration while providing recreational and economic opportunities which are sensitive to environmental issues. The Cooperative, through implementation of the SFMS is charged with seeking, securing and maintaining dual forest certification under the Forest Stewardship Council (FSC) and Sustainable Forestry Initiative (SFI) forest management standards which are recognized worldwide. Upon receiving a group certificate, the Cooperative will be recognized, globally, as an organization which manages its forests sustainably while being sensitive to environmental, social and economic values. In 2006, the Cooperative sought Requests for Proposals for an integrated third party audit of the Cooperative’s forest management practices according to the FSC and SFI Standards. Proposals were received from the following auditing firms: SGS Certification Services, SCS, QMI and Smartwood. The Cooperative conducted interviews and recommended contracting with SGS which is a recognized leader in forestry certification worldwide which was founded in 1878. On 10-10-06, the Crow Wing County Board of Commissioners accepted the Proposal submitted by SGS for Group audit services for FSC and SFI certification with preliminary and main audits to cost $7,560 per county and four annual surveillance audits to cost $1,740 per county per year plus travel expenses (costs based upon participation of six counties…..Becker County later declined participation, therefore total costs will be divided by five counties which will slightly increase costs for each of the five participating counties). Further, the County Board agreed to enter into a cooperative contract arrangement between the Counties of Crow Wing, Carlton, Clearwater, Beltrami, Becker and Koochiching with audit services conducted in Crow Wing County to be paid from the Forfeited Tax Sale Fund. From July 30 through August 3, 2007, SGS conducted a “Pre-Audit” of the Cooperative against the FSC and SFI Standards. The Auditor found that member counties of the Cooperative were not fully implementing its standard operating procedures and were therefore not ready to initiate the “Main Audit”. Minor and major non-conformances were noted which prompted the Cooperative to intensify training over the remainder of the year. Main Audit was conducted from August 4 through August 8, 2008. The Cooperative awaits the results.

NOTE

Harvest plans are based upon the timber inventory database. Because the timber inventory was designed to require minimal sample plots, data is, often times, weak in reflecting the actual components / condition of the stand. With the passing of time, as foresters conduct field inspections of the stands, the reliability of the data is improved as corrections are made. The table, above, reflects how inventory acres of various species were “drained” or “dealt with” following actual on-the-ground inspections. In the case of aspen, the harvest plan called for 635 acres of aspen. This, as you will note, does not necessarily mean that 635 acres of aspen will be harvested, but rather, 635 acres of the “worst-first” stands will be “dealt with.” “Dealing with” can result in a variety of outcomes, as follows: 1.) inventory is accurate and harvest is prescribed, or; 2.) inspection reveals an error in age, so, stand is “dealt with” by correcting the age in the database, or; 3.) inspection reveals an inaccurate main species, so, stand is “dealt with” by correcting the main species, or; 4.) inspection reveals that timber stand is inoperable for timber harvest for a variety of reasons e.g. size, terrain, recreational sensitivities, volumes, private access, high conservation values, road building, etc., so, stand is “dealt with” by removing the stand from the “timberland” category and placing the stand in a “reserve” category which will result in no future consideration for timber harvest.

MINNESOTA TREE IMPROVEMENT PROJECT - JACK PINE SEED ORCHARD Location: Section 31-T46-R29 (Irondale Township) Crow Wing County has been a member of the Minnesota Tree Improvement Cooperative since the early 1980's. The purpose of the Cooperative is to increase the quantity and quality of timber yields through genetics. Crow Wing County's improvement efforts have focused upon Jack Pine, which is a variable species from a genetics standpoint. Due to this genetic variability, the chance of making improvements to growth, form, branching, disease resistance, etc. can be a reality with long-term effort and commitment. In June 1985, 2800 six (6) month old containerized seedlings were planted at a 4 x 4 foot spacing on approximately three acres. Since that time, the seedlings have been intensively guarded against damage from deer, gophers, insects, people, etc. Initial survival was excellent. Survival after one year was 100%. The orchard has been a complete success from the very beginning and received a "Showcase Orchard" award in 1987. A Summary of Cone Harvest is as follows:

As a result of Crow Wing County’s efforts in conjunction with the Minnesota Tree Improvement Cooperative, Crow Wing County has the best possible jack pine seed source available for our use. Jack pine seedlings grown from seed harvested from Crow Wing County’s seed orchard is regularly being out-planted on Crow Wing County administered tax forfeited land.

MINNESOTA TREE IMPROVEMENT PROJECT - SECOND GENERATION JACK PINE SEED ORCHARD Location: Section 35-T43-R32 (Fort Ripley Township)

Crow Wing County, in cooperation with MNDNR and the MN Tree Improvement Cooperative, established a SECOND GENERATION JACK PINE SEED ORCHARD in Section 35 of Fort Ripley Township.

Intensive site preparation activities and fence installation took place in the fall of 1998. Hand planting of containerized stock was completed in the spring of 1999 utilizing Land Department Staff and DNR MCC Crew members. Survival during the first growing season was excellent; 95%+. The purpose of the fence was to protect the seedlings from predation from deer and rabbits; no predation has been witnessed. Gophers continue to be present in scattered locations which require quick response by County crews. The un-planted areas inside the fence and around the outside of the fence are periodically disked to deter gophers and to provide fire protection. The seedlings used for out-planting for this project were produced by controlled cross pollinations of superior trees from seed orchards developed in the mid 1980s. Seed produced from this orchard should produce a higher quality, more productive tree than trees produced from seed coming from our first generation seed orchard established in 1985.

See below, excerpts from the 2003 MNTREE Improvement Annual Report: Short and long-term planning Five-year measurements were collected from the two remaining second-generation plantings (Crow Wing County/MN DNR’s County Line and St. Louis/IRR’s Ellsburg Rd. East plantings). Data is currently being analyzed and tentative results are shown in Appendix C. Both second-generation sites had a substantial cone crop, and crossed will be made in these orchards as soon as 2004. Seed from these crossed will be planted as a progeny test in the future. A progeny test will serve to identify the best “general combiners,” or individuals that will make the best parents for an improved second-generation seed orchard. Jack pine regeneration has become limited by deer browse in many Counties in western Minnesota. However, the need for improved seed will increase as the DNR increases cutting of over-grown jack pine forests and utilizes artificial regeneration to reclaim them. In the past year demand for improved seed has outweighed availability for some Cooperators. Fifth year field measurements of jack pine second-generation population Introduction The need to progress into second-generation material led the Minnesota Tree Improvement Cooperative to begin an extensive breeding program of jack pine. Breeding work began in 1993 and was completed in 1997. In all, over two hundred full sib, unrelated crosses were produced from five different seedling-seed orchards across Minnesota. Seed was stored until all crosses were completed. In 1998, seed was germinated at IRR greenhouse, and seedlings were out-planted in May 1999 at two sites, one each in St. Louis Co. and Crow Wing Co. Sites were planted as a randomized complete block design with single-tree plots. Methods In 2003 (after three growing seasons in the field), tree heights were measured to the nearest centimeter using a height pole. In 2003, in addition to tree heights, tree diameters (outside bark) at breast height (1.3 meters) were measured using calipers to the nearest millimeter. Data collected in 2003 also included stem straightness (stem form) and the incidence of gall rust (Cronartium Quercuum or Cronartium harnessii). Stem form was assessed on a scale of 1-6 using a key provided by the New Brunswick Tree Improvement Council (Fullarton, 2001). Results Survival at both sites was excellent, exceeding 90%. Site means and maximum values for heights and diameters are shown in Table 1 for 2001 (three year data) and 2003 (five year data). Heights and diameters were generally larger at Crow Wing that at St. Louis.

PARKS REPORT Administration of the Parks Division is one of the responsibilities of the Land Department. The maintenance crew is comprised of three full-time employees IE. one parks supervisor and two parks maintenance technicians. NOXIOUS WEED REPORT

Pursuant to the Minnesota Noxious Weed Law (Minnesota Statutes Chapter 18, Section 18.75 to 18.88), the purpose of this legislation is to protect the residents of this state “from the injurious effects of Noxious Weeds on public health, the environment, public roads, crops, livestock, and other property”. Section 8.78, Subd. 1 states, “a person owning land, a person occupying land, or a person responsible for the maintenance of public land shall control or eradicate all noxious weeds on the land at a time and in a manner ordered by the commissioner, a county agricultural inspector, or a local weed inspector.” Section 18.80, Subd. 1 states, “The county board shall appoint one or more county agricultural inspectors…” As a result of this mandate, Crow Wing County has employed a County Agricultural Inspector within the Land Commissioner’s Office/Parks Division over the last two decades. Crow Wing County’s involvement has primarily concentrated on eliminating noxious weeds within county road right of ways via application of approved herbicides by Certified Applicators. Additional effort is required by the County Agricultural Inspector to address noxious weed complaints and resolve those complaints according to law. Work performed in county road right of ways are paid by the Parks Division’s Weed & Seed Budget and later reimbursed by the County Highway Department. September 3, 2003 The Crow Wing County Board

of Commissioners adopted the following ordinance - EFFECTIVE 8/1/2005. AN

ORDINANCE REGULATING THE USE OF HUNTING STANDS ON COUNTY MANAGED PUBLIC LANDS

1.0 GENERAL PROVISIONS

1.1 Authority. This ordinance is adopted pursuant to the authority vested in Crow Wing County pursuant to Minnesota Statutes Section 282. The Forest Management Plan for the Tax Forfeited Lands of Crow Wing County is hereby incorporated herein by reference.

1.2 Purpose. The purpose of this ordinance is to minimize damage to

trees, minimize property damage to logging and mill processing equipment and bodily injury to the processors, promote public safety, promote fair and equitable public use of public lands, and enhance the aesthetic qualities of County managed public lands.

2.0 DEFINITIONS

The following words or terms as used in this Ordinance have the meaning given them in this section unless a different meaning is clearly indicated by the context. 2.1 “County Managed Public Lands” means tax forfeited lands and natural

resource lands located in Crow Wing County and owned in fee by the County.

2.2 The term “portable tree stand” means a device, designed for the

purpose of elevating a person while hunting, which is lightweight in design and is transported by a person to its destination and attached to a tree. Examples include, but are not limited to, platforms which strap-on or chain-on to the tree, climber stands and ladder stands.

2.3 The term “portable free standing stand” means a device, designed for

the purpose of elevating a person while hunting, which is transported to its destination and is capable of supporting itself without being attached to a tree.

3.0 HUNTING STAND USE

3.1 No person may construct, occupy or use any hunting stand on County Managed Public Land except portable tree stands or portable free standing stands. Permanently constructed or non-portable stands of any type are not allowed on County Managed Public Land.

3.2 Portable tree stands or portable free standing stands shall not be

placed earlier than one (1) week prior to the opening of Minnesota’s big game hunting season and must be removed no later than one (1) day following the close of the season.

3.3 Portable tree stands or portable free standing stands not removed as

required in Section 3.2 shall be considered abandoned personal property and dealt with pursuant to MN Statute 345.15 entitled, Counties, Unclaimed Property; Disposition; Duty of Sheriff.

3.4 Persons wishing to use portable elevated devices on County Managed Public Land for recreational purposes, other than hunting, may do so if they first obtain a permit from the Land Commissioner’s Office.

4.0 DAMAGE TO TREES 4.1 No person may cause damage or injury to any tree by the placement or

erection of portable tree stands or portable free standing stands or by any other manner while climbing or hunting from a portable tree

free standing stand except that small lateral branches less than 1” in diameter may be removed.

4.2 No person may cause damage to trees by creating clear lanes for

shooting except as allowed in Section 4.1. 4.3 Screw-in steps and/or anchor bolts for portable tree stands are allowed

providing they are removed when the stand is removed. 5.0 ENFORCEMENT

5.1 This ordinance shall be enforced by Crow Wing County enforcement personnel and/or enforcement personnel of other jurisdictions through mutual enforcement agreements.

6.0 PENALTIES

6.1 Any person who violates any of the provisions of this ordinance, or who fails to comply with the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine with a maximum of $1,000 or by imprisonment for up to 90 days or both. A person who damages any tree in violation of this ordinance will also be responsible for restitution in the amount of the value of the tree.

6.2 Nothing in this Ordinance shall prohibit the County from pursuing

Criminal prosecution or civil remedies as provided pursuant to Federal law, State law or other County ordinances.

7.0 SEVERABILITY

7.1 If any section or portion of this Ordinance shall be found unconstitutional or otherwise invalid or unenforceable by a court of competent jurisdiction, that finding shall not serve as invalidation or affect the validity and enforceability of any other section or provision of this Ordinance.

8.0 EFFECTIVE DATE
