This brochure includes the Crooked Creek Property Owners Association Bylaws, Restrictive Covenants and some interesting facts and history about our community, which celebrated its 43nd anniversary in 2011.
Now known as the Crooked Creek Property Owners Association, it was chartered in 1968 to operate, in accordance with its Bylaws and North Carolina General Statutes Chapter 55A as a non-profit corporation with perpetual duration. In addition, portions of Chapter 47F, North Carolina Planned Community Act, apply to our community.
Membership in the Association is automatic upon acceptance of deed to any lot in the subdivision. Deed acceptance also causes the grantee to legally agree to abide by the Restrictive Covenants.
The Association owns and is responsible for maintaining the 15.8 acre lake & park open areas. The 127 acre golf course open area, which is also an integral part of the 323 acre subdivision, is privately owned and maintained, but open to the public.

CROOKED CREEK LAKE AND PARK USE RULES
(Adopted November 7, 1984)
1.Fishing, boating and use of the park is restricted to residents and their house guests.2. Local guests are permitted lake and park use while in the company of a property owner or resident member of owner’s family.3. Lakeside property owners are free to permit unaccompanied local guests to fish,butonlyfromhost’sproperty,andareurgedtoprovideoff-streetparking.
AMENDMENT(Adopted January 25, 1989 - and Amended October 27, 2003)1. Property owners and up to ten guests may use the park or the lake at any time (in accordance with the above rules).2. When the guest group exceeds ten , a use permit must be secured before the planned use date; a two-week lead time is advised.

1. Establishes conditions of use.2 Requires approval by three directors (President or Vice-President and two others).3.Requires property owners adjacent to park be notified after approval of thepermit and prior to the planned use. LEASED PROPERTY OWNERS
GUIDELINES FOR RESOLVING NEIGHBORHOOD DISPUTES
December 8, 1993 RevisionThe Crooked Creek Property Owners Association recognizes that disagreements between neighbors are a naturally occurring phenomenon and one that its board members stand ready to be of assistance in, whether or not the dispute involves violation of the restrictive covenants. The board encourages residents to be solution-oriented in their approach to neighborhood disagreements rather than affixingblame,andmembersoftheboardarewilling,wheninvited,to approach neighbors about violations of the restrictive covenants, particularly paragraph number 11 which deals with noxious and offensive activities and anything which may become an annoyance or nuisance to the neighborhood. If you encounter a situation that represents a problem to you and/or is a violation of the restrictive covenants, the following steps are recommended:
1. Talk to the neighbor yourself, or approach the neighbor accompanied by a board member. In certain situations the board member will speak to the neighbor alone, if you are unable or unwilling to make personal contact yourself.
2.Ifyoufeelthisfirststepdidnotbringaboutthedesiredsolution,refer your problem to the Henderson County Dispute Settlement Center where trained mediators will meet with you and your neighbor at the center to work out a mutually agreeable solution, using an American Bar Association process of mediation. A telephone call to thecenter’soffice,697-7055,willinitiatethisprocedure.
3. If your neighbor declines mediation, (it is a voluntary process) and informal talks with the neighbor have not produced a solution to your problem, refer to the Association for assistance, by calling its President. The problem will be reviewed by the board and a decision made to take formal board action or present a recommendation to you.
