(LIBOR), REALTORS® and associations throughout the U.S. and internationally for a weekend open house. Potential home buyers rely on open hous- es to help them find the home of their dreams. During Nationwide Open House weekend, buyers can have a greater chance of doing just that. The weekend is organized by state and local Realtor® associations across the country and around the world, uniting Realtors® as they host thousands of open houses while engaging consumers on the benefits of homeownership and bringing buyers and sellers together. The Nationwide Open House Weekend offers buyers a stress-free way to visit homes for sale in different neighborhoods where they might want to live. For sellers, the weekend provides a high-visibility effort to promote traffic and drive home sales. According to NAR’s 2012 Profile of Home Buyers and Sellers, 45 percent of all buyers used open houses as a source in their home search process. This figure suggests the value of open houses even in the Internet era. In fact, 46 percent of the buyers who went to open houses found out about them through internet searches. Plan to be a part of the campaign, hosted by the Long Island Board of REALTORS® and participating state and local REAL- TOR® associations on Saturday and Sunday, April 20-21. Any office in Nassau, Suffolk, or Queens, can sign up to partici- pate in the Open House Weekend by visiting LIRealtor.com/NOHW. All participating offices will receive a complimentary Open House promotional kit that includes a supply of blue Open House balloons, posters for your office, a press release that you can cus- tomize and use in your own newsletter, advertisements and/or on your Web site. All participating offices will be listed on the NOHW homepage. (This page will be updated regularly as offices sign up to par- ticipate.) Additionally, In an effort to motivate would be buyers to attend your open houses that weekend, LIBOR will be giving away an iPad with Retina display to one lucky Open House attendee. Kate Koplinka, the Chairperson of the LIBOR Public Relations committee, together with Vice Chairperson, Carlos Diaz, will select one winner, on Tuesday, April 23rd and the winner will be notified by phone. All entries must be made online at the designated sweepstakes website address before midnight on Monday, April 22nd. All open house atten- dees will receive printed instructions at each open house on how to enter the iPad sweepstakes. Sweepstakes instructions and details will be included in each participating promotional kit and bro- kers/agents will be responsible for making sure they have enough copies for the public at each of their open houses that weekend. In June REALTORS® from around NewYork State will journey to Albany for ourAnnual Lobby Day. In past years we haveachieved huge successes such as the pas-sage of the Commission Escrow Act andthe New York State property tax cap whichlimits tax increases to 2 % a year or the rateof inflation or whichever is less when itcomes to your local property taxes.

OUR TOP 3 LEGISLATIVE PRIORITIES THAT WE ARE SUPPORTING THIS YEAR ARE:

Mandate ReliefNYSAR joined a coalition of 11 business,

local government and education organiza-tions to launch “Let New York Work: ACommon Agenda for the Common Good.”This initiative was designed to advance sig-nificant mandate relief in New York such asmaking the pension system predictable andaffordable, reducing the costs of constructionon public/private projects, and reforming theScaffold Law. To date, the coalition has beensuccessful in supporting Tier VI implementa-tion and the takeover of Medicaid growth bythe state. NYSAR will continue to work withthis coalition this year to advocate for man-date relief for New York’s local governmentsand school districts.

Appraisal ManagementCompany Registration

A new issue that NYSAR will be consid-ering in 2013 is legislation that will requirethe registration of Appraisal ManagementCompanies (AMCs) that operate in NewYork State. Many other states have alreadyput into place laws that require this type of

registration and in some cases, licensure toattempt to address some of the problemsthat homeowners and REALTORS® haveexperienced. AMCs are not new, but thenumber and the frequency of their use haveincreased since the adoption of the HomeValuation Code of Conduct (HVCC) in2008. The HVCC prohibits mortgage pro-fessionals from ordering appraisals andmandates that lenders have either a separatedepartment to order appraisals or use thirdparty companies to select appraisers suchas AMCs. In recent years many lendershave simply chosen to use AMCs ratherthan restructure their own operations.

First-time Homebuyer SavingsAccounts (S.3581 – Robach)

NYSAR supports passage of legislationthat will allow individuals and couples tomake pre-tax contributions to a savingsaccount that would be dedicated to the pur-chase of a first home.

THESE BILLS THAT WE AREOPPOSING ARE:

Requirement of License NumberDisclosure (A.4216 – DenDekker)

NYSAR strongly opposes legislation thatwould require every real estate salespersonand real estate broker involved in or presentduring a real estate transaction to includehis or her license number on every docu-ment requiring a signature. This bill isunnecessary, burdensome and will notachieve its desired result.

Broker Signature on All RealEstate Documents (A.4217 –DenDekker)

Status: Assembly Judiciary NYSAR strongly opposes this legisla-

tion, which would require real estate bro-kers to sign every document that requiresthe signature of a salesperson during thelease, rental or sale of real property. Thisbill is unnecessary, impractical and overlyburdensome. License law and the REAL-TOR® Code of Ethics already impose aduty of supervision and responsibility onbrokers and their affiliated licensees.

Source of Income (S.168, S.187 ñSquadron; S.2716 – Adams)

Status: Investigations andGovernment Operations

NYSAR opposes this legislation whichseeks to add “source of income” as a pro-tected class in New York State HumanRights and Executive Law. The sweepinglanguage of these bills would constitute aserious intrusion on the rights of propertyowners to conduct their own business withprospective purchasers and renters.

Before November of 2012, the MultipleListing Service of Long Island reported11 consecutive months of higher yearover year contracted sales activity forLong Island and Queens. This was apositive sign that the local real estatemarket was in recovery mode, as confi-dent buyers were taking advantage ofexcellent housing affordability condi-tions and they were making their homepurchases. Then in November, themonth directly following Super StormSandy, the trend of higher year over yearsales activity was temporarily interrupt-ed. By December of 2012, however,sales activity began to return to normal,and the trend picked up where it left off,showing year over year increases in thearea of contracted sales activity.

So what’s happening now? February2013 housing data shows that contractedsales activity was up 9.2% over the yearprior and in January 2013, sales activitywas 26.2% higher than the year prior. Ifthis trend continues, and available inven-tory continues to downward, we should

eventually begin to see an increase inhome prices based simply on the princi-ple of supply and demand.

The reality of today’s real estate prac-titioner is that you have to be aware andat least somewhat comfortable with tech-nology based tools. Quite simply, itwould be extraordinarilydifficult to be very success-ful without them. What theMLS tries to do is meetboth of those needs withour MLS Products andServices group.

However, even before wedo that, we have to find,investigate and evaluate theproducts which are out there. The staffregularly attends industry trade shows atNAR and checks out the offerings. Inaddition, vendors come to us directly tocall our attention to their products. Theresult is a range of products and serviceswhich are available to you and many ofthem are free.

The first step is making you aware ofwhat we have and following that is pro-viding detailed assistance in implement-ing that capability into your business. Tothat end, we have developed an exten-sive array of courses starting with“Money Making Solutions You Can’tLive Without” which for $75.00 alsoearns you CE credit.

The tools we have available touchupon social marketing, the internet andtracking. We then designed specificcourses in their application and usage.By this time, Realtors generally knowthe value of websites. We offer a rangeof website capabilities which vary price-wise with the features. However, wealso provide many free features that youcan have for your website. They includeFinancial Calculators, Consumer VideoTips, School Statistics andNeighborhood Profiles to name a few.

You can capitalize on another productthat enables you drive traffic to your list-ing while connecting to your buyers’ andsellers’ social network. It’s called

We too, have housing value estimateson MLSLI.com with the Realist Valuemaps. You can add these to your web-sites to keep the public there rather thanhaving them go to the national sites. Ourvaluations include the latest MLS datawhich make them more accurate in mostcases than any national site. Again, thisis another free product that helps yourbusiness.

Taking information availability to thenext level is providing prices of “Sold”properties. The big national sites havethis but again they can only base it onPublic Records”. You can have “Sold”information on your websites whichinclude the very latest MLS closingswell before they are available throughpublic records. That capability is avail-able to you for your sites for only $49.00a year!

What you owe yourself at a minimum,is to be aware of technology trends in themarketplace. Once you’ve taken thatstep, you can then evaluate what couldwork for you. You can get all this infor-mation at MLSTechs.com. No one issaying “Use everything now.” Rather,this should be an orderly phased inapproach in which you add, adapt andmaster that capability before moving onto the next. “Slow” is better than “No”!

Real estate is an integral part of ourlives, whether we act like a true real estateprofessional or not. It is my firm belief thatit is crucial that all agents are cooperativewith one another and moreover, accuratewith the information that they provide toeach other. Accuracy is not only a serviceto other agents and the public, but it is aservice to ourselves. I’m sure many of youcan relate to feeling frustrated when youcall on a property that is marked “avail-able” only to call a short time late to makean appointment and the property is nolonger available, or worse, has an acceptedoffer.

Nowadays, the public, namely thoselooking to purchase a home, are coming tothe table with money and are looking to gettheir money’s worth. It’s disheartening towatch them go to a property, fall in lovewith it, only to find out that there arealready multiple offers on the property.When this happens, not only do we wasteour valuable time, but we also watch ourclient’s dream home slip through their fin-gers. This becomes even more heartbreak-ing in this market where the availableinventory is significantly shrinking and wedon’t always have a lot of other propertiesto show them.

When this sort of situation happens, or

something along the same lines, it reflectspoorly on the agent showing the proper-ties, but it also leaves a mark on all realestate professionals. It leaves our clientsuntrusting of Realtors®, which doesn’tserve any of us well. This is why it is in ourbest interest as Realtors® to not be ourown worst enemy. We all need to workmore diligently at providing accurateinformation to one another, and keepingthe property information accurate on thesystem that we all subscribe to. This issomething we can control versus all theunforeseen challenges that arise during thecourse of any real estate deal that we can’tcontrol.

Time is money in this business, and Idon’t want any of my fellow Realtors® tolose out on business because of misinfor-mation or lack of cooperation. The onlyway to survive is to adapt, and we mustadapt to the rapidly changing real estatemarket. Business is moving very quickly,and as such we need to keep office staffand appointment services in the loop sothey have accurate information to share. Achange starts with us and we must lead byexample to ensure cooperation amongst allRealtors®.

President Moses Seuram, LindaBonarelli Lugo and I attended a receptionfor Congressman Steve Israel on March21. The congressman shared 5 interestingfacts from a “think tank” regarding projec-tions for 2030, a mere 17 years from now:

1. world-wide population will be 1.6billion

2. a greater percentage of that popula-tion will be living in cities than now

3. a greater percentage of that popula-tion will be old/older

4. the technology which will be in usethen has not yet been invented

5. there will be great shortages of ALLour natural resources

Are you noticing a trend? We will needmore housing in our metropolitan areasand more senior housing, both accessibleto public transportation, shopping, recre-ation, etc. And we Realtors® will beworking with consumers via technologyunheard of today. BUT, we will still beneeded, probably EVEN MORE THANNOW, to help consumers make sense ofthe information with which they will beinundated.

The one caveat to that projection is leg-islation: Will future laws and regulationsallow us to maintain our service to thepublic to help them realize, and keep, thedream of home ownership alive? Yourinvestment in the Realtors®’ PoliticalAction Committee will assure our future.

Many of us will be in Washington May15 to meet with our Congressmen andwomen and Senators to implore them to

preserve Mortgage Interest Deduction(MID) and to not implement QualifiedResidential Residential (QRM). Howmany of you, and your clients and cus-tomers, utilize MID and would be finan-cially impacted without it?? How many ofyou sold homes to buyers who had lessthan 20% down and you, and those con-sumers, would be financially impacted ifQRM was enacted?? MID + QRM = RIPfor Realtors®!!

We DO NOT MIND time away fromour families and businesses to go to D.C.to champion causes that are right forRealtors and the consumers we serve; weWILL do the work. However, we DOMIND when you do not invest in RPAC!!Your investments get us seats in our legis-lators’ offices; if we are not at the table, weare on the menu!! Q. I was told that, when I have a buyer,I should check the Agency Disclosureform on the right side next to “Buyer”and “Broker’s Agent.” Then I took aclass and was told that I should bechecking on the left side of the form,“Seller” and “Broker’s Agent” or“Seller’s Agent” depending on whetherI am showing other office’s listings orlistings from my own office. Now I ammore confused than ever.

A. If a buyer is your customer, whichhe is unless you and he agree to enterinto an agency relationship, you willcomplete the agency disclosure form asfollows: when you are showing the buyeryour office’s listings, you are workingfor the seller as a seller’s agent. Whenyou show the buyer other offices’ list-ings, you are working for the seller as abroker’s agent. Those are all on the leftside of the page. You only check the dis-closure form on the right side of the pagewhen you are representing the buyer asyour client.

Q. How can I get paid if I represent thebuyer and the listing agent has offeredno compensation to a buyer agent?

A. You may add your compensation tothe offer and ask the seller to pay you outof the transaction funds, but remember,the seller is under no obligation to do so.There is another way to be paid, howev-er: the buyer can pay you directly.

Q. I am a buyer’s agent and my buyerdoes not want anyone to know who heis. The listing agent won’t present myoffer until I send over my buyer’sagency disclosure. What do I do?

A. You never send your buyer’s

agency disclosure to anyone. You sendover an agency disclosure to the listingbroker for his seller to sign which hasbeen checked on the right side of theform indicating that you work for thebuyer as a buyer’s agent. The seller isactually your customer and your agencydisclosure is informing him that you donot work for him. That is what the statuterequires you to do. Think about theprocess in reverse. When you work forthe seller as his agent and a buyer cus-tomer comes into your office, you do notgive him the agency disclosure your sell-er client has signed. You give him hisown agency disclosure telling him youdo not work for the buyer, but rather forthe seller.

Q. Can I be paid by both my buyer andseller?

A. Yes, but each must be told you arebeing paid by the other party as well.

Could Rising Mortgage RatesHelp Housing?

Mortgage rates are still near recordlows but they have been inching upslightly in recent weeks as the U.S. econ-omy shows some signs of improving.The 30-year fixed-rate mortgageóthemost popular choice among home buyer-sóreached its highest level in more thansix months last week, averaging 3.63 per-cent, according to Freddie Mac figures.

Mortgage rates are projected to risehigher this year, which could make buyinga home more expensive. But some hous-ing analysts say that the higher rates couldactually help aid the housing recovery.

Home buyers who have been lingeringon the market may finally move forwardon a purchase. The increasing rates maydrive home the point that while borrowingis still cheap, they’d better lock in a ratenow before rates move any higher.

Study: Buying a Home Is 44%Cheaper Than Renting

The recent rises in asking prices hasbeen outpacing the increases in rents,but home buying still may make morefinancial sense, a new study shows.Owning a house was found to be 44 per-cent cheaper than renting, according tothe latest study from Trulia that com-pared the costs of the two.

The study found that owning is lessthan half the cost of renting in 46 of the100 largest metros. “Buying a home ischeaper than renting in all of the 100largest metro areas,” according to Trulia.

Falling mortgage rates are helping tokeep home buying more affordable. Butdepending on where you live, the differ-ence between owning versus renting canbe big or small.
