Director of the company that gained approval for a land division application. The Presiding Member suggested that, while the Panel should note Ms Perry’s interest, there should be no need for her to absent herself from the meeting for that item as it only required the Panel to note a decision that had already been made by the administration under delegation.

4. Roof drainage water from the structures shall be disposed to rainwater tanks, street water table or stormwater sump upon installation of roof cladding being installed so as to avoid nuisance to neighbours or destablisation to building foundations or to the subject land itself.

The land use activities herein approved and the performance and conduct of the development generally and its users shall at all times be managed and controlled in a manner to the reasonable satisfaction of Council so as to not cause undue nuisance or adverse affect on neighbouring landowners or to other land uses within the locality.
Reason: To ensure there is no nuisance to adjoining occupiers of land.
7. No materials, goods or containers or the like shall be stored within the car park areas or driveway and at all times shall be kept free of obstruction and always remain available for the parking of vehicles by users of the land when the premises are open.
Reason: To ensure car parking is available for use when
required. 8. The loading and unloading of all commercial vehicles
associated with the development shall at all times be restricted to the confines of the subject land itself and shall not be allowed to occur in any form on the adjacent roadway(s) or their verge.
Reason: To ensure that vehicles associated with the land use do not cause disruption or danger to vehicles on adjoining roads.
9. Landscaping shall be planted within 6 months from the date
of occupation or use of the development herein approved and maintained in good order and condition thereafter to the reasonable satisfaction of Council.
Reason: To improve and maintain the site appearance and protect the stability of the land surface
10. Prior to Development Approval being granted the applicant
shall provide evidence to the Council that an amalgamation process has commenced of allotments 164 and 165 in FP 889 with the Lands Title Office.

Department Manager: Development & Environment Reporting Officer: Kathy Jones, Development Officer - Planning Subject: Request for LMA 14: 431/D001/96 Amendment File No: 433/183/17 Date: 20 October 2017 PROPOSAL The purpose of this report is for the Council Assessment Panel to provide advice to Council regarding a proposed waiving of a condition of the Land Management Agreement 14 (431/D001/96). The waiving would allow for the erection of a shed outside the designated building envelope. The request relates to a development application upon land situated at Lot 21 (D74027), Penwortham, as contained within Certificate of Title Volume 6012 Folio 376. The subject land is owned by Ben Calder. RECOMMENDATION That the Council Assessment Panel: 1) considers that the erection of the shed 5 metres from the southern boundary is an
acceptable outcome for development application 433/183/17; and 2) provides this advice to Council in respect of Land Management Agreement 14
(431/D001/96) clause 2.3.

Request for LMA 14: 431/D001/96 Amendment
DISCUSSION Land Management Agreement 14 was registered on the Certificate of Title for the subject land as a result of land division application 431/D001/96. Clause 2.3 was included to prevent structures being erected outside of the designated building envelope. Allotment 21 has a small narrow plateau to the east in which structures can be erected on the property without extensive earthworks being undertaken. The allotment slopes steeply to the west and is also located in a medium bushfire risk area. Highlighted in red on the photo below is the plateau area that is suitable for building without extensive earthworks.
The applicant has requested that Council consider waiving clause 2.3 in the Land Management Agreement to enable the erection of a shed 5 metres (approximate location marked in black above) from the southern boundary instead of 10 metres. This will enable sufficient area suitable for the erection of a dwelling, effluent disposal and car parking in the future. A site visit was undertaken on 22 September (see attached photos) and there would be no impact to the adjoining property. Since the LMA was entered into in 1996, Council has undertaken various Development Plan Amendments which have reviewed the planning policy contained within Council's Development Plan and subsequently updated the policies that formerly applied to the land. The LMA is outdated and does not meet the objectives and principles of the Primary Production Zone, Horticulture Policy Area 2 contained within the Clare and Gilbert Valleys Development Plan.

This advice would then be provided to Council for them to approve the amendment. RECOMMENDATION That in respect of Land Management Agreement 46 (433/25/00), CAP advises Council to extinguish the Land Management Agreement in its entirety between Clare & Gilbert Valleys Council and Greenwood Holdings (SA) Pty Ltd in accordance with the correspondence received from Sawley Lock O'Callaghan dated 7 August 2017.

DISCUSSION Land Management Agreement (LMA) 46 was registered on certificate of title 6017/211 for the subject land as a result of development application 433/25/00 to allow for the construction of a larger family home. Originally the LMA was entered into so that the applicant could construct a larger family home and retain the existing smaller dwelling to accommodate visiting extended family members. The applicants have requested that Council consider extinguishing the Land Management Agreement in its entirety as the transportable dwelling was removed approximately 3 years ago and therefore no longer required. The allotment now only contains 1 dwelling. Clause 2.2 of the LMA states that “the owner shall not commence or proceed with or cause, suffer or permit to be commenced or proceeded with any application to the relevant planning authority or other relevant authority for approval to divide the subject land.” Since the LMA was entered into in 2000, Council has undertaken various Development Plan Amendments which have reviewed the planning policy contained within Council's Development Plan and subsequently updated the policies that formerly applied to the land. By extinguishing the LMA this will allow for the owner to proceed with lodging their boundary realignment application which will be assessed against the provisions contained within Council's Development Plan.
