A regular session of Troy City Council was held Monday, October 5, 2015, at 7:00 p.m. in Council Chambers.

Members Present: Clark, Heath, Kendall , Oda, Phillips, Schweser, Snee, Tremblay and Twiss.

Presiding Officer: Alan R. Clark, President of Council Pro Tern Mr. Clark commented that as Mayor Beamish is not available to attend the meeting to sign legislation that may be approved, in accordance with the Ohio Revised Code, Mrs. Baker is Acting Mayor and he is presiding as President Pro T em .

INVOCATION: The meeting began with an invocation given by Mr. Clark, followed by the Pledge of Allegiance.

PRESENTATION: Tamara Ganger, Executive Director of the Troy Senior Citizens Center, presented cookies to elected officials to thank them for their efforts on behalf of the community.

MINUTES: The Clerk gave a summary of the minutes of the September 21, 2015, meeting of Troy City Council. There were no corrections or add itions to these minutes. A motion was made by Mr. Phillips, seconded by Mr. Schweser, to approve these minutes. Motion passed by unanimous roll call vote.

COMMITTEE REPORTS: Community & Economic Development Committee: Mr. Twiss, Chairman, reported as follows:

1) Committee recommends legislation be prepared to accept the dedication of right-of-way of 2.451 acres of existing IL 6898 along Experiment Farm Road just south of 1501 Experiment Farm Road, which right­of-way acceptance has been recommended by the Troy Planning Commission.

2) Committee recommends legislation be prepared to accept the dedication of right-of-way of 0.189 acres of existing I Ls 8659 and 7159 along the south side of W. Market Street/SR 55 and the west side of Barnhart Road, which right-of-way acceptance has been recommended by the Troy Planning Commission. Committee supports emergency legislation as the property owner, Segna, Inc., is plann ing a business expansion and cannot commence work until the plat including the right-of-way is approved and filed .

Dr. Jason Johnston. • 117.278 acre parcel , formerly known as the Huelskamp farm .

COMMENTS OF THE ACTING MAYOR: Acting Mayor Baker, noted the following upcoming events:

• October 15, Meet the Candidate event, 7 p.m. • October 24, Halloween Parade for Children, 9 a.m. followed by Trick or Treat at downtown businesses. • October 24, Mayor's Prayer Breakfast, 9 a.m. at First Baptist Church. • October 29, Trick or Treat, 6-8 p.m.

COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY: Mr. Titterington noted that the new recycling program using the 65 gallon containers is underway. Mrs. Oda commented that she has observed residents placing the containers in the grass and not the curb, and Mr. Titterington noted that the education process will take some time. Mr. Kendall commented he observed the drivers placing the containers in an appropriate location so they could be emptied.

COMMENTS OF THE PRESIDENT OF COUNCIL PRO TEM: Mr. Clark passed around letters some students had sent thanking those involved with bringing the Lincoln Funeral Train to Troy in September.

AUDIENCE COMMENTS: -Scott Frank of DP&L noted that DP&L has re-designed their bill; he provided a copy of a "community briefing" flyer the company intends to provide to the City on a quarterly basis; and introduced a flyer about "Right Tree, Right Place" to introduce "utility friendly trees" and help citizens avoid planting a tree in a location where it will interfere with utility lines. He announced that DP&L will soon launch a grant program of a total of $50,000 available to communities that have the Tree City USA designation and involves funds for trees. -Lester Conard, 1210 S. Clay Street, commented that he understands regular refuse, as well as the recycling, will no longer be picked up in the alley, and he does not feel that information has been well communicated. -Penny Rife, Katie Goodrich, Pamela Jenkins, Valerie Harris, and Carmen Tharpe, residents from the Staunton Commons apartment complex, explained that the complex owner charges tenants for DP&L and City water as a part of the rent, but is considerably behind in the payment of these utilities and, as a result, the tenants have experienced frequent shutoff of water and electricity, they have no mechanism to have the utilities transferred into their names to avoid this, and they asked for any assistance. Mr. Titterington explained that the City has to follow certain regulations, and DP&L has to follow the regulations of PUCO, but he is willing to see if there is anything that can be suggested and also suggested the residents talk to Mr. Frank of DP&L.

EXECUTIVE SESSION: A motion was made by Mr. Twiss, seconded by Mr. Phillips, that Council recess into Executive Session for discussion of preparing for, conducting or reviewing negotiations or bargaining sessions with public employees concerning their compensation or other terms and conditions of their employment. Motion passed by unanimous roll call vote.

At 7:35 p.m. Council recessed into Executive Session.

A motion was made by Mr. Twiss, seconded by Mrs. Oda that Council return to regular session. Motion passed by unanimous roll call vote. Council returned to regular session at 8:02 pm .

There being no further business, the meeting adjourned at 8:03 p.m.

SUBJECT: AMENDMENTS TO MOBILE FOOD VENDOR PROVISIONS

SUMMARY REPORT: (To be read at Council meeting) This Committee met on October 12, 2015, to review amendments proposed by staff related to mobile food vendor provisions. The amendments were proposed in response to requests to provide opportunities during certain special events and events that may be sponsored by the City at which mobile food vendors may exceed the one hour time fame to remain stationary in one location and operating for sales purposes.

RECOMMENDATION: (To be read at Council meeting) It is the recommendation of this Committee that legislation be prepared to amend the provisions related to mobile food vehicles to provide more opportunities for the operators of those vehicles as proposed by staff with a change from the staff recommendation that Section 721.10 ( d) (2) read: " ... shall not remain stationary in one location for longer than six (6) hours ... "

This Committee met on October 12, 2015, to consider amendments to the provisions regarding mobile food vendors. This meeting was also attended by Council President Baker, all Members of Council, the Director of Public Service and Safety, members of the City staff, and citizens.

In 2012 Council enacted legislation to update regulations regarding vendors, including the applicability of the regulations to mobile food vehicles. Those regulations include that a mobile food vehicle may be stationary at one location and operating for sales purposes for a one hour period. Particularly in recent months there have been requests that the provisions be less restrictive to provide opportunities during certain special events and events that may be sponsored by the City at which mobile food vendors may exceed the one hour time fame to remain stationary in one location and operating for sales purposes. The Committee reviewed proposed amendments in response to those requests, with the following primary proposed changes:

The one hour stationary limitation is increased to four hour on private property; A mobile food vehicle would be permitted to be within 100 yards of an eating establishment with the written approval of the owners of any such eating establishment; and On land owned by the City or an educational institution, and with approval of the Director of Public Service and Safety, a mobile food vehicle could remain stationary in one location for up to a 48-hour period, excluding the time for set up and tear down.

Our discussions noted that the prov1s1ons still provide protections to downtown businesses and the investments the owners have made in those businesses and that if the owner of an eating establishment did not want to provide the written approval for the location of a mobile food vehicle, such food vehicle would not be permitted to be located within 100 yards of that eating establishment. As this was discussed, several members of Council indicated a preference that the increased period (for the mobile food vehicle to be in one location) should be from one hour to six hours on private property, rather than one hour to four hours.

RECOMMENDATION: It is the recommendation of this Committee that legislation be prepared to amend the provisions related to mobile food vehicles to provide more opportunities for the operators of those vehicles as proposed by staff with a change from the staff recommendation that Section 721 .10 (d) (2) read " ... shall not remain stationary in one location for longer than six (6) hours ... "

SUBJECT: REVIEW OF MCKAIG ROAD/MCKAIG A VENUE SPEED LIMIT BETWEEN DORSET ROAD AND SR 718

SUMMARY REPORT: (To be read at Council meeting) This Committee met on October 12, 2015, related to the speed limit of McKaig Road/McKaig Avenue between Dorset Road and SR 718. A westbound vehicle passes a corporate limit 10 times within this roadway area. To stabilize the speed limit, the Ohio Revised Code (ORC) has established a process that can be followed.

RECOMMENDATION: (To be read at Council meeting) It is the recommendation of this Committee that legislation be prepared, as provided by the ORC, authorizing the Director of Public Service and Safety to request the Director of the Ohio Department of Transportation (ODOT) to perform/review a study related to the speed limit of McKaig Road/McKaig Avenue between Dorset Road and SR 718 and that the City support that the Director then establish a speed deemed appropriate and safe based on the study and the response of ODOT related to stabilizing the speed limit for this portion of McKaig Road/McKaig Avenue within the corporate boundary.

This Committee met on October 12, 2015, related to the speed limit of McKaig Road/McKaig Avenue between Dorset Road and SR 718. This meeting was also attended by Council President Baker, Council Members Oda, Twiss, Clark and Tremblay, the Director of Public Service and Safety, and members of the City staff.

The speed limit on McKaig Road/McKaig Avenue between Dorset Road and SR 718 will vary between 25 MPH for the roadway within the incorporated area and 55 MPH for the roadway outside the incorporated area. A westbound vehicle passes a corporate limit 10 times within this area. Citizens have made requests that the speed limit be stabilized. The Ohio Revised Code (ORC) has established a process that can be followed to stabilize the speed limit.

The Office of the Miami County Engineer has completed a speed study for this area of the roadway. As a result of the study, the City could request that the Ohio Department of Transportation (ODOT) support the revised speed limit to be 45 MPH as provided by the ORC. We were advised that ODOT is aware that the study has been done and is supportive of the proposed speed limit. The ORC process is that the legislative body would request the Director of Public Service and Safety to request ODOT to perform a study/review of the speed limit study of the County and, upon receipt of the response of ODOT, approve the Director to establish a standard speed limit.

The speed limit of 25 MPH will remain for McKaig east of Dorset Road. Currently, a driver traveling east on McKaig could legally drive at 55 MPH when reaching the 25 MPH limit.

The Committee and members of Council commented that enforcement jurisdiction may still be a concern at times due to the areas of McKaig that are not within the City of Troy. However, the members of the Committee concurred that a consistent speed on this portion of McKaig Road/McKaig Avenue is preferable to the current situation.

RECOMMENDATION: It is the recommendation of this Committee that legislation be prepared, as provided by the ORC, authorizing the Director of Public Service and Safety to request the Director of the Ohio Department of Transportation (ODOT) to perform/review a study related to the speed limit of McKaig Road/McKaig Avenue between Dorset Road and SR 718 and that the City support that the Director then establish a speed deemed appropriate and safe based on the study and the response of ODOT related to stabilizing the speed limit for this portion of McKaig Road/McKaig Avenue within the corporate boundary.

SUBJECT: VACATION/DEDICATION OF STORM SEWER EASEMENT AT 15 N. KINGS CHAPEL DRIVE

SUMMARY REPORT: (To be read at Council meeting) This Committee met on October 12 to consider the vacation and dedication of a storm sewer easement at 15 N. Kings Chapel Drive to allow for an expansion of the business. The easement vacation and dedication is part of a replat process. However, Council action is required to provide the for vacation/dedication of the storm sewer easement.

RECOMMENDATION: (To be read at Council meeting) It is the recommendation of this Committee that legislation be prepared approving the vacation/dedication of a storm sewer easement for the property at 15 N. Kings Chapel Drive. We support emergency legislation so that a project expansion can proceed without delay.

This Committee met on October 12, 2015, to consider the vacation and dedication of a storm sewer easement at 15 N. Kings Chapel Drive to allow for an expansion of a business. This meeting was also attended by Council President Baker, Council Members Oda and Phillips, the Director of Public Service and Safety, and members of the City staff.

Early in 2013, Council approved the vacation of a storm sewer easement associated with the location of the Car Star business on Kings Chapel Drive. The business is now planning an expansion at the same location. The expansion will require the relocation of the storm sewer utility and the easement for the proposed route of the new storm sewer. This is part of a replat that can be approved by the City Engineer; however, Council action is required to provide for the storm sewer easement vacation/dedication. All costs associated with the relocation of the storm sewer utility will be paid by the property owner. We were advised that to accommodate the additional development and to allow the utility to be relocated during optimum construction season, the property owner asked for consideration of emergency legislation.

RECOMMENDATION: It is the recommendation of this Committee that legislation be prepared approving the vacation/dedication of a storm sewer easement for the property at 15 N. Kings Chapel Drive. We support emergency legislation so that a project expansion can proceed without delay.

WHEREAS, currently inconsistent speed limits exist on McKaig Road/McKaig

Avenue between Dorset Road and SR 718 where such roadway goes in and out of the

Corporate Limits of the City of Troy several times, and

WHEREAS, the Miami County Engineer has conducted a speed study of the

roadway area of McKaig Road/McKaig Avenue between Dorset Road and SR 718.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Troy, Ohio

as follows:

SECTION I: That the Director of Public Service and Safety of the City of Troy,

Ohio is hereby authorized to request the Director of the Ohio Department of Transportation

(ODOT) to perform/review a study related to the speed limits of McKaig Road/McKaig Avenue

between Dorset Road and SR 718, and that the Director of Public Service and Safety of the City

of Troy, Ohio is hereby authorized to establish a speed deemed appropriate and safe based on

the study and the response of the Director of the Ohio Department of Transportation related to

stabilizing the speed limit for this portion of McKaig Road/McKaig Avenue between Dorset Road

and SR 718 within the corporate boundary.

SECTION II: That this Resolution shall be effective at the earliest date allowed

bylaw.

ORDINANCE APPROVING THE REPLAT OF INLOT 10510 IN THE CITY OF TROY, OHIO, AND THE VACATION AND DEDICATION OF STORM SEWER EASEMENTS AND DECLARING AN EMERGENCY

WHEREAS, a request has been made to replat current lnlot 10510 in the City of

Troy, Ohio, and to relocate storm sewer easements thereon, and

WHEREAS, such replat has been submitted to this Council for approval,

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Troy, Ohio,

as follows:

SECTION I: That the replat of current lnlot 10510, in the City of Troy, Ohio, as

shown on the attached map as Exhibit A, including the vacation of a storm sewer

easement and the dedication of a new storm sewer easement, is hereby approved and

ORDINANCE AMENDING SECTIONS 721.10 AND 721.15 OF THE CODIFIED ORDINANCES OF THE CITY OF __ TROY, OHIO RELATED TO MOBILE FOOD VEHICLES

WHEREAS, the Law and Ordinance Committee of Troy City Council has recommended

to Troy City Council that the Ordinance provisions related to mobile food vehicles be amended.

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Troy, as follows:

SECTION I: That Section 721 .10, attached hereto as Exhibit "A", and Section 721 .15,

attached hereto as Exhibit "B", of the Codified Ordinances of the City of Troy, Ohio, are hereby

repealed.

SECTION II: That Section 721 .10 of the Codified Ordinances of the City of Troy, Ohio is

hereby enacted as follows:

" 721.1 0 ADDITIONAL REQUIREMENTS FOR MOBILE FOOD VEHICLES. In addition to the provisions of this Chapter that apply to all Vendors, the

following shall apply to the owners/operators of mobile food vehicles: (a) The issued Mobile Food Vehicle Vending License is valid for one (1)

vehicle only.

{b) There shall be Issued to each vendor for whom a Mobile Food Vehicle Vending License has been issued, a suitable decal that shall be permanently and prominently affixed to the vehicle for which issued at all times.

( c) Each operator of a mobile food vehicle shall have been issued a current Vendor License issued under this Chapter and the owner of each mobile food vehicle shall pay a separate Mobile Food Vehicle Vending License fee and be issued a separate Mobile Food Vehicle Vending License 'under this Chapter for each mobile food vehicle operated in the City of Troy.

(d) Mobile Food Vendors operating for sales purposes in the public Right-of­Way are allowed in all zoning districts defined in Section 1141.01(d-e) of the Codified Ordinances of the City of Troy, Ohio in accordance with 721.10(d){1 ). Mobile Food Vendors operating for sales purposes on private property are only allowed in Commercial and Industrial zoning districts as defined in Section 1141.01(d-e) of the Codified Ordinances of the City of Troy, Ohio in accordance with 721 .10(d){2), with the exception of land owned by the City of Troy or on land owned by educational institutions. Mobile Food Vendors operating for sales purposes on private property on land owned by educational institutions are allowed in all zoning districts defined in Section 1141.01(d-e) of the Codified Ordinances of the City of Troy, Ohio in accordance with 721 .10(d)(3). Mobile Food Vendors operating for sales purposes on city owned land are allowed in all zoning districts defined in Section 1141.01(d-e) of the Codified Ordinances of the City of Troy, Ohio in accordance with 721.10{d)(3).

(1) In the public Right-of-Way, a mobile food vehicle shall not remain stationary in one location for longer than one ( 1) hour while open for business and operating for sales purposes. This restriction does not prohibit a mobile food vehicle which is not open for business and not operating for sales purposes from being legally parked for a duration longer than one ( 1) hour. After a mobile food vehicle has been stationary in one location and operating for sales purposes for a period of one ( 1) hour, the mobile food vehicle must be moved to a location at least one hundred {100} yards from the previous location.

(2) On private property, land not deemed public Right-of-Way, City of Troy owned property or on land owned by educational institutions, a Mobile Food Vehicle shall not remain stationary in one location for longer than six (6) hours while open for business and operating for sales purposes, provided that Mobile Food Vehicles are setback a minimum of ten (10) feet from the public Right-of-Way and located in the rear yard as defined by Section 1133.02 (179) of the Codified Ordinances of the City of Troy, Ohio. If a rear yard does not exist on a property then the Mobile Food Vehicle shall be located opposite of the yard which serves as the front entrance of the building.

(3) On land owned by the City of Troy or by an educational institution, a Mobile Food vehicle shall not remain stationary in one location for longer than forty-eight ( 48) hours while open for business and operating for sales purposes, provided that Mobile Food Vehicles are setback a minimum of thirty (30) feet from the _public Right-of-Way and approved by the Director of Public Service and Safety.

(e) A mobile food vehicle shall not be open for business or operate for sales purposes within one hundred (100) yards of an eating place, carry out; eating place, drive-in; eating place No.1; or eating place No.2 as defined in Sections 1133.02 (71) through (74) of the Codified Ordinances of the City of Troy, Ohio, unless written approval is received from each business that falls within one hundred (100) yards of an eating place as described in this section, and approved by the Director of Public Service and Safety.

(f) While located upon a public street, all food or drink items shall be sold. offered for sale or dispensed only from the curb side of a mobile food vehicle .

(g) A mobile food vehicle shall be operated or parked so as not to obstruct or impede the normal movement of traffic. A mobile food vehicle shall be parked or stopped with the curb-side wheels parallel with and not more than twelve (12) inches from the curb when food items are sold or dispensed.

(h) Flashing lights shall be operated continuously at all times when a mobile food vehicle is parked, stopped, or otherwise open for business and operating for sales purposes on a public street so as to be clearly visible to drivers of other vehicles approaching such vehicle from the front or rear.

(i) The owner/operator of each mobile food vehicle licensed by the City of Troy shall comply with all provisions of federal, state and local laws and ordinances.

U) The owner/operator of any mobile food vehicle licensed by the City of :rroy shall comply with all notices, orders, decisions, and rules and regulations made by the Police Department of the City of Troy or any other City of Tray Department and/or Agency. "

SECTION Ill: That Section 721 .15 of the Codified Ordinances of the City of Troy, Ohio

is hereby enacted as follows:

any recognized educational , civic, religious or charitable organization, shall be exempt from the licensing provisions of this chapter. Additionally, authorized individual vendors and operators of mobile food vehicles conducting business at special community events sponsored by any recognized educational, civic, religious or charitable organization, shall be exempt from the licensing provisions of this chapter. However, those not required to obtain a Vendor License or a Mobile Food Vehicle Vending License shall be required to comply with Sections 721 .10 (d) through U), 721.11and721.12 hereinabove. City sponsored events shall not be required to comply with Section 721.10, as approved by the Director of Public Service and Safety."

We are providing the following for your information:

• The bid opening for the Fa9ade Improvements to 121 Public Square was held on Thursday, October 8. Two bids were received ranging from $67,245 - $69,500. Council authorized $65,000 for this project, which is from CDBG Funds. Staff is reviewing the bids.

• Major Project Update: o Sidewalk Program 8 - the work has been completed. Quantities are being

finalized in order to send letters to the property owners receiving new sidewalks through the City's contractor.

o Curbside Recycling Program for FY 2015-2017 was awarded to Rumpke of Ohio, Inc. The new 65 gallon recycling containers were delivered to residents and program started the week of October 6. Staff members continue to respond to residents who have questions or concerns related to the new containers.

o McKaig Road Improvement Phase 2 - effective June 15, McKaig Avenue was closed to through traffic from Monroe Street to Madison Street for the construction of the McKaig Road Improvement Project Phase 2. This area will be closed until mid-November, 2015. Access for residents in the construction area is being maintained. Stormwater main installation is complete and curbs were poured this week. Road base will proceed next.

o Marina Building - interior work progresses as the drywall is now complete in the fireplace room. Ceiling grids are placed in all but two of the rooms in which the HV AC duct work is being finalized. Electrical work continues throughout the building and some of the fixtures are now being installed. The materials for the front entry have arrived and the framing is underway. The concrete in front of the building has been placed and the paver placement will begin next.

o Treasure Island Park - plantings designed to prevent erosion and minimize maintenance on the island's slopes are scheduled to be placed in early November. Base work is complete for the parking areas and bike trails around the marina building. Paving is scheduled for late October for the first course of asphalt. Support posts are up for the amphitheater and the shelter house posts are underway.

o Streetscape (East Main Street between Walnut and Mulberry Streets) -work on the south side of the street is complete except for the delivery and setting of the traffic signal poles. Work on the north side of East Main Street is progressing. Traffic signal bases are being set and the contractor is waiting delivery of the poles which are scheduled for delivery in 2016. Staffis discussing temporary lighting with the contractor.

o Paving Program - the grinding work and resurfacing is complete. Restriping will commence with modifications to Adams Street's existing striping.

• The first round of leaf collection began on Monday, October 5 and is in full swing. Weather permitting, round 2 will begin on November 2. This information and a map are also posted on the web site.

• Fire Chief Simmons announced that on Sunday, October 18 the Fire Department will be dedicating their new fire engine at Fire Station 1. This will be celebrated with an "Open House" from 3:00 - 5:00 p.m. In an effort to highlight October as "National Fire Prevention Month," and educate the public, fire prevention information will be available along with Fire Department's inflatable smoke house.

• Hobart Arena has appointed David Kerg as Hobart Arena Concessions/Food and Beverage Manager effective October 19. Mr. Kerg comes to us from the Olive, an urban dive restaurant in the Oregon District, where he was the lead chef and kitchen manager.

• October 24, the Children's Halloween parade sponsored by the Noon Optimist Club will start at 9:45 a.m. at the parking lot of the Miami County Public Library. Costume judging will take place on Prouty Plaza. This will be followed by a downtown merchant trick-or-treat for the children. There is no rain location for the costume contest.

• As a reminder that Trick or Treat will be on Thursday, October 29, from 6-8 pm.

• In the next couple of weeks, DP&L's tree trimming vendor will begin trimming trees northwest of Troy, between Farrington Road and SR-41 and also between Stillwell Road and 1-75. DP&L representative Terry Meeks informed the City that they will be contacting, via phone, all customers affected by the tree trimming, and the tree company will also be making contact with each property owner prior to trimming the trees.

• Collected and transported 230 tons of residential trash since last report of 249 tons.

• Asphalted one water service and five areas marked for repair including seam repair on S. Dorset from W. Main to McKaig Road.

• Worked on mowing ditches and rights-of-way. • Used over 675 tons of asphalt on street repairs throughout the City. • Completed alley trimming operations. • Collected T-bags and brush. Several letters were sent out for non-compliant

brush piles. We are reminding citizens that brush must be bundled or placed in T-bags in order for it to be collected by the city. We also are reminding citizens that the Dye Mill Facility is open, and we encourage them to take their brush to that facility in lieu of placing it to the curb.

• Recycling program: The recycling program has begun and seems to be slowly catching on. We have had fewer calls after the first week of the program than we had before the program started.

Water Treatment Plant - Jeff Monce • For the month of September 2015, the WTP pumped a total of 111.525 million

gallons (MG) to our distribution system and customers in West Milton and parts of Miami County (avg. 3.718 MG/day). Total precipitation recorded at the WTP for Sept. was 1.13". Respective totals for Sept. in previous years are:

• 10 bulk water account holders withdrew a total of 122, 140 gallons from the WTP Bulk Water Station during the month of September, total revenue was $1,095.44.

• A total of 9,337,315 gallons were pumped to the Extra High Service pressure zone in northwest Troy by the EHS Booster Station in September, for an average daily consumption in that zone of 0.3220 MG.

• Magnetic door switches have been installed at all elevated towers and the EHS Booster Station. These sensors are tied into existing WTP alarm systems via microwave radio-linked SCADA to improve security at these locations. An alarm system for all hatches to the 4 MG finished water reservoir will be installed after evaluation of design options.

• Annual sampling of 19 monitoring wells within the 1-year and 5-year time of travel zones was completed. Samples will be analyzed by MASI Laboratories and thoroughly evaluated for any contaminants emerging in the aquifer. This sampling is part of Troy's early-warning system to detect pollutants in source water long before they can reach our production wells.

• Updates to the WTP Contingency Plan and Source Water Assessment Plan are being completed by the WTP Superintendent.

• Annual basin changeover was conducted on October 12. Train 2 clarifiers are in service and operating well. Train 1 will be drained this week with cleaning and inspection to begin as soon as possible.

• High Service Pump 3 was removed October 15 and will be completely refurbished.

Wastewater Treatment Plant - Tim Snider • The paving project at the plant is complete. • Vendor was on site to complete fourth quarter calibration of the plant gas

monitoring equipment. • Three staff members attended the Heavy Truck Driver Training refresher course,

provided by the City.

• Vendor completed the painting project on FST #3 and FST #5. • Staff completed repairs to south primary clarifier. This unit is now available for

operation. • Gravity sludge thickener #2 was put back into service and took gravity sludge

thickener # 1 out of service and cleaned. • Staff removed the motor from Race Drive pump #2. Motor has been taken to our

vendor to be re built. • Contractor took over operation of the biosolids dewatering and disposal

operations on October 1. • Completed the required preventive maintenance work orders. • September 14 marked the 1 year anniversary of single shift staffed operations

since the completion of the SCADA/ Automation project. Third shift was eliminated on May 31, 2014 and second shift was eliminated on September 14, 2014. As of September 14 this has resulted in 6,148 hours of unstaffed operations at the WWTP. During this time period there have been 22 call-ins, via the auto dialer system alerting staff to alarm conditions, totaling 50.5 hours of overtime at a cost of $2, 176.52. This has resulted in an overall savings of $234,435.40.

• Average Daily Effluent Flow for September was 3.58 MGD. • Average Daily Effluent Total Suspended Solids for September was 8.3 MG/L with

96.5% removal efficiency. • Average Daily Effluent C-BOD5 for September 9.3 MG/L with 95.5% removal

efficiency.

Council approved the ODOT LPA Agreement including accepting ODOT funding and to begin to acquire bike path according to federal regulations. The first report shows all permits that were issued by the Planning Division. The report contains the address and type of permit and separates the information by each ward. There were 25 permits issued during this time period.

The second report contains the address, type of concern, and a summary of the current status of on-going issues. Both open and closed concerns are listed and are separated by each ward.

As in the past, all costs associated with the removal of trash and elimination of noxious weeds will be invoiced to the property owner. If the property owner does not pay the invoice, the cost will be assessed to the property taxes.

NOTES:

1) The Economic Development Revolving Loan Fund (ED RLF) has larger loans, but usually long terms because it finances only capital assets. This is Troy's oldest loan program and in the past generated the most revenue. All projects must create at least one new job per $25,000 loaned. Due to increasing state/federal restrictions, no ED RLF loan has been taken since 2009.

2) The Downtown Business Building Repair Revolving Loan Fund (DBR) is for real estate assets, only. The DBR usually has longer terms, therefore less revenue. Prevailing Wage rules apply.

3) The Ohio Development Services Agency is in the process of changing CDBG requirements which is requiring the total combination of the ED RLF and the DBR by the end of this year. Sta1ting this year, any DBR-type projects will need to be reviewed in advance by the Ohio CDBG program mangers. The extra CDBG requirements probably will result in many fewer loans being made, as has happened with the original ED RLF program.

4) The combined cash balance of the ED RLF and the DBR is down to $53,000, which should be sufficient for the time being to avoid its recapture by the Ohio CDBG program managers.

5) The Small Business Development Revolving Loan Fund (SBD) is Troy's newest program. It does not have the federal Community Development Block Grant restrictions that affect the ED RLF and DBR loan programs. The SBD typically has smaller loans and shorter terms.

6) Brian & Karen Hammond and David & Melissa Kuo remain in default. Judgments have been obtained.

7) A $250,000 SBD loan to Clopay Building Products has been approved, but not yet disbursed.

8) A $850,000 DBR loan to Troy Community Works has been approved, with $199,900 disbursed.

9) Initial inquiries have been made regarding several other small business loans, but arc not yet firm projects.

A fire of undetermined origin in a loading dock area of a pallet construction company caused $75,000 damage to the structure and $75,000 damage to the contents.

Run #3912, September 24, 2015

A residential fire caused by an (undetermined) electrical source in a bedroom resulted in $30,000 loss to the structure and $5,000 loss to the contents.
