Best Practices For Protecting The Attorney-Client Privilege For In-House CounselIn-house lawyers play a trusted advisor role in the day-to-day activities of the company in a manner very different from outside counsel. Depending on the size of the company, in-house counsel might work with everyone from new hires to sales teams, to personnel performing internal business functions (e.g., Human Resources or Procurement), to the Audit Committee and the Board of Directors. In-house counsel are also brought into the thick of sensitive situations at the corporation, such as internal audit investigations, disputes, regulatory matters, and litigation. Protecting the attorney-client privilege is:

› Defining the privilege: Who is the attorney and who is the client?

› What is privileged? What are the best practices to make distinctions between business advice and legal advice? How can discoverable facts and privileged communications be distinguished?

› What are the best practices to take to attempt to preserve the attorney-client privilege in communications?

› What are the best practices to take to attempt to avoid waiver?

› How can in-house counsel prepare to address the privilege issues that arise during litigation and depositions?

› Dealing with special issues such as: Special Committees; Parents and Subsidiaries; Merger & Acquisitions; Disclosure to non-“control group” employees; and Accountants, Auditors, Bankers, and Consultants

Hilgers Graben is a boutique litigation firm founded by former “Big Law” attorneys specializing in complex commercial/intellectual property disputes around the country. We have also developed a cutting-edge e-discovery service using proprietary processes and technology to substantially reduce the cost of document reviews while increasing overall quality.

The firm’s litigation team is filled with former AmLaw100 attorneys, judicial law clerks, and graduates of top law schools. We have offices in Nebraska, Texas, and Colorado which support our nationwide trial practice. The firm is built on two ideas. The first is that clients want to pay for legal services and not non-legal overhead. By basing the core of its operations in Lincoln, Nebraska, we have substantially lowered our cost profile allowing us to offer the same level of attorneys and quality found at the “big firms” at roughly half the cost. The second is that innovation could create a law firm that provides better value in the marketplace. Where other industries produce innovations that make their products and services better and cheaper over time, the price of complex legal services seems to rise at a 5–10% annually because of nothing more than inertia and industry practice. Not us. We have grown our ranks and kept our already low rates basically flat over the past several years.

Our EDGE e-discovery service is comprised of W-2 employees who have been together for years and specialize in e-discovery. Our team will hit review speeds of 200 documents per hour (triple the industry standard). We have also partnered with a number AmLaw 100 firms to provide our budget-friendly e-discovery services as discovery counsel while the big firm provides the trial expertise.

Just some of the reasons why Hilgers Graben was named for the third straight year to the Inc 5000 “Fastest Growing Companies” list.

Managed Discovery is re-inventing the contract attorney review process to focus on the dual goals of cost efficiency and legal defensibility. We provide both a virtual review service featuring attorneys working remotely as well as a secure document review room for particularly sensitive matters. We are sharply focused on the defensibility of our review, ensuring that all of our services are managed by qualified attorneys, well prepared to provide affidavits or testimony in the event of any discovery challenge. Our U.S.-based attorney review is supervised by a former DOJ trial attorney with deep experience in the managed review process in addition to all market prominent, review software, so we’re platform neutral. We also utilize the latest technology security measures to limit the risks posed by any document review.

Recently announced, Managed Discovery launched a new Mainland China document review service, which includes both substantive review and compliance review (e.g., privacy and state secrets review). For security purposes, our China reviews take place either in a secure document review room or at the premises of the client or its international counsel. And the reviews are supervised by a senior partner in a highly respected PRC law firm with whom our team member has cooperated for over a decade.

Managed Discovery also offers a dynamic suite of e-discovery technology and services in support of our core document review service. Our U.S. e-discovery service is managed by an attorney technologist with long e-discovery experience and a deep familiarity with legal technology and defensible work flows.

Novus Law is a global legal services firm that finds the story of “what happened” in all types and sizes of disputes and investigations.

Corporate law departments get the early insight they need to make better decisions faster and resolve more matters early on because we deliver the story 3x to 5x sooner than is possible using the traditional approach to discovery.

Our clients reduce their overall costs by 25 to 35 percent and our fixed-fee structure results in $4 of savings for each $1 we receive because we eliminate the wasteful re-reading of documents. As they understand their matters earlier and more thoroughly, our clients often also reduce their indemnity spend.

Novus Law is neither an eDiscovery company, a technology solution, nor a law firm. We are unique.

We are lawyers, who as non-testifying consulting experts, use the measurably more accurate and efficient Novus One-Touch Process™ to examine, analyze, and organize evidence. We provide all of the witness and key issue files, fact analyses, chronologies, deposition summaries, and other work product that a client may need to pursue their legal strategy.

Our firm is an Association of Corporate Counsel Value Champion and the recipient of two global innovation awards from the College of Law Practice Management.
