Who is Consumer?

Consumer is generally understood as a person who uses or consumes goods or avails of any services.

According to consumer protection act any person who buy goods for a consideration,which has been paid or promised,or partly paid or partly promised,or under any scheme of deferred payment.

What is consumer Protection?????Consumer protection is government regulation to protect the interests of consumers, for example by requiring businesses to disclose detailed information about products, particularly in areas where safety or public health is an issue, such as food. Consumer protection is linked to the idea of consumer rights (that consumers have various rights as consumers), and to consumer organizations which help consumers make better choices in the marketplace.

They don’t follow their responsibilities.They don’t know their rights..Lack of knowledge.They are not aware of consumer protection

act,1986 and other acts like “the Sale of Goods act,1930 ,the Contract Act,1982 ,the Prevention of Food Adulteration Act,1954 ,the Standards of Weights and Measures,1976.

Why Problem arises against Consumer??

Consumer’s ResponsibilitiesBuy only standardised goods.We should look for ISI mark on

electronic goods,FPO mark on foods products,Hallmark on jewelry etc.

Follow manufacturer’s instructions and use the products safely.

Read labels carefully about prices,quality,weight,expiry date of the product.

Ask for cash memo.Avoid black marketing,hoarding etc.Respect the environment.Avoid waste,littering and

contributing to pollution.

WHO CAN FILE A COMPLAINT??? Any Consumer Any registered consumers association The Central Govt. or any State Govt. One or more Consumers,on behalf of

numerous consumers having the same interest.

A legal heir or representative of deceased consumer.

Redressal Agencies

1.District Forum - (a)It consists of a president and 2 other member

(b)the value of goods and services in question does not exceed Rs.2O lakhs

(c)if party is not satisfied with the order of district forum he can appeal before the state commission

2.State Commission - (a)It consists of a president and not less than 2 other member and one should be woman.

(b)the value of goods and services in question should exceed Rs.20 lakhs and does not Rs.1 crore.

(c)if party is not satisfied with the order of state commission can appeal before the national commission.

3.National Commission - (a)It consist of a president and at least 4 other members ,one should be woman

(b)the value of goods and services in question should exceed Rs.1 cr.(c)If party is not satisfied with the order of national commission can

appeal before supreme court.

Role of NGOs

Educating the general public about consumer right

Filing complaints in appropriate consumer court on behalf of consumers.

Encourging consumers to strongly protest and take an action against unscrupulous,exploitative and unfair trade practices of seller.

Carrying out comparitve testing of consumer products in accredited labolatories to test relative qualities of competing brands and puslishing the test results for the benefit of the consumer.
