Lewis Brisbois has assembled a premier group of attorneys with extensive experience in the various aspects of consumer privacy issues. They regularly counsel clients in developing guidelines for compliance with the Gramm-Leach-

Bliley Act (GLBA), Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), Health Insurance Portability and Accountability Act (HIPAA) as well as all state and local rules and regulations governing consumer privacy issues. These services include:

• Assessing and minimizing the risks of the misappropriation of consumer information to identify reasonably foreseeable internal and external risks to the security, confidentiality, and integrity of consumer information that could result in the unauthorized disclosure, misuse, alteration, destruction or other compromise of such information.

• Employee training and management to address changing circumstances and new developments in privacy laws and its application and enforcement.

• Network & information system integrity analysis to assess and minimize the risks of customer information compromise with respect to information technology systems, including, but not limited to, paper files, computers and servers, internet access, and back-up files.

• Contingency planning to address any foreseeable breaches of physical, administrative, or technical safeguards.

• Perform a cost-benefit analysis, and balance the size of the operation, the complexity of the private information used, the volume of the information, and the sensitivity of the data, with the practicability of the available measures.

• Continued compliance counseling to determine what, if any, other measures should put in place to protect or secure sensitive information.

Lewis Brisbois has successfully litigated a wide variety of FDCPA, FCRA, HIPAA and TIL issues, including class action defense. The members of our Consumer Privacy Group have extensive experience defending individuals and companies that have been sued for violating various consumer statutes.

Firm members are experienced in handling litigation in both State and Federal Courts through trial and on appeal. Our attorneys are licensed to practice in multiple State and Federal jurisdictions and also represent professionals in administrative proceedings before the N.A.S.D. and many different State agencies.

Gordon Calhoun advises insurance companies, hospitals, health maintenance organizations and

governmental entities about their obligations to protect privacy in the context of responding to civil

discovery and subpoenas. This includes state and federal medical privacy laws, e.g., HIPAA and

state laws dealing with mental health, sexually transmitted diseases, etc., financial records, e.g.,

Gramm-Leach-Bliley, insurance records, e.g., California Insurance Code section 791.13, among

other types of personal records. He also advises clients with multinational records sources about

the different regulatory regimens that may limit or prohibit cross border sharing of information.

This also involves advising clients about what tho do when a data breach occurs. This can subject a

client to state and federal exposure in court and before administrative agencies like the FTC.
