CITY OF KAMLOOPS

BYLAW NO. 23-30 (AS AMENDED)

A BYLAW TO REGULATE TRAFFIC, PARKING, AND THE USE

OF STREETS, WITHIN THE CITY OF KAMLOOPS

The Council of the City of Kamloops, in open meeting assembled, enacts as follows: 1. This Bylaw may be cited as “City of Kamloops Traffic Bylaw No. 23-30, 1981”. 2. Former City of Kamloops Bylaw No. 23-1; City of Kamloops Bylaws No. 23-27 and

24-12; former Town of Valleyview Bylaw No. 28; former District of Brocklehurst Bylaw No. 16; former District of Dufferin Bylaw No. 17, and all amendments thereto are hereby repealed.

PART I - DEFINITIONS In this bylaw, unless the context otherwise requires, the expressions and definitions contained within the “Motor Vehicle Act”, the “Motor Carrier Act”, the “Highway Act”, the “Municipal Act”, the “Interpretation Act” and the “Commercial Transport Act” and regulations thereto, shall be applicable and these additional interpretations shall prevail throughout:

“ACCESS” means a driveway intended for ingress and/or egress to abutting property from a highway.

“ACCESS PERMIT” means a permit which authorizes provision of access to an abutting property from an adjacent highway.

“ANGLE PARKING” means the parking of a vehicle other than parallel to a curb.

“ARTERIAL STREET”

means a highway classified as arterial by the Official Street Classification Map of the City.

“BIKEWAY” means the portion of the highway intended either exclusively or partially for use by cyclists.

(23-72) “BLOCK FACE” means the block or portion of a highway at which a vehicle is parked, extending to the intersections of the highway beyond either end of the vehicle.

(23-73) “BOULEVARD” means that portion of a highway or street between the curb line and the adjoining property, or the lateral line of a roadway or lane and the adjoining property, be it either side, front and/or back. It includes, but is not limited to, sidewalks, flat land, slopes, and ditches.

“BUS” means a motor vehicle which is designed, constructed and used for the transportation of more than nine passengers.

“BUS ROUTE SIGN” means a sign designated and issued by the Urban Transit Authority at which public transit buses may stop and allow the ingress and/or egress of passengers.

“BUS STOP ZONE” means that entire length of the curb lane within an area extending from 20 m on the near side to 7.5 m on the far side of any bus route sign indicating a bus stop or any length of curb area delineated by a red curb.

“BYLAW ENFORCEMENT OFFICER”

means the person appointed by the City and any person delegated to assist him in enforcing municipal laws and regulations as set out in this bylaw.

“CHIEF BUILDING INSPECTOR”

means the person appointed as such by the City, and any person delegated to assist him in carrying out his duties under this bylaw.

“CITY” means the City of Kamloops.

“COIN” means a lawful coin of Canada or U.S.A.

“COLLECTOR STREET”

means a highway classified as collector by the Official Street Classification Map of the City.

(23-46) “COMMERCIAL VEHICLE”

has the same meaning as commercial vehicle in the Commercial Transport Act.

“COUNCIL” means the Council of the City.

“CURB” means the raised structural element which may be installed at the outside edge of a highway or median parking area, primarily for a gutter.

(23-46) “DESTINATION” means the location indicated on a driver’s bill of lading.

“DOUBLE PARKING”

means the standing of a vehicle in the travelled portion of the highway, adjacent to a parked vehicle, or parking space.

“FIRE CHIEF” means the person appointed as such by the City and any person delegated to assist him in carrying out his duties under this bylaw.

“FIRE ZONE” means that portion of a highway which is contained within the projected extension of the lateral boundaries of every parcel of land upon which any Fire Hall is constructed and in which any equipment for use in fighting fire and/or other emergency uses is held, stored or maintained by the City.

(23-46) “GROSS VEHICLE WEIGHT”

means the number of kilograms derived by adding the weights on all the axles of a commercial vehicle.

“HANDICAPPED ZONE”

means that portion of a highway designated by a traffic control device for the exclusive use of vehicles displaying an authorized handicapped identification label.

“HAZARDOUS MATERIALS”

Repealed by Bylaw 23-36

“HIGHWAY” includes all public streets, roads, ways, trails, lanes, bridges, trestles, ferry landings and approaches and any other public way or right-of-way designed or intended for or used by the general public for the passage of vehicles.

“HOLIDAY” means Sunday and any officially proclaimed statutory holiday as well as any other day proclaimed or declared by the Federal, Provincial or Municipal governments as a holiday.

“LAND” means land owned by the City.

“LANED HIGHWAY” means a highway or the part of a highway that is divided into two or more marked lanes for the movement of vehicular traffic in the same direction.

“LANEWAY” means a service road along the back of residential or commercial property not exceeding 8 m in width.

(23-46) “LICENSED GROSS VEHICLE WEIGHT”

means the maximum gross vehicle weight for which a commercial vehicle is licensed.

“LIMITED PARKING”

means regulated or restricted parking.

“LOADING ZONE” means that portion of a highway designated by a traffic control device for the exclusive use of vehicles loading or unloading passengers or property.

“LOCAL STREET” means a highway classified as local by the Official Street Classification Map of the City.

(23-73) “METERED SPACE” means that portion of a highway or land marked exclusively for the parking or standing of vehicles at which a parking meter or a pay station has been installed and a traffic control device regulates such parking requiring the operator of the vehicle to pay a fee for parking.

“METERED PERIOD”

means the period between 9:00 hours and 18:00 hours of every day except Sunday and holidays for meters on any street or any portion of the street.

(23-73) “METERED ZONE” means any highway or land marked exclusively for the parking or standing of vehicles in respect of which a parking meter or pay-by-licence plate system or a pay-by-phone system may be established and maintained to collect fees for parking vehicles in such metered zones.

“OFFICIAL STREET CLASSIFICATION MAP”

means the street classification map adopted by Council.

“ONE WAY STREET”

means a highway designated as one way, by traffic control devices, upon which vehicles shall move only in the direction indicated.

“OPERATOR” means any person who drives, operates, propels or is in physical control of a vehicle, and shall be deemed to include the person in whose name the vehicle is registered.

“OVERPARKED” means

(i) at a metered space the standing of a vehicle, whether occupied or not, when the signal on such meter indicates the parking time has expired, or indicates violation.

(ii) at an unmetered space the standing of a vehicle, whether occupied or not, contrary to a traffic control device.

(23-73) (iii) at a metered space the standing of a vehicle, whether occupied or not, when the time purchased at a parking pay station or pay-by-phone for that vehicle has expired.

“OWNER” means as applied to a vehicle:

(i) the person who holds the legal title to the vehicle; or

(ii) the person who is entitled to be and is in possession of the vehicle; or

(iii) the person in whose name the vehicle is registered.

“PARADE” means the procession or group of pedestrians (except members of the Armed Forces) numbering more than twenty, standing, marching or walking on any street or sidewalk, or any group of vehicles numbering ten or more (except funeral processions) standing or moving on any street.

“PARK” when prohibited, means the stopping or standing of a vehicle, whether occupied or not, upon a highway, except when standing temporarily for the purpose of, and while actually engaged in loading or unloading.

(23-73) “PARKING COUPON DISPENSER”

Repealed October 8, 2013.

“PARKING CONTROL SUPERVISOR”

means a person appointed by the City and any person delegated to assist him in carrying out his duties under this bylaw.

(23-73) “PARKING METER” means a device to measure the time during which a vehicle may legally occupy a metered space.

“PARKING STALL” means a portion of a highway or City parking lot indicated by a traffic control device as a parking place for one vehicle.

(23-73) “PAY-BY-LICENCE PLATE”, or grammatical variations of that term

means a system established by or on behalf of the City under which the operator of a vehicle may pay the fee for parking the vehicle in a metered space remotely at a pay station in accordance with the requirements of that system as indicated on or at the pay station.

(23-73) “PAY-BY-PHONE”, or grammatical variations of that term

means a system established by or on behalf of the City under which a person may: i) set up a cash or credit card account; and ii) pay the fee for parking a vehicle in a metered space remotely by

telephone in accordance with the requirements of that system.

(23-73) “PAY STATION” means an electronic appliance designed for the purpose of gauging and indicating a time within which the operator of a vehicle may park the vehicle in a metered space.

“PERMIT” means a document in writing issued pursuant to this bylaw.

“PERSONS” means human beings, male or female, and includes a company or body corporate.

“PEACE OFFICER” means any member of the Royal Canadian Mounted Police and any person delegated to assist him in carrying out his duties under this bylaw.

“PUBLIC TRANSIT BUS”

means any vehicle operated under the auspices of the Urban Transit Authority for use by general public.

(23-64) “PUBLIC WORKS AND UTILITIES DIRECTOR”

means the person appointed as such by the City, and any person delegated to assist him in carrying out his duties under this bylaw.

“RECREATION VEHICLE”

means a chassis-mounted camper, motor home, holiday trailer, or boat trailer intended exclusively for recreational use.

“RESERVED PARKING”

means a parking stall reserved for a special use as indicated by a traffic control device.

“RESIDENTIAL AREA”

means any area zoned for residential land use in the Zoning Bylaw.

“RESIDENTIAL PARKING PERMIT”

means a permit which authorizes the parking of a vehicle on a highway contrary to a traffic control device issued pursuant to this bylaw.

“ROAD CLOSURE PERMIT”

means a permit which authorizes the closure of a highway or portion of a highway.

“SHOULDER” means the portion of the highway between the travelled portion of an uncurbed highway and the ditch; or if there is no ditch, the area between the travelled portion of the highway and the boulevard.

“SIDEWALK” means the portion of a highway intended exclusively for use by pedestrians.

“SIDEWALK CROSSING”

means the alteration portion of a sidewalk or curb for passage of vehicular traffic.

“TIME” means either Pacific Standard Time, or Pacific Daylight Saving Time, whichever is proclaimed to be in effect by the Province of British Columbia.

“TRAFFIC NOTICE” means a Notice of Traffic or Parking Violation.

(23-73) “TRAFFIC CONTROL DEVICE”

means a sign, traffic control signal, line, parking meter, pay station, pay and display, marking, space, barricade, or other device, placed or erected under this bylaw.

(23-65) “TRAILER” means a vehicle without motor power designed to be drawn by, or used in conjunction with, a motor vehicle and includes a semi-trailer as defined in the Commercial Transport Act

(23-46) “TRUCK ROUTE” means highways that are listed on Appendix ‘A’ and shown for convenience purposes on Appendix ‘B’, both attached to and forming part of this bylaw, on which vehicles in excess of a licensed gross vehicle weight of 10,900 kg may travel at any time.

“WALKWAY” means a public way designed and intended exclusively for use by pedestrians.

PART II: AUTHORITIES

PUBLIC WORKS AND UTILITIES DIRECTOR

201. The Public Works and Utilities Director by himself or anyone under his direction is hereby authorized and empowered to order to place, replace or alter traffic control devices at any location he may determine to give effect to the provisions of the Motor Vehicle Act and this bylaw.

PEACE OFFICERS 202. (1) Peace Officers, or any person duly authorized, may:

(a) issue traffic notices for violations of this bylaw;

(b) direct and regulate traffic in any manner deemed necessary and in doing so, may disregard any traffic control device;

(c) impound any vehicle, trailer or cycle that is in violation of this bylaw;

(d) require the driver of any vehicle to weigh same at any weigh scale forthwith.

FIRE CHIEF 203. (1) The Fire Chief, or any person duly authorized, may:

(a) direct and regulate traffic in any manner deemed necessary and in doing so, may disregard any traffic control device;

(b) impound if necessary for the purpose of carrying out required duties, any vehicle or trailer;

(c) designate in any manner, a line or lines near the location of a fire or other emergency, beyond which the public shall not pass.

BYLAW ENFORCEMENT OFFICER

204. (1) The Bylaw Enforcement Officer, or any person duly authorized, may:

(a) issue traffic notices for violations of this bylaw;

(b) place temporary “No Parking” signs and barricades or other applicable traffic control devices:

(23-73) (c) hood, or otherwise temporarily remove from service a parking meter or pay station;

(d) issue parking permits for residential parking, special vehicle use, or other purposes which may be approved, from time to time;

(e) impound any vehicle, trailer or cycle in violation of this bylaw.

PARKING CONTROL OFFICER

205. (1) The Parking Control Officer, or any person duly authorized, may:

(a) issue traffic notices for violations of this bylaw;

(b) place temporary “No Parking” signs and barricades or other applicable traffic control devices;

(23-73) (c) hood, or otherwise temporarily remove from service a parking meter or pay station;

(d) issue parking permits for residential parking, special vehicle use, or other purposes which may be approved, from time to time;

(e) impound any vehicle, trailer or cycle in violation of this bylaw.

PART III: GENERAL TRAFFIC REGULATIONS

TRAFFIC CONTROL DEVICES

301. Notwithstanding any other provisions of this bylaw, all traffic control devices installed in the City shall be deemed to be duly authorized traffic control devices under this bylaw.

CONFORMANCE 302. No person shall park, drive or operate a vehicle or cycle, in contravention of a traffic control device.

DAMAGE TO DEVICES

303. No person shall drive or walk on or over a newly painted line or marking, nor remove or alter any traffic control device.

OBEY COMMANDS 304. Every person shall at all times comply with any lawful order, direction, signal or command made or given by a police officer, bylaw enforcement officer, fireman, flagman, ambulance attendant, or school patrol.

SPEED LIMITS HIGHWAY

305. No person shall operate a vehicle on a highway at a greater rate of speed than 50 km/h unless otherwise posted.

SPEED LIMITS LANEWAY

306. No person shall operate a vehicle on a laneway at a greater rate of speed than 20 km/h.

SPEED LIMITS CONSTRUCTION

307. No person shall operate a vehicle within a construction zone at a speed greater than 30 km/h unless otherwise posted.

DAMAGE TO SIDEWALKS

308. (1) No person operating a vehicle shall park, drive in, over or upon any walkway, sidewalk, curb or boulevard so as to encumber, obstruct, or damage the same.

(2) When a sidewalk crossing is not available, crossing by a vehicle will be permitted upon adequate provision being made to protect the sidewalk or boulevard from damage by the use of suitable planking or other material, having due consideration for the size and weight of the vehicle and load.

BLOCKING INTERSECTIONS

309. No person operating a vehicle shall block an intersection or a marked crosswalk, notwithstanding any traffic control signal.

VEHICLE WHEELS 310. (1) No person shall, without a permit, operate on a highway a vehicle having wheels, tires, or tracks constructed or equipped with projecting spikes, cleats, ribs, clamps, flanges, lugs, or other attachments or projections which extend beyond the tread or traction surface of the wheel.

(2) Nothing in this section is intended to prohibit the use of snow chains or studded tires during the period from October 1 in any calendar year to April 30 of the following year.

TRUCK ROUTES 311 (1) The highways shown in Appendix “A” attached to and forming part of this bylaw are hereby designated as truck routes.

(2) Every person operating a truck exceeding the GVW of 10,900 kg upon a highway not classified as a truck route shall travel by the closest and most direct route to the destination of the trip upon entering or leaving the truck route.

LOAD LIMITS 312. No person shall, without a permit issued under authority of this bylaw and subject to the provisions of this bylaw, operate on a highway a vehicle or combination of vehicles and trailers having a weight not conforming to the requirements of the Commercial Transport Act and Regulations thereto.

VEHICLE SIZE 313. No person shall, without a permit, and subject to the provisions of this bylaw, operate on a highway a vehicle or combination of vehicles and trailers having a size not conforming to the requirements of the Motor Vehicle Act and Commercial Transport Act and Regulations thereto.

TRAFFIC AND LOAD RESTRICTIONS

314. Where in the opinion of the Public Works and Utilities Director any highway is liable to damage through extraordinary traffic thereon, he may regulate, limit or prohibit the use of the highway by any person operating or in charge of the extraordinary traffic or owning the goods carried therein or the vehicles used therein.

OVERLOAD OVERSIZE PERMIT

315. (1) Overload and/or Oversize Permits may be issued to persons transporting extraordinary commodities.

(2) Applications are processed through the Engineering Division.

(3) Permit Cost - No charge, except for any direct costs incurred due to utility relocation.

HIGHWAY CLOSURE PERMIT

316. REPEALED BY BYLAW 23-43.

CYCLES 317. (1) No person shall ride a bicycle on a sidewalk or walkway.

(2) No person shall leave a cycle on a highway or public place in a position which obstructs the free movement of pedestrian or vehicle traffic, and where a cycle is found as stated herein, the said cycle may be impounded forthwith.

(3) Cycles impounded will be sold at public auction after 90 days, unless claimed by the owner.

DRIVING ON BIKEWAY

318. (1) No person shall ride, drive or lead an animal, or move, drive, run, propel, or park any vehicle along, over or across any bikeway except at bikeway crossings specifically constructed for vehicular traffic.

(a) Light carriages or chairs designed for the convenience of children or invalids may be operated on a bikeway.

(2) All cyclists must yield right-of-way to any pedestrian, light carriages or chairs designed for the conveyance of children or invalids stationed or standing upon crossings or proceeding along any bikeway.

PROOF OF PAYMENT

319. Proof of Payment for any parking or traffic notice shall be an official receipt obtainable at City Hall.

COMMERCIAL PARKING PERMITS

320. (1) Commercial parking permits may be issued annually on request to the owner of a commercial vehicle upon payment of the required fee, unless the Parking Permit issued to such owner has been revoked within twelve calendar months of the application for such permit.

(2) Permits may be issued to the owner of a vehicle which is used by a business established within the boundaries of the City and who complies with the following provisions:

(a) Holds a current licence plate under the current City “Commercial Vehicle Licensing Bylaw”.

(b) The vehicle is clearly marked with permanent signs painted on the body, covering an area of not less than .05 m² on each side.

(c) The business is licensed under the categories of Schedule “A” attached to the City of Kamloops Business Licence Bylaw.

(3) The permit so issued shall be valid only for the year in which it is issued.

(4) Such permit may be revoked at any time, and a proportionate amount of the fee paid covering the period to the end of the year for which the permit was originally issued shall, upon application therefore and upon surrender of such permit, be refunded to the person to whom the permit was issued.

(5) (a) A Parking Permit may be transferred from one commercial vehicle to another providing all such vehicles are owned by the applicant for the permit. Such permit must be visible through the windshield when required for use.

(b) A list of vehicle licence numbers which are covered by a permit must be submitted to the Parking Control Office at time of application for a permit.

(23-67) (6) (a) All commercial vehicles displaying a valid 15 Minute Commercial Parking Permit may be parked for up to fifteen (15) minutes at a metered space or where limited parking is designated in the City at any one time;

(b) With the exception of 6 (c) below, all commercial vehicles displaying a valid Two (2) Hour Commercial Parking Permit may be parked for up to Two (2) hours at a metered space or where limited parking is designated in the City at any one time.; and

(c) Two (2) Hour Commercial Parking Permits are not valid on Victoria Street.

(23-67) (7) (a) The charge for a 15 Minute Commercial Parking Permit shall be One Hundred Dollars ($100) per annum; and

(b) The charge for a Two (2) Hour Commercial Parking Permit shall be Two Hundred Fifty Dollars ($250) per annum.

UTILITY PARKING PERMIT

321. (1) Utility Parking Permits may be issued annually on request, to Federal and Provincial Government Departments or agencies, Crown corporations and utility service organizations.

(2) All utility vehicles displaying a valid parking permit may be parked for up to four hours at a metered space or where limited parking is designated in the City at any one time.

(23-57) (3) The charge for such Parking Permit shall be One Hundred Dollars ($100) per annum.

OFFICIAL PARKING PERMIT

322. (1) Official Parking Permits may be issued annually to persons engaged in duties directly related to the administration of the City in an official or service capacity.

(2) Applications are processed through the Bylaw Enforcement office and permit holders must supply the appropriate vehicle licence plate number.

RESIDENTIAL PARKING PERMIT

323. (1) Residential Parking Permits may be issued annually on request to homeowners in areas of the City where limited parking restrictions are in force.

(23-66) (2) Two permits may be issued for each residence or lot, and one additional permit may be issued for every 8 m of highway frontage of a residence or lot with highway frontage that exceeds 16 m.

(3) Permit Cost - No charge.

COURTESY PARKING PERMIT

324. (1) Courtesy Parking Permits may be issued to persons from out of town attending conventions, seminars or other activities where large numbers of people are staying temporarily in the City.

(2) Applications will be in writing and must be received at least one month before the event is to take place.

(3) Permit Cost - No charge.

EXEMPTIONS 325. (1) The operator of any of the following vehicles shall be exempt from the provisions of Sections 507 and 611 of this bylaw:

(a) Vehicles identified by sign or insignia as belonging to the City;

(b) Vehicles having attached to the windshield a permit issued under Sections 322 and 324.

(2) It shall be unlawful for any person to display on any vehicle any card, sticker or certificate purporting to provide for any exemption from the provisions of this bylaw unless such card, sticker or certificate has been duly authorized as set out in this part.

(3) The operators of taxicabs may use a metered space without charge for the period of time actually required for taking on or discharging passengers, such period of time not to exceed two (2) minutes.

(23-46) (4) Public service vehicles including, but not limited to, municipal, transit and school buses are exempt from restricted truck routes limiting access to vehicles over a licensed GVW of 10,900 kg.

(5) The holder of an authorized handicap permit may, when that permit is properly displayed on a vehicle, park at any metered space for the maximum period of time indicated by the traffic control device.

(6) The operator of a vehicle bearing a veteran licence plate shall be exempt from the provisions of Section 611 for the maximum period of time indicated by the traffic control device.

REMOVAL OF TRAFFIC NOTICES

326. No person, other than the owner or operator of a vehicle, shall remove from a vehicle any traffic notice issued under the authority of this bylaw.

IMPOUNDMENT OF VEHICLES

327. (1) A Peace Officer finding a vehicle unlawfully occupying any portion of a highway or public place, may detain, remove or impound such vehicle, and thereupon shall cause it to be taken to a place of storage.

(2) All costs and charges for the removal, care, or storage of a motor vehicle removed under this bylaw shall be paid by the owner of the motor vehicle, and shall be a lien thereon in favour of the keeper of any repair shop, garage or storage place in which that motor vehicle is stored, and the same may be enforced by him in the manner provided by the Repairers Lien Act or the Warehouse Lien Act.

REGULATED PARKING ZONES

328. All highways and City parking lots, where parking is permitted or restricted are hereby designated as regular parking zones and traffic control devices may be placed from time to time to indicate such regulations or restrictions.

PART IV: PEDESTRIAN REGULATIONS

CROSSING HIGHWAYS

401. No pedestrian shall stand on the travelled portion of a highway while waiting to cross a highway.

ENTERING ROADWAY

402. No pedestrian shall leave the curb, or other place of safety and walk or run into the path of a vehicle that is so close that it is impractical for the driver to stop.

BUS STOP 403. No pedestrian shall cross a highway in front of a bus which has stopped to load or unload passengers except at an intersection controlled by a traffic control signal.

WALKING ON ROADWAY

404. No pedestrian shall walk on the travelled portion of a highway if a sidewalk or shoulder or other space is available as a walking area.

CROSSWALKS 405. No pedestrian, crossing a highway where marked crosswalks exist, shall cross outside the limits of the markings.

TRAFFIC CONTROL SIGNAL

406. No pedestrian shall cross a highway in a crosswalk in contravention of a traffic control signal.

HITCHHIKING 407. No pedestrian shall stand upon or walk along a travelled portion of the highway for the purpose of soliciting a ride.

WALKING ON HIGHWAYS

408. Every pedestrian crossing a highway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall give the right of way to all vehicles on the highway.

PART V: PARKING REGULATIONS

UNLAWFUL PARKING

501. (1) No person shall park a vehicle in any public place unless such person shall comply with all conditions of this bylaw and other regulations posted by traffic control devices.

(2) (a) Where a motor vehicle or trailer is left, without the consent of the occupier of private property on such private property in the City, the owner of a motor vehicle or trailer shall be deemed to have authorized and empowered the occupier to be his agent for the purpose of towing the motor vehicle or trailer to a place of storage and of storing it;

(b) The agent has a lien against the motor vehicle or trailer for all reasonable advances made or charges incurred in connection with the towing and storing of the motor vehicle or trailer in the course of the agency;

(c) The procedure respecting enforcement of the lien shall be governed by the “Warehouse Lien Act”.

TIME LIMITS 502. Notwithstanding any other provisions of this part, no person shall park a vehicle on any highway for more than forty-eight (48) hours continuously.

(23-73) PAY AND DISPLAY PARKING

503. No person operating a vehicle shall park such vehicle in a facility controlled by a parking pay station at any time during the hours, when according to traffic control devices displayed in the vicinity, such device is in operation unless:

(a) Payment has been deposited in the pay station in the amount and in the manner prescribed; and

(b) When requiring a coupon to be displayed, the coupon shall be obtained from the pay station and conspicuously displayed in or upon such vehicle at all times while it is so parked.

PARKING GAP 504. No person, where vehicles are parked parallel to the edge of the roadway, shall park a vehicle closer than 1 m from any other parked vehicle.

LANE PARKING 505. (1) Whenever access can be had to any laneway, all deliveries or collections of goods to or from any commercial building shall be made therefrom.

(2) No person shall park a vehicle in a laneway unless he is actively engaged in the loading or unloading of goods from a vehicle in which case parking will be permitted for a period of up to fifteen (15) minutes, and such vehicle shall be parked in a manner so as to not block the laneway entirely.

(3) No person shall park a vehicle in a laneway for the purpose of loading and unloading where a loading zone is provided on site.

PROHIBITED PARKING

506. (1) Except when necessary to avoid conflict with traffic or to comply with the law or the directions of a peace officer or traffic-control device, no person shall stop, stand, or park a vehicle;

(a) on a sidewalk or boulevard;

(b) (i) in front of a public or private driveway in a residential district;

(ii) in front of nor within 2 m of a public or private driveway in a commercial or industrial zone.

(c) within an intersection;

(d) within 5 m of a fire hydrant measured from a point in the curb or edge of the highway which is closest to the fire hydrant;

(e) on a crosswalk;

(f) within 6 m of the approach side of a crosswalk;

(g) within 6 m upon the approach to any flashing beacon, stop sign, or traffic-control signal located at the side of a highway;

(h) within 6 m of an intersection;

(i) within 15 m of the nearest rail of a railway crossing;

(j) upon any highway for the purpose of

(i) displaying a vehicle for sale;

(ii) advertising, greasing, painting, wrecking, storing, or repairing any vehicle, except where repairs are necessitated by an emergency;

(iii) displaying signs;

(iv) selling any product.

(k) alongside or opposite a highway excavation or obstruction when stopping, standing or parking obstructs traffic;

(l) upon a bridge or other elevated structure on a highway, or within a highway tunnel, except as permitted by a traffic-control device;

(m) (i) on a highway in such a manner as to obstruct or impede the normal flow of traffic;

(ii) or on a marked lane of a laned highway.

(n) in a place in contravention of a traffic-control device that gives notice that stopping, standing, or parking is there prohibited or restricted;

(o) in such a manner as to obstruct the visibility of any standard traffic sign.

(2) No person shall move a vehicle that is not lawfully under his control into any of the places mentioned in Subsection (1).

(23-73) LIMITED PARKING AREAS

507. No person shall stop, stand, park or over-park a vehicle on a highway, for any length of time, in excess of the maximum period of parking time posted by a traffic control device.

PARKING DISTANCE FROM CURB

508. (1) No person shall park a vehicle on a highway except on the right-hand side thereof, and the right-hand wheels shall be not further than 30 cm from the face of the curb.

(2) On any one-way highway, a person may park on the left-hand side of the highway, in the same direction as the normal flow of traffic, however the left wheels shall be not further than 30 cm from the face of the curb.

DOUBLE PARKING 509. No person shall double park a vehicle on a highway.

TRAILER PARKING 510. No person shall park any trailer upon any highway unless in emergency situations or the trailer is attached to a vehicle by which it may be propelled or drawn.

SCHOOL AND PLAYGROUND ZONES

511. No person shall park a vehicle on a highway on the side adjacent to a school or playground where such school or playground is unfenced, or within 8 m from an opening in a fenced school or playground, between 8:00 hours and 17:00 hours in a school zone on days when school is normally in session, and between dawn and dusk in a playground zone on any day.

(23-59) LOADING ZONES 512A No person shall park a vehicle in a loading zone unless he is actively engaged in the loading or unloading of goods or passengers from a vehicle, and then the maximum duration of parking shall be ten (10) minutes.”

COMMERCIAL LOADING ZONES

512B No person shall park or stop a vehicle in a commercial loading zone except:

(i) for a period not exceeding five (5) minutes for the purpose of and while actively engaged in the loading or unloading of passengers and where the operator must remain with the vehicle;

(ii) for a period not exceeding fifteen (15) minutes for the purpose of and while actively engaged in the loading or unloading of merchandise or material, and such vehicle displays a current Commercial Parking Permit.”

BUS STOP ZONE 513. No person shall stop or park a vehicle in a bus stop zone.

HANDICAPPED 514. No person shall park a vehicle in a parking space designated for use by handicapped persons, unless such vehicle displays a valid handicap numbered S.P.A.R.C. certificate or other authorized certificates.

RESIDENTIAL PARKING PERMIT

515. No person shall park a vehicle on a highway in a residential area contrary to a traffic control device unless such person has acquired an authorized Residential Parking Permit, and such permit is displayed on the vehicle, and the vehicle is parked in accordance with the conditions of the permit.

WEIGHT RESTRICTIONS

516. Notwithstanding any other provisions of this bylaw no person shall park any vehicle having a gross vehicle weight exceeding 5,500 kg, or a length in excess of 7.5 m on a local street within a residential area for a consecutive period longer than two (2) hours.

HAZARDOUS MATERIALS

517. Repealed by Bylaw No. 23-36.

(23-70) UNLICENSED VEHICLES

518. No person shall park a vehicle or trailer on any highway, boulevard, sidewalk, or other public place without having a valid licence, and a numbered plate affixed to and issued for the lawful operation of the vehicle or trailer upon a highway.

(23-70) BOAT LAUNCH FACILITIES

519. No person shall park a vehicle or trailer at any boat launch facility in contravention of a traffic-control device that gives notice that stopping, standing, or parking is prohibited or restricted.

(23-72) BLOCK FACE RESTRICTION

520. No person shall park a vehicle at any non-metered block face at which it was previously parked, until not less than two (2) hours has passed since the vehicle last occupied that block face.

(23-73) PART VI: METERED PARKING REGULATIONS

(23-60) (23-73)

METERED FEES 601. The fee for parking in any metered space shall be such amount as shown upon the parking meter or pay station. The words ‘25¢ Piece’, ‘One Dollar’, and ‘Two Dollars’ shall be construed as meaning ‘quarter’, ‘loonie’, and ‘toonie’, respectively.

APPLICABLE METER

602. The parking meter applicable to a metered parking space shall be the meter designated by an arrow or other indication shown on the meter head or post.

(23-73) LAWFUL PAYMENT 603. No person shall insert any object in a parking meter or a pay station other than a lawful coin of Canada or USA, a credit card, or other payment methods accepted by the City.

(23-53) METER OPERATION

604. Every person parking a vehicle in a metered parking space shall immediately after parking the vehicle, deposit a coin in the appropriate meter as required, and thereupon the parking stall may be lawfully occupied by such vehicle during the period indicated by the timer contained in the meter head.

(23-73) UNEXPIRED TIME 605. Repealed October 8, 2013.

(23-73) REPEAT METERING PROHIBITED

606. Upon expiration of the time paid for, no person shall purchase additional time in the same metered space beyond the maximum time indicated by a traffic control device. The depositing of each additional payment after expiration of the maximum time shall constitute a separate offence under this bylaw.

PARKING SPACE OCCUPANCY

607. No person, where parking spaces are designated by traffic control devices, shall park a vehicle so as to occupy more than one stall, unless paying for two (2) stalls.

(23-73) FAULTY METERS 608. Repealed October 8, 2013.

(23-73) RESERVED PARKING

609. (1) No unauthorized person, when a metered space has been reserved by a traffic control device, shall park a vehicle in that parking stall.

(23-73) (23-67)

(2) Every person, where a metered space is reserved for the benefit of that person, shall pay a fee of Fifteen Dollars ($15.00) per day or part of a day for each day, other than Sundays or holidays, that the metered space is reserved.

TEMPORARILY OUT OF USE

610. No person shall park a vehicle in a metered space that has been temporarily taken out of use as a parking space by the placement of an appropriate traffic control device.

(23-73) EXPIRED TIME 611. Every operator of a vehicle who permits such vehicle to be, or remain, in a metered space when authorized parking time has expired, shall be deemed to be overparked and shall be guilty of an infraction of this bylaw.

(23-73) PLACING PARKING METERS

612. The Parking Control Supervisor is hereby authorized to mark out metered spaces in all metered zones in the City and to place and install parking meters or pay stations in each metered zone.

TIME LIMITS 613. Notwithstanding any other provisions of this part, no person shall park a vehicle on any highway or City parking lot for more than forty-eight (48) hours continuously.

(23-73) (23-67)

EXTENDED DURATION VIOLATION

614. Every operator of a vehicle shall be guilty of a separate and additional infraction of this bylaw for every hour or fraction thereafter he or she permits such vehicle to be, or remain, in a metered space after the first hour the authorized parking time expired or was identified to have expired.

(23-73) (23-72)

METERED SPACE RESTRICTION

615. No person shall park a vehicle in a metered space at which it was previously parked, until not less than three (3) hours has passed since the vehicle last occupied that metered space.

(23-73) PLACING PAY STATIONS

650. Pay stations shall be installed with at least one pay station on each side of each block of any highway or land marked exclusively for the parking or standing of vehicles as a pay-by-licence plate, or pay-by-phone, or pay and display, metered zone.

(23-73) PAY-BY-LICENCE PLATE

651. A person who chooses to pay-by-licence plate must comply with the City’s requirements regarding the pay-by-licence plate system.

(23-73) PAY-BY-PHONE 652. A person who chooses to pay-by-phone must comply with the City’s requirements regarding the pay-by-phone system.

(23-73) METHOD OF PARKING

653. (1) A person who parks in a metered zone must:

(a) Pay-by-licence plate by:

(i) entering, at a pay station, the licence plate number of the person’s vehicle, and the amount of parking time required; and

(ii) pay the fee indicated by the pay station by a

method of payment prescribed at the pay station; or

(b) Pay-by-phone by calling the telephone number for the pay-by-phone system, entering the metered zone number, and activating and terminating payment, to park up to the maximum time permitted.

(2) When, after the action taken in subsection (1) above:

(a) The time recorded by the pay station; or

(b) The time recorded by the City under the pay-by-phone option;

shows a time period that is greater than 0, the metered space may be lawfully occupied by a vehicle during the period of time shown, subject to all other restrictions, limitations or conditions of this bylaw, including, but not limited to, Sections 654 and 655.

ON-STREET PARKING RATES

654. A person who parks in a metered zone must comply with the parking rates. Unless another rate is indicated at the pay station, the parking rates are as follows:

(a) $1.00 per hour for the first two hours, $2.00 for the third hour;

655. A person may use the unexpired time from parking at a metered space under pay-by-licence plate or pay-by-phone at another metered space within the same metered zone. Failure to move a vehicle after the maximum allowed time for the metered space has expired shall constitute an offence under Section 615 of this bylaw.

PART VII: USE OF HIGHWAYS REGULATIONS

DRAINAGE 702. No person shall alter or stop the flow of water through any drain, sewer, ditch or culvert on any highway.

(23-74) LITTERING 703A. (1) No person shall place, throw, deposit or discard on any highway any rubbish, litter or waste material of any description.

(2) Anyone found guilty of Section 703A, shall be liable for all costs incurred by the City to remove any rubbish, litter or waste material of any description.

SECURING LOADS 703B. (1) No person shall operate on a highway, a vehicle or combination of vehicle and trailer unless it is so constructed, loaded, or covered as to prevent any of its load from dropping, shifting, leaking, or otherwise escaping therefrom.

(2) Should any material, due to any cause whatsoever, fall from the vehicle, the operator shall forthwith take all reasonable precautions to safeguard traffic from the consequences thereof and shall remove such material from the spillage area.

(23-45) (3) No person shall transport rubbish or refuse of any description in a motor vehicle unless the portion of the motor vehicle in which the refuse is transported is completely covered or enclosed so as to prevent refuse from spilling or escaping from the vehicle.

CONSTRUCTION 704. (1) No person shall excavate or construct any works or occupy the highway for purposes of construction adjacent to the highway unless otherwise authorized by permit.

(2) Where authorized works are carried out on, over, or under any highway, appropriate signs, flashers, barricades or other warning devices shall be provided around the construction zone to the satisfaction of the Public Works and Utilities Director.

IMPEDING TRAFFIC DAMAGE TO HIGHWAYS

705. No person shall cut, saw, break, split, place or pile firewood, lumber, blocks, stone, debris, or other material or mix mortar or do any act upon any highway which impedes traffic or causes damage to same.

NOISE AND ADVERTISING

706. No person shall operate upon a vehicle any calliope, loudspeaker or other noise-making device upon the streets of the City for advertising or other purposes unless a permit has been applied for and granted by the Council.

TREES OVER HIGHWAYS

707. Every person being the owner or occupier of real property shall cause all trees, shrubs or other vegetation to be properly trimmed and cut back, so as to prevent physical obstruction and visibility impairment to pedestrian and vehicle traffic on the sidewalk or highway.

STRUCTURES OVER HIGHWAYS

708. (1) No person shall, except as provided herein or by any other bylaw, or unless otherwise authorized by the Public Works and Utilities Director, erect or maintain any structure which encroaches on or over any highway or public land.

(2) Approved structures overhanging the highway shall have a minimum clearance of 2.5 m above any sidewalk or walkway and 5 m above any roadway.

(3) No person shall place, erect, remove or alter any sign, structure or other device on or over a street or land without the express consent of the Public Works and Utilities Director.

(23-43) PARADES 709. (1) Any person desiring to hold a parade shall prior to the event make application in writing to the Public Works and Utilities Director, and in such application, furnish the following information:

(a) the name and address of the applicant;

(b) the nature and object of such parade;

(c) the month, day and hours during which the parade will be held;

(d) a description of the intended route of the parade and assembly area or the intended area in which the parade will be limited to, as the case may be; and

(e) a description of the composition of the parade.

(2) The Public Works and Utilities Director may approve or disapprove of the aforesaid application and, if the approval is given, may issue an order permitting the parade on such terms and conditions as he deems appropriate.

(3) The Public Works and Utilities Director is authorized to regulate and to control pedestrian and vehicular traffic over the route or area in which the parade will occur.

(4) If the Public Works and Utilities Director does not approve the application for the parade then the applicant may present its application to Council.

FUNERAL PROCESSION

710. (1) The operator of a vehicle in the lead of a funeral procession approaching an intersection where a traffic control device exists, shall comply with the instruction of such device, and shall not enter the intersection until it is safe to do so.

(2) Every person operating a vehicle in a funeral procession shall have the headlamps of such vehicle on for the duration of the procession.

PROPERTY ACCESS

711. No person shall alter an existing access to a property or construct a new access to a property without obtaining an access permit from the Public Works and Utilities Director.

PART VIII: PENALTIES

(23-73)

GENERAL PENALTY

801. No person shall do any act or suffer or permit any act or thing to be done in contravention of this bylaw.

802. Every person who violates any provision of this bylaw, or who permits any act or thing to be done in contravention of this bylaw, or who fails to do any act or thing required by this bylaw shall be deemed to have committed an offence against this bylaw and:

(a) Shall be liable to a fine set out in the City of Kamloops Municipal Ticket Utilization Bylaw, as amended; or

(b) Shall be liable to a fine of not less than the amount identified in Section 803, Voluntary Payment of this bylaw, in addition to any other penalty imposed under this bylaw; or

(23-74) (c) Any person guilty of an infraction of Section 514 of this bylaw shall be liable for a penalty of One Hundred Dollars ($100);

(23-74) (d) Any person guilty of an infraction of Section 703A of this bylaw shall be liable to a fine and/or penalty of not less than Five Hundred Dollars ($500) and not more than Ten Thousand Dollars ($10,000), plus the costs of prosecution, and any other order imposed pursuant to the Community Charter.

(e) Where a specific penalty has not otherwise been designated, shall be liable to a fine and/or penalty provided under the Community Charter of not less than Forty Dollars ($40) and not more than Ten Thousand Dollars ($10,000), plus the costs of prosecution, and any other order imposed pursuant to the Community Charter; or

(f) Any combination of the above.

(23-73) VOLUNTARY PENALTY

803. (1) Any person guilty of an infraction of Sections 507, 611, and 613 of this bylaw, shall be liable to a fine of not less than Forty Dollars ($40.00).

Notwithstanding anything hereinbefore contained, where any notice of a parking violation is issued pursuant to the provisions of Sections 507, 611, and 613 of this bylaw, any person may pay to the City the following sum within the prescribed time frame as full satisfaction for each violation applicable: - Ten Dollars ($10.00) within Twenty Four (24) hours;

or - Twenty Dollars ($20.00) within Thirty (30) days.

VOLUNTARY PENALTY (CONTINUED)

(2) Any person guilty of an infraction of Part V of this bylaw, excluding Sections 507 and 514 of this bylaw, shall be liable to a fine of not less than Fifty Dollars ($50).

(23-74) Notwithstanding anything hereinbefore contained, where any notice of a parking violation is issued pursuant to the provisions of Part V excluding Sections 507, 514, 518, and 519 of this bylaw, any person may pay to the City the following sum within the prescribed time frame as full satisfaction for each violation applicable: - Fifteen Dollars ($15) within Twenty Four (24) hours;

or - Twenty Five Dollars ($25) within Thirty (30) days;

(23-73) SEPARATE OFFENCES

804. Except where otherwise provided in this bylaw, each day that an offence against this bylaw continues shall be deemed a separate and distinct offence.

805. Any penalty imposed pursuant to this bylaw shall be in addition to, and not in substitution for, any other penalty or remedy imposed pursuant to any other applicable statue, law, or legislation.

(23-73) DEFAULT 806. In addition to any other penalty that may be incurred, anyone failing to comply with the provisions of Part VII of this bylaw within the time limited therefore, or within a reasonable time upon notice to that effect by the City, shall be subject to the City carrying out any such work at the expense of the offender, and any charges or costs incurred by the City in this regard, shall be recoverable by it in any Court of competent jurisdiction.

(23-73) RESPONSIBILITY OF OWNER

807. (1) The owner of a vehicle shall incur the penalties provided for any violation of this bylaw with respect to any vehicle owned by him unless at the time of such violation the vehicle was in the possession of some person other than the owner without the owner’s consent; but nothing in this section shall relieve the operator of a vehicle not being the owner, from incurring the penalties provided for such violation.

(2) The onus of establishing that the vehicle was in the possession of some person other than the owner rests with the owner.
