SUBJECTS AFFIXING MARK OF CONFORMITY
MANUFACTURER
AUTHORIZED REPRESENTATIVE
DETERMINED BY TECHNICAL LEGISLATION (in RoS usually by the Rulebook adopted by the line minister in charge)
IMPORTER (exceptional
cases)
MANNER OF MARKING OF CONFORMITY
Before the placing the product on the market or in use, the product which conforms to technical regulation requirements shall be marked with the mark of conformity, if the technical regulation so stipulates.
Mark of conformity shall be affixed by the manufacturer, hiss representative or importer in accordance with the technical regulation, after the completion of conformity assessment of the product as prescribed by the regulations
AFFIXING OF MARK of CONFORMITY
Mark of conformity shall be affixed by the manufacturer, his representative or importer
Mark of conformity has to be visible, legible and indelible
MARKS OF CONFORMITY
Marks of conformity are:
1) Serbian Mark of conformity
2) CE marking
3) Other marks of conformity, in accordance with specific regulations (i.e. “E” mark of homologation)
Shall be THE ONLY MARK OF CONFORMITY:
- As of the day of entering into force of a ratified international Agreement on Conformity Assessment and Acceptance of industrial products with the EU (ACAA), but
- Not later than on the date of acession of Republic of Serbia in the EU
CE MARKING
SERBIAN MARK of CONFORMITY
Shall be THE ONLY MARK OF CONFORMITY in Serbia for
the products in compliance with New Approach
regulations:
- Prior to the day of entering into force of a ratified
ACAA, but
- Not later than the date of acession of Republic of
Serbia in the EU
WRONG MARKING
Wrong marking:
marking of non-compliant products, or affixing mark of conformity on a product which is not covered by technical regulations
affixing of symbols, signs or other marks whose affixing is prohibited
marking of the mark of conformity with reduced visibility and/or legibility
failure to affix mark of conformity where required
MEASURES IN CASE OF WRONG MARKING
MARKET SURVEILLANCE AUTHORITY requires:
-corrective actions (to mark the product in accordance with the regulations, to remove marks prohibited, etc)
-restriction or prohibition of delivering of the product on the market
-withdrawal of product from the market
RECOGNITION OF FOREIGN MARKS OF CONFORMITY
Same principles and procedure as for the recognition of foreign documents of conformity*
Precondition: Recognition of foreign document of conformity, based on which the mark was affixed
