Commitment to a Healthy Environment andStrong Economy for Overburdened Communities
The Federal Interagency Working Group on Environmental Justice (IWG)
was established in 1994 under Executive Order (EO) 12898. The IWG is
comprised o ederal agencies and several White House oces. Chaired
by the Administrator o the U.S. Environmental Protection Agency (EPA),
the IWG’s ocus is to integrate environmental justice into ederal agency
programs, policies and activities. In August 2011 the ederal amily rearmed
its commitment to work or environmental justice and continue the
collaborative work o the IWG. The IWG works to share lessons-learned and
ensure opportunities or collaboration in addressing environmental justice
concerns.
The IWG is pleased to provide this guide as a source o inormation or
individuals and organizations working in communities overburdened by theadverse health impacts o exposure to toxics where they live, work and
play. The programs included in this guide are ocused on resources that
would assist communities with technical or nancial assistance to reduce
exposure. Through this and other eorts, ederal agencies are recommitting
to improving the health and sustainability o communities across America.

Marine Debris ProgramThe NOAA Marine Debris Program serves as a
centralized marine debris capability within NOAA
in order to coordinate, strengthen, and increase
the visibility o marine debris issues and eorts
within the agency, its partners, and the public.
This Program is undertaking a national and
international eort ocusing on identiying,
reducing, and preventing debris in the marine
environment. Additionally, the MDP supportsand works closely with various partners across
the U.S. to ulll the Program’s mission. The
NOAA Marine Debris Program also supports

National Estuarine ResearchReserve SystemThe National Estuarine Research Reserve
System (NERRS) is a partnership program
between NOAA and the coastal states,
encompassing 28 sites nationwide that have
been established or long-term research,
education, and coastal stewardship.
Reserve sta work with local communities andregional groups to address natural resource

change, non-point source pollution, habitat

Coastal and Estuarine LandConservation ProgramThe Coastal and Estuarine Land Conservation
Program (CELCP) was established in 2002 to
protect coastal and estuarine lands considered
important or their ecological, conservation,
recreational, historical or aesthetic values. The
program provides state and local governments
with matching unds to purchase signicant
coastal and estuarine lands, or conservationeasements on such lands, rom willing sellers.
Lands or conservation easements acquired with
CELCP unds are protected in perpetuity so
that they may be enjoyed by current and uture
generations. CELCP is a potential tool that can
be used to protect lands within communities

AssistedLiving Conversion
ProgramProvides grants to private nonprot owners o
eligible developments to convert some or all o
the dwelling units in the development into an
assisted-living acility or the rail elderly.
This program provides unding or the physical
costs o converting some or all o units in an
eligible development into an assisted-living
acility (ALF), including the unit conguration,
common and services space, and any necessary
remodeling consistent with HUD’s or the state’sstatute or regulations (whichever is more
stringent). ALFs are designed to accommodate
rail elderly and people with disabilities who can
live independently, but need assistance with
activities o daily living (e.g., assistance with
eating, bathing, grooming, dressing, and home
management activities). Under this program,
ALFs must provide supportive services,
such as personal care, transportation, meals,
housekeeping, or laundry. The acility must
be licensed and regulated by the state (or, ithere is nostate law providing such licensing
and regulation, by the municipality or other
subdivision in which the acility is located).

Emergency Capital Repairs
ProgramProvides grants or substantial capital repairs to
eligible multiamily projects that are owned by
private nonprot entities.
This program provides grants or substantial
capital repairs to eligible multiamily projects
with elderly tenants that are needed to
rehabilitate, modernize, or retrot aging
structures, common areas, or individual dwelling
units. The capital repair needs must relate to
items that present an immediate threat to thehealth, saety, and quality o lie o the tenants.
The intent o these grants is to provide one
time assistance or emergency items that could
not be absorbed within the project’s operating
budget, and where the tenants’ continued
occupancy in the immediate uture would be
called into question by a delay in initiating the
proposed cure.

construction or substantial rehabilitation
o multiamily (ve or more units) rental or

displaced amilies. Projects in both cases may
consist o detached, semi-detached, row, walk-
up, or elevator structures. SRO projects may
consist o units that do not contain a complete
kitchen or bath.
Currently, the principal dierence between the
programs is that HUD may insure up to 100
percent o replacement cost in the case o new
construction under Section 221(d)(3) or public,
nonprot and cooperative mortgagors, but
only up to 90 percent under Section 221(d)(4),
irrespective o the type o mortgagor.

Hospitals (Section 242)

Multifamily Mortgage Risk
Sharing Programs (Sections542(b) and 542(c))Two multiamily mortgage credit programsunder
which Fannie Mae, Freddie Mac, and state
and local housing nance agencies share the
risk and the mortgage insurance premium on
multiamily housing.
Section 542(b) o the Housing and Community
Development Act o 1992 authorizes HUD to
enter into reinsurance agreements with Fannie
Mae, Freddie Mac, qualied nancial institutions(QFIs), and the Federal Housing Finance Board.
The agreements provide or risk-sharing on a
50-50 basis. Currently, only Fannie Mae and
Freddie Mac have active risk-sharing programs
with HUD.
Section 542(c) enables HUD to carry out a
program in conjunction with qualied state
and local housing nance agencies (HFAs) to
provide ederal credit enhancement or loans or
aordable multiamily housing through a system
o risk-sharing agreements. Agreements provide
or risk-sharing between 10 percent and 90
percent.
The Fiscal Year 2001 Appropriations Act
changed the program rom a pilot program into a
permanent insurance authority.

Preserves long-term low-income housingaordability by restructuring FHA-insured or
HUD-held mortgages or eligible multiamily
housing projects.
The Multiamily Assisted Housing Reorm and
Aordability Act o1997 (MAHRA) authorized a
Mark-to-Market program designed to preserve
low-incomerental housing aordability while
reducing the long-term costs o ederal rental
assistance, including project-based assistance
rom HUD, or certain multiamily rental
projects. The projects involved are projects with
(1) HUD-insured or HUD-held mortgages; and
(2) contracts or project-based rental assistance
rom HUD, primarily through the Section 8
program, or which the average rents or
assisted units exceed the rent o comparable
properties. The program objectives are to (1)
preserve housing aordability while reducing the
costs o project-based assistance; (2) restructure
the HUD-insured or HUD-held nancing so that
the monthly payments on the rst mortgagecan be paid rom the reduced rental levels; (3)
reduce the costs o insurance claims; and (4)
ensure competent management o the project.
The restructured project is subject to long-term
use and aordability restrictions.

National Natural Landmarks
ProgramThe National Natural Landmarks Program
recognizes and encourages the conservation o
outstanding examples o our country’s natural
history. It is the only natural areas program o
national scope that identies and recognizes

eatures in both public and private ownership.
National Natural Landmarks (NNLs) are

Tribal Preservation Program
The National Park Service (NPS) TribalPreservation Program assists Indian tribes in

Title VI/Nondiscrimination
Recipients o Federal nancial assistance areobligated to assure nondiscrimination in all their
programs and activities. Thereore, they are
required to have a comprehensive and proactive
Title VI/nondiscrimination enorcement program
to prevent and eliminate discrimination in each o
the ederally assisted programs they administer.
Nondiscrimination provisions apply to all Federally
and non-Federally assisted programs and activi
ties o Federal-aid recipients, subrecipients, and
contractors, regardless o tier. Primary recipients
are responsible or determining and obtaining
compliance by their subrecipients and contrac
tors. It is the policy o the FHWA to ensure
compliance with Title VI and related, nondis
crimination statutes and regulations. The ocal
point o nondiscrimination and the oundation o
environmental justice is Title VI o the Civil Rights
Act o 1964 (42 USC 2000d), which prohibits dis
crimination on the basis o race, color, or national
origin in any program or activity receiving Federal
nancial assistance. The broader application o
nondiscrimination is ound in other statutes, regu
lations and Executive Orders. Title 23 CFR, Part
200 provides guidelines or implementation o
FHWA’s Title VI compliance programs and related
civil rights laws and regulations, and or conduct
ing Title VI program compliance reviews relative
to the Federal-aid highway program. Further, Part
200 states that it is the States’ responsibility to
conduct reviews o planning agencies and other
recipients o Federal-aid highway unds.
