In the event that watercourse construction activities need to occur within the instream restricted

activity timing windows, a qualified fish biologist, in consultation with the appropriate regulatory

authority, will determine appropriate mitigation measures. These may include assessing the

crossing location for the presence of fish and mussels prior to construction work beginning,

conducting fish and mussel salvage from the work site, and relocating fish and mussels to suitable

nearby habitat. In addition, Enbridge will reduce instream work duration by ensuring all equipment

and supplies are on site prior to commencement to the extent feasible, completing work in as little

time as possible, and maintaining the natural volume of stream flow at all times. All activities will be

in accordance with approvals from the appropriate regulatory authorities. A qualified fish biologist

will be available, as needed, during instream construction activities to provide advice to reduce

impacts and ensure compliance with regulatory approvals.

The most current watercourse listing for the project was filed with the Board in the preliminary

project EPP on July 15, 2016 [NEB filing: A78552] in Appendix O, Table

2. However, further updates will be added to the table for the Electrical Transmission Corridor

Route (once field data is summarized) and for any subsequent reroutes that may affect

watercourses. Updates will be submitted to the Board prior to the commencement of construction.

Enbridge is committed to restoring irrigation systems affected by pipeline construction to their

preconstruction condition (or equivalent) based upon consultation/agreements with individual

Post-Construction Scheduled Enbridge Construction This will be reviewed post-construction.

The proposed mitigation for the Project will avoid vegetation clearing during the pre-volant period

when bats are less resilient to disturbance. Sensory disturbance as a result of construction activities

will be temporary. The proposed mitigation to avoid operation of heavy equipment between dusk

and dawn will reduce potential for sensory disturbance of roosting bats.

Enbridge commits to offsetting any impacts to identified critical bat habitat. Enbridge is committed

to installing bat boxes to mitigate habitat loss. Enbridge commits to putting the information in the

maternity roosting habitat to the extent possible.

Enbridge will consult with the appropriate government agencies, including Environment and Climate

Change Canada ("ECCC"), as warranted, if red-headed woodpeckers, eastern whip-poor-wills or

any other migratory bird species at risk listed under Schedule 1 of the Species at Risk Act is

identified that has not previously been identified and is considered to potentially be impacted by

the Project. Additionally, if proposed mitigation measures to reduce potential effects to those

species change from described in the application or are determined to be unsuccessful, Enbridge

will consult with the appropriate agencies.

Ensure that test water withdrawn from one regional watershed will not enter into another regional

watershed. The location of regional watersheds along the pipeline route are identified on the

• Niagara Peninsula Region Watersheds.

Construction Scheduled Enbridge Environment The project will use municipal water for the mainline hydrotest and the disposal will

be directed to the City of Hamilton sanitary sewer.

Environmental supplemental studies to be completed in spring 2017

include:

• Rare plant surveys (spring and summer);

• Weed surveys;

• Amphibian breeding surveys;

• Jefferson Salamander pond suitability studies;

• Bobolink/Eastern Meadowlark surveys;

• Breeding bird surveys; and,

• Crepuscular bird surveys.

The results from these surveys will be summarized and provided to

the NEB after the 2017 Spring surveys have been completed.

To date Enbridge has not consulted on noise levels associated with HDD activities to directly

affected landowners. Once construction drilling rig specifications are finalized including anticipated

noise levels, Enbridge will further consult with directly affected landowners within 200 m of the

HDD location on the noise levels and appropriate mitigations as previously outlined in Enbridge’s IR

No.2 response

Pre-Construction In Progress Enbridge Land Services Enbridge has undertaken HDD consultation with all landowners within 1000m of

the HDD drill locations. All directly affected landowners with residences within

150m of the HDD entry and exit points shall receive a form of compensation to

mitigate impacts associated with increased construction traffic and noise levels

during the HDD drilling activities. Landowner concerns raised during HDD activity

will be addressed and mitigation measures from the EPP will be utilized.

Prior to HDD activity, an Enbridge representative will make reasonable efforts to contact the

landowner a minimum of seven days in advance of startup. We will then work with the landowner

to discuss access, estimated compensation for potential impacts, determine a preferred work

schedule, review Enbridge Environment and safety considerations provide Enbridge contact

information, and address any questions and property-specific concerns.

Pre-Construction In Progress Enbridge Land Services Pre-construction meetings were held with all directly affected landowners to review

consultation materials, answer questions and to discuss any questions or concerns

prior to commencing construction. Any landowner commitments made have been

documented and provided to the construction contractor. HDD Consultation was

undertaken with all directly affected landowners within 1000m proximity to the

HDD drill exit and entry points. Seven days prior to the HDD activity beginning,

Enbridge representatives made reasonable efforts to provide reminder notifications

of the upcoming activity.

Butternut trees at one location were assessed on July 6, 2016 by a Butternut Health Assessor. The

assessment of the additional trees that may be impacted will occur in the fall of 2016. The results

of these assessments will be submitted to the Ministry of Natural Resources and Forestry ("MNRF")

after the results have been determined and will be included in a Supplemental Enbridge

Environment and Socio- economic Impact Assessment and/or Enbridge Environment Protection

Plan, as appropriate.
