REASON #2:

The Obama administration is funding environmental groups in Maryland FACT: Environmental groups received more

than $14M of American Reinvestment &Recovery Act money).

REASON #3:

Environmental policy is being driven by groups that are using our own tax dollars to lobby for policies that injure our farmers and businesses.

FACT: The Environmental Groups receive public money and spend hundreds of thousands a year in convention, travel, & lobbying expenses (source 2009,2012 990’s)

IMPACT: Advocates of anti-farming and anti-business regulations are giving money to unaccountable environmental groups that then use the money to advocate policies that are hostile to Carroll County farmers and businesses.

Because environmental “non-profits” are BIG BUSINESS with BIG MONEY.

FACT: In 2014, the CBF had more than $100M in assets and more than $32,000,000 in unrestricted revenues (source CBF June 30 2014 audited financial statement )

FACT: Eight officers in the Chesapeake Bay Foundation make combined compensation exceeding $1,100,000; President received more than $200,000 in compensation. (source 2012 990 Part VII)

Question: Is it possible that “actually fixing the Bay” would be a threat to the wealth of some non-profits?

Because environmental so-called non-profits are spending big money on legal and promotional items. FACT: The Chesapeake Bay Foundation’s vice-president

of litigation made more than $167,000 in 2012. (source 2012 CBF 990)

IMPACT: IN 2012 the CBF spent more than $600,000 in travel and advertising expenses alone. (2012 990)

INCONVENIENT TRUTH: Prior to the CCC, environmental groups with no accountability to taxpayers controlled all of the speaking points. There was no intelligent debate; and no one to wage a debate.

FACT: The CBF spends 100 times more money on annual activities than the ten-county Clean Chesapeake Coalition

FACT: The CCC is the only organization challenging their assertions and claims.

Why LEGAL FEES & LAWYERS?

FACT: Because the nature of the work involves highly technical, highly detailed and complex legal expertise in order to function at a level comparable to those that are prosecuting a one-sided; one-size fits all; environmental agenda that is harming our businesses, farms, schools, and property rights.

What about other coalitions?

FACT: As a representative for Carroll on both the Rural Coalition and the Clean Chesapeake Coalition, it is my observation that the Clean Chesapeake Coalition has been infinitely more effective and active defending our farmers and businesses from ill-conceived mandates and policies.

FACT: This is evidenced by the robust involvement and research of the CCC as evidenced by their website. NOTHING else compares to it in Maryland.

MOVING FORWARD May characterize the May 2010 CONSENT AGREEMENT

between the ENVIRONMENTALISTS and EPA as a “friendly lawsuit” IMPACT: Multiple organizations friendly to each

other’s interests consent to a massive settlement agreement, but County Taxpayers who have to pick-up-the-tab and pay the bill receive no due process.

Possible action: Petition federal court to set aside the Consent Agreement under the straightforward grounds that County and State taxpayers were denied DUE PROCESS. We were not represented in these negotiations.

ENSURE PROPER CALIBRATION OF POLLUTION LOADING FOR CARROLL & MARYLAND COUNTIES FOOD FOR THOUGHT: The Conowingo Dam is

essentially the Mid-Atlantic’s LARGEST stormwater management pond.

FACT: It has received no maintenance in 90 years.

IMPACT: By proving the dam is no longer trapping nutrients and sediment, we can demonstrate we are receiving a disproportionate share of pollution attributable to others. A small recalibration could save Maryland billions of dollars; and Carroll County would enjoy its pro-rata share of savings.

WHY THE INTERVENTION WITH THE FEDERAL ENERGY REGULATORY COMMISSION IS CRITICAL: The relicensing event constitutes major federal

intervention.

ACCOUNTABILITY: Drawing federal attention to the impact of the dam, increases the likelihood of federal involvement and a regional solution funded by regional or federal dollars.

There is no one else lobbying in our behalf. Other coalitions lack the resources and expertise to research and address the legal, licensing, investigative, and scientific issues. All heavy-lifting has been done by the CCC.

FAILURE TO ACT: Would leave Maryland and Carroll taxpayers paying the bill for PA, NY, NJ pollution. FACT: The dam pool has received no maintenance in 90 years.

THE MDE’s and Environmentalists’ defacto approach to cleanup appears to be Everything-Everywhere-at Any Price.

This is not a formula for success. IT IS A FORMULA FOR FAILURE. It is also inconsistent with EPA policy. Consider MD. Septics account for less than two percent of all

alleged Bay Pollution, YET, Maryland will spend 50% ($7B) of it $14.4B budget on BAT Septics. Why?

Unaccountable and previously unchallenged activists exploit the Bay as an Archimedean Lever to impose controls on activities of little impact to the Bay. THIS INJURES OUR FARMERS, BUSINESSES, PROPERTY RIGHTS & SCHOOLS

The CCC operates with a budget that is 1/100th the size of the CBF, yet we have altered the course of dialogue regarding the Bay. .

FY16 Elements for Draft Statement of Work

1. Continue work on FERC to improve downstream water quality and reduce burden on our farmers, businesses, & homeowners.

2. Negotiate with EXELON to ensure a valid sediment study, & help coalition counties fund their TMDL abatement initiatives

3. Work to influence work and scope of sediment study to influence 2017 TMDL recalibration that is fair to our citizens

4. Advance Oyster restoration- most cost effective abatement strategy

5. Push for scientifically sound WIP’s that increase flexibility for local government inspired policies

6. Refocus state on large “drivers” of pollution, and move state away from de minimus sources such as septic systems.

GOVERNOR HOGAN

In early 2015, the CBF graded the Bay’s health a D- plus, unchanged since the last report in 2012.

Hogan cited Chesapeake Bay Foundations own report on Bay’s health to conclude it was “time for a new approach.” (source Capital Gazette 2/6/2015)

This reinforced the Clean Chesapeake Coalition’s position.
