MBD 9 CERTIFICATE OF INDEPENDENT PROPOSAL DETERMINATION
1 This Municipal Bidding Document (MBD) must form part of all proposals¹ invited.
2 Section 4 (1) (b) (iii) of the Competition Act No. 89 of 1998, as amended, prohibits an agreement
between, or concerted practice by, firms, or a decision by an association of firms, if it is between parties
in a horizontal relationship and if it involves collusive bidding (or bid rigging).² Collusive bidding is a pe
se prohibition meaning that it cannot be justified under any grounds.
3 Municipal Supply Regulation 38 (1) prescribes that a supply chain management policy must provide measures for the combating of abuse of the supply chain management system, and must enable the accounting officer, among others, to:
a. take all reasonable steps to prevent such abuse;
b. reject the proposal of any bidder if that bidder or any of its directors has abused the supply
chain management system of the municipality or municipal entity or has committed any improper conduct in relation to such system; and
c. cancel a contract awarded to a person if the person committed any corrupt or fraudulent act
during the bidding process or the execution of the contract.
4 This MBD serves as a certificate of declaration that would be used by institutions to ensure that,
when proposal are considered, reasonable steps are taken to prevent any form of bid-rigging.
5 In order to give effect to the above, the attached Certificate of Proposal Determination (MBD 9) must

INTRODUCTION
City Power makes use of power and distribution transformers in the provision of electricity to its customers. Efficiency and reliability of transformers are critical in terms of meeting statutory Quality of Supply parameters as well as customer satisfaction and cost-effective network operation. Mineral insulating oil plays a crucial role in the performance of transformers, performing the functions of electrical insulation and heat dissipation. Due to the scarcity and cost of virgin (new) transformer oil and in line with City Power’s corporate responsibility in terms of environmental awareness and resource renewal, City Power will, where possible, give preference to used insulating oil that has been regenerated to the standard of SANS 555.
1 SCOPE
This specification defines City Power’s requirements for new and regenerated transformer oil in accordance with SANS 555.
2 NORMATIVE REFERENCES
The following documents contain provisions that, through reference in the text, constitute requirements of this specification. At the time of publication, the editions indicated were valid. All standards and specifications are subject to revision, and parties to agreements based on this specification are encouraged to investigate the possibility of applying the most recent editions of the documents listed below.

3 DEFINITIONS AND ABBREVIATIONS
The definitions and abbreviations in the above documents shall apply to this specification.

4 REQUIREMENTS
4.1 General
4.1.1 All virgin (new) oil shall comply fully with the requirements of SANS 555 and this specification, including the values indicated in the A&B Schedules. Reference to compliance with SANS 555 shall mean compliance with this specification where the requirements of this specification are more stringent than those of SANS 555.
4.1.2 The process of regeneration shall entail the removal of water, suspended particles, inorganic acid, deleterious matter, dissolved acids and chemical materials and gases, as well as the adjustment of the chemical and physical properties of the reclaimed oil to ensure compliance with SANS 555.
4.1.3 After regeneration, the oil shall match or exceed the requirements of SANS 555 and the values indicated in the A & B Schedules of this specification. Reference to compliance with SANS 555 shall mean compliance with this specification where the requirements of this specification are more onerous than those of SANS 555.
4.1.4 All new (unused) mineral insulating oil shall be polychlorinated biphenyl (PCB) free when tested in accordance with IEC 61619.
4.1.5 New mineral insulation oil for transformers shall be classified as uninhibited transformer oils (U), contain no antioxidant in accordance with IEC 60666.
4.1.6 All regenerated (reclaimed) mineral insulation oil polychlorinated biphenyl (PCB) level shall not be more than 20 mg/kg in accordance with IEC 61619.
4.1.7 The quantity of oil supplied or regenerated shall be determined (in litres) by calibrated flow meters.
4.1.8 The tenderer shall be fully responsible for the cleanup and rehabilitation of the site for all oil spillages emanating during the oil supply and/or regeneration process.
4.1.9 All new and regenerated oil shall bear the SANS 555 mark.
4.1.10 The oil may be required to be collected, regenerated and delivered in accordance with one or more of the following methods:
a) Collection in bulk, regeneration and supply in 210 litre drums;
b) Collection in bulk, regeneration and supply in bulk;
c) Circulation and regeneration of oil in transformer on site;
d) Circulation and regeneration of oil from tank to tank at Reuven Workshops; or
e) Supply of oil (in 210 litre drums) where the source oil is not supplied by City Power.
f) All oil supplied to City Power in drums shall be delivered in Class A drums. Any signs of rust on the drums shall be deemed unacceptable and such drums shall be returned to the supplier.
g) All old oil collected from City Power, in old or damaged drums, for disposal, shall be disposed of in their entireity by the successful tenderer – disposal includes old or damaged drums.

4.1.11 In all cases except 4.1.8 (e) above, the tenderer will be required to collect the used oil from City Power, regenerate it and return the oil to City Power.
4.1.12 For bulk collection, regeneration and delivery (clause 4.1.8 (b)) the oil shall be delivered in a tanker of suitable capacity. Tenderers shall state what percentage of oil is lost in the regeneration process in all cases where oil is collected in bulk.
4.1.13 For on-site regeneration in transformers, the minimum capacity of the oil regeneration plant used shall not be less than 3 000 litres and the flow rate capacity of the plant shall not be less than 4 500 litres per hour. The personnel responsible for, or engaged in, operation of the plant shall be proficient in its operation. A 24 hour service shall be provided for on-site regeneration.
4.1.14 For on-site regeneration at Reuven (tank to tank) the minimum flow rate capacity of the oil regeneration plant shall not be less than 4 500 litres per hour. The personnel responsible for, or engaged in, operation of the plant shall be proficient in its operation. A 24 hour service shall be provided for on-site regeneration.
5. TESTS
5.1 Each batch/lot of regenerated oil delivered shall be tested in accordance with SANS 290 (for PCBs) and SANS 555 and a test certificate at the time of filling, certifying compliance, shall be provided by the tenderer for acceptance of the regenerated oil by City Power.
5.2 Each batch/lot of used oil collected shall be tested in accordance with SANS 290. A test report shall be submitted to the Laboratory Manager:
5.3 All test certificates shall be issued by a certified test laboratory.
5.4 All costs associated with the testing described above shall be borne by the tenderer and included in the quoted price of regeneration. No claims in this respect shall be entertained by City Power.
5.5 City Power reserves the right to test any oil supplied in accordance with SANS 555 up to two weeks after delivery. Should the oil fail the tests the entire batch/lot may be returned, at the sole discretion of City Power, to the supplier for further processing at no cost to City Power.
5.6 Should any dispute arise between City Power and the tenderer, an independent test authority shall test the oil at the cost of whichever party is proven wrong.
6. MARKING AND PACKAGING
6.1 In the case of oil which is supplied in 210 litre drums, the drums shall become the property of City Power. The drums shall not be galvanised on any surface which are in contact with the oil.
6.2 The packing shall further be in accordance with clause 4.1.2 of CP_TSSTAN_014.
6.3 All drums containing new (SAP 552) or regenerated (SAP 551) mineral insulating oil shall be labelled in accordance with City Power SAP numbers
7. DOCUMENTATION
7.1 Proof of bearing the SANS mark shall be submitted with the tender.

7.2 Documentation pertaining to the tests contemplated in clause 5 of this specification shall be supplied. Sample test reports of actual samples will suffice.
7.3 Details of the test laboratory referred to in clause 5.4 shall be supplied.
7.4 Any other relevant technical data, including environmental contingency plans, shall be submitted.
7.5 Documentation pertaining to the tenderer’s ISO 9001 and ISO 14001 accreditation shall be submitted with the tender.
8. QUALITY MANAGEMENT
A quality management plan shall be set up in order to assure the proper quality management of the mineral insulating oil during development, production and regeneration phases. Guidance on the requirements for a quality management plan may be found in the ISO 9001. The details shall be subject to agreement between City Power SHEQ and the Supplier.
9. ENVIRONMENTAL MANAGEMENT
An environmental management plan shall be set up in order to assure the proper environmental management of mineral insulating oil throughout its entire life cycle (i.e. development, production, and disposal phases). Guidance on the requirements for an environmental management system may be found in ISO 14001 standards. The details shall be subject to agreement between City Power and the Supplier. This is to ensure that the product created conforms to environmental standards and City Power SHEQ Policy.
