CITY OF SPARTA COMMON COUNCIL MINUTES
May 13, 2020 PRESENT: Mayor Gust, Kevin Brueggeman, Josh Lydon, Kevin Riley, Matthew Hoffland, Ed Lukasek, Bruce Humphrey, Norm Stanek, Jim Church ABSENT: None ALSO PRESENT: Todd Fahning, Mark Sund, Jim Hellman, Emilee Nottestad This meeting was held face to face in the Council room and also available to citizens via phone conference. Mayor Gust called the meeting to order at 6:00 p.m. Roll Call was done by the City Clerk. The Pledge was led by Alderman Ed Lukasek. A motion was made by Norm Stanek and seconded by Josh Lydon to approve the consent agenda consisting of the minutes of the regular meeting of April 15, 2020 (2019-2020), first meeting of April 15, 2020, (2020-2021), Special Council meeting of April 22, 2020, Special Council meeting of May 4, 2020, and monthly bills. Motion carried 8-0. We had a phone conference with a representative from HSR regarding the plans for the Police Department. Norm had a concern regarding the height of the doors and Ed had a concern regarding the wash bay. There were no additional costs regarding the decisions of the doors or the wash bay.

RESOLUTION APPROVING SMALL BUSINESS EMERGENCY ASSISTANCE (COVID-19)
Kevin Riley read the Resolution the first and second time. Norm Stanek moved to read the Resolution third time by title only, rules be suspended and placed before the Council for immediate action, seconded by Kevin Brueggeman. Motion carried 8-0. Mayor Gust read the Resolution third time by title only and the Resolution was approved on a roll call vote 8-0. Motion carried 8-0. One small change was made on this Resolution. A statement was added that businesses operating prior to March 25, 2020 would be eligible to apply. Todd went over the City Administrator Report. The HVAC project has started at the Community Center The Five Shovelmen have made progress to sidewalks in Evans-Bosshard Park. The deck at the Golf Course is currently being reconstructed.

May 26, 2020 PRESENT: Mayor Gust, Kevin Brueggeman, Josh Lydon, Kevin Riley, Matthew Hoffland, Ed Lukasek, Bruce Humphrey, Norm Stanek, Jim Church ABSENT: None ALSO PRESENT: Todd Fahning, Mark Sund, Jim Hellman, Emilee Nottestad, Booker Ferguson, Ryan Pawlisch, Wally Habhegger, Pat Mulvaney Mayor Gust called the meeting to order at 5:30 p.m. Roll Call was done by the City Clerk. Brad and Ryan presented several scenarios showing costs if the pool were to open up at 100%, 75%, 50% 25% and if it were closed. Also, the scenarios included the concession stand being open or closed, lazy river closed and diving boards closed. They had swimming lesson schedules figured out, how many could be able to be in the pool at one time, and a plan for certain lifeguards that would be policing the pool. There was a lot of discussion regarding this. A motion was made by Kevin Brueggeman and seconded by Matthew Hoffland to go with option 1 which was to operate at 25% with no concessions, diving boards or lazy river, to follow recommended guidelines by the CDC and Health Dept. and to revisit July 1st. Roll call vote taken: Jim Church – yes; Bruce Humphrey – no; Kevin Brueggeman – yes; Matthew Hoffland – yes; Kevin Riley – no; Ed Lukasek – no; Norm Stanek – no; Josh Lydon – yes. This vote was tied and the Mayor vote the tie with a yes vote. 5 yes - 4 no. It was next discussed whether or not to cancel adult sporting events. Some of the sports mentioned in this were baseball, softball, fitness classes pickle ball and youth sports. The Dept. of Health Services is recommending all youth sports be cancelled. Brad and Ryan did have a plan to possibly have some small group clinics or practices and virtual fitness classes if needed. A motion was made by Kevin Brueggeman to cancel all sports events, adult and youth, in Sparta, seconded by Bruce Humphrey. Roll call vote taken: Jim Church – no; Bruce Humphrey – yes; Kevin Brueggeman – yes; Matthew Hoffland – no; Kevin Riley – yes; Ed Lukasek – yes; Norm Stanek – yes; Josh Lydon – no. 5 yes – 3 no. June 1, 2020 PRESENT: Mayor Gust, Kevin Brueggeman, Josh Lydon, Kevin Riley, Matthew Hoffland, Ed Lukasek, Bruce Humphrey, Norm Stanek, Jim Church ABSENT: None ALSO PRESENT: Todd Fahning, Mark Sund, Jim Hellman, Emilee Nottestad, Booker Ferguson, Ryan Pawlisch, Brad Gilbertson, Sammy Weaver, Pat Mulvaney, citizens Mayor Gust called the meeting to order at 6:00 p.m. Roll Call was done by the City Clerk. A motion was made by Bruce Humphrey and seconded by Matthew Hoffland to approve the agenda for this meeting. Motion carried 8-0. Since last week’s meeting on May 26th regarding opening the Aquatic Center and was decided to open the pool at 25% capacity, new information has come forth from the DHS. Right now the pool is scheduled to open on June 6th and the staff has been trained and ready to go. The recommendations from the State and Monroe County Health Department are that the pools be closed. Jim Hellman spoke about the possibility of the City being liable if someone were to get COVID-19 and say they got it from the swimming pool. He is recommending we follow the CDC guidelines. There was lengthy discussion regarding closing the pool. A motion was made by Josh Lydon and seconded by Matthew Hoffland to close the Sparta Aquatic Center per DHS guidelines. Roll call vote taken: Jim Church – no; Kevin Brueggeman – yes; Bruce Humphrey – yes; Norm Stanek – yes; Matthew Hoffland – yes; Ed Lukasek – yes; Josh Lydon – yes; Kevin Riley – yes. 7 yes – 1 no. There were some citizens in the audience that had wanted to speak about wanting the pool to be open. Mr. Lukasek requested that the Mayor to let them speak since they are attending this meeting. They were allowed to speak. One of the citizens in the audience said he had a petition with 261 signatures requesting the City to allow softball leagues to play and have the concession stand open. They were going to start up their own league if the City wouldn’t start it up. Softball is outdoors and people can bring their own chairs if needed to stay 6 ft. apart. There was lengthy discussion on this and the other sports programs. A motion was made by Bruce Humphrey and seconded by Jim Church to allow adult softball (age 16 and older) and adult fitness classes with no youth sports. Roll call vote taken: Jim Church – yes; Kevin Brueggeman – yes; Bruce Humphrey – yes; Norm Stanek – yes; Matthew Hoffland – yes; Ed Lukasek – yes; Josh Lydon – yes; Kevin Riley – yes. 8 yes – 0 no. A motion was also made by Jim Church and seconded by Matthew Hoffland to show support for the Sparta Miller Baseball Program. If we are to hold the 4th of July fireworks, the deadline to order the fireworks is June 4th. Sec, 12-36. - Extension of Class "B"/"Class B" license beyond the building premises
(a) Any retail Class "B" or "Class B" license issued shall limit and restrict the consumption of fermented malt
beverages and intoxicating liquors as defined in Wis. Stats. ch. 125 to the building premises so defined on the
liquor license application unless, prior to the application of a liquor license or renewal thereof, approval has
been obtained from the plan commission for an outdoor facility.
(b) Upon making application to the plan commission, the person shall submit a site and landscape plan of the
entire parcel showing the outdoor facility designating its location with respect to the main premises and ottter
buildings on the site, designating entrances and exits of both the main structure and outdoor facility and the
location of the outdoor facility with respect to buildings on adjoining sites and such other information as thc
plan commission may require to ensure compliance with this Code.
(c) The plan commission shall consider the following guidelines when reviewing an application for an outdoor
facility:
(2) Fencing. The outdoor area should be enclosed with a fence. The h eight and style of fencing will deperrd
on location.
(3) Overall appearance. The overall appearance must be attractive.
(4) Exifs. The normal entry and exit should be from inside the building, However, an emergency exit must be
available from the outdoor facility. The fire department will review the emergency exit systems.
(5) Tables, chairs and trash receptacles. A seating plan should be submitted and reviewed by the firc
department to establish occupancy load. Seating capacity should be clearly posted. Trash receptacles will
be required.
(6) Trash,fhe outdoor area must be patrolled for trash and cleaned on a daily basis.
(7) Liquor availability.The availability of liquor shall be consistent with the liquor license of the applicant.
The approved liquor license must include the outdoor area as part of the premises.
(8) Use of right-of-way. No outdoor area shall be located on a dedicated public right-of-way,
(9) Size limitation. An outdoor area shall not be larger than the inside area of its parent building.
(10) Setback from public right-of-way. A minimum 20 foot setback from the public right-o1'-way. Exceptions
may be requested for those lots not able to accommodate 20 feet.
(1 1) Hours of operation Outdoor facility hours may only occur during open hours under Wis. Stats. S
125.32(3).
(12) Music allowed. As a general rule, music should not be allowed; however, applicants may make a special
req uest.
(13) Bartender required. Whenever the outdoor facility is open to customers and intoxicating liquor or
fermented malt beverages are sold, at least one licensed bartender must be staffing the area.
(d) The plan commission shall conduct a public hearing and make a recommendation to the city council. Notice
shall be given by ordinary mail of the proposed establishment of an outdoor facility to the owners of property
immediately adjacent to the area to be considered for the new use extending 200 feet therefrom and to the
owners of properties extending 200 feet from the street frontage of the opposite property and also by a Class I
publication in the official newspaper. The recommendation shall be one of the following:
(1) Approve without special conditions;
(2) Approve with special conditions taking into consideration the above guidelines; or

City Administration Report June 2020
City Projects & Information
-Goodman Court storm water retention nearing completion -Final plan for PD complete. Bid process will begin in August. -Bike trail improvement project has begun. A huge thank you to the Five Shovelmen who have completed the sidewalks in Evans-Bossard Park. The new bridge in Beaver Creek Parkway has started. -HVAC project at Community Center complete -The DPW continues to work on tree removal. There are still around 180 trees yet to be removed and this has been a priority. The brush dump is almost full and the contractor cannot chip and remove the brush until the end of June.
Budget
2020 budget mill rate will be $7.08.
Financial

Economic Development
-Martin Warehousing complete. -Spartan Services in Eastside BP complete -Blue Northern Distribution complete -Golden Eagle Roofing has decided to remain at their location off Hwy 21 due to Covid losses. They have given the land back to the City. -Herrman Elementary School nearing completion. -Brook’s Tractor has postponed construction until fall/early winter -Street lighting for South Pointe should be starting soon -Icecap Road stormwater should begin soon. We are waiting on DNR permits.
Other news
-The City Hall and Municipal buildings have been open since June 1 without any issues.
