CITY OF NEWARK DELAWARE RESOLUTION NO. 21-__ A RESOLUTION RENAMING COLLEGE SQUARE LOCATED AT 100, 115 AND 121 COLLEGE SQUARE TO THE GROVE AT NEWARK; NAMING THE NORTH/SOUTH RUNNING STREET COMPASS WAY AND NAMING THE EAST/WEST RUNNING STREET GROVE LANE WHEREAS, Section 27-24, Code of the City of Newark, Delaware, provides City Council the authority by resolution to approve the renaming of a subdivision or street if the council deems it appropriate; and WHEREAS, College Square III, LLC; College Square II, LLC; 115 College Square, LLC; and CS Residential, LLC (hereinafter referred to as the “Owners”) submitted a petition to the Planning and Development Department, dated March 22, 2021, requesting the renaming of the shopping center and subdivision located at 100, 115, and 121 College Square from “College Square” to “The Grove at Newark”; and WHEREAS, as part of the same petition, the Owners requested that the north/south running street in the subdivision be named “Compass Way” and the east/west running street in the subdivision be named “Grove Lane”; and WHEREAS, the Newark Police Department 911 staff has reviewed the request and has no objection to the proposed change. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Newark, Delaware changes the name of the subdivision and shopping center located at 100, 115, and 121 College Square from “College Square” to “The Grove at Newark”; names the north/south running street in the subdivision “Compass Way”; names the east/west running street in the subdivision “Grove Lane”; and directs the City Secretary to notify the Planning and Development Department, the Delaware Department of Transportation, Newark Police 911, Aetna Hose, Hook, and Ladder Company, and the United States Postal Service of these changes. RE: Revisions to College Square Subdivision Plan (PR#18-05-04)

A major subdivision by site plan approval with special use permits for the College Square Shopping Center was approved by City Council on March 25, 2019. The plan included demolition of sections of the existing shopping center and the construction of new sections of shopping center and apartment buildings with 305 apartment units. Demolition and construction have commenced, and the applicant now desires to make revisions to the approved plans including renaming the shopping center and its internal streets, as well as sign parameters. The revision process is further described below.

Renaming shopping center and internal streets

The applicant would like to make the following name changes: • Change the subdivision/shopping center’s name to “The Grove at Newark.”• Change the north/south running street within the subdivision to “Compass Way.”• Change the east/west running street within the subdivision to “Grove Lane.”

The applicant’s petitions requesting the name changes and a site diagram showing the street locations is included in Attachment 1. Code Section 27-24. - Renaming subdivision and land development plans or streets, stipulates that the planning and development department shall review the request with the Newark Police Department and make a recommendation to council. The Newark Police Department has reviewed the proposed name changes and has no objections. The Planning and Development Department; therefore, recommends that council approve the applicant’s requested name changes.

Revised sign parameters The applicant would like to make the following sign parameter changes:

• Increase in height and area of primary entrance signs (including addition of LED Screen) • Increase in number of secondary entrance signs, illumination method, and content • Increase in number of tertiary entrance signs, area, and content

The proposed sign parameter changes are further detailed in the applicant’s request letter in Attachment 2. Per the Subdivision Agreement paragraph eight (8) for College Square, the subdivision plans submitted to the City need to be substantially consistent with the subdivision plans as approved by City Council on March 25, 2019. Per Section 27-22 of the City Code, these proposed changes were reviewed by City Staff and the City Manager has determined that the proposed sign changes are a substantial change to the approved subdivision plans, and thus the proposed sign changes are being presented to Council for approval. It should be noted that Code Section 32-59.(j) stipulates that a shopping center identification sign may be allowed without regard to size or shape if the sign or signs are approved by the planning commission and council as part of the subdivision approval procedure. The applicant is requesting the revision of the approved subdivision plan to include these new sign parameters. City staff has reviewed the proposed changes and find them to be comparable to other area shopping centers and well within the character of community standards. For comparison, Attachment 3 includes photos of existing shopping center signs in the City of Newark. The Newark Shopping Center sign is about 28 feet tall and the Suburban Plaza sign is about 21 feet tall. The new proposed maximum sign height for The Grove at Newark is 30 feet. Planning and Development staff does have some minor concerns with the proposed LED sign and recommends a stipulation that the sign images must remain static. Recommendations The Planning and Development Department recommend the following: Motion for Subdivision and Street Renaming

I move to , approve the renaming of the College Square subdivision to “The Grove at Newark,” approve the renaming of the north/south running street within the subdivision to “Compass Way,” and approve the renaming of the east/west running street within the subdivision to “Grove Lane.”

Motion for Revisions Sign Parameters

I move to approve the revised sign parameters as described in the applicant’s request titled “Signage Revisions for “The Grove at Newark” dated March 22, 2021, with the stipulation that the LED sign images must remain static.
