Schedule the public hearing for Bylaw No. 2547 to be held at the Regular Meeting of Council on Monday, October 24 th , 2016 at 7:00 p.m. BACKGROUND An application has been received from the owners of 931 Dogwood Drive requesting a zoning amendment to allow for tourist accommodation use on the subject property. The current R-6 zoning of the property allows for bed & breakfast use (i.e. single family dwelling used as the principle residence of the B & B operator with rental of not more than four bedrooms for the temporary lodging of paying guests) but tourist accommodation (i.e. use of the building for temporary lodging by visitors where payment for occupancy is on a daily or weekly basis) is not permitted. The R-6 zone is a low density residential cluster of 12 properties on Dawnsview Place and Dogwood Drive. The properties in the R-6 zone, developed primarily with single- family dwellings, are surrounded by multi-unit residential buildings in the AC-1 zone. The AC-1 zoning allows for any or all of the individual units to be used for tourist accommodation when such dwellings are not occupied for residential use. The house at 931 Dogwood Drive has previously been used for tourist accommodation but this unauthorized use was discontinued after enforcement action in 2015 in response to complaints from adjacent property owners. The proposed zoning amendment would create a new R-6A zone and change the zoning of the subject property only, the zoning of the adjacent properties would not be changed. The proposed R-6A zoning will allow for tourist accommodation of the property restricted to not more than four bedrooms and up to eight guests.

Proposed Zoning Amendment - 931 Dogwood Drive Staff has prepared amending bylaw 2547 (attachment 3) which is presented with this overview report with recommendation for Council's consideration of 1st reading and scheduling of a public hearing. Approval of first reading will initiate the formal bylaw review process and allow Council to receive public input, through the public hearing, prior to any further decisions on the proposed amendment. After the public hearing, the amending bylaw may be refused or approved. The amending bylaw may also be revised by Council following the public hearing and prior to approval of any further readings. ANALYSIS Inter-Government Relations: Approval from the Ministry of Transportation and Infrastructure will not be required as the subject land is beyond 800m of a controlled access highway (97A). Financial Implications: The application fee has been paid and the applicant will also be invoiced for cost of the public hearing advertising. ATTACHMENTS
A BYLAW OF THE CITY OF KIMBERLEY TO AMEND “CITY OF KIMBERLEY ZONING BYLAW NO. 1850” The Municipal Council of the City of Kimberley, in open meeting assembled, enacts as follows: 1. Bylaw No. 1850 is amended in the manner set forth in this Bylaw. 2. Section 7.01 is amended by adding a new Zone Title and Short Title under the
category of Commercial Zones, as follows: Zone Title Short Title
“Recreational Residential Zone R-6A”
3. A new section 7.08.01 Recreational Residential Zone: R-6A is added as set out
Schedule “A” attached hereto and forming part of this Bylaw. 4. The Zoning Map, Schedule “A” attached to and forming part of Bylaw No. 1850, is
amended by rezoning a portion of those lands legally described as Lot 13, District Lot 13799, Kootenay District, Plan 12597, Parcel Identifier: 011-926-571, civically identified as 931 Dogwood Drive, Kimberley, BC from “Recreational Residential Zone: R-6” to “Recreational Residential Zone: R-6A”, as shown in heavy outline on the map in Schedule “B” attached hereto and forming part of this Bylaw.
5. If any section, subsection, clause, phrase or word of this Bylaw is held to be invalid by
a decision of a court of competent jurisdiction, the invalid section, subsection, clause, phrase or word shall be severed, and the severance shall not affect the validity of the remainder.

RECREATIONAL RESIDENTIAL ZONE: R-6A 7.08.01
(1) Intent
The intent of this zone is to provide for low density residential use with provision for temporary lodging by visitors near the Kimberley Alpine Resort area.
(2) Permitted Uses
Within this zone, the following uses only are permitted:
(a) single family dwelling; (b) public utility use; (c) park.
(3) Accessory Uses
(a) bed and breakfast;
(b) despite any other provision of this Bylaw, a single family dwelling in this zone
may be used for tourist accommodation of not more than four bedrooms and 8 guests during periods when not occupied for residential use.
(4) Parcel Area and Dimensions
No parcel shall be created in this zone which is less than 266 m2 (2864 ft2) in area.
(5) Density
No person shall construct or permit construction of more than one (1) single family dwelling on a parcel in this zone.
(6) Siting
(a) No person shall site a principal building in this zone which has:
(i) a front yard less than 5.0 m (16.4 ft.); (ii) a rear yard less than 5.0 m (16.4 ft.); (iii) an interior side yard less than 1.5 m (5 ft.); (iv) an exterior side yard less than 2.0 m (6.6 ft.);

(b) No person shall construct or permit construction of an accessory building or structure in this zone
(7) Size and Dimensions of Buildings and Structures
No person shall construct or permit construction of a principal building in this zone which exceeds a height of 10.5 m (35 ft.).
(8) Other Regulations
(a) No person shall use or permit the use of any portion of a parcel in this zone
for the repair of vehicles or for the storage of more than one (1) derelict vehicle.
(b) All persons carrying out a use permitted in the R-6 zone shall comply with the
relevant provisions of Sections 4 (General Regulations), 5 (Parcel Area Requirements) and 6 (Parking and Loading Regulations) of this Bylaw.
