• The Charles Town Utility Board's (CTUB) Resolution No. 2019-01 - Resolution of
the Charles Town Utility Board in Support of the Route 9 Sewer Infrastructure
Project State Funding Package and the desire not to add amendments to the
agreement between the Utility Board and Rockwool. It has now been revealed
that CTUB is assisting Rockwool in their negotiations with the State to receive
public funding for the Route 9 Sewer Infrastructure Project.
IV. REPORTS
A. Ward Reports
Ward #2 - Mr. Tester reported he attended a ceremony with the WV State Treasurer,
Mr. Riley Moore, for the presentation of a check to the City of Charles Town
representing unclaimed money in the amount of approximately $20,000.
Ward #3 - Mr. Coyle reported that despite the unusual weather, the May 8th
Mother's Day Celebration event in downtown was a success.
Ward #3 - Ms. Petti reported the following:
• The Izaak Walton League's Annual Fishing Derby will be held on Saturday,
June 5, 2021;
• Jefferson County Parks and Recreation Department is accepting registration for
the Jefferson Memorial Park Tennis League. Interested parties should sign up
soon as spots are filling up fast; • Jefferson County Museum now has a “TikTok” page where patrons will be
able to view short videos;
• Potomac Valley Audubon Society is holding a native plant sale at Sunny
Meadows Garden Center on May 22, 2021; and • Ranson Community Garden is holding a cooking demonstration on May
22,2021.
Ward #4 - Ms. Twyford reported the following:
• She attended the Mother's Day Celebration event and congratulated Charles
Town Now on the fantastic job they did; • Her congratulations to Maggie Slover - Mayor of the Day winner;
• That outdoor seating is becoming very popular in cities throughout the
Country; and
• Washington High School will be having a drive-thru parade for all the
graduating seniors on Thursday May 19th at 6:00PM
Ward #4 - Mr. George reported he also attended the Mother's Day Celebration event
and had a wonderful time.
He reported he attended the following meetings:
• Personnel Committee;
• Historic Landmarks Commission; and
• Charles Town Utilities Board
B. Mayor's Report
Mayor Trainor reported he attended the following: • Finance Committee meeting;
• Police Pension Board meeting;
• Jefferson County Commission meeting where he presented the findings and
recommendations in the Homelessness Committee Report; • Mother's Day Celebration in downtown Charles Town; and
• WV State Treasurer's unclaimed property check presentation at the
Municipal Building.
1. 4794: Mayor for a Day Contest Winner(s)
Mayor Trainor congratulated the winner of the Mayor for a Day contest Maggie
Slover and runner up Lucy Field. Each contestant received a certificate,
commemorative coin and had the opportunity to present their ideas to the
Council.
C. Committee Reports
1. 4806: Finance Committee Report for May 4, 2021
Mayor Trainor reported that the Finance Committee met on May 4, 2021. The
FY21 General Fund Budget Revision will be discussed and voted on later in the
meeting.

2. 4807: Personnel Committee Report for May 10, 2021
Mr. George reported that the Personnel Committee met on May 10, 2021. The
committee requested City staff to create a policy for payment of employee
benefits while on extended leave and a policy on maternity/paternity leave for
the committee to review and finalize. He also reported that the June meeting is
cancelled because of the upcoming election and the seating of the new City
Council.
3. 4808: Street Committee Report for May 13, 2021
Mr. Hines reported the Street Committee did not meet due to a lack of a quorum.
The Pavement Condition Assessment Report will be presented to the new City
Council at a future meeting.
D. City Manager's Report
Daryl Hennessy reported the following:
▪ The pool at Jefferson Memorial Park will be opened on Memorial Day this year
to start the 2021 summer season;
▪ The Charles Town Utility Board land parcels in Tuscawilla Hills and Patrick
Henry Estates have been completed.
▪ The American Rescue Plan funds have not yet been distributed from the State;
and
▪ The early voter turn-out for the election so far is roughly double that of the
early voter turn-out numbers at this juncture of the 2019 municipal election.
1. 4811: Boards and Commissions Roster (as of May 10, 2021)
The City Manager reviewed with Council the vacancies on the City of Charles
Town’s various Boards and Commissions.
2. 4812: Vacant Structures Tracking List
The City Manager reviewed the vacant structure tracking list with the Council.
E. Police Chief's Report
Chief Kutcher informed the Council that the Charles Town Police Department is
continuing to advertise for the department's police officer vacancy.
He thanked everyone who celebrated National Police Week 2021 by showing their
appreciation for the Charles Town Police Department. In particular, he thanked the
Charles Town Utility employees, Mrs. Wasson's 2nd grade class at C.W. Shipley
Elementary School, and Mrs. Flinchum's kindergarten class at Asbury Little Angels
Preschool.
Finally, he reported that a few vehicles, that were left unlocked, had been broken
into over the weekend. He reminded everyone that they should lock their cars and
not leave anything of value in them.
V. UNFINISHED BUSINESS
1. 4802: Public Hearing on Amendments to the Codified Code of the City of Charles
Town, West Virginia with Regard to Part 11 Health and Sanitation Code,
Article 1101 Nuisances
Mr. George moved to open the public hearing on the Second Reading and
Consideration of Amendments to the Codified Code of the City of Charles
Town, West Virginia with Regard to Part 11 Health and Sanitation Code,
Article 1101 Nuisances. Mr. Coyle seconded the motion. Hearing no
objections, Mayor Trainor opened the public hearing.
Mr. Hennessy informed the Council that no one signed up for public comment.
Mr. George moved to close the public hearing. Mr. Coyle seconded the

Since approving this item would require a budget revision, the Committee voted to table it until the new City Council is seated.

2. B&O Penalty and Interest Waiver Request (4838)
Staff presented a B&O penalty and waiver request submitted by Ms. Karen Henline, Murray Sheet Metal. Ms. Henline explains in her waiver request that the B&O taxes were sent to Charleston, WV instead of Charles Town, WV. After being notified of the error, Ms. Henline contacted the City of Charleston, informed them of the error and submitted the full amount due to the City of Charles Town. She also requested that the City waive the penalty and interest charges associated with the late B&O payment. Since this situation appears to have been an honest mistake and was corrected shortly after Murray Sheet Metal was notified of the non-payment of B&O taxes due to Charles Town, the Committee authorized staff to waive the penalty and interest fees.

3. Establish New Bank Account – American Rescue Plan (4835)
Per the American Rescue Plan (ARP) requirement that any and all ARP funds must be held and accounted for in a separate account, the Committee authorized the City to open a separate account for the anticipated ARP funds. Further, since the Bank of Charles Town (BCT) offered a slightly better interest rate and terms than the City’s other banking partner, the Committee recommended that staff open the account at BCT.

4. Establish New Bank Account – Parks and Recreation USTA (4836)
The United States Tennis Association (USTA) has revised their fee collection process. Instead of localities collecting tournament fees and remitting dues to USTA, fees will be paid directly to USTA, who in turn will remit the locality’s share directly to their bank account. The Committee authorized the City to establish a separate bank account for USTA sponsored tournaments, per Staff’s recommendation.

WHEREAS, on March 16, 2020, Governor Jim Justice declared a state of emergency for all counties in West Virginia to allow agencies to coordinate and create necessary measures to prepare for and respond to the outbreak of COVID-19; and WHEREAS, on March 23, 2020 Governor Jim Justice issued Executive Order 09-20 requiring West Virginians to stay-at-home and non-essential businesses within the state to temporarily cease operations as a means for slowing the spread of COVID-19; and WHEREAS, in response to the Governor’s initial directives, City Council adopted Resolution
#2020-006 at a special meeting on March 30, 2020, to temporarily suspend Section 111.01(1)(a)
of the city code and conduct future Council meetings telephonically or through other electronic
means; and
WHEREAS, on April 27, 2020, Governor Justice released initial guidance entitled West Virginia
Strong – The Comeback, a plan for reopening West Virginia’s economy and setting the stage for
lifting some of the public gathering restrictions imposed in his previous executive orders;
WHEREAS, The Comeback guidance continues to be periodically updated but was supplemented
on November 14, 2020 with Executive Order 77-20, which requires face coverings in all public
buildings and created a communication issue for members of Council and the public who found it
difficult to hear others behind the face coverings; and
WHEREAS, Governor Justice has recently started to lift face covering restrictions for some West
Virginians and publicly announced his intention for a more widespread lifting of the face covering
mandate on June 20, 2021;
WHEREAS, while COVID-19 remains present in the community, public health officials have
acknowledged that its risks are mitigated by the presence of vaccines, social distancing and
sanitation practices, and lower prevalence of community spread.
NOW, THEREFORE BE IT RESOLVED, the Charles Town City Council rescinds Resolution #2020-006 and plans to hold all future City Council meetings in the Council Chambers beginning with the next regularly scheduled meeting on June 22, 2021; and
NOW, THEREFORE BE IT FURTHER RESOLVED, that Council will allow, to the extent it does not conflict with any other rules or by-laws, that other City Boards, Committees, and Commissions may continue to conduct meetings telephonically or by other electronic means under the requirements that all members and staff may hear, and be heard, by each other, and by which members of the public may, at a minimum, hear the proceedings, until such time as the new Council convenes to review the matter.
