Nature of Council’s Role in Decision Making Advocacy: When Council advocates on its own behalf or on behalf of its community to

another level of government/body/agency. Executive/Strategic: The substantial direction setting and oversight role of the Council, e.g. adopting

plans and reports, accepting tenders, directing operations, setting and amending budgets.

Legislative: Includes adopting local laws, town planning schemes and policies. Review: When Council reviews decisions made by Officers. Quasi-Judicial: When Council determines an application/matter that directly affects a person’s

rights and interests. The Judicial character arises from the obligations to abide by the principles of natural justice.

5. Declaration of Interest

Members should fill in Disclosure of Interest forms for items in which they have a financial, proximity or impartiality interest and forward these to the Presiding Member before the meeting commences. Section 5.60A: “a person has a financial interest in a matter if it is reasonable to expect that the matter will, if dealt with by the local government, or an employee or committee of the local government or member of the council of the local government, in a particular way, result in a financial gain, loss, benefit or detriment for the person.” Section 5.60B: “a person has a proximity interest in a matter if the matter concerns – (a) a proposed change to a planning scheme affecting land that adjoins the person’s

In accordance with Reg. 7(4)(a) of the Local Government (Administration) Regulations 1996, members of the public in attendance at the meeting may stand, state aloud their name and address, and ask a question in relation to any matter over which the municipality of Bunbury has jurisdiction or involvement. In accordance with Standing Order 6.7(3)(a) a person wishing to ask a question, must complete a question form which is provided in the trays at the back of the public gallery and on the City’s website. The completed form must include your name and address and contain no more than three (3) questions. Summary The purpose of this report is to present the results from the public comment period regarding the recommended site for the Youth Precinct. Executive Recommendation That Council: 1) Endorse a portion of Lot 681 (Luciana Park) as presented at Appendix DCCS 1 as the preferred

site for a new Youth Precinct;

2) Request the Chief Executive Officer engage a suitably qualified contractor to commence a community engagement process in order to produce a concept design and management plan for the Youth Precinct encompassing elements that may include but are not limited to parkour, adventure play, skate park, landscaped open space, exercise areas, useable public art and performance/event spaces.

Regional Impact Statement The Youth Precinct will become a destination park that will be a drawcard for locals and tourists alike, offering a central location for young people to socialise and interact in the Bunbury Geographe region. Whilst it is anticipated that a skate park will form only a portion of the Youth Precinct, it is relevant to note that the City of Bunbury currently has two skate parks; one in Glen Iris and one in the CBD on Blair Street. In comparison to other skate parks in the region, Bunbury’s skate parks lack potential and fail to accommodate for the future needs of the skateboarding community in Bunbury. In 2016, the City of Busselton launched the Busselton Youth Precinct and Skate Park. The Shire of Dardanup is currently in the concept design phase of developing a new skate park in Eaton, whilst the Shires of Harvey and Capel also currently have well-established skate parks. Background The Youth Advisory Council (YAC) made a recommendation to Council on 19 February 2019 to endorse a portion of Lot 681, commonly referred to as Luciana Park, as the preferred site for a new Youth Precinct. Council resolved to support the recommendation subject to a 30-day period of public comment as per the below:

Council Decision 034/19 That Council: 1. Endorse Lot 681 (Luciana Park) as presented at Appendix RAC-1 as the preferred site for a

new Youth Precinct subject to a period of public comment of no less than thirty (30) days; 2. Request the Chief Executive Officer present a summary of all submissions received during the

public consultation period to Council for consideration; 3. Appoint the Youth Advisory Council Committee as the steering group for additional

community engagement relating to the Youth Precinct.

The public comment period was open from 20 February to 22 March 2019 via the City’s online engagement platform Social Pinpoint, asking community members if they support the proposed site and the reason/s for their opinion. 217 submissions were received with 173 ‘yes’ responses (80%) and 44 ‘no’ responses (20%).

The submissions against the proposed site can be categorised into the following seven themes:

Theme 1: The location is “prime land” and “too valuable” for the proposed facility. Many believed it will be “eye sore” that will negatively affect the aesthetic look as the entry or “gateway” into the CBD. Some respondents suggested that this “prime” location could be better utilised for other purposes, such as parking, future development and expansion, large park/green open space and something for all ages.

30 It is to be noted that the Youth Precinct’s proposed site is for only a portion of Luciana Park (Lot 681) to allow for other uses in the north-west corner of the park. The next stage of community engagement is concept design which will identify key components and specifically aim to make the facility an attractive entry statement and create interconnectivity between the CBD and Koombana Bay.

Theme 2: Existing skate park is sufficient Some submissions believed there are already two skate parks in the City of Bunbury and that is adequate. Respondents suggested extending the current skate park on Blair Street.

15 The proposed project is for a Youth Precinct, not just a skate park. Nonetheless, the current skate park on Blair Street is aged and too small to cater for the demand and larger events. In the site analysis, it was noted that the area could not accommodate further expansion.

Theme 3: Better location for the Youth Precinct Other suggestions were made on locations such as Withers, near Big Swamp and Back Beach.

These sites were considered in the first round of consultation and subsequent site assessment however did not score as highly as Luciana Park.

Theme 4: Anti-social behaviour Respondents believed the Youth Precinct would encourage crime, litter and increased noise.

9 Research suggests that having a youth facility in an open area with passive surveillance decreases the risk of anti-social behaviour, which is what the proposed site offers.

Theme 5: Negative impact on current events Respondents voiced their concerns about the impact of events such as Australia Day fireworks and 4WD expo.

5 The Youth Precinct would be built to cater for large scale events and take into consideration the fireworks. The Events team at the City of Bunbury have been consulted and can find alternative locations for events.

Theme 6: Inadequate community engagement Respondents believed that the community consultation process is “flawed” and insufficient to gauge community opinion.

5 The Social Pinpoint consultation was open from 1-31 October 2018 and was promoted through various communication channels (online, traditional and face-to-face).

Theme 7: Safety concerns Issues regarding the site’s safety due to its close proximity to the water and a main road were raised. One nearby resident suggested it would increase the traffic on Koombana Drive.

3 Safety will be a key consideration in the concept design stage of the project.

Council Policy Compliance Not applicable. Legislative Compliance Planning and Development Act 2005 Greater Bunbury Region Scheme Part 6 The proposed development of a Youth Precinct on reserved land will require the City of Bunbury to seek planning approval from the Western Australian Planning Commission under Part 6 of the Greater Bunbury Region Scheme to enable the development on portion of Luciana Park. Officer Comments

The public comment period was promoted through various communication channels including City Focus, City Beat, a media release and social media posts (City of Bunbury and Youth Advisory Council accounts). A letter was dropped into all residential mailboxes in Lyons Cove and an email was sent to all nearby businesses and organisations including Bunbury Regional Entertainment Centre and Quest Apartments. Additionally, members of the Youth Advisory Council conducted face-to-face consultation at the Action Sports Games held at the Bunbury skate park on Sunday 17 March. The members met with spectators to inform them about the project and enable them to complete the survey via an iPad. The ‘yes’ responses were positive about the possibility of a youth precinct at the proposed site as a central location that is accessible and provides connectivity to other facilities in Bunbury. Many noted that the area was currently underutilised and welcomed the opportunity for the space to be activated as a youth hub and somewhere for the entire community to enjoy. Verbal and written feedback questioned the future of the current skate park if this facility was to be built. This will be clarified to the community once a formal decision has been made.

In relation to the skate park component, it is important to note that concept design of the Youth Precinct is proposed to take place following Council’s decision on the proposed site. Whilst it is expected that a skate park will form part of the project, other elements may include but are not limited to:

- Parkour - Urban playground - Adventure play - Sports climbing - Exercise areas - Hangout spaces - Useable public art - Performance/event spaces - Multi-use games areas - Landscaped open space - Casual activity spaces Examples of recently completed youth precinct-type developments in Western Australia can be viewed at Appendix 3. Survey respondents will receive an email outlining the Council decision within three (3) working days of the resolution. Whilst 44 ‘no’ responses were received, many responses provided reasons that crossed a number of themes, hence why the Number of Submissions Relating to Theme in the above-listed table is larger than 44. Social Pinpoint was used as the survey mechanism as it is now the City’s standard practice to utilise this portal. The portal tracks IP addresses meaning that staff can assess whether individuals make multiple submissions with the intention of swaying a result. Staff can confirm that this did not take place for this consultation. Communications indicated that should people wish to make a submission but were not comfortable using Social Pinpoint they were invited to contact the City to lodge their comments. One paper-based and one email submission was made regarding the site selection. The former was received by the City on 26 March which was after the close of the consultation period. The comments have therefore not been included in the abovementioned statistics; however the 2 submissions are at attachment DCCS 4 for Elected Member information. The latter was received via Councillor Warnock’s email address on Friday 22 March prior to the closing date and therefore has been included. Should Council endorse the recommendation, staff will commence a procurement process to appoint a suitably qualified contractor to conduct community consultation in order to develop a concept design and management plan.

Analysis of Financial and Budget Implications $50,000 is allocated in Council’s 2018/19 budget for PR-4603 Implement planning and community consultation for a proposed new skate park.

$100,000 is allocated in Council’s 2018/19 budget for PR-4631 Develop business cases for future capital works. Outcome – Council Meeting 16 April 2019 The recommendation (as printed) was moved Cr Kelly, seconded Cr Steele. During debate on the matter Cr Steck foreshadowed an alternate motion in the event that the executive recommendation was not carried, as follows: That Council request the Chief Executive Officer research Pioneer Park (Russell Esplanade) as an option for the proposed Youth Precinct, and report back to Council in this regard as soon as possible, and in any case prior to the end of May 2019. Cr Steck moved and Cr Smith seconded a procedural motion pursuant to Standing Order 11.6 that debate on this matter be adjourned for 6 weeks to enable further site considerations. The Mayor put the procedural motion to the vote and it was LOST 3 votes “for” to 8 votes “against”. For: Cr Steck, Cr Smith, Mayor Brennan Against: Cr Kelly, Cr Steele, Cr Morris, Cr McCleary, Cr Brown, Cr Miguel, Cr Cook, Cr Warnock The Mayor put the substantive motion to the vote and it was adopted to become the Council’s decision on the matter.

Council Decision 101/19 That Council: 1) Endorse a portion of Lot 681 (Luciana Park) as presented at Appendix DCCS 1 as the

preferred site for a new Youth Precinct; 2) Request the Chief Executive Officer engage a suitably qualified contractor to commence a

community engagement process in order to produce a concept design and management plan for the Youth Precinct encompassing elements that may include but are not limited to parkour, adventure play, skate park, landscaped open space, exercise areas, useable public art and performance/event spaces.

Background The Western Australian Planning Commission has resolved to prepare a land use planning strategy for the Bunbury-Wellington sub-region. This work will be undertaken by the Department of Planning, Lands and Heritage on behalf of the Commission. The context of this project and a description of the strategy area are outlined in the Terms of Reference, is attached at DPDS 1. The success of this project will require contribution from a large and diverse range of stakeholders. To facilitate this, the Commission is forming a Steering Group and Five themed Working Groups.

The purpose of the Steering Group will be to guide the Department of the preparation of the Strategy and to provide advice to the Commission. As per the Terms of Reference, the Commission is seeking a member of Council to participate on the Steering Group. It is anticipated that the Steering Group would meet twice per hear of the three year duration of the project. The first Steering Group Meeting will take place on 20 May 2019. The City of Bunbury has been invited to nominate a Council representative to the Steering Group. Council Policy Compliance There is no policy compliance consideration impacting on this report. Legislative Compliance The proposed Strategy will form part of the State Planning Framework under the Planning and Development Act 2005. Officer Comments The proposed land use planning strategy for the Bunbury-Wellington sub-region will be the overarching policy guiding the strategic planning of the region and will influence future planning strategies for the City of Bunbury. It is therefore important that the City of Bunbury has representation during the formulation of the strategy. The CEO conducted a secret ballot with Cr Brown being the successful nominee. The recommendation including Cr Brown as the Council nominee was moved Cr Steele, seconded Cr Miguel.
