City of Becker City Council Regular Meeting of September 7, 2021 The Becker City Council met in regular session at 5: 00 p. m. on Tuesday, September 7, 2021, at 12060 Sherburne Avenue, Becker. Present: Mayor Tracy Bertram, Council Members Rick Hendrickson, Robin Dingmann, Mike Doering, and Becky Olmscheid. Guests were in attendance. 1. Mayor Tracy Bertram called the September 7, 2021, City Council Meeting to order at 5: 00 p. m. 2. The Pledge of Allegiance was recited. 3. Minutes from the August 24, 2021 City Council and Executive Session Meetings and August 30, 2021 Special City Council Meeting were reviewed. Dingman / Olmscheid motioned to approve the minutes. All Council Members present voted in favor of the motion. The motion carried. 4. Hendrickson / Doering motioned to approve the agenda as presented for September 7, 2021. All Council Members present voted in favor of the motion. The motion carried. 5. Mayor Bertram invited guests to speak during the Guests and Open Forum. Brian Zachman stepped forward to speak on behalf of his fence height variance request, which was on the agenda. He stated his reason for the request ( safety of his kids), and his challenges to the reasons given to him at the Planning Commission Public Hearing that was held previously. He also noted that there were trees where he would be allowed to put the fence, so he wanted to put the fence on the outside of the trees. 6. Council reviewed committee meetings. Budget and Finance Committee met on August 25, 2021 and went over financials through July. The City had received the first half of tax settlements. The BCC was continuing to move in the right direction financially and Golf was doing excellent. They also discussed water revenue, which was up due to usage, the investment portfolio review, update on short- term lending if needed, past due utilities water shut offs to resume, PCI compliance for taking credit cards, and updated numbers for the golf simulators project. The Senate Capital Investment Committee stopped in Becker as part of their tour on August 26, 2021. There were several community partners present as well. The City was asking for funds for the engineering portion of the Highway 10 and Highway 25 intersection project. The meeting went very well. Police Management Committee met on August 27, 2021 and discussed police department staffing, which the department is currently fully staffed, two recent hires that came from other departments with experience, Chris Lindbloom' s promotion to Lieutenant, the new Recreational Vehicle ordinance, which the department had received 16 applications for with no issues reported. those living outside the City, which after research and discussion, would beallowed. Police Department staff is working on Chapters 9 and 10 updates. The
committee also discussed current statistics, which were up slightly from 2020,the 2022 budget, and the co- responder program that had a mental health
professional ride along with police in alternating communities in SherburneCounty, which was going really well.
Planning Commission met and held a public hearing for a fence variance, whichwas on the agenda, called for a public hearing on Chapter 11 edits, and gavestaff direction to do more research and bring back more information on the fenceordinance.
7. Public Works Director, Phil Knutson, presented a request to authorize staff to build apark pavilion at Snuffy's Landing. This was part of the project staff had been workingon with the Becker Lion' s Club, who had donated the funds for the improvements atSnuffy's Landing. The site had been prepped and was ready for the building. Staff was
pursuing a variance for the building and the Minnesota Department of Natural ResourcesDNR) had been on site and supported the location, staff was just waiting on a formal
comment from the DNR, which would follow the variance process. Staff already hadcommitments for materials and labor with the hope of the project being done this year,weather permitting. He also noted that the updated license agreement with Xcel Energyhad language in it that allowed the City to create a structure like this on the site. Therewas discussion about the variance request and construction timeline. Doering /Dingmann motioned to approve the buildout of a pavilion at Snuffy's Landing. AllCouncil Members present voted in favor of the motion. The motion carried.
8. City Planner, Mary Roe, presented a fence height variance request that staffrecommended be denied. She gave a brief background of the property and request.The lot was a corner lot, which the ordinance stated, " corner lots have two front yard
setback requirements, one for each side facing the street, and shall also have two sideyards of 10 feet for the remaining two sides." There was a Public Hearing held at thePlanning Commission meeting on August 30, 2021. She stated that one written
comment was received that would prefer the fence be set back 10 feet, and three
people spoke at the public hearing including the homeowner, who were in support ofthe variance. There was a lot of discussion about the request, and it was noted thatstaff had been directed to review the ordinance as it related to the fence variances andbring back to the Planning Commission at the next meeting. It was noted that most of
the Planning Commission was supportive of the variance request, but as the ordinance isright now, the request did not meet the requirements to approve it. After furtherdiscussion Hendrickson / Doering motioned to approve Resolution 21- 74, a resolutiondenying a variance for an increase in the height requirement as defined in the single-family residential zoning district to allow for a six-foot tall fence in the front yard of theproperty identified as PID 60- 407- 0140 ( 13202 Brenda Boulevard SE) in Becker,Sherburne County, Minnesota. All Council Members present voted in favor of themotion. The motion carried.
Staff was directed to keep in contact with the homeowner on any potential changes tothe ordinance at the next Planning Commission meeting and subsequent City Councilmeetings.

9. Community Development Director, Marie Pflipsen, presented a request for a propertysale with Potter Investments, LLC. TJ Potter Trucking ( Potter Investments, LLC) wantedto purchase two city parcels adjacent to their current facilities for additional storage areawith the intent to construct a large expansion on their recently constructed warehouse.The City recently approved a lease for the property, but Potter would like to moveforward with a purchase, so they are able to combine their current property with thenewly acquired property to allow for a building expansion. Dingmann / Doeringmotioned to approve Resolution 21- 75, a resolution authorizing the purchase agreementand sale of property owned by the City of Becker to Potter Investments, LLC for theirbusiness expansion. All Council Members present voted in favor of the motion. The
motion carried.
10. Finance Director, Mark Ebensteiner, presented the 2022 preliminary levies. The state
required that all jurisdictions with tax authority certify proposed levies by September30th.
These levies were used in preparing parcel specific notices of proposed propertytaxes for each parcel of property for the taxes payable in 2022. Overall, the total
general fund preliminary levies increased $ 855, 709 or 10. 5 percent over 2021 and the
Capital Improvement levies was $ 2, 617, 223. The 2022 City and EDA local tax capacityrates were 44.311 percent for the City and 1. 086 percent for the EDA. The Truth- in-Taxation Public Hearing would also be set for December 7, 2021 at 6: 00 pm. After the
short presentation on the preliminary levy, Hendrickson / Doering motioned to approveResolution 21- 73, a resolution setting proposed property tax levies for 2022 for the Cityof Becker. All Council Members present voted in favor of the motion. The motion
carried.
11. City Administrator, Greg Pruszinske, presented the revised Consent Agenda consisting ofthe following:
Hiring and Termination Reports for Becker Community Center, Public Works, andPebble Creek Golf Club.
Partial pay request No. 1: Pember Companies, Inc. for the Hauled WasteReceiving Station Modifications in the amount of$ 111, 245. 00.
Partial Pay Request No. 1: American Liberty Construction for 2020 New MunicipalWellfield — Contract B: New Well House in the amount of $120, 597. 64.
Construction Assistance Agreement with Mahler Architects for the Golf Simulator
buildout project.
Watering Restriction Extension
Doering / Olmscheid motioned to approve the revised Consent Agenda as presented. All
Council Members present voted in favor of the motion. The motion carried.
12. Dingmann / Hendrickson motioned to pay the bills including checks 8003 through 8193and 103677 through 103789. All Council Members present voted in favor of the motion.
