The replacement home is similar in appearance to the previous home and is respectful of the host community. The size of the proposed home is similar to the existing residences in the immediate community. If Council decides to grant the exemption, site plan approval is required before a building permit can be issued. Staff recommends that Council approve the ICBL exemption request for 27 Crescent Hill Drive North. RECOMMENDATIONS: 1. BACKGROUND

On February 13 2013 City Council enacted a one year Interim Control By-law 35-2013 (ICBL) to control additions to existing residential dwellings or replacement dwellings within the Citys mature neighbourhoods starting March 1 2013 On February 26 2014 Council granted a one year extension to the ICBL in order to complete a study on infill development in the Citys mature neighbourhoods The study will recommend land use control policies to assess new infill development proposals The ICBL will expire on February 28 2015 The ICBL applies to all additions to residential dwellings or replacement dwellings that propose an increase in gross floor area beyond 15 percent of the existing floor area of the dwelling

The ICBL seeks to protect the Citys mature neighbourhoods from incompatible building additions or replacement dwellings otherwise permitted by existing zoning regulations The provisions of the Citys Zoning By-law for many of the older neighbourhoods throughout Brampton are based on historical zoning regulations that generally permit lot coverages setbacks and building heights that exceed those of the existing dwellings within these mature communities

City Council directed staff to initiate a study to examine the impact of infill development on mature neighbourhoods within Brampton The policy review will include a review of the Citys current zoning regulations and Official Plan policies with respect to infill development to ensure that the Citys mature neighbourhoods are adequately protected from incompatible building additions or replacement dwellings

Exemption Criteria

Property owners who seek an increase in gross floor area beyond 15 percent of the dwellings existing floor area must obtain an exemption from the ICBL Adoption of an exemption to By-Law 35-2013 by City Council is required before the City can issue a building permit to construct the replacement dwelling

As the ICBL seeks to temporarily control incompatible building additions or replacement dwellings within the Citys mature neighbourhoods pending the outcome of the policy review all exemption requests are reviewed and assessed by City staff before a recommendation is presented to Council

At its March 27 2013 meeting Council endorsed the following criteria to be applied by staff when assessing exemption requests

bull Whether the addition to the existing dwelling or replacement dwelling is respectful of the physical character of the existing neighbourhood with regard to massing built form and siting matters

bull Whether the development proposal generally support the principles of Chapter 7 of the Citys Development Design Guidelines (Architectural Control Guidelines) with respect to streetscape design and architectural design standards and

bull Whether satisfactory drainage and property maintenance can be adequately provided

Streetscape design considerations address the relationship between the street and building and to massing and building height compatibility with adjacent dwellings Architectural design considerations address fagade improvements building projections and the proposed design of main entrances roof lines and porches

Staff applies the foregoing criteria to demonstrate due consideration of the existing built-form and physical character of the host community and that the height and massing of the proposed addition or new construction is appropriate

CURRENT SITUATION

ICBL Exemption request for 27 Crescent Hill Drive North

Property Description

bull 27 Crescent Hill Drive North is located north of Dixie Road on the east side of

Howden Boulevard in the Central Park Secondary Plan Area (SP11)

bull The property is zoned Residential R1A -102

bull The property is located in an area that is subject to site plan control

Proposal

bull To permit a replacement dwelling of approximately 2864 sq m (30828 sq ft) which was destroyed by a fire in 2013 The original gross floor area of the home was 17182 sq m (18495 sq ft)

bull The proposal represents an increase of 666

The exemption requested is to construct a replacement dwelling that is larger than the previous dwelling that was destroyed in a fire in July 2013

Assessment

The property owners have designed the replacement dwelling to be similar to their previous home with larger rooms in the rear of the house so that it will not be visible

from the street The replacement dwelling has been sited farther back on the lot in order to comply with the existing front yard zoning set back requirements The size of the replacement homes is similar to the existing residences in the immediate neighbourhood

Zoning Services has reviewed the proposal and have advised that a variance is not required No servicing or drainage issues have been identified as part of this review

Urban Design staff has reviewed the submission and is satisfied that the proposed addition meets the exemption criteria and complies with the Citys Architectural Control Guidelines From an urban design perspective the proposal is compatible with and sympathetic to the existing architectural style of the area which is characterized primarily by large bungalows and one and two storey homes

The property is located in a site plan control area and subject to site plan review If the ICBL exemption is granted the property owner can then pursue site plan approval following which building permits are required to construct the replacement dwelling

The proposed addition satisfies the Council approved criteria for exemption Staff recommends that the exemption be granted so that the property owner can complete the site plan approval process and secure building permits from the City to construct the replacement dwelling

There are no costs anticipated to the City

Corporate Services and Planning amp Infrastructure staff has reviewed the content of this report Comments received as part of this circulation are contained herein

CONCLUSION

Staff recommends that Council enact an exemption by-law (attached as Appendix C) to allow the property owner to pursue site plan approval and acquire a building permit to construct the replacement dwelling at 27 Crescent Hill Drive North

Hi Jeff

It is Jan Petrykowski from JAP Design Studio

We talked about this project some time ago

As you know my clients house burned down in the Summer

They hired me to design a new house in the same location

The existing house was about 1850 sf plus 570 sf garage

The proposed replacement house is 3080 sf plus 658 sf garage X M- fe

Iknow it looks like abig increase but when you compare the exiting layouts (before fire)

and the new once they are very similar only the rooms are bigger to reflect the needs ofabig

family (see attached plans and the letter from my clients)

We will utilize the same driveway and notrees will be injured orremoved

The street will benefit because the proposed house is much nicer and reflects the style of the

neighborhood The lot is very large so the increase ofthe GFA is insignificant from the urban point ofview the added volume is at the back so it will not be visible from the street

Also the position of the house onthe lot isalmost identical We had tomove it slightly back

to comply with the current zoning (front yard) requirements

Otherwise the house complies with the current zoning by-laws

The Council of The Corporation of the City of Brampton in accordance with the provisions of the Planning Act RS01990 cP 13 hereby ENACTS as follows

123 On lands described as Concession 5 EHS Part of Lot 6 and referenced as the Lands Subject to Specific Exemption From Interim Control By-Law 35-2013 as amended by By-Law and as shown on Schedule A to this by-law as 27 Crescent Hill Drive North there shall be permitted a dwelling with a total gross floor area not exceeding 3100 square feet

It is Jan Petrykowski from JAP Design Studio

We talked about this project some time ago

As you know my clients house burned down in the Summer

They hired me to design a new house in the same location

The existing house was about 1850 sf plus 570 sf garage

The proposed replacement house is 3080 sf plus 658 sf garage X M- fe

Iknow it looks like abig increase but when you compare the exiting layouts (before fire)

and the new once they are very similar only the rooms are bigger to reflect the needs ofabig

family (see attached plans and the letter from my clients)

We will utilize the same driveway and notrees will be injured orremoved

The street will benefit because the proposed house is much nicer and reflects the style of the

neighborhood The lot is very large so the increase ofthe GFA is insignificant from the urban point ofview the added volume is at the back so it will not be visible from the street

Also the position of the house onthe lot isalmost identical We had tomove it slightly back

to comply with the current zoning (front yard) requirements

Otherwise the house complies with the current zoning by-laws

bull Whether satisfactory drainage and property maintenance can be adequately provided

Streetscape design considerations address the relationship between the street and building and to massing and building height compatibility with adjacent dwellings Architectural design considerations address fagade improvements building projections and the proposed design of main entrances roof lines and porches

Staff applies the foregoing criteria to demonstrate due consideration of the existing built-form and physical character of the host community and that the height and massing of the proposed addition or new construction is appropriate

CURRENT SITUATION

ICBL Exemption request for 27 Crescent Hill Drive North

Property Description

bull 27 Crescent Hill Drive North is located north of Dixie Road on the east side of

Howden Boulevard in the Central Park Secondary Plan Area (SP11)

bull The property is zoned Residential R1A -102

bull The property is located in an area that is subject to site plan control

Proposal

bull To permit a replacement dwelling of approximately 2864 sq m (30828 sq ft) which was destroyed by a fire in 2013 The original gross floor area of the home was 17182 sq m (18495 sq ft)

bull The proposal represents an increase of 666

The exemption requested is to construct a replacement dwelling that is larger than the previous dwelling that was destroyed in a fire in July 2013

Assessment

The property owners have designed the replacement dwelling to be similar to their previous home with larger rooms in the rear of the house so that it will not be visible

from the street The replacement dwelling has been sited farther back on the lot in order to comply with the existing front yard zoning set back requirements The size of the replacement homes is similar to the existing residences in the immediate neighbourhood

Zoning Services has reviewed the proposal and have advised that a variance is not required No servicing or drainage issues have been identified as part of this review

Urban Design staff has reviewed the submission and is satisfied that the proposed addition meets the exemption criteria and complies with the Citys Architectural Control Guidelines From an urban design perspective the proposal is compatible with and sympathetic to the existing architectural style of the area which is characterized primarily by large bungalows and one and two storey homes

The property is located in a site plan control area and subject to site plan review If the ICBL exemption is granted the property owner can then pursue site plan approval following which building permits are required to construct the replacement dwelling

The proposed addition satisfies the Council approved criteria for exemption Staff recommends that the exemption be granted so that the property owner can complete the site plan approval process and secure building permits from the City to construct the replacement dwelling

There are no costs anticipated to the City

Corporate Services and Planning amp Infrastructure staff has reviewed the content of this report Comments received as part of this circulation are contained herein

Strategic Plan

The recommendation contained in this report supports the Growth Management priority and specifically the strategic initiative to build complete communities

CONCLUSION

Staff recommends that Council enact an exemption by-law (attached as Appendix C) to allow the property owner to pursue site plan approval and acquire a building permit to construct the replacement dwelling at 27 Crescent Hill Drive North

Urban Design staff has reviewed the submission and is satisfied that the proposed addition meets the exemption criteria and complies with the Citys Architectural Control Guidelines From an urban design perspective the proposal is compatible with and sympathetic to the existing architectural style of the area which is characterized primarily by large bungalows and one and two storey homes

The property is located in a site plan control area and subject to site plan review If the ICBL exemption is granted the property owner can then pursue site plan approval following which building permits are required to construct the replacement dwelling

The proposed addition satisfies the Council approved criteria for exemption Staff recommends that the exemption be granted so that the property owner can complete the site plan approval process and secure building permits from the City to construct the replacement dwelling

It is Jan Petrykowski from JAP Design Studio

We talked about this project some time ago

As you know my clients house burned down in the Summer

They hired me to design a new house in the same location

The existing house was about 1850 sf plus 570 sf garage

The proposed replacement house is 3080 sf plus 658 sf garage X M- fe

Iknow it looks like abig increase but when you compare the exiting layouts (before fire)

and the new once they are very similar only the rooms are bigger to reflect the needs ofabig

family (see attached plans and the letter from my clients)

We will utilize the same driveway and notrees will be injured orremoved

The street will benefit because the proposed house is much nicer and reflects the style of the

neighborhood The lot is very large so the increase ofthe GFA is insignificant from the urban point ofview the added volume is at the back so it will not be visible from the street

Also the position of the house onthe lot isalmost identical We had tomove it slightly back

to comply with the current zoning (front yard) requirements

Otherwise the house complies with the current zoning by-laws

It is Jan Petrykowski from JAP Design Studio

We talked about this project some time ago

As you know my clients house burned down in the Summer

They hired me to design a new house in the same location

The existing house was about 1850 sf plus 570 sf garage

The proposed replacement house is 3080 sf plus 658 sf garage X M- fe

Iknow it looks like abig increase but when you compare the exiting layouts (before fire)

and the new once they are very similar only the rooms are bigger to reflect the needs ofabig

family (see attached plans and the letter from my clients)

We will utilize the same driveway and notrees will be injured orremoved

The street will benefit because the proposed house is much nicer and reflects the style of the

neighborhood The lot is very large so the increase ofthe GFA is insignificant from the urban point ofview the added volume is at the back so it will not be visible from the street

Also the position of the house onthe lot isalmost identical We had tomove it slightly back

to comply with the current zoning (front yard) requirements

Otherwise the house complies with the current zoning by-laws

To exempt the property municipally known as 27 Crescent Hill Drive North from Interim Control By-Law 35-2013 as amended

The Council of The Corporation of the City of Brampton in accordance with the provisions of the Planning Act RS01990 cP 13 hereby ENACTS as follows

The Council of the Corporation of the City of Brampton ENACTS as follows

1 By-Law 35-2013 as amended is hereby amended as follows

11 Section 1 is amended by adding after the words Except as provided for in Section 11 Section 12 Section 13 Section 14 Section 15 Section 16 Section 17 Section 18 Section 19 Section 110 Section 111 Section 112 Section 113 Section 114 Section 115 Section 116 Section 117 Section 118 Section 119 Section 120 Section 121 and Section 122 the following Section 123

It is Jan Petrykowski from JAP Design Studio

We talked about this project some time ago

As you know my clients house burned down in the Summer

They hired me to design a new house in the same location

The existing house was about 1850 sf plus 570 sf garage

The proposed replacement house is 3080 sf plus 658 sf garage X M- fe

Iknow it looks like abig increase but when you compare the exiting layouts (before fire)

and the new once they are very similar only the rooms are bigger to reflect the needs ofabig

family (see attached plans and the letter from my clients)

We will utilize the same driveway and notrees will be injured orremoved

The street will benefit because the proposed house is much nicer and reflects the style of the

neighborhood The lot is very large so the increase ofthe GFA is insignificant from the urban point ofview the added volume is at the back so it will not be visible from the street

Also the position of the house onthe lot isalmost identical We had tomove it slightly back

to comply with the current zoning (front yard) requirements

Otherwise the house complies with the current zoning by-laws

Please look atthe provided material and get to me as soon as possible

The Council of The Corporation of the City of Brampton in accordance with the provisions of the Planning Act RS01990 cP 13 hereby ENACTS as follows

The Council of the Corporation of the City of Brampton ENACTS as follows

1 By-Law 35-2013 as amended is hereby amended as follows

To exempt the property municipally known as 27 Crescent Hill Drive North from Interim Control By-Law 35-2013 as amended

The Council of The Corporation of the City of Brampton in accordance with the provisions of the Planning Act RS01990 cP 13 hereby ENACTS as follows

The Council of the Corporation of the City of Brampton ENACTS as follows

1 By-Law 35-2013 as amended is hereby amended as follows

11 Section 1 is amended by adding after the words Except as provided for in Section 11 Section 12 Section 13 Section 14 Section 15 Section 16 Section 17 Section 18 Section 19 Section 110 Section 111 Section 112 Section 113 Section 114 Section 115 Section 116 Section 117 Section 118 Section 119 Section 120 Section 121 and Section 122 the following Section 123

12 The following is added as Section 123

123 On lands described as Concession 5 EHS Part of Lot 6 and referenced as the Lands Subject to Specific Exemption From Interim Control By-Law 35-2013 as amended by By-Law and as shown on Schedule A to this by-law as 27 Crescent Hill Drive North there shall be permitted a dwelling with a total gross floor area not exceeding 3100 square feet
