Chronicle 2020 1

WELCOME FROM THE PRESIDENTI am pleased to welcome

you to our first, completely virtual gala event, “All Dressed Up and Nowhere to Gala”! While our Gala will be very different this year, our message is the same – to celebrate women lawyers and promote our mission of the full and equal participation of women in the legal profession and in a just society.

This has been a year unlike any other. After the quarantine was implemented due to COVID-19, WBA leadership quickly transitioned from our standard in-person networking events, substantive programs, and advocacy to operating our organization remotely and ensuring its financial stability through the economic downturn. We spent time reflecting on who we are as an organization, and what we are doing to work towards the achievement of our mission. With the murders of George Floyd, Breonna Taylor, Ahmaud Arbery, and countless other Black lives who have died and suffered because of systemic racism, injustice, and violence, we are reminded starkly that we do not live in a just society. As lawyers and as community members, we have an obligation to become better allies and advocates, examine and address white privilege and bias, and hold ourselves and each other accountable to making our society just. We will continue to do this work

and work in coalition with other affinity bar associations.

2020 also brought us the loss of two great leaders in the legal profession, SJC Chief Justice Ralph Gants and Supreme Court Justice Ruth Bader Ginsberg. Justice Gants left a profound impact on all those who knew him and on our court systems in Massachusetts. He was a brilliant and thoughtful jurist and relentless in his pursuit of access to justice and legal services. For so many of us, Justice Ginsberg was our hero, an icon; she was the trailblazer in the legal fight for women’s rights. Her work, both as a litigator and as a judge, changed the way the law viewed women. These losses were devasting – both were tireless in their advocacy for justice – and we must now take up the torch and carry on their work.

Despite the losses and challenges of 2020, the

WBA accomplished much to celebrate. It has been incredible to see our members come together as a community to support one another, develop dynamic virtual programs, promote diversity on the bench, address the role of lawyers in advancing racial justice, and continue our legislative and amicus advocacy. In January we kicked off our sixth Women’s Leadership Initiative (WLI), a program that brings together senior women attorneys and up and coming stars of the legal profession for leadership development and mentoring. I am thrilled that we are honoring and recognizing the WLI class participants at this year’s Gala. They are a phenomenal group of women with impressive accomplishments and truly are the next generation of leaders in our profession.

The WBA held a number of exciting programs this year including: Women’s Health and Reproductive Rights: Legal, Medical and Political Perspectives Shaping the National Conversation; Financial Literacy for New Nonprofit Board Members; Managing Litigation as an In-House Lawyer; Race, Incarceration & Clemency; and Women in Finance: Insights from Industry Leaders. We also celebrated an incredible legislative achievement with the passage

and enactment into law of An Act Relative to the Penalties for the Crime of Female Genital Mutilation (FGM). The WBA’s FGM taskforce played an instrumental role its passage. It is our hope that this bill will change the lives of girls in Massachusetts, helping to ensure their physical and mental health.

As I reflect on the year, it is also important to note we are celebrating the 100th anniversary of women’s suffrage. Recognizing that the 19th amendment did not give all women the right to vote, it is critical to remember that our power to vote, the power of our collective voices, and our ability to engage in making our communities more just are essential to our democracy. As Justice Ginsberg said, “Fight for the things that you care about, but do it in a way that will lead others to join you.” If you are looking for ways to get involved, I invite you to join us. There are ample opportunities to get involved. The WBA cannot do its work without the support of our staff, volunteer leaders, members, firm members, Gala sponsors, and corporate partners. Together, we will get through 2020 and build a better future for all.

The WBA has been a formative organization throughout the advancement of Heather Gamache’s career, and she is honored to support its work and mission in the role of President-Elect. Heather has been an active WBA member for over 10 years and has served on the Board of

Directors since 2017.Heather initially became involved

with the WBA upon returning to Boston after practicing out-of-state for several years and was immediately struck by the generosity of the leaders and members of the organization, especially with their time and commitment to advancing the mission of the WBA. Her involvement increased after she was selected to participate in the 2015/16 Women’s Leadership Initiative class. Heather became involved with the Law Firm Advancement Committee, which she later co-chaired for four years, and also the Women in the Courtroom Committee. As a co-chair of the Law Firm Advancement Committee, Heather is particularly proud of the Committee’s involvement with a comprehensive workplace conduct study at Massachusetts law firms with the Rikleen Institute for Strategic Leadership, which shined a light on challenges related to women’s

advancement and was covered by the Boston Globe, Massachusetts Lawyers Weekly, Law 360, Bloomberg, and other news outlets.

As part of the WBA’s Executive Board, Heather has worked to increase the organization’s membership base, strengthen its relationship with law firms, and support programming and networking opportunities for its members and women attorneys.

Heather is a Director at Rackemann, Sawyer & Brewster where she practices in the firm’s litigation group. Prior to joining Rackemann, Heather was a partner at Prince Lobel Tye. She also previously worked at several law firms practicing general civil litigation and served as a pro se law clerk in the United States District Court for the District of Hawaii. Heather is a graduate of University of Massachusetts Amherst and Suffolk University Law School.

CHRONICLE 2020

Together, We Make Things HappenBy Kimberly DonlonRuth Bader Ginsberg once said, “So

often in life, the things that you regard as an impediment turn out to be great good fortune.”

2020 was a Sisyphean impediment for us all. COVID. Politics. Job losses. Racial and social injustice. Death and violence. Fires and floods. Toilet paper shortages. It is really hard to find the fortune in this mess of a year.

But it is there. We have learned that if we work

together, we can make things happen. We wear masks to protect others. We donate food. We order take-out to support local restaurants. We march. We vote. We stand up for what is decent and right. We care for each other, even if we can’t give hugs right now.

In 2020, the WBA has embodied

RBG’s quote. We are a professional organization for women attorneys who rely on us for leadership opportunities, for rewarding work in our communities and as a networking forum for business development. We worried about how we could ever morph that personal experience into the cyber world? But we did it. Our committees created great virtual programming: Women in Finance, Women who Run for Office, Homebuying 101. We held Sip and Network evening events, and Supermom Lunch meetings. And our members came, making many of these Zooms as well attended as our pre-COVID in person events.

We also learned our members and the legal community care about us. The WBA’s primary sources of revenue are membership dues and our in-person

annual Gala. And with the financial hardships facing the legal and business community, we expected to see mass attrition and a steep loss of revenue. But we did not. And so, I thank our individual members, our firm members, our corporate partners, our virtual Gala sponsors, and every person who bought at ticket to tonight’s amazing event for supporting us this year. We truly could not do this without you.

And there is our great good fortune.

CHRONICLE 2020

Women’s Leadership InitiativeLaunched in 2009, the WBA’s

Women’s Leadership Initiative (WLI) brings together senior women attorneys and rising stars of the legal profession for leadership development and mentoring. This year’s WLI chairs are Meredith Ainbinder, Deputy General Counsel of Emerson College, and Erin Higgins, Partner at Conn Kavanaugh Rosenthal Peisch & Ford, LLP, along with Mary Ryan, Partner at Nutter McClennen & Fish LLP, as Senior Chair.

The WBA is thrilled to recognize this year’s exciting and diverse WLI class, which includes women practicing in firms, government, and in-house, and touches a wide variety of sectors/industries including the criminal justice system, higher education, legal services, and the financial services and biotechnology industries.

Each WLI event, including large-scale networking, group mentoring and one-on-one meetings, leverages the experiences of accomplished women attorneys in Massachusetts interested in cultivating the next generation of women leaders. The twenty-one

members of this year’s mentor class reflect a cross section of the legal community, offering insights and advice through no-holds barred Q&A sessions. The WLI mentees also have the opportunity to work directly with their mentors and with one another, to build their networks and further their careers.

The year began with a large networking reception, allowing mentors and mentees to meet and mingle. WBA Legislative Update: MA 2020 Legislative Session Highlights Including Passage of Bill Banning Female Genital Mutilation (FGM)

Massachusetts has a two-year legislative session (2019-2020). In the first year of the session (2019), the WBA enjoyed an early success with the passage of An Act to Lift the Cap on Kids. In the second year of the session (2020), COVID-19 significantly affected the typical course of legislative business at the Massachusetts State House and the legislature prioritized issues relative to COVID-19.

However, the WBA and advocates were successful in getting the Massachusetts House and Senate to pass and Governor Baker to sign H4606 - An Act Relative to the Penalties for the Crime of Female Genital Mutilation (FGM) in Massachusetts.

The WBA FGM taskforce, which began working in May 2013, drafted the legislation and filed it in the 2015-2016, 2017-2018, and 2019-2020 legislative sessions. The WBA also played an instrumental role in building widespread support in both the legislature and the community. The bill had over 100 House and Senate cosponsors and had also been supported by ~ 50 organizations, including the AHA Foundation, Sahiyo, UNICEF USA, the U.S. End FGM/C Network, Boston Mayor’s Office of Women’s Advancement, Office of the Child Advocate, MA Caucus of Women Legislators, American Academy of Pediatrics – Massachusetts Chapter, and American Congress of Obstetricians and Gynecologists (ACOG) – Massachusetts section.

FGM is defined by the World Health Organization as removal of all or part of a girls’ healthy sex organs and surrounding tissue for non-medical reasons, often resulting in serious health consequences, the risk of death in childbirth, and lifelong trauma. There are no health benefits to this practice. According to the Centers for Disease Control, half a million women and girls living in the United States have been cut or are at risk of FGM. Over fourteen thousand such women and girls reside in Massachusetts, which ranks our state as

12th in the nation for at-risk populations. With the continuous advocacy of the WBA and our partners,

Massachusetts this year became the 39th state to ban FGM. The WBA thanks its members over the past few years including Deborah Benson, Joanne Golden, Jean Zeiler, Kate Symmonds, Danielle McCourt, Beth Muir Watters, Jessica Cruzzati-Flavius, as well as the WBA Legislative Policy Committee for their tireless advocacy on behalf of women and girls in Massachusetts.

The MA legislature was typically scheduled to adjourn on July 31, 2020. However, due to COVID-19 and the need to still pass other priority items including the FY21 State Budget, the legislature decided to extend the legislative session through 2020 and the WBA is continuing to advocate for its remaining priority items. Since Justice Ginsburg’s death, there has been renewed

enthusiasm for the ROE Act. The Coalition for Choice, of which the WBA is a member, hopes to leverage this momentum and call for the immediate passage of the Act. The WBA is also advocating for adequate funding for civil legal aid – a need which has been further compounded by COVID-19, as well as other legislation relative to racial injustice/police accountability, racial disparities in maternal health, wage transparency, emergency paid sick time, and lifting kids out of deep poverty/one-time cash assistance.

Please contact Krina Patel ([email protected]), Co-Chair of the WBA Legislative Policy Committee, if you’d like to get involved in the organization’s advocacy efforts.

The Women of Color Committee of the Women’s Bar Association (WoCC) has continued to serve as a resource for minority women attorneys by providing educational and professional development programing. In November 2019, WoCC collaborated with the Massachusetts Black Women Attorneys to provide a private screening of the movie Harriet, followed by a social. Subsequently, the Committee organized the program, “Professional Development Through Writing,” which was hosted by Hogan Lovells on December 19, 2019. This program provided women attorneys an opportunity to learn more about low commitment writing opportunities that could further their brand and professional platform. The program panel featured women from diff erent writing

backgrounds: Marcela Garcia, Editorialist from The Boston Globe, who spoke on submitting op-eds and letters to the editor; Attorney Lauren Song from the Boston Bar Association Journal, who shared her insight on getting short legal articles published electronically in the BBJ; and Nicole Alcantara Beiner of Melanin + Moxie, who addressed non-traditional legal writing avenues such as blog articles and writing in other digital spaces.

Continuing this theme of education, the Committee began 2020 with a program focused on fi lling fi nancial information gaps for those members who serve on nonprofi t boards. On January 23, the Committee held, “Financial Literacy for Serving on a Nonprofi t Board” at Burns and Levinson, LLP. Led by Eva Herzing and Carol Ruiz from PWC, attendees learned how to

Despite COVID-19 putting a halt to in-person meetings, the Committee has maintained a strong connection with its members through virtual networking events, get-togethers, and check-in meetings. In August, the Committee held a Virtual Sip & Network event featuring a demonstration of two cocktails by Camila Chaparro of America’s Test Kitchen. This event was hosted by Goulston & Storrs.

This year’s upcoming events include a virtual workshop, “Build Your Personal Brand: Business Development for Women of Color,” co-hosted with the South Asian Bar Association of Greater Boston (SABA GB) on October 15, 2020. The purpose of this

program is to equip attendees with the essential tools and knowledge to either create an action plan for brand development or refi ne their current one. The Committee also plans to host a virtual debrief after the November election and a Book Club Meet-Up where Committee members can chat informally about a book of their choice.

Despite the current state of the nation, the WoCC is constantly trying to develop new and innovative ideas for programming that furthers its mission. The WoCC is excited to continue working with its members to put on programs and provide networking opportunities and resources to support, advance, and advocate for women of color attorneys.

GLC made the best of a challenging year. We kicked off with a networking event on November 20, 2019 at the Atrium in TradeCenter in Woburn, featuring speakers Middlesex District Attorney Marian Ryan and former federal prosecutor Natashia Tidwell.

We continued our networking at a lunch event at Rebecca’s Café on February 20, 2020. We organized a well attended virtual event on October 14, 2020, that focused on a pressing issue—racial disparities in the Massachusetts Criminal System. The discussion was led by Professor Dehlia Umunna, Deputy Director and Clinical Instructor at the Criminal

Justice Institute; Brook Hopkins, Executive Director at the Criminal Justice Policy Program, and Chijindu Obiofuma, Harvard Law School Legal Fellow. They, with others, recently published a report commissioned by the MA Supreme Judicial Court, which analyzed detailed administrative data to explore the factors that led to persistent racial inequities.

The WBA, as always, provided great support for all GLC events. The GLC is thriving and providing a necessary forum for government lawyers to connect, share ideas, socialize and network with one another.

On August 26, 2020, the North of Boston Committee hosted the first of its virtual Conversation Series. The purpose of the Conversation Series is to foster professional and personal connections through substantive conversations about various topics relevant to our practices and our lives. Each conversation is to be sparked by an expert who will briefly provide a substantive overview of the topic, and then to offer a thought-provoking question to get the conversation started.

The inaugural virtual Conversation Series program featured Patricia Comfort, Executive Director of the League of Women Voters of Massachusetts (and former Executive Director of the WBA and WBF). Pattye gave a brief presentation on the Safe Elections Law of 2020 and the work of the Election Modernization Coalition to modernize election laws in Massachusetts in order to expand access to the vote. Pattye offered

resources for further information on elections and voting in the Commonwealth and ways for people to volunteer to protect our elections and our right to vote. Following Pattye’s presentation, Michele Liu Baillie, co-chair of the North of Boston Committee, presented some facts concerning the Supreme Court and voting rights, as well as various voter suppression methods being practiced.

Participants then gathered in small groups to discuss, “Looking beyond the 2020 elections and the pandemic, what lessons should we learn from the current state of access to the vote?” Through lively discussion, participants shared thoughts and observations on the topic and the question presented.

The North of Boston Committee looks forward to bringing WBA members together in 2020-2021 in future virtual Conversation Series programs featuring timely topics worthy of discussion and the exchange of ideas.

The Middlesex County Committee has continued its monthly Friday lunch meetings throughout 2020. In March, we pivoted to virtual meetings over Zoom. In April, we hosted a discussion with Victoria Spetter, Laura Unflat and Alice Mutter, of the challenges of practicing family law in the time of Covid-19, court closures and social distancing. In May, we recognized Lawyer Wellbeing Week with a discussion led by Heidi Alexander, Director of the SJC’s Standing Committee on Lawyer Well-Being. In June, the co-chairs made the decision to devote the next year of programming to issues surrounding racial justice, and specifically racial justice in the legal system, and in the delivery of legal services. We launched a Goodreads group, open to all WBA members, with recommendations and links to books and films related to racial justice. While we suspended formal meetings for the summer, Veronica Zolina and Laura Unflat led monthly zoom discussions in July and August. In September, we hosted a discussion of the film Just Mercy, led by criminal defense attorney Monica Shah and Middlesex ADA Whitney Williams. Stay tuned for more information on upcoming meetings.

NEW LAWYERS COMMITTEE

The past year has been a great success for the New Lawyers Committee (NLC). NLC had a series of fall get-togethers, including a happy hour at Tiki Rock. Over the following months, the NLC volunteered at the Pine Street Inn, serving dinner to the residents on the women’s side, and held its annual Holiday Party at the Ginger Man in December. The committee started off 2020 with planning a First Time Homebuyers Seminar, originally to be held in April. Despite the pandemic, the committee was fi nally able to hold this event over Zoom in August and is considering hosting a re-run either in late 2020, or early 2021. The committee has been hosting monthly virtual happy hours since March, off ering an opportunity for members to catch up face-to-face and share their experiences during this time. While the committee has not yet determined when it will hold its signature career-building event, we are actively planning another Zoom program to educate our members on how to be a good boss, mentor, and colleague. We look forward to the year ahead and hope it will bring a change in circumstances that will allow us to see each other in person.

NLC members Yelena Greenberg, Barrett & Singal; Sarah Sousa, Co-chair, Arrowood LLP; Erin Thurston, Jones Kelleher; and Jaclyn Neely, Co-chair, Morgan Brown & Joy LLP served dinner on the women’s side of Pine Street Inn.
