Changes to the Guidelines to the Minimum StandardsWhat’s new? What does my school need to do?As of 1 July 2018, all schools must be compliant with the revised 2017 Regulations and Guidelines.

Not-for-profit

Non-government schools

Strengthening of the not-for-profit requirements for non-government schools:• a statutory declaration has replaced

the Attestation of a School’s Not-for-profit Status

• broadening of the definition of ‘proprietor’

• broadening of the definition of ‘prohibited agreement or arrangement’.

A non-government school must:• provide an executed Statutory Declaration of

the school’s not-for-profit status• review the school’s constitution, governance

charter and financial statement*• have controls in place to ensure school

property and assets are not distributed or used for the profit or gain or another person or entity.

Student safety

All schools Addition of a duty of care requirement under the Wrongs Amendment (Organisational Child Abuse) Act 2017.

All schools must take precautions to prevent abuse of a child by an individual associated with the school while the child is under the care, supervision or authority of the school.

* To be actioned by 1 July 2018 and documents retained by the school unless requested by the VRQA.

Fact sheetOn 25 June 2017, the Education and Training Reform Regulations 2017 (Regulations) commenced, replacing the Education and Training Reform Regulations 2007. This fact sheet provides an overview of the subsequent changes made to the Guidelines to the Minimum Standards and Other Requirements for Registration of Schools Including Those Offering Senior Secondary Courses (Guidelines).

• yearly curriculum program plans for each cohort of students• an indication of how the eight learning areas will be addressed across the years of

schooling.

• Removal of AusVels references and replaced by references to approved curriculum programs.

• Removal of the transitional provisions relating to enrolment numbers. All schools

What if my school is due for review?Independent schools under review should use the below table to know which Regulations and Guidelines they will be assessed against.

Government and Catholic school review bodies should also use the below table when planning reviews of government and Catholic schools.

What if my school needs to amend its registration?Applications to amend a school’s registration are subject to the revised 2017 Regulations and Guidelines. Applications close on 30 June 2018.

What if my school needs to change its particulars?Schools must notify the VRQA in writing within 30 days of any change to its particulars, including changes to their governing body, school council or principal.

Changes to particulars before 1 July 2018 are subject to the 2007 Regulations and Guidelines. Changes to particulars from 1 July 2018 are subject to the 2017 Regulations and Guidelines.
