Marine Spatial Planning (MSP) is:a public process of analyzing and allocating the spatial and temporal distributionof human activities in marine areas to achieve ecological, economic, and socialobjectives that usually have been specified through a political process
Ehler & Douvere, 2007

Characteristics:
Capable of learning from experience
Across sectors and among government levels
Involving stakeholders actively
Focussed on the long-term
Integrated management of all human activities within a spatially-limited marine area
Partecipatory
Strategic & Future-Oriented
Place-based

• Legal status is important for MSP implementation in the area (i.e. high seas pockets and divergent maritime zones)
• Legal Authority –Who is enforced by Law?
• Legal Basis –Proposal for a Directive on MSP and ICM - undergoing

2) How to define Management Boundaries ?The experience of ADRIPLAN
ADRiatic Ionian maritime spatial PLANningwww.adriplan.euProject co financed

The definition of management boundaries is essential to concentrate the analysis on trans-boundary mismatches and opportunities and define appropriated strategies and actions

The definition of management boundaries is essential to concentrate the analysis on trans-boundary mismatches and opportunities and define appropriated strategies and actions
Criteria to establish ADRIPLAN boundaries:• Coherence with project scope• Representativity of transboundery and cross-border character
of MSP• Intensity of maritime uses• Potential future conflicts/synergies of uses in the area• Operability and applicability of measures related to MSP• Existence of environmental dynamics which define specific
domains

Northern Adriatic «SOFT» and «HARD» BOUNDARIES
Considering the juridical complexity of Northern Adriatic (EU countries, high seas and different jurisdictions)
“Soft boundaries” means boundaries for the analysis purposes, with no legal nature or jurisdictional aims. They are not for management purposes, but they are meant to intercept and to consider transboundary issues, conflicts, synergies and opportunities within the maritime areas included within the boundaries.
“Hard boundaries” are meant for a management purpose, to build MSP, and they are traced to intercept maritime competences and jurisdictions.

FOCUS AREA 2- «SOFT» BOUNDARIES
AREA FOR ANALYSIS OF MARITIME USES AND ENVIRONMENTAL COMPONENTSThe area include Marche Region and the Croatian part in front of Marche region following the natural boundary of the Northern Gyre.
PLEASE NOTE: This subdivision is not for management purposes (MSP), but it constitutes the area to be investigated in the analysis to consider trans-boundary issues, conflicts synergies and opportunities. Boundaries are «soft» (not of some legal nature)

- Guided by the scope of the project and the partners involved
- Adding the entire Marche Region does not add anything in terms of transboundary issues.

Marine strategies shall apply an ecosystem -based approach to the management of human activities, ensuring that:
a) the collective pressure of such activities is kept within levels compatible with the achievement of good environmental status and
b) the capacity of marine ecosystems to respond to human-induced changes is not compromised,
c) while enabling the sustainable use of marine goods and services by present and future generations.
(MSFD, 2008, art. 1, comma 3)

Conclusions (Opportunities)
- Wide reflection to find a path towards the implementation of Transboundary MSP Adriatic and Ionian Macroregion
- Governance issues – How to establish a Transboundary management oraganization? According to what legal basis and of what nature?
- Boundaries definition Management competences?
- Integration of MSFD with MSP, beside data sharing and data availability
- National management and trans-boundary effects how to manage at Macro Regional scale impacts and synergies?
- Relationship between maritime sectors at different scales, to integrate local, regional and macro regional scale
- Sharing data and scientific effort – best available Knowledge – what perspective to integrate on a consolidated platform different projects and contributions to be acquired in practice
