Dr. Combs: Should the Board grant you permission to take the exam-ination. it will be geographically limited until you getcitizenship. You would probably be limited to the Bca rd ofHealth. If you left there, we would change it up until thetime you became a citizen. We give you six years to getcitizenship and if you have not gotten citizenship at that timethe Board may take up your license.

VERDICT: Dr. J. J. Combs moved that Ursula M. And erson begranted permission to take the written examination and if she passedthe license to be limited to the State Board of Health. This motionwas duly seconded by Dr. L. R. Dof fermyre and passed unanimously.

RE: Dr. Jose h U. To lia appeared applying for permisstake the written examination. He was graduated by the Medicalsity of Rome. Dr. Combs: What are your plans as to North Carolina'?A. I was hoping to be an instructor in Neurology at the University

of North Carolina. I have learned since that it is researchand I am not interested . So I have had to give up this. Iwill be in Charlotte this year as a neurologist. I have receiv-ed an interview from several doctors, including Drs. Coffey andCulbreth and Drs. Fisher and Gage helping me in starting to beassociated with the clinic.

Dr. Rasberry: Where have you been?A. I was three years in North Carolina at Bowman Gray in Neurology.

I left Bowman Gray in 1958. I was required to go abroad for aperiod of two years to return as an immigrant.

Dr. Anderson: Did you tak training in Neurology or Neurological Psy-chiatry?

A. I was in Neurology.

VERDICT: The Board voted f our to one to grant Dr. Joseph U.Toglia the privilege of taking the written examination and if success-ful to be granted limited license until citizenship obtained.

RE: Dr. Jan de Bakker, graduate of the Medical College of Vir-ginia and an immigrant, appeared applying for the privilege of takingthe written examination. Dr. de Bakker received his first two yearsof medicine at Duke University School of Medicine. He presented immi-gration visa. He is a native of Holland.

Dr. Combs: Why did you transfer from Duke to Medical College ofVi rg i n i a?

A. I had a contract for two years and that was not renewed.

Dr. Tyner: What kind of contract?A. This was an arrangement with the dean that I should transfer

to another school. They did not have enough vacancies. Theysupported me when I f ini shed my f irst two years.

Anderson. : What are your plans?I am to take an interneship at the M. dical College of Virgi nia.I plan to come to North Carolina for specialty in surgery.Probably western North Carolina. I spent a good deal of my timein western North Carolina. I lived in Elkin three years. Iwent to school there and Maryville, Tennessee. I worked forDr. Tate. After three years I went to Maryvi lie College. Itried to get in at the University of North Carolina and couldnot on account of my citizenship status. I came in this countryin 1948 by jumping ship. In 1942 I joined the underground move-ment in Holland. Then I joined the Marines, then I came backfrom Indonesia where I fought against the rebels. I came toHolland and tried to immigrate, so I tool the short end around,became a sailor and jumped ship. I had a friend in North Caro-lina. He said he would see what he could do. I came t o NorthCarolina and joined him. From there I went to BannerElk. In1949 they issued a statement by the Federal Government sayi ngall aliens should report. I had a legal battle of eight years.After a long drawn up process, I got a job with Dr. Farmer.I went to the Bahamas and came through Florida.

VERDICT: Dr. Jan de Bakker was unanimously approved to takethe written examination and if successful. to be granted limited lic-ense unt i 1 c i tizenship obtained.

RE: Dr. Richardo Galbis-Beltran appeared applying for per-mission to take the written examination. He was graduated by BowmanGray School of Medicine. He presented his immigration card. He isa native of Cuba.

Dr. Anderson: What are your plans as to North Carolina?A. I like Greensboro. I know many people there. I guess, if I

practice in North Carolina, I would practice in Greensboro.

RE: Dr. John M. Gambill Snow Hill, North Carolina - Tosummarize, Dr. Gambill was formally heard by the Board on chargesJanuary 10th, 1960, license to practice medicine in North Carolinawas revoked, and the judgment and revocation was suspended uponcertain conditions. (See Minutes January, 1960) The Order and Judg-ment set out that upon receipt of evidence or information satis-factory to the Board or its of f icers of the violation of any of theterms and conditions of this suspension, the judgment and revoca-tion of the license of Dr. Johm M. Gambill to practice medicinein the State of North Carolina would become effective immediately.

The secretary stated that the reports required in the Orderand Judgment on the 15th day of each month were not received inMay, 1960. The secretary further reported that he received verbalreports from the sheriff of the county, the Chief of Police of SnowHill. and direct information from a physician and the councilor ofthat district of the State Medical Society that the said Dr. Gymbilihad violated the terms of the suspension in that he had taken bar-biturates and imbibed alcohol to the extent that on at least oneoccasion he was found by the night policeman in an unconscious stateas a result of imbibing alcohol and/or barbiturates, between April15th and May 15th, 1960.

VERDICT: Upon motion duly made by Dr. T. G. Thurston and sec-onded by Dr. L. R. Doffermyre. it was resolved that the action ofthe Board at its last meeting in ordering that the previous judg-ment of the Board revoking Dr. Gambill's lic ense to practice medi-cine be put into effect upon oonfirmation of the information pre-viously received, be and the same is hereby confirmed and ratifiedand that the license of Dr. Johm M. Gambill to practice medicinebe revoked.The meeting was adjourned.Monday June 20th8:30 A. M. Registration for Part I and Parts I and IIof the exami nat i on.

RE: Dr. Franklin Baile Wilkins, Winston-Salem, North Caro-lina — (Native of Mars Hill, North Carolina)

A report was received from the Cali f ornia Board of Medical Ex-aminers that the license of Dr. Franklin Bailey Wilkins to practicemedicine and surgery was revoked as of April 27th. 1960; that the eff-.ectiveness of the order was stayed f or a period of three years, dur-ing which time he was placed on probation and subject to certain con-ditions. (See file) The action of the California Board was takenafter Dr. Wilkins was convicted in the Municipal Court in Los AngelesCounty. Cali f ornia ~ where he entered a plea of guilty and was convict-ed of violation of sections of the law regulating narcotics in thathe did issue a prescription for demerol and failed to make recordsas to name and address of patient, character and quantity of narco-tics involved, and the purpose for the prescription. The CaliforniaBoard did not find him guilty of narcdic addiction.

On interview Dr. Wilkins stated that he had been very ill; thathe had had a stroke, malignant melanoma, amnesia and taxia. Tha t hehad been under competent medical care; that he had received narco-tics during his illness and he denied narcotic addiction' He statedthat he came to the attention of the Narcotic Bureau when he reportedthat his office had been entered and all narcotics taken and that he

RE: Dr. Franklin Baile Wilkins continued

was subjected to investigation, trial by court and by the CaliforniaBoard of Medical Examiners and that he was not convicted of narcoticaddiction. He said that he was doing general surgery in California.He said that he was now at Bowman Gray School Medicine as assistantresident in surgical pathology and that he had related to Dr. R. P.Morehead, Professor of Pathology. the circumstances that had occurredin California.

Dr. George Leiby (Colonel) appeared on behalf of Dr. Wilkins.He advised that he is Dr. Wilkins' brother-in-law; that he had theopportunity to observe him during his illness and at one period hewas at the Veterans Administration. Research Hospital in Chicago, ofwhich hospital he was manager; that he saw him when was first takenill in Long Island. New York, and later in California. Dr. Leibystated that in his opinion Dr. Wilkias was qualified to practice;also that he had never been addicted to narcotics. He presented letterfrom Dr. Walter C. Ralston, internist of Anaheim, California, who hadtreated Dr. Wilkins. Dr. Ralston advised that Dr. Wilkins had re-sponded well and that he had encouraged him in his present plans.

Dr. Wilkins was questioned as to his compliance with the condi-tions of the suspension of the California Board and he informed theBoard that he had sent his quarterly report to the Board; that hewould continue to do so and would appear before the Boa rd in one year.

VERDICT: Dr. J. J ~ Combs moved that the president instructDr. Franklin Bailey Wilkins that in view of the conference we havehad, he will be considered on proba'tion in North Carolina and thatthe Board feels his decision to go in surgical pathology is a goodone and we wish him ihe best of luck in his medical practice. Thismotion was duly seconded by Dr. C. V. Tyner and, passed unanimously.

RE: Dr. Thomas O. Wheless, Louisburg, North Carolina - Uponreport from the Narcotic Bureau dated May 12th, 1960. Dr. Whelesswas requested to appear bef ore the Boa rd. His narcotic tax stamp wassurrendered April 7th. 1960. He admitted having taken dilaudid fromJuly. 1959 to December. 1959. He stated that he went to WestbrookSanatorium for treatment January 3rd ~ 1960, and was there approximatelysix weeks; that he had no narcotics since December. 1959. RE: Dr Miriam N Muldrow, Whiteville. North Carolina- Pursuantto the judgment of the Board in June, 1958, Dr. Muldrow made a rou-tine appearance to continue the surveillance of the Board. She statedthat she is doing very well, working in her office two hours in themorning and two hours in the afternoon; that she had a: transfusion inApril for anemia and was out of the office two weeks. She stated thatshe was getting along all right without writing narcotic prescriptions;that if she had a very sick or painful patient she sent him to thehospital. She presented letters of recommendation from representativepersons in her community.

The meeting was adjourned.

RE: Januar 1961 Meetin - The Board originally set January19-22nd. 1961 for the meeting at the Mid Pines Hotel. Due to pre-vious committments the hotel was not able to grant reservations atthat time. The Board elected to meet January 5-8th, 1961.

RE: Dr J R Medlin J . . Rural Hall, North Carolina - (Seepre vi ous Mi nutes — Narc ot ic addiction )

On October 27th, 1959, Dr. Medlin went voluntarily to the UnitedStates PublicHealth Service Hospital at Lexington. Kentucky for treat-ment of demerol addiction. His narcotic stamp was surrendered April22nd, 1959.

Following indictment and conviction of violation of the narco-tic laws in the Forsyth County Superior Court, the Board directedon May 7th. 1960 that charges be made against Dr. Medlin looking torevocation of his license to practice medicine in the State of NorthCarolina.

Dr. Medlin filed no answer to the charges made against him andappeared without counsel. The Board was represented by John H, Ander-son Attorney.

The evidence presented against Dr. Medlin was as follows

The defendant comes into open Court and through his counsel Eugene H.Phillips enters a plea of guilty to Obtaining Narcotics by Fraud ascharged in the Indictment in case 03895, and enters a plea of nolo con-tendere to obtaining narcotics by fraud as charged in the indictment incase 03895-A.In case No. 3895, it is the judgment of the Court that the defendant beconf ines in the Central Prison. Raleigh. -for a period of not less thanone (1) nor more than three (3) years and be assigned to do labor asprovided by law, This prison sentence is suspended for a period of five(5) years on conditions:1. "6. That in the foregoing respects you have berm guilty of dishonor-able conduct unworthy of and affecting the pra0tice of your profession,and grounds exist for the revocation of your license to practice medi-cine in the State of North Carolina.

himself; that he had joined the Alcoholic Anonymous and was under thecare of Dr. A. C. Randolph, Psychiatrist at Bowman Gray School of IIIedicine,

Dr. Cornelius Lansing. Psychiatrist. at the University ofNorth Carolina School of Medicine, under whose care Dr. Hayman hasbeen, in a telephone conversation with the secretary, recommendedthat the Board approve reinstatement of his narcotic license.

Dr. Hayman came in and discussed his situation with the Board.He said that he had not taken any narcotics since 1955. He saidthat his wife had demonstrated some feeling with respect to his ob-taining narcotic privileges. He said that he had gotten along wellin his practice without narcotics.

When he asked what he wanted the Board to do his reply was,"I would want you to grant my request, that is nothing be done atthis time. ?

VERDICT: Dr. L. R. Dof fermyre moved that the Board grantDr. Louis D. Hayman's request and do nothing at this time. Thismotion was duly seconded and passed unanimously.

The meeting was adjourned.

RF: State Bureau of I~vestigation report of June 8th. 1960. whichinvolved the following physicians, who had prescribed narcotics foraddicts, a man and his wife:

RE: Dr. Robert Lee Felton Jr. , Carthage, North Carolina- Dr.Felton appeared for an interview and he stated thathe was completelyfooled; that the woman asked for demerol for her mother. who was dyingwith cancer and that they were trying to get her in a nursing home; thathe had learned everything she told him was fictitious. He said he didnot see the man. He said each time he said he would go to see the motherthere was some excuse. He stated that he did not prescribe for addictsand that he had not previously prescribed for a patient whom he had notseen.

Dr. Felton was advised by the Board to abide by the narcotic laws.

RE: Dr. Cordon S auldin Fuller Jr. , Pittsboro. North Carolina. -Dr. Fuller stated that the man had been a problem for about 10 years;that he had had many illnesses and he had him in and out of the hospital;that he did not know he had become addicted; that they changed one pre-scription to demerol which he had written.

Dr. Fuller was advised to be more careful in writing his pres-criptions.

RE: Dr. ndrew Albert Vanore ~ Robbins. North Carolina - Dr. Vanorestated that he also was completely fooled; that the woman did not givehim the impression of an addict and told him the many stories abouther mother. He denied having written all the prescriptions which werealleged to be signed by him and that the amounts in some were incorrect.

Dr. Vanore was advised to abide by the Narcotic Law and not treatany patient whom he had not seen.

RE: Dr. William Louis Patman, Siler City. North Carolina — Thereport of the State Bureau of Investigation revealed that Dr. Patmanhad written two prescriptions for the addicts and did not have a nar-cotic tax stamp. He admitted this and stated that he was fooled by thepatient; that he thought he was doing a human thing. That he knew hehad done wrong.

Dr. Patman was advised that he could be indicted by the NarcoticBureau for writing prescriptions for narcot ics without a narcotic tax stamp

RE: Dr. Geor e David Pleasants. Siler City, North Carolina — Dr.Pleasants was reported by the State Bureau of Investigation, after hav-ing signed a prescription for Dr. Patman. Dr. Pleasants admitted thathe signed this prescription carelessly as it was included in some ofhis own prescriptions. He said that he was not taken in by the addicts.

Upon being requested to appear before the Board at this time. Dr.Thomas replied that he was ill.

VERDICT: Dr. E. A. Rasberry, Jr. moved that Dr. William ClydeThomas be directed to come to the secretary's office for an interview.This motion was duly seconded by Dr. L. R. Doffermyre and passed unan-imously.

RE: Dr R. D. Patterson Liberty, North Carolina, was reported bythe State Bureau of Investigation for having written one prescription fordemerol without having seen the patient. It was learned by the secre-tary that Dr. Patterson was critically ill following a stroke and hewas not requested to appear.

Baker reported by phoneon June 15th, 1960 that Dr. Griggs had been a patient at CharlotteMemorial Hospital in March. with kidney stones. and he did exception-ally well asfar as narcotics were concerned, no more than normal. ThatDr. Gr iggs had reported the week be f ore that he had xe current stones andinfection and might have to return to the hospital; that he was doingwell with narcotics.

RE: Dr. Harold P eston B rba e appeared before the Board inMay. 1960. applying for license by endorsement. He had accepted theposition as health officer of Granville County North Carolina andhad already begun work.

The Board at that time had received information from the Nar-cotic Bureau that Dr. Burbage had been addicted to the use of nar-cotic drugs and had been treated for the same at the United StatesPublic Health Service Hospital, all of which was denied by Dr. Burbage.He admitted having surrendered his narcotic special tax stamp.

The secretary was instructed to obtain further in formation.

The secretary thereupon asked the director' of the County HealthDepartment of the State Board of Health to instruct Dr. Burbage tofurnish this office with a statement to the United States Public HealthService Hospital to give this office any information it might desirewith regard to his stay there, which permit was given by Dr. Burbage.The secretary presented a report from the United States Public HealthService Hospital at Lexington, Kentucky verifying the fact that Dr.Burbage was a voluntary patient there from January 31st. 1940 forthe treatment of drug addiction until July 13th, 1940. VERDICT: Dr. C. V. Tyner moved that license by endorsement ofcredentials be denied to Dr. Harold Preston Burbage. This motion wasduly seconded by Dr. L. R. Doffermyre and passed by a vote of four.One member abstained from voting.

RE: Dr. Geor e W. Melchior — The aboard at the May 1960 meet-ing instructed the secretary to obtain a report from Dr. M. M. Vitols.Superintendent of the Cherry Hospital. with regard to Dr. Melchior inview of the report received at this time.

The secretary presented Dr. Vitols' report under date of May30th, 1960, which stated that Dr. Melchior had recently had someemotional disturbance. That aside from this episode he had been gett-ing along all right. That his work was satisfactory. Dr. Vitols re-commended that he be allowed to continue his work there.

VERDICT: Dr, L. R. Doffermyre moved that Dr. George W. Melchior'sspecial limited license be renewed on an annual basis. This motionwas duly seconded by Dr. T. G. Thurston and passed unanimously.

Dr. Marion B. Roberts failed to register his license to practicemedicine in January, 1960, and after due notif ication the same wassuspended. He was advised that he had been practicing' medicine withouta license since May 9th, 1960. Dr. Roberts stated that he had notopened his mail and was unaware of this fact. The law was explainedand he paid fee of $5. 00 and penalty of $10.00 at this time.

VERDICT: Dr. C. V. Tyner moved that Dr. Marion B. Roberts' lic-ense to practice medicine be reinstated. This motion was duly second-ed by Dr. J. J. Combs and passed unanimously.
