CATT has a strong community ethic. Giving back to the community is fundamental to the very existence of C.A.T.T. Community

Project and is evident in the things we do such as helping the Truckee Donner Chamber with Good Morning Truckee or working collaboratively with other non-profits on a Truckee Community Build-ing. Another way CATT gives back to the com-munity is through the Sierra Seniors Breakfast in Truckee, set for Sunday, Dec. 1. This is the Sun-day right after Thanksgiving. There are two shifts,

with the early birds setting the tables and getting the kitchen running at 7 am. The second shift handles the mid-morning heavy influx of diners with all cleanup done by 11:30 am or so. Money raised from this breakfast pays for the “Meals on Wheels” program. Please let me know if you can help serve, cook, or clean up. The CATT Annual Meeting is Monday, Jan. 6, 2014, 5 pm, at the CATT office.This is the meeting where new officers and directors take their seats and a recap of the previous year’s activities and accomplishments are presented. TRUCKEE BUILDING & SAFETY DIVISION

Iwanted to take a moment and introduce myself to the Contractors Association as the new Building Official in Truckee. My name is Johnny Goetz and I previously worked for the Town of Mammoth Lakes (2004-2013) as the Senior Inspector and more recently the Assistant Building Official. I had been the Acting Building Official since

September 2010. I bring with me to Truckee my beautiful wife, Heidi, and our two boys, Calvin (five years old) and Casey (seven months). When the opportunity was presented to us, there was no doubt that we wanted another small town and had to be in the mountains (with a lot of skiing), and Truckee is just that. We are extremely grateful and excited to be a part of this community and look forward to establishing many new friendships while maintaining our Mammoth roots.

As many of you may have heard, I have a very strong opinion that everyone should be included in how the Building Division can achieve strong relationships and efficiencies for the community as a whole. My belief is that we all are part of the bigger picture and the most sensible way is “great” communication. With communication comes solutions, albeit not withstanding some challenges; however, in the end we all want solutions in order to maintain productivity in a safe and efficient way. A couple of goals that I will be striving for in the immediate future include online permitting, a “one stop shop” for all agencies, and a review of fees which at the end of the day results in our revenues equaling our expenditures.

Online permitting is something that will come with challenges, but if done slowly with successful momentum will create a “real” efficiency. Online permitting will only continue to expand throughout our industry, and will likely be a paperless process. In terms of the “one stop shop,” this is something that will enable the applicant to submit a project once and not have to submit to all agencies. This will not diminish the fact that utility approvals would still be required; rather, it would create a hub from which the information would be processed and distributed. Fees are always somewhat controversial, yet are needed in order to provide the service that one comes to expect. The basic premise that revenues should equal expenses sounds easy, but requires a balance that is fair and equitable to all.

The fourth quarter of 2013 is rapidly approaching. This means more unpredictable weather leading up to the wet weather months at years end in the Truckee/Tahoe vicinity. For many, this means planning for

the spring construction season and for others it is a scramble to beat the weather to close up an on-going job.

In the Truckee/Tahoe area there are multiple layers of jurisdictional regulations which are applicable to all construction projects. The Town of Truckee, the Lahonton Regional Water Quality Control Board, and Placer County, have area-specific and project-specific regulations which can over-lap. Many of these regulations pertain to lot size, amount of grading, dura-tion of grading (including time of year), and conformance with applicable approved local plans. These include General Plans, and specific water quality plans such as the Total Maximum Daily Load (TMDL) for Squaw Creek program and the Storm Water Management Plan (SWMP) devel-oped jointly by the Town of Truckee and Placer County. It is critical that lo-cal contractors become familiar with these regulations along with the State of California Construction General Permit.

On sites where significant grading occurs, BMP (Best Management Practices) options are numerous to protect the subject site as well as adja-cent properties. If a SWPPP (Storm Water Pollution Prevention Plan) has been prepared for the project, that document is the best source for site specific BMP’s. Slope stability is imperative throughout the winter months to ensure that soils remain intact and that no sediment laden run-off occurs. This can result in the creation of off-site problems and liability with impacts to adjacent properties. Allow time at the conclusion of the site grading to mitigate potential impacts. Slopes should be hydroseeded, jute matting in-stalled, wattles positioned on the slopes, or other alternatives should be given enough time to become established to be effective slope stabilizers.

Attention must also be given to other infrastructure improvements such

as drainage structures, if the project is this far along in the development process. “Winterizing” existing improvements can preserve the work al-ready completed. This will reduce the need to reconstruct or re-install these improvements because of foul weather damage during the winter months. Again, BMP’s should be installed to preserve work accomplished.

The utilization of wattles, gravel bags, and filter fabric are all relatively inexpensive means and methods of preserving the integrity of newly in-stalled site improvements. There are many other more sophisticated BMP’s that might be applicable. The project SWPPP should be consulted when unique conditions are encountered. If there is no project SWPPP, a “Construction BMP Handbook” can be obtained from the California Storm-water Quality Association (CASQA) from their website at www.casqa.org/.

It all comes down to scheduling and preparing the site for the winter months. If problems occur i.e., run-off, sloughing of soils onto adjacent property, flooding, etc. the local Regional Water Quality Control Board can become involved to enforce the Construction General Permit provisions adopted by the State of California in 2009. Fines and penalties levied by the State can be extremely harsh. Good site housekeeping and installa-tion of sound BMP’s will enable most construction projects to survive the Sierra winter storms and to be incident free. Additional information on spe-cific details and requirements of the State Water Resources Control Board (SWRCB) Construction General Permit can be obtained from their website at www.swrcb.ca.gov.

Fire Codes The State of California amended the CA Fire Code and now local jurisdictions have the opportunity to amend their local codes based on specific climatic, topographic, or geological conditions of the jurisdictions. Most jurisdictions will be adopting their own Fire Codes in November or December of 2013. Firepits, gas meter covers, LPG standards, and sprinkler supply line testing are some topics that have been addressed by local jurisdictions. Q&A for ContractorsBy Shauna Krause, President Capitol Services, Inc.

I have heard that ‘timing is everything’ in humor, but it is no joke when deciding on making changes in your contractor’s licensing as our first question illustrates. Timing is again the issue in our second question, but

the answer goes well beyond his immediate need. Anyone with, or hoping to obtain, an LLC license will find good news in new legislation signed by the Governor…

Q: We currently have two licensed corporations that we will be selling the assets of. The buyer will form two new corporations and obtain new license numbers, however one of the conditions of the sale is that the Responsible Managing Officer (RMO) stay on as his Qualifier for the first few years of business. I was reading that an RMO can be on up three licenses at a time as long as there is some common ownership (which there is). Once the sale is final we will cancel the existing corporations’ licenses, so he will no longer be listed as the RMO on those two licenses. I just wanted to be sure that there will be no issues with transferring him over to the two new corporations. Thank you for your expert advice.

A: You are correct that when the ownership requirement is met an RMO can be on up to three active licenses at a time, but if you read that regulation further it states that an RMO can be up on three active licenses at a time within a one-year period. Your Qualifier is currently on two active licenses, so the CSLB would allow him to qualify one of the new entity’s licenses, but it’s unlikely that they will allow him to qualify both. In order to qualify the “fourth” entity, he would need to wait one year from the time he

is removed from the current corporation’s license. Q: I am the RMO on my brother’s corporation’s license. He recently

went to work for another company so he inactivated his corporate license. Since he’s not using the license, I would like to remove myself from the license to be released of any potential liability but I don’t want his license to go suspended as a result. I assume he will have 90 days to replace me once I disassociate?

A: Actually, Inactive licenses are not required to have an RME/RMO. Likewise, Inactive licenses are not required to have Bonds or Worker’s Compensation on record with the CSLB. If and when your brother decides to activate the license in the future he will be required to list a new RMO/RME as well as comply with bond and insurance requirements.

LLC Licensing Note: AB 1236 was signed by Governor Brown, which will authorize contractors licensed as LLC’s to obtain liability insurance from a surplus line insurer. Current law requires that licensed LLC’s maintain a certain level of liability insurance, and it is to be written by an insurance company admitted to underwrite insurance in California. Many times LLC contractors are unable to obtain a contractor’s license due to the fact that they cannot obtain the required liability insurance because such coverage is unavailable from any California admitted insurer. Many contractors in California that operate as corporations use a surplus lines carrier for their liability insurance. The new legislation will allow those corporations to apply for LLC status without changing insurance carriers.

This new legislation authorizing LLC’s to obtain the required liability insurance from a surplus line insurer will go in to effect on January 1, 2014.
