Năm 2011 Chi cục Bảo vệ môi trường đã tiến hành biên soạn và in ấn “Cẩm nang bảo vệ môi trường dành cho chủ Doanh nghiệp” để phân phối đến

các doanh nghiệp. Trong năm vừa qua, các văn bản pháp luật về bảo vệ môi trường đã có những thay đổi và có các văn bản mới thay thế cho các văn bản trước đây. Do đó, để kịp thời cung cấp các thông tin và các quy định mới của pháp luật bảo vệ môi trường đến chủ các cơ sở sản xuất công nghiệp, Chi cục Bảo vệ môi trường đã tổ chức biên soạn lại tài liệu này nhằm cập nhật các quy định mới nhất về bảo vệ môi trường mà doanh nghiệp cần phải biết, phải thực hiện kể từ khi chuẩn bị thành lập đến khi đi vào sản xuất ổn định.

Đây là tài liệu hướng dẫn rất hữu ích dành cho các Doanh nghiệp để thực hiện các giải pháp bảo vệ môi trường cho cơ sở sản xuất của mình; đồng thời cũng là tài liệu tuyên truyền bổ ích dành cho các cán bộ làm công tác quản lý nhà nước về môi trường.

Trong quá trình biên soạn có thể sẽ có một số vấn đề chưa hoàn chỉnh, Ban biên tập rất mong nhận được những ý kiến đóng góp quý báu của các nhà quản lý, các chuyên gia môi trường để tài liệu được hoàn thiện hơn trong những lần tái bản sau.

In 2011, Environmental Protection Agency compiled and printed “Environmental protection manual for business owners” to distribute to

enterprises. In recent years, the legal documents for environmental protection have been changed and new documents replaced old ones. Therefore, in order to update timely information as well as new rules of the environmental protection law to the owners of industrial production facilities, Environmental Protection Agency has recompiled this document to instruct the latest laws about environmental protection issues that the enterprise need know and has to perform from established preparation to production stably.

This guide-material not only is very useful for enterprises to implement measures of environmental protection for their production facilities but also is helpful propaganda material for cadres working in State management about environmental field.

During compilation process, may have some uncompleted issues so the editorial board looks forward to receiving valuable comments of managers, environmental experts in order that the manual can be improvable in next editions.

PREPARATION PERIOD


Lưu ý: Nếu cơ sở SX, KD, DV đang hoạt động nhưng có nhu cầu cải tạo, mở rộng, nâng cấp, nâng công suất mà có tổng công suất (hiện hữu và mở rộng) tương đương với các DA được quy định tại phụ lục II của NĐ 29/2011/NĐ-CP thì lập ĐTM, ngược lại lập CKBVMT cho DA mở rộng.

Remarks: If an enterprise or entity (manufacturing, business, services) has the need to modify, expand, upgrade, increase capacity and the new production capacity (including the existing one plus the expanded one) meets the capacity requirements as listed in the Annex II of Decree 29/2011/NĐ-CP), the enterprise would need an EIA, otherwise, only CEP is needed for the expansion project.

1. Phải lập ĐTM hoặc CKBVMT trình cơ quan có thẩm quyền phê duyệt, xác nhận.

2. Xem Phụ lục II “Danh mục các DA phải lập ĐTM” ban hành kèm theo NĐ 29/2011/NĐ-CP để xác định DA thuộc đối tượng lập ĐTM hay CKBVMT.

3. Thời điểm lập ĐTM hoặc CKBVMT:

- DA thăm dò, khai thác khoáng sản: trước khi xin cấp, điều chỉnh giấy phép thăm dò, khai thác khoáng sản.

- DA có hạng mục xây dựng công trình: trước khi xin cấp, điều chỉnh Giấy phép xây dựng.

- Các DA còn lại: trước khi quyết định đầu tư DA.

4. Nơi nộp ĐTM, CKBVMT

- Nếu DA thuộc đối tượng lập ĐTM: nộp về Sở TNMT hoặc Bộ TNMT theo Phụ lục III “Danh mục các DA thuộc trách nhiệm thẩm định và phê duyệt ĐTM của Bộ TNMT” ban hành kèm theo NĐ 29/2011/NĐ-CP.

- Nếu DA thuộc đối tượng lập CKBVMT: nộp về UBND cấp huyện nơi thực hiện DA.

I. WHAT SHOULD AN ENTERPRISE DO DURING THE CONSTRUCTION PERIOD?

1. Make an EIA or CEP and submit it to the authorized agencies for approval.

2. Refer to The Annex 2 “List of enterprises require the EIAR” issued together with Decree 29/2011/NĐ-CP to see if an enterprise/project needs an EIA or CEP or not.

3. When to make the EIA or CEP?

- Mineral exploration and production projects: before applying for or before asking approval on the modifications of the Mineral Exploration and Production License.

- Projects with construction works: before applying for Construction License and before asking for approval on the modifications of the Construction License.

- Other projects: before the investment decision is made.

4. Where to submit the EIA/CEP

- EIA: to the DONRE or MONRE as regulated in the Annex III ‘List of projects under the MONRE’s EIA review and approval ” issued together with the Decree 29/2011/NĐ-CP.

- CEP: to the District’s People’s Committee where the project takes place.


1. A set of documents (for those who are not required for the EIA) include:

- Three (03) CEP using the template specified in the Annex 5.1 and the Annex 5.2 of the Circular 26/2011/TT-BTNMT.

- One (01) investment project (feasibility study report) with the projects owner’s signature and stamp.

2. A set of documents (for those which are not required for the Investment project and for the EIA) includes:

- Three (03) CEP using the template as regulated in The Annex 5.3, Circular 26/2011/TT-BTNMT.

- One (01) Report describes the details of manufacturing, business, and services signed by authorized representative persons and stamped with the enterprise’s chop.

3. Approval time: 5 working days

1. Hồ sơ đăng ký đối với DA đầu tư không thuộc đối tượng phải lập ĐTM gồm:

- Ba (03) bản CKBVMT theo mẫu quy định tại Phụ lục 5.1 và 5.2 của TT 26/2011/TT-BTN-MT.

- Một (01) bản DA đầu tư (báo cáo nghiên cứu khả thi) có chữ ký và đóng dấu của chủ DA.

2. Hồ sơ đăng ký đối với các DA không thuộc đối tượng phải lập DA đầu tư và không thuộc đối tượng phải lập ĐTM gồm:

- Ba (03) bản CKBVMT theo mẫu quy định tại Phụ lục 5.3 của TT 26/2011/TT-BTNMT.

- Một (01) bản thuyết minh về phương án SX, KD, DV được chứng thực bởi chữ ký của người đại diện có thẩm quyền và và đóng dấu của cơ sở SX, KD, DV.

3. Thời gian xác nhận: 05 ngày làm việc

1. Hồ sơ đề nghị thẩm định gồm: - Một (01) văn bản đề nghị thẩm định theo mẫu quy định tại Phụ lục 2.3 của TT

26/TT-BTNMT - Bảy (07) bản ĐTM theo các nội dung, cấu trúc quy định tại Phụ lục 2.4 và 2.5

của TT 26/2011/TT-BTNMT.- Một (01) bản DA đầu tư (báo cáo nghiên cứu khả thi) có chữ ký và đóng dấu

của chủ DA. 2. Thời gian thẩm định: 45 ngày làm việc

Lưu ý: Trong quá trình triển khai DA đầu tư, hoạt động sản xuất, kinh doanh nếu có những điều chỉnh, thay đổi về các nội dung của ĐTM, CKBVMT và biện pháp BVMT đã được phê duyệt, xác nhận: phải có báo cáo bằng văn bản gửi cơ quan đã phê duyệt, xác nhận và chỉ được phép thực hiện sau khi có ý kiến chấp thuận bằng văn bản của cơ quan này.

Lưu ý: Trong quá trình lập ĐTM, chủ DA phải tham vấn ý kiến UBND cấp xã nơi thực hiện DA và đại diện cộng đồng dân cư, tổ chức chịu tác động trực tiếp của DA.

Quan trắc môi trường để lập ĐTM

1. Documents for review include: - One (01) document asking for review/approval – using the template in the

Annex 2.3 of the Circular 26/2011/TT-BTNMT.- Seven (07) EIA whose contents and structure are in line with the Annex 2.4

and 2.5 of the Circular 26/2011/TT-BTNMT.- One (01) investment project (feasibility study report) with the projects owner’s

signature and stamp.2. Reviewing and approval time: 45 working days.

Remarks: During the project implementation, if there is any modifications and changes to the contents of the EIA Report and of the CEP Report, and to the approved environmental protection measures, the project owners must notify and get approval of the authorized agencies who have approved the Report before making any changes.

Remarks: During the EIA Process, the projects owner(s) need to consult the People’s Committee of the Commune where the project takes place and the local people representatives and organizations who will be directly impacted by the project.

2. Đối với CKBVMT:

- Thay đổi địa điểm thực hiện hoặc sau 24 tháng DA mới triển khai thực hiện kể từ ngày CKBVMT được đăng ký.

- DA có một trong những thay đổi về công nghệ, quy mô, công suất làm gia tăng phạm vi gây tác động, gia tăng các tác động xấu đến môi trường hoặc làm gia tăng mức độ phát thải hoặc phát sinh các loại chất thải mới, chất thải có thành phần gây ô nhiễm cao hơn so với dự báo trong CKBVMT đã được đăng ký nhưng chưa tới mức phải lập ĐTM.

1. Đối với ĐTM:

- Thay đổi địa điểm thực hiện DA hoặc sau 36 tháng DA mới triển khai thực hiện kể từ ngày ĐTM được phê duyệt.

- DA có một trong những thay đổi về công nghệ, quy mô, công suất làm gia tăng phạm vi gây tác động, gia tăng các tác động xấu đến môi trường hoặc làm gia tăng mức độ phát thải hoặc phát sinh các loại chất thải mới, chất thải có thành phần gây ô nhiễm cao hơn so với kết quả tính toán, dự báo trong ĐTM đã được phê duyệt.

Lưu ý: Trường hợp không có sự thay đổi về công suất thiết kế, công nghệ và tác động đến môi trường thì chỉ cần làm văn bản giải trình với cơ quan phê duyệt, đăng ký để được điều chỉnh.

Expand or inrease the scales of production

1. For the EIA:

- The project location is changed or the project has not started within 36 months since the date the EIA gets approved.

- The project has one of the following changes: technology, scale, and production capacity which can increase the negative environmental impacts such as increasing the air emission level or generating new wastes or wastes of higher polluting level than initially calculated in the approved EIA.

2. For the CEP:

- The project is relocated or has not started within 24 months since the date the CEP is registered.

- The project has one of the following changes: technology, scale, production capacity which can increase the negative environmental impacts such as increasing the air emission level or generating new wastes or wastes of higher polluting level than initially calculated in the approved CEP but less than the levels required for the EIA.

Remarks: When there is no change in terms of designed production capacity, technology and the environmental impacts, the project just needs to submit a document detailing the changes to the approving/registration agencies for modification approval.

1. Điều chỉnh DA đầu tư để đảm bảo phù hợp với yêu cầu của QĐPD ĐTM.

2. Lập, phê duyệt và niêm yết công khai kế hoạch quản lý môi trường tại trụ sở UBND cấp xã nơi thực hiện việc tham vấn ý kiến cộng đồng để nhân dân biết, kiểm tra, giám sát.

3. Tổ chức thực hiện các biện pháp bảo vệ môi trường trong giai đoạn chuẩn bị đầu tư và giai đoạn thi công xây dựng DA theo yêu cầu của QĐPD ĐTM.

4. Thiết kế, xây lắp các công trình và thực hiện các biện pháp xử lý nước thải, chất thải nguy hại, chất thải rắn thông thường, bụi, khí thải … theo ĐTM được phê duyệt.

5. Vận hành thử nghiệm các công trình xử lý chất thải phục vụ giai đoạn vận hành của DA.

6. Lập hồ sơ đề nghị kiểm tra, xác nhận việc thực hiện các công trình, biện pháp BVMT phục vụ giai đoạn vận hành của DA trước khi đi vào vận hành chính thức theo mẫu quy định tại Phụ lục 4.2, 4.3 của TT 26/2011/TT-BTNMT.

Lưu ý:

- Đối với trường hợp DA không có công trình BVMT phục vụ giai đoạn vận hành, chủ DA không phải lập hồ sơ đề nghị kiểm tra, xác nhận việc thực hiện các công trình, biện pháp BVMT phục vụ giai đoạn vận hành của DA;

- Trường hợp DA được đầu tư theo nhiều giai đoạn hoặc có nhiều hạng mục độc lập, chủ DA được lập hồ sơ đề nghị kiểm tra, xác nhận việc thực hiện các công trình, biện pháp BVMT phục vụ giai đoạn vận hành của DA theo từng giai đoạn hoặc theo các hạng mục độc lập của DA.

1. Adjust the investment project to ensure that it is in line with the requirements specified in the decision for the EIA Approval;

2. Make, get approved and publish the environmental management plan at the People’s Committee of the commune where the public consultation process has taken place to inform the local people so that they can monitor the implementation.

3. Coordinate the implementation of environmental protection measures during investment preparation phase and during the construction phase in accordance with the requirements specified in the decision for the EIA Approval;

Remarks:

- For those who do not need environmental protection facilities for the operational period, the project’s owners are not required to make a file asking for the inspection and certification of envi-ronmental protection facilities for the operational period.

- In case the project has different investment phases or independent works the projects owners need to create a file asking for the inspection and certification of environmental protection facilities for each phase of the project or for each independent work.

4. Design and install environmental facilities including wastewater treatment, hazardous waste and non-hazardous waste management, air and dust emission treatment, etc. as committed in the approved EIA;

5. Conduct the operational trials of the waste treatment facilities;

6. Create a file to ask for inspection and approval of the environmental protection facilities before they are put into official operation. The file must use the template in the Annex 4.2, and 4.3, Circular 26/2011/TT-BTNMT.

I. CHỦ DỰ ÁN PHẢI LÀM GÌ SAU KHI ĐTM ĐƯỢC PHÊ DUYỆT? I. WHAT SHOULD AN ENTERPRISE’S OWNER NEED TO DO AFTER THE EIA GETS APPROVED?


Tổ chức thực hiện các biện pháp giảm thiểu những tác động xấu đến môi trường trong CKBVMT đã được đăng ký.

1. Hồ sơ đề nghị xác nhận gồm:

- Một (01) văn bản đề nghị kiểm tra xác nhận việc thực hiện các công trình, biện pháp BVMT phục vụ giai đoạn vận hành của DA thực hiện theo mẫu quy định tại Phụ lục 4.2 TT 26/2011/TT-BTNMT;

- Một (01) bản sao quyết định phê duyệt kèm theo bản sao ĐTM đã được phê duyệt;

- Năm (05) báo cáo kết quả thực hiện các công trình, biện pháp BVMT phục vụ giai đoạn vận hành của DA thực hiện theo mẫu quy định tại Phụ lục 4.3 TT 26/2011/TT-BTNMT.

- Năm (05) phụ lục với các tài liệu kèm theo quy định tại khoản 4 Điều 25 NĐ 29/2011/NĐ-CP.

2. Thời gian giải quyết: 40 ngày làm việc.

Lưu ý: Nếu các công trình, biện pháp bảo vệ môi trường có thay đổi, điều chỉnh so với phương án đã được phê duyệt trong ĐTM thì cần mô tả rõ các thay đổi, điều chỉnh đó (phương án, quy mô, công nghệ …) vào Báo cáo kết quả thực hiện các công trình biện pháp BVMT phục vụ giai đoạn vận hành để được xem xét, thống nhất.

The projects owner needs to implement all environmental protection measures as committed in the CEP to reduce the negative environmental impacts.

1. The file must include:

- One (01) document asking for the inspection and certification of environmental protection facilities to be used for the projects operational period using the template as regulated in the Annex 4.2, Circular 26/2011/TT-BTNMT;

- One (01) copy of the Decision of the EIA Approval and one (01) copy of the approved EIA;

- Five (05) Reports on the implementation results of the environmental protection facilities for the operational period using the template in the Annex 4.3, Circular 26/2011/TT-BTNMT;

- Five (05) Annexes with all related supporting documents as regulated in the Item 4, Article 25 of the Decree 29/2011/NĐ-CP.

2. Processing time: 40 working days.

Remarks: If environmental protection facilities and measures have changed compared with what had been approved in the EIA, these changes need to be described in details (plan, scale, technology, etc.) in the Report on the implementation of environmental protection facilities for the operational period for consideration and approval.

Trong quá trình hoạt động, Doanh

nghiệp phải:

1. Lập hồ sơ đăng ký chủ nguồn thải CTNH.

2. Kê khai và nộp phí BVMT đối với nước thải.

3. Lập báo cáo giám sát môi trường định kỳ.

4. Tuân thủ các quy định BVMT đối với nước

thải, khí thải.

5. Tuân thủ các quy định BVMT đối với CTR.

6. Tuân thủ các quy định BVMT đối với tiếng

ồn, độ rung, ánh sáng, bức xạ.

7. Hướng dẫn về lập Đề án BVMT và các điều

chỉnh ĐTM, CKBVMT.

ENVIRONMENTAL MANAGEMENT AND PROTECTION DURING THE OPERATIONAL PERIOD

During the operation period, the enterprise is required to do the following things:

1. Make a file to register the enterprise as a hazardous waste generator;

2. Declare and pay the environmental protection fee for wastewater;

3. Make periodic environmental monitoring reports;

4. Comply with all environmental protection regulations/standards regarding wastewater and air emission;

5. Comply with all environmental protection regulations/standards for solid waste;

6. Comply with all environmental protection regulations/standards for noise, vibration, light, and radiation.

7. Guide the generation of the EPP and the modifications of EIA and of the CEP.


1. The file for registration: 2 sets of documents including: registration application using the template as regulated in the Annex 1A and all associated papers in line with guidance in the Annex 1B, Circular 12/2011/TT-BTNMT, and send them to the Binh Duong EPA for considerations.

2. Processing time: 10 days for the file consideration, 20 days for the Hazardous Waste Generator Registration Booklet.

3. Several major responsibilities of the enterprise’s managers:

- Segregate, collect, store and treat hazardous waste in accordance with all requirements in the Circular 12/2011/TT-BTNMT;

- Sign the hazardous waste collection and treatment contract with the licensed hazardous waste vendor;

- Quickly discharge hazardous waste for treatment, and be responsible for the supervision of hazardous waste collection, transportation and treatment.

- Follow the hazardous waste declaration procedure and use the hazardous waste manifest for each hazardous waste transfer as regulated.

- Make a Report on hazardous waste management using the template in the Annex 4A, Circular 12/2011/TT-BTNMT every 6 months;

- When the operation ends, the enterprise must notify and return the Hazardous Waste Generator Registration Booklet to the EPA.

3. Một số trách nhiệm chính của Nhà quản lý doanh nghiệp

- Phân loại, thu gom, lưu giữ và xử lý CTNH theo đúng quy định tại TT 12/2011/TT-BTNMT;

- Ký hợp đồng thu gom, xử lý CTNH với đơn vị có giấy phép hành nghề quản lý CTNH;

- Nhanh chóng chuyển giao chất thải đi xử lý, có trách nhiệm theo dõi, giám sát việc chuyển giao và xử lý CTNH.

- Thực hiện đúng quy trình kê khai và sử dụng chứng từ CTNH mỗi lần chuyển giao CTNH theo quy định.

- Lập báo cáo quản lý CTNH theo mẫu quy định tại Phụ lục 4A của TT 12/2011/TT-BTNMT với kỳ báo cáo 06 tháng/lần;

- Khi chấm dứt hoạt động, phải thông báo bằng văn bản và nộp lại Sổ đăng ký chủ nguồn thải CTNH cho Chi cục BVMT.

Lưu ý: Việc lập hồ sơ đăng ký chủ nguồn thải CTNH không bắt buộc đối với một trong các trường hợp sau:

- Thời gian hoạt động cửa DA dưới 01 (một) năm;

- Phát sinh thường xuyên với tổng số lượng không quá 120 kg/năm đối với các CTNH có chứa các thành phần nguy hại đặc biệt vượt ngưỡng CTNH theo quy định tại QCVN 07:2009/BTNMT hoặc 600kg/năm đối với CTNH có chứa các thành phần nguy hại khác.

Lưu ý: Trường hợp cần lưu giữ tạm thời CTNH quá thời hạn 06 tháng phải thông báo cho Chi cục BVMT bằng văn bản.

Remarks: Registration as Hazardous Waste Generator is not applied to the following cases:- The enterprise’s operational period is less than a year.

- Regular generation of no more than 120 kg/year of hazardous wastes containing special hazardous substances exceeding the threadhold as regulated in QCVN 07:2009/BTNMT or no more than 600kg/year for hazardous waste containing other hazardous substances.

Remarks: In case hazardous waste needs to be temporarily stored for more than 06 months, the enterprise must notify the EPA of this long-term storage in writing.

- Phải thu gom và xử lý toàn bộ lượng nước thải phát sinh trong quá trình hoạt động (bao gồm cả NTSX và NTSH) và khí thải; đảm bảo nước thải, khí thải sau xử lý đạt quy chuẩn xả thải theo quy định của pháp luật hiện hành.

- Các công trình trong hệ thống xử lý đã được xây dựng phải được vận hành đồng bộ và liên tục.

Lưu ý: Nếu có bất kỳ sự thay đổi nào về phương án xử lý so với phương án đã được phê duyệt/đăng ký trong ĐTM/CKBVMT, phải có văn bản báo cáo về cơ quan quản lý môi trường để có ý kiến về việc thay đổi này và chỉ được thực hiện khi có ý kiến chấp thuận bằng văn bản.

Nhà quản lý doanh nghiệp phải thực hiện việc phân loại và chuyển giao CTR sinh hoạt và công nghiệp theo đúng quy định tại NĐ 59/2007/NĐ-CP; QĐ 43/2007/QĐ-BYT và TT 12/2011/TT-BTNMT.

Nhà quản lý doanh nghiệp phải đảm bảo tiếng ồn, độ rung, ánh sáng, bức xạ trong nhà xưởng đáp ứng các yêu cầu về vệ sinh ban hành kèm theo QĐ 3733/2002/QĐ-BYT.

Remarks: If there is any change in the environmental treatment measures versus the ap-proved treatment ones in the EIA/CEP, the tentative changes must be communicated to the DONRE in writing for considerations and approval before any change can be made.

Each enterprise must implement waste segregation and discharge domestic waste and industrial waste in accordance with the guidance in the Decree 59/2007/NĐ-CP; Decision 43/2007/QĐ-BYT và Circular 12/2011/TT-BTNMT.

The enterprise must ensure that noise level, vibration, light and radiation in the workshop(s) meet industrial hygiene standards as regulated in the document as-sociated with Decision 3733/2002/QĐ-BYT.

1. If an enterprise (manufacturing, business, and service) is in operation or has completed the construction, equipment installation and trial operation but has not obtained the EIA Approval Decision, Certification of Environmental Standards Compliance, CEP Approval, the enterprise must make the EPP.

Files and Procedure for EPP generation and certification are detailed in the Circular 01/2012/TT-BTNMT.

2. During the operational period, if an enterprise (manufacturing, business, service) wants to expand, upgrade, up-scale, increase production capacity or plans to adjust the contents of the EIA, CEP, the enterprise needs to do the following things.

- If the project is expanded and upgraded to less than twice the current production capacity and generates less than twice the amount of waste, or if the project has some modifications which do not generate any new waste, the project must notify the DONRE or the agency who has approved the CEP for considerations before any change can be made.

- If the project is expanded and upgraded to equal or more than twice the current production capacity and thus generates equal or more than twice the amount of waste, or generates new waste, an EIA or CEP must be made and submitted to the authorized organizations for considerations, approval and registration before the expansion and production scale-up can be implemented.

3. During the operational period, if an enterprise has implemented the changes versus the contents of the EIA or of the CEP without notifying and getting approval from authorized agencies, the enterprise has violated the Vietnam environmental protection law. Therefore, the enterprise must actively make remediation as follows.

- If the entity has expanded the production to less than 2 times or the increased waste generation is less than 2 times, a document detailing the changes and modifications compared with the previous setting must be sent to DONRE or to the organization who had approved the CEP.

- If the entity has expanded the scale and production capacity more than twice and generated the waste more than twice or generates new waste or waste with higher polluting substances compared with the previous setting, the enterprise must make the EPP.

1. Nếu cơ sở SX, KD, DV đã đi vào hoạt động kể cả đã triển khai xây dựng, lắp đặt thiết bị, vận hành thử nghiệm nhưng không có QĐPD ĐTM; giấy xác nhận bản đăng ký đạt tiêu chuẩn môi trường, đăng ký CKBVM phải lập Đề án BVMT.

Hồ sơ, quy trình lập Đề án BVMT và xác nhận việc thực hiện Đề án BVMT thực hiện theo quy định tại TT 01/2012/TT-BTNMT.

2. Trong quá trình hoạt động, nếu cơ sở SX, KD, DV có dự án mở rộng, nâng cấp, tăng quy mô, công suất hoặc dự kiến thay đổi nội dung ĐTM, CKBVMT phải thực hiện như sau:

- Nếu dự án mở rộng, nâng cấp có quy mô, công suất và tổng lượng chất thải tăng dưới 02 lần hoặc có các nội dung điều chỉnh, thay đổi mà không làm phát sinh chất thải mới so với trước đây: phải có văn bản báo cáo, giải trình gởi về Sở Tài nguyên và Môi trường hoặc cơ quan đã xác nhận, đăng ký CKBVMT để được xem xét, thống nhất trước khi thực hiện việc điều chỉnh, thay đổi.

- Nếu dự án mở rộng, nâng cấp có quy mô, công suất và tổng lượng chất thải tăng từ 02 lần trở lên hoặc phát sinh các loại chất thải mới so với trước đây thì phải lập ĐTM hoặc CKBVMT và gửi về cơ quan có thẩm quyền để xem xét phê duyệt, đăng ký trước khi triển khai thực hiện việc mở rộng, nâng công suất.

3. Trong quá trình hoạt động, nếu cơ sở SX, KD, DV đã thực hiện việc thay đổi, điều chỉnh các nội dung của ĐTM hoặc CKBVMT nhưng không báo cáo và chưa được sự thống nhất của cơ quan có thẩm quyền là đã vi phạm các quy định của Luật BVMT. Do đó, các cơ sở sản xuất, kinh doanh phải chủ động khắc phục như sau:

- Nếu đã mở rộng, nâng cấp, tăng quy mô, công suất dưới 02 lần hoặc có tổng lượng chất thải tăng ít hơn 02 lần phải có văn bản giải trình về những thay đổi, điều chỉnh so với trước đây và gởi về Sở Tài nguyên và Môi trường hoặc cơ quan đã xác nhận, đăng ký CKBVMT .

- Nếu đã mở rộng, nâng cấp, tăng quy mô, công suất hoặc tăng tổng lượng chất thải từ 02 lần trở lên hoặc phát sinh các loại chất thải mới, chất thải có thành phần gây ô nhiễm cao hơn so với trước đây phải lập Đề án BVMT .

Lưu ý: - Lập Đề án BVMT chi tiết nếu cơ sở có quy mô, tính chất tương đương với đối tượng lập ĐTM.

- Lập Đề án BVMT đơn giải nếu cơ sở có quy mô, tính chất tương đương với đối tượng lập CKBVMT.

Remarks: - Make the detailed EPP if the scale and the nature of the enterprise are equivalent with those of the enterprises which require the EIA.

-Make the simple EPP if the scale and the nature of the enterprise are equivalent with those of the enterprises which require the CEP.

1,000m3/24hrs, all industrial parks and industrial clusters need to install the

- Wastewater generators of between 200m3 and 1,000m3/24hrs must have both

Remarks: The automatic wastewater quality monitoring equipment must be built and in-stalled in accordance with the Technical Guidance on the automatic wastewater quality monitor-ing equipment issued by the DONRE. The flow monitoring device, and the automatic wastewa-ter sampler and analyzer (or the automatic wastewater quality monitoring equipment) must be connected with the Control Room of the DONRE’s automatic wastewater monitoring network.

1. Đối với việc xây dựng điểm quan trăc nguồn nước thải:

- Khi xây dựng cửa xả nước thải vào hệ thống thoát nước chung phải lắp đặt hố gas ở vị trí thuận lợi cho việc kiểm tra, giám sát. Vị trí hố gas phải được đặt cạnh hàng rào bên ngoài cơ sở sản xuất để các cơ quan quản lý, chính quyền địa phương giám sát việc xả thải.

- Nắp hố gas phải được thiết kế và lắp đặt sao cho dễ quan sát được nước thải trong hố gas, đồng thời dễ dàng thao tác mở nắp khi cần thiết. Đường kính hoặc chiều rộng hố gas tối thiểu là 0,7 m; ống thoát nước vào hố ga phải cách mặt đáy 0,5 m, ống thoát nước ra khỏi hố ga phải đặt cách mặt đáy 0,3 m để thuận lợi cho việc giám sát và lấy mẫu.

- Nghiêm cấm việc xây dựng các cửa xả thải ngầm.

1. Construction of the wastewater source sampling points

- When building the wastewater discharge points into the common wastewater network, the manhole should be positioned at the place convenient for wastewater inspection and supervision. The manhole should be placed next to the entity’s fence at the outside to facilitate the supervision of the wastewater discharge by the local authorities and management agencies.

- The cover of the manhole should be designed and constructed to facilitate the wastewater monitoring and to be easily opened when needed. To facilitate wastewater monitoring and sampling, the manhole’s minimum diameter or width should be 0.7m; the wastewater inlet must be placed 0.5m above the bottom of the manhole, and wastewater outlet must be placed 0.3m above the manhole’s bottom

- Strictly ban the construction of the hidden wastewater discharge points.

2. Construction of the air emission monitoring points

- The generator of air emission or exhaust air via stacks needs to build the air emission or exhaust air monitoring points on the air emission discharge pipeline or on the stack.

- The exhaust air monitoring point must be placed at the height level which is at least 3 times of the stack’s diameter. The exhaust air sampling point’s diameter is 100mm for stacks with diameter of more than 300mm; and is 10mm for stacks with diameter of less than 300mm. Each stack must have 2 exhaust air sampling points on the same cross sectional area and together with the center point of the cross-sectional area to make an angle of 900.2. Ống khói, ống thải phải có 02 điểm quan trắc cùng trên một tiết diện ngang và vuông góc với nhau.

4. Phạt tiền từ 130.000.000-170.000.000 đồng nếu không xây lắp, xây lắp không đúng, không vận hành, không vận hành thường xuyên hoặc vận hành không đúng quy trình xử lý môi trường đã được duyệt.

5. Bị phạt tiền từ 200.000.000 - 300.000.000 đồng nếu không có ĐTM hoặc Đề án BVMT.

5. Pay a fine from VND 200,000,000 to VND 300,000,000 if the EIA or the EPP is not available.

- The exceeding level is equal to or more than 10 times, the fine is from VND 8,000,000 to VND 300,000,000

- Vượt dưới 2 lần, mức phạt từ 100.000 -

150.000.000 đồng.

- Vượt từ 2 – dưới 5 lần, mức phạt từ 500.000

- 200.000.000 đồng.

- Vượt từ 5 – dưới 10 lần, mức phạt từ 2.000.000 - 250.000.000 đồng.

- Vượt từ 10 lần trở lên, mức phạt từ 8.000.000 - 300.000.000 đồng.

- Phạt từ 400.000.000 - 500.000.000 đồng đối với hành vi xả nước thải có chứa chất

phóng xạ gây nhiễm xạ môi trường vượt tiêu chuẩn, quy chuẩn kỹ thuật cho phép.

1. Phạt tiền từ 15.000.000 - 25.000.000 đồng nếu không lập bản CKBVMT.

2. Phạt tiền từ 500.000 - 5.000.000 đồng nếu thực hiện không đúng hoặc không đầy đủ các nội dung của bản CKBVMT.

3. Phạt tiền từ 10.000.000 - 15.000.000 đồng nếu không xây dựng, xây dựng không đúng, không vận hành, không vận hành thường xuyên hoặc vận hành không đúng quy trình xử lý môi trường đã cam kết.

Các hành vi vi phạm pháp luật về bản CKBVMT sẽ bị xử lý vi phạm theo quy định tại điều 7, NĐ 117/NĐ-CP/2009.

3. Pay a fine from VND 10,000,000 to VND 15,000,000 if the environmental fa-cilities are not built, not properly built, not regularly operated, or not operated in accordance with the environmental treatment measures as committed.

Legal violations in the CEP will be settled in line with the Article 7, Decree 117/2009/NĐ-CP.

2. For air emission:Those who violate the air emission

regulations will be settled by the Article 11 and the Article 14 Decree 117/2009/NĐ-CP and depending on the air emission flow and the extent of the air emission concentration violation, the fine is from VND 100,000 to VND 500,000,000. The details are as follows.

- Discharge the odor and nuisance smell into the environment: the fine is from VND 500,000 to VND 2,000,000;

- The exceeding level is less than 1.5 times: the fine is from VND 1,000,000 to VND 120,000,000;

- The exceeding level is from 1.5 times to less than 2 times, the fine is from VND 2,000,000 to VND 150,000,000;

- The exceeding level is from 2 times to less than 3 times: the fine is from VND 5,000,000 to VND 200,000,000;

- The exceeding level is from 3 times to less than 5 times: the fine is from VND 20,000,000 to VND 250,000,000;

- The exceeding level is equal to or more than 5 times: the fine is from VND 20,000,000 to VND 300,000,000;

- Those who emit the air emission containing over-standard radiation substances: the fine is from VND 400,000,000 to VND 500,000,000.

2. Đối với khí thải:

Nếu vi phạm sẽ bị xử phạt theo Điều 11

và Điều 14 NĐ 117/NĐ-CP/2009 tùy theo lưu

lượng và nồng độ vượt tiêu chuẩn, quy chuẩn

mà mức phạt từ 100.000 – 500.000.000 đồng

như sau:

- Thải mùi hôi thối, mùi khó chịu vào môi

trường, mức phạt từ 500.000 - 2.000.000

đồng.

- Vượt dưới 1,5 lần, mức phạt từ 1.000.000 - 120.000.000 đồng

- Vượt từ 1,5 – dưới 2 lần, mức phạt từ 2.000.000 - 150.000.000 đồng.



- Vượt từ 5 lần trở lên, mức phạt từ 20.000.000 - 300.000.000 đồng.

- Phạt từ 400.000.000 - 500.000.000 đồng đối với hành vi xả khí thải có chứa chất

phóng xạ gây nhiễm xạ môi trường vượt tiêu chuẩn, quy chuẩn kỹ thuật cho phép.

Those violate hazardous waste management regulations will be fined according to the Article 17 Decree 117/2009/NĐ-CP with the minimum fine of VND 2,000,000 and the maximum fine of VND 150,000,000.

6. Nghị định số 29/2011/NĐ-CP ngày 18 tháng 4 năm 2011 của Chính phủ quy định về đánh giá môi trường chiến lược, đánh giá tác động môi trường, cam kết bảo vệ môi trường;

7. Thông tư số 26/2011/TT-BTNMT ngày 18 tháng 7 năm 2011 của Bộ TNMT quy định chi tiết một số điều của Nghị định số 29/2011/NĐ-CP ngày 18 tháng 4 năm 2011 của Chính phủ quy định về đánh giá môi trường chiến lược, đánh giá tác động môi trường, cam kết bảo vệ môi trường;
