Ed, Jeff, Tim, George Morasci and the Host families have been putting on the miles to bring an outstanding and diversified presentation. We are gearing up for an entertaining event full of laughter and fun that you will not want to miss in the Durrer Family “Party Barn”. Here’s the Schedule of Events: • March 22, Thursday afternoon 4:00 pm, the party begins…the cattle viewing, the food and drink, wine tasting, music and dancing, the basketball games on the large video screens AND don’t forget Frank Borba’s famous grilled oysters. Expect to stay late and enjoy. We will have complimentary buses to and from the Hotel. • March 23, Friday is the Main Event – 8:30 am, will be the anticipation of walking through the animals, making your final selections and then at 10:30 am, the California Earthquake SALE will trem-ble and shake! Following the auction, the party continues…more grilled oysters, more laughter, with a fun-filled evening of a buffet dinner of tri-tip, pork tenderloin and all the fixings AND a variety of ice cream for dessert. After dinner-more music and dancing, basketball games on the large video screens and fun. The party ends when the last person leaves. We hope that this sale will be reminiscent of the past, great California sales. “Thank You” to the consignors across North America, to our sponsors for their generosity and to Ed and Jeff for this opportunity. PAYMENT OF CONSIGNORS: Payment to consignors will be as soon as possible after buyers check has cleared through Butler Fellers Auctions.
SPECIAL TERMS:
Prior Approval IS REQUIRED by seller or sale management prior to the sale. Indi-vidual consignments listed as selling on Special Terms will follow the payment schedule indicated on the pedigree or will be available at the sale on the update sheet or announced from the sale box.

selection/possession.

Most Special E T Terms will follow the payment schedule below; however, individual special terms may differ and will be indicated on the pedigree or announced at sale.
25% due a conclusion of sale 37.5% due at selection and possession, no interest 37.5% due 12 months after possession, 5% interest possession date will be when the youngest calf in the group offered is 3-4 months of age or is otherwise listed on the pedigree or announced at the sale
Additional E T Choice Information: Seller is entitled to $4.00 per day board fee after the youngest calf is 4 months of age.
If Buyer fails to make selection and take possession of a sound healthy female calf within 60 days after the youngest calf is 4 months of age and if the Seller has notified the Buyer by Certified Mail of the impending default of the sale and after giving the Buyer 10 days to respond to this certified letter, the seller can proceed with any legal means necessary against the buyer to secure the balance due or can declare the buyer in default and the Buyer will lose all rights as purchaser and will forfeit his down payment and commission. Seller is to complete all blood typing and transfer the registration certificate in a timely manner.
Should a sound healthy female chosen from the respective flush fail to meet the breeding guarantees as stated in Holstein USA’s Terms and Conditions listed in this cata-log, the Seller will refund the Buyer the purchase price in full, less the salvage value of the animal. No boarding fee, feed expense or trucking expenses are due from the Buyer. Should an acceptable sound healthy female not result from the respective flush, the fol-lowing steps will be taken to fulfill the purchase agreement;
1. Seller will offer choice of other flushes or calves that are available from the donor with no interest and the payment schedule will remain the same with respect to age of calf selected
2. If no pregnancies can be made available to the buyer, as in the sale or death of donor, or the donor’s inability to produce embryos; the seller shall provide the buyer a good, healthy, acceptable calf from another cow of equal or greater value as determined by the Sale Management.
3. Any disputes regarding choice of flush purchases are strictly between buyer & seller. Sale management is NOT liable to buyer or seller regarding refund of any sale commission.
4. Sale management will negotiate and mediate on behalf of both buyer & seller in any dispute.
CONDITIONSOF SALE
A.I., EMBRYO & FEMALE CONTRACTS:
Because of their elite status within the Holstein Breed, many of the individuals selling will sell with a number of contracts. Every effort will be made by the Sale Management and the Sale Host to have the contracts available at the sale for your full inspection. It should be noted that every contract is conditional and many will have expiration dates along with other criteria that needs to be accomplished. It is the Buyer’s responsibility to become aware of the conditional requirements before a purchase is made. Each po-tential buyer is encouraged to visit with the Owner (not the Sale Management) well in advance of the auction and familiarize themselves with the contracts offered with each consignment.
HEALTH:
An Interstate Health Certificate will be provided with each animal sold. Each consign-ment has been asked to be tested negative within 30 days of sale date for: Brucellosis (unless calfhood vaccinated and under the required age limit ) TuberculosisOptional tests are Blue Tongue, Leukosis, EHD, Johnes, Anaplasmosis and BVD (animals are not required to be negative for any or all of these optional tests)
It is the Buyer’s responsibility to learn the health requirements of his State or Country and to inquire as to the respective test results of his prospective purchases. Individual Consignments are not guaranteed to have been tested or to qualify for entrance into any particular State or Country. Any additional health testing required will be at the Buyer’s expense and are not guaranteed.
TRUCKING:
Assistance will be provided to secure trucking for your purchases after settlement has been made with the sale clerk the day of the sale. However, trucking is the sole respon-sibility of the Buyer.
RISK & MORTALITY INSURANCE: Each individual consignment is at the sole risk of the seller until sold and at the sole risk of the buyer when struck off by the auctioneer Insurance is available to the seller prior to the sale and is available to each buyer at the sale. Sale Management and the Sale Host encourages everyone to afford themselves of this protection. For all purchases made on terms, insurance is recommended the day of the sale on the unpaid balance with Buyer & Seller listed as loss payee.
STANDARD EMBRYO GUARANTEE:
The following is a guideline for any potential buyer and seller embryo guarantee agree-ment. No Embryos are guaranteed by sale management, any embryo guarantee is strictly between buyer & seller. The seller may guarantee the individual animal will produce transferable embryos over a designated period of time. The Seller may agree to a percent-age of the embryos less than the amounts designated. A natural calf will be a credit of one (1) against the sellers embryo warranty.
RESPONSIBILITY:
The seller, buyer, and manager of this sale are obligatedto comply with the provisions of these terms and conditions.

OF SALE - Cont.BIDS:
The highest bidder is the buyer. Bidding parties or their agents areresponsible for all bids placed. Every animal or lot presented for biddingis pledged to absolute sale. In case of dispute, the animal or lot will againbe put up for advance bids, and if there is no advance bid, the animal orlot will be sold to the person the auctioneer accepted the last bid from.In case two or more claim the bid, the auctioneer will indicate the partywhose bid he recognized. Other claimants will be given an opportunityto increase the bid and bidding will be restricted to the two or moreclaimants.
TRANSFER OF OWNERSHIP:
For all Registered HolsteinsSM, the transferof ownership to the buyer will be recorded on the records of HolsteinAssociation USA and a certificate of registration showing that transferof ownership will be provided to the buyer free of charge. For embryos,the transfer of ownership to the buyer will be recorded on the records ofHolstein Association USA free of charge to the buyer.
WARRANTIES:
1) Each consignor warrants clear title to the animal or lot, and the right to sell same.
2) To the best of the seller’s knowledge, each animal is sound and healthy in every respect and embryos have been recovered, processed, frozen, transferred and graded in keeping with IETS recommendations unless otherwise noted in the catalog or announced from the auction stand. Every precaution will be taken to represent the physical condition of each lot exactly as is known. Examination of all purchases should be made immediately after the purchase and before the close of the sale, and if found not to be as represented, complaint must be reported to the sale management before the close of the sale. In the event no complaint is filed, it is understood that the buyer assumes full ownership in the case of animals at sale site together with all risks, after which no representations of the seller can be challenged through the sale management. Heifers that never calved are in no way guaranteed as to the condition of their udders following calving. 3) Breeding Warranty The seller guarantees all animals to be breeders, but not beyond the purchase price, with the following understanding: a. Males - Should any bull after reaching the age of fourteen months fail to prove a breeder after being used for two months on cows or heifers known to be breeders, the matter shall be reported in writing to the seller within three months of the sale date. The report must include the animal’s examination record, a written statement of treatment, and a statement of the animals’ inability to breed, by a licensed veterinarian. The seller has the option to refund the purchase price or make other settlement that is satisfactory to the buyer. In either case the rights of ownership of the animal return
to the seller. The seller guarantees that the bull will make freeze able semen exceptable to A.I. standards. b. Females - All females are guaranteed to be breeders with the exception of: 1. Cows over 7 years of age when sold; 2. Cows and/or heifers carrying a pregnancy that is the result of an embryo transfer.
Report of a non-breeder must occur in writing within 3 months of the date of sale or before the animal reaches 21 months of age and must be submitted to the seller. The report must include the animal’s examination record, a written statement of treatment, and a statement of the animals’ inability to breed, by a licensed veterinarian. The seller has the option to refund the purchase price or make other settlement that is satisfactory to the buyer. In either case the rights of ownership of the animal return to the seller. Females bred when sold and pronounced in calf are presumed to be pregnant but pregnancy is not guaranteed unless so announced. The seller makes no warranty that pregnant cows will deliver calves or that they will carry calves full term. c. If, after the sale, embryos or oocytes are recovered from a female or an attempt is made to superovulate her, this negates the breeding warranty unless there is a separate written agreement between buyer and seller.
SHIPPING:
Assistance will be given in arranging shipping of the animalsafter the sale. All costs, risks and responsibility will be borne by the purchaser.
ERRORS:
The material in this catalog has been carefully edited. If any er-rorsor omissions are discovered, they will be announced. Such an-nouncements take precedence over that printed in this catalog.
ACCIDENT:
The sale management, the consignors, and the owner ofthe grounds will not be responsible in any case for the condition of the grounds or the behavior of the animals and disclaim any li-ability in the event of personal accident or property loss.
LIMITATIONS OF WARRANTIES:
Warranties contained herein, unlessterminated earlier, will cease upon the resale of an animal.
