RE: Elk Rapids Day Park Stair Replacement
As of Friday, August 31, 2018, no bids had been received for the
replacement of two staircases and railings at Elk Rapids Day Park.
At the direction of the Buildings, Lands, and Infrastructure
Committee, the Administration Office consulted with the Building
Department to put together a list of potential contractors who may
be interested in the project. As of Tuesday, September 25, 2018, no
bids had been received from the second advertisement period. Bids
are due to the Administration Office on September 28th. If we do
not receive any bids by the end of the week it is our assumption
that between now and the end of the year contractors are too busy
to fit the project in their schedule.
There is $16,200 budgeted for the project in 2018. If we do not
receive any bids by the deadline (we will know by the date of the
Committee meeting), we recommend that the project be moved to 2019
and the budgeted amount be increased by 3% for inflation. If
approved we will send the project out for bids in the early
spring.

Dear Mr. Herber:
This letter serves to memorialize our conversation about the
wetland violation that occurred this summer on Bellaire
Highway.
As you know, there was another wetland violation that occurred
this spring in Forest Home Township on SE Torch Lake Drive where we
met on site with the Michigan Department of Environmental Quality
and representatives from DTE Energy. At that time, we stressed that
any wetland or stream that may be impacted by the installation of
the pipeline must be avoided or permitted by MDEQ. You assured me
that you would bore under wetlands or streams through which the
pipeline would travel. Instead of boring the wetland at the Clam
Lake Road and Bellaire Highway intersection area, you cast spoils
into that wetland area in clear violation of the limits we
discussed.
I had not sent this letter until the MDEQ made its
jurisdictional determination. They are expecting DTE Energy to
secure an after-the-fact permit for the work done in that area.
Antrim County has developed a fine escalation policy, see
enclosed. Because you knowingly violated, you should be charged
$2500. Because you cleaned the area in question when requested and
implemented the proper stabilization methods at the site, I am only
fining you for the major release into a regulated habitat:
$1000.
Your restoration/stabilization practices have been great. Except
for the above violations, you have been great to work with. It
pains me to issue this fine because we have worked well together,
but protecting our natural resources is paramount in Antrim County.
Roese does good work, but this violation was clearly avoidable.
I strongly encourage you to work closer with the companies for
whom you are placing pipe. Make sure you are given plans that
identify wetlands, steams or other vulnerable areas and make sure
you discuss what the limitations are with the work you are
planning. If you cannot bore a 3000’ wetland and need to break up
the run by coming up into the wetland – make

sure it is permitted by the appropriate agency. It is the
applicant’s responsibility to develop the erosion control plan and
to secure all other needed permits. It is your responsibility to
ensure you fully understand and follow the limits in a proposed
job. If you need to add additional erosion control measures – silt
fences, sediment eels, straw wattles, check dams, etc. make sure
those needs are expressed. If you know you cannot perform a certain
activity as it is presented on the construction documents, make
sure you express that to the applicant as well. If you are in my
county, I will work with you to ensure things run smoothly; it’s
important that we all work together.
Please remit the $1000 fine to the Antrim County Treasurer, P.O.
Box 544, Bellaire, MI 49615. The fine should be made payable to
Antrim County.

Soil Erosion and Sedimentation Control Program Fine Escalation
Procedure
1 February 2, 2018
Power given to regulate and issue fines for Soil Erosion and
Sedimentation violations are provided in the Natural Resources and
Environmental Protection Act (excerpt) Act 451 of 1994 Part 91 Soil
Erosion and Sedimentation Control and the Antrim County Soil
Erosion Sedimentation and Stormwater Runoff Control Ordinance.
Terms Defined:
Cease and Desist Order – An order issued under this ordinance by
the Soil Erosion Control Officer (SECO) to a person, or the
permittee, their employees, agents, or contractors requiring the
cessation of activities related to soil erosion violations.
Regulated habitat – Regulated waters of the state including
lakes, streams, rivers and regulated wetlands, 324.9101 (20).
Site – Permitted work area identified on Site Plan and/or Soil
Erosion and Sedimentation Control Plan.
See Antrim County Soil Erosion Sedimentation and Stormwater
Runoff Control Ordinance or NATURAL RESOURCES AND ENVIRONMENTAL
PROTECTION ACT (EXCERPT) Act 451 of 1994 PART 91 SOIL EROSION AND
SEDIMENTATION CONTROL for additional terms.
Noncompliance issues – Soil erosion control officer will work
with the responsible party when an issue of non-compliance is found
to rectify the situation before initiating further enforcement.
1. Cease and Desist Order – Notice of Noncompliance: Antrim
County Soil Erosion,Sedimentation and Stormwater Runoff Control
Ordinance; 13-400.
a. Issued in writing: posted on site or hand delivered and
emailed or mailed(read or return receipt requested
respectively).
b. Includes what measures are required to abate
theviolation/noncompliance.
c. Remedies must be installed within five (5) days of Notice of
Noncompliance(Cease and Desist Order).
d. Cease and Desist will be removed when all measures have been
taken tocome into compliance with statute, ordinance or permit.
2. Notice of Violation – (including fine) issued after a five
(5) day period of continuednoncompliance after Cease and Desist
Order-Notice of Noncompliance issued.(Fines – Table 1)
a. Before issuing Violation Notice reasonable attempt will be
made by SECOto resolve violation.

to“construct, implement, and maintain soil erosion and
sedimentationcontrol measures” in conformance with County Ordinance
or Part 91 ofthe Natural Resources and Environmental Protection Act
451 at the costto the homeowner/permitholder. Remedies costing no
more than $10,000may be conducted without prior written notice if
there is threat to thewaters of the state or adjacent properties.
Remedies over a cost of$10,000 must first be proposed in writing,
Part 91, 324.9119.
d. Five (5) days will be given to conform to permit after
“Notice of Violation”is given. If site is not in compliance after
the five (5) day period additionalfines may be levied (Table
1).
e. After five (5) days of noncompliance, Notice of Violation, 10
days from theoriginal “Cease and Desist” order, SECO may take the
site owner/permitholder to court for an injunction.
3. In addition to a fine assessed under this policy, a person
who violates this ordinance isliable for damages for injury to,
destruction of, or loss of natural resources resultingfrom the
violation. The court may order a person who violates this part to
restore thearea or areas affected by the violation to their
condition as existing immediately prior tothe violation and order
such person to pay for expenses of
prosecution/enforcement,including reasonable attorney fees;
13-401-6 (Antrim County Ordinance).
4. Knowingly making false statements on application or site plan
can result in a fine up to$10,000 for each day of violation.
5. Permit holder who knowingly violates Ordinance or Part 91
after receiving notice ofviolation can result in a civil fine of
not less than $2,500 or more than $25,000 for eachday of
violation.

The Department of Environmental Quality (DEQ), Water Resources
Division (WRD), conducted an inspection on September 6, 2018, at
the above-referenced property. The purpose of the inspection was to
evaluate compliance with Part 303, Wetlands Protection, of the
Natural Resources and Environmental Protection Act, 1994 PA 451
(NREPA). At the time of the inspection, WRD staff observed open
trench utility installation and wetland impacts from directional
boring operations (as shown on the enclosed plan). This letter is
being sent because you have been identified as the contractor
responsible for the property and activities.
Section 30304 of Part 303 of the NREPA prohibits the following
without first obtaining a permit from the WRD:
(a) Deposit or permit the placing of fill material in a
wetland.(b) Dredge, remove, or permit the removal of soil or
minerals from a wetland.(c) Construct, operate, or maintain any use
or development in a wetland.
A review of WRD files indicates that no permits have been issued
for these activities. Therefore, it appears that these activities
were conducted in violation of Part 303 of the NREPA.
The DEQ advises all unauthorized activities occurring within
regulated areas on this property stop.

Attached is Attachment 1 submitted by Mike Meriwether, County
Forester in which he requests the Committee to approve a negotiated
“sell by scale timber sale” for timber on County properties at
Lakes of the North-Simpson Road and at the Cedar River. The
Forestry Bid Policy includes the following language:
If the Agent, along with the oversight committee, determines
that the use of competitive sealed bidding is either not
practicable nor advantageous to Antrim County, a contract may be
entered into either by competitive sealed proposals or through sole
source negotiations.
The Policy also include the following definition of a scale sale
(in case you were wondering):
Scale Sale or Cut and Scale – A timber sale in which the seller
is paid a certain amount for each unit of product cut (e.g. so many
dollars per board feet, cord, per post, per pole, etc.) This type
of sale requires someone to measure the products harvested.
The following motion is presented for your consideration:

ATTACHMENT 1 – Justification for a Sell by Scale timber sale
Star 26 / Lake of the North – Simpson Road and Cedar River
Pine
These properties contain multiple forest products white pine,
red pine, jack pine, and spruce. These species are lower in value
and require special marketing to maximize the value of selected
trees.
It is my intension to negotiate a price per cord/ ton with the
end users of these products. Biewer Lumber from Mcbain and/or
Auruco from Graying are considered the end user mills excepting
these materials. A timber sale contract will be developed with one
or both of these receiving mills.
The reason why I feel a negotiated sale is in the best interest
of the county include:
The ability to negotiate values is advantageous to the
County.
The ability to negotiate utilization, timing of the sale is
advantageous to the forest management.
Separated parcels being combined into one sale.
Cutting parameters may change when cutting begins.
Cutting volumes may change during cutting operations. I may
change cutting parameters as mentioned.
Limited markets for pulpwood products being produced.
Master Logger certification will be required to comply with
Forest Stewardship Counsel certifications. needed to deliver wood
to these receiving mills.
Motion:
I would like the County to approve the “sell by scale” sale of
forest products from the Star 26, Simpson Road and the Cedar River
properties as negotiated by Mike Meriwether the forester with the

Trees Designated for Sale: Trees to be harvested have been
marked in orange paint on the stem and the stump. Buyers are
encouraged to examine these trees before placing a bid. All volumes
are estimated as follows:
SUGAR MAPLE: 136 trees estimated at 30,438 board feet. • Average
18.00 inches in diameter
RED MAPLE: 8 trees estimated at 1,880 board feet.
CHERRY: 6 trees estimated at 1,000 board feet.
Only those trees marked with orange paint on the stem and the
stump may be cut. Non- merchantabletrees have also been marked with
orange paint and can be used for felling and operational purposes
ifneeded. The above tree volumes are only estimated. Please review
these wood products carefully.
This is a Lump Sum Sale. Producers will be required to submit a
lump sum price for those trees marked for sale on the property.
Twenty five percent (25%) of the accepted bid price will be
required once the contract to harvest trees has been approved and
signed by the seller and the purchaser. The remaining seventy five
percent (75%) will be required prior to the harvest of any
trees.
The producer will be responsible for any site reclamation needed
after the harvest and trucking of trees.
Timing of Sale – A one-year contract will be awarded to the
successful bidder.
Before Cutting Begins – The following will be required:
1. Signed Timber Sale Contract
2. Full payment to Antrim County Treasurer
3. A 10 performance bond or letter of credit will be
required.

On Friday, September 14 at approximately 4:45pm, came to the
Clerk's office demanding to see a Judge and/or the Magistrate. He
wanted someone "right now'' to get his buddy out of jail. He stated
that we were all just a bunch of corrupt assholes. He then leaned
over the counter and pointed to Micki Hocking, who was sitting at
her desk towards the back of the office, and proceeded to tell her
that she was the most corrupt bitch of them all, that she better
put her bead in the sand and that he had her number, he knew who
she was. He said again I want the Judge or Magistrate right now, if
not I will have 60 minutes and the news here in 5 minutes and tell
them how corrupt you all are.
It was about this time that Micki went to Sheryl's desk to hit
the PANIC button and . llllllllsaid, that's right bitch you make a
phone call, bring them in, I know you. He then turned to Connie and
said, "You Cam Lacy are the most corrupt" I told him that this was
not Cam Lacy and he said -~ell I can't see her but (as his is still
pointing at her) I bet you are just as corrupt as that bitch is
too.
He just kept saying he wanted- out of jail, that he was going to
get the news here and teU them all how corrupt we are and that we
all lie. I could smelJ alcohol and something that smelled like
skunk on him. He was VERY agitated with me and walked out the side
entrance toward the Courthouse.
I came back to my desk, at the back of the office, and called
dispatch to see why someone had not responded yet. I am sure that
Jennifer Gregory answered and I told her that• . - was either going
to District Court or heading to the jail and that he was not happy
and that he appeared to be under the influence of something. She
asked for a description of what he was wearing. It was at this time
that I noticed Officer Todd Johnson on the sidewalk between the
Court House and the County Building, talking to - ·• - still looked
agitated and his hands were moving all over and seemed to be
yelling at Mr. Johnson.
I walked out of the office down the hall to the main entrance of
the county building and learned that the Treasurer's office had
called Officer Johnson and told him what was happening. I then
noticed, in front of the building, Deputy Cicansky got out of his
vehicle to address - who was standing at the front of the Deputy's
vehicle. -put his hands in front of him as a gesture of getting
hand cuffed(which he did not) then another Officer arrived ( who I
learned later was Officer McBee). Officer Johnson, Deputy Cicansky
and Officer McBee came into the county building and we told them
what had happened.
At 5:00pm, after we Jocked up for the weekend, Office Johnson
was waiting for us to make sure that we got to our vehicles with no
issues.

On September 14 approximately 4:45 p.m. an individual by the
name of- came to the window hit the counter with his hand demanding
a judge. He was clearly agitated, he wanted to get his friend out
of jail. He was shouting and pointing his hand in the direction of
Micki and daiming he knew who she was and had her number (not
saying what number). Danell went to the front and spoke with
him trying t o calm him down. She let him vent hoping it would
give him an opportunity to bring himself
to a calm and then leave. He continued to address Micki calling
her names, then he looked at me and
referred to me as cam Lacy, he must have realized that I wasn' t
because he said "You have the same color hair" and "You're probably
as corrupt as that bitch!" He ranted this way for about 3
minutes,
Micki went to Sheryl's desk to push the panic button and he said
"Go ahead bitch and make that phone
call!" All the while Danell was trying to keep his attention and
speaking calmly to him. At one point he
started to move in the direction of the door and I had fully
expected him to come through the door. He
left the counter as agitated as when he arrived. Danell called
dispatch and notified them that- had
been to our counter and had left. I observed Todd Johnson coming
to the County Building and speaking
with - outside. When Danell, Micki, and I left at 5:00 Todd
Johnson gave us an escort to our vehicles because ~ sked to stay in
his vehicle until the employees had left the parking lot, it is
my understandin~ refused, hence the escort.

Impact statement of Michelle Hocking from events on
7/14/2018
On Friday September 14th, 2018 at roughly 4:45 pm- came to our
counter at the Oerk's office. Before anyone could get to the
counter to wait on him he immediately started yelling that he
wanted his buddy- out of jail. He pointed at me and yeled that he
knew me, and that I should be ashamed, and that I am a corrupt
bitch. Danell went to the counter to speak with him and try and
diffuse the situation. As she got to the counter he leaned towards
her and pointing a finger at her kept yelling that he wanted a
Judge or a Magistrate right away and tbat if we did not get one for
him he would have the news here in 5 seconds.
He then went back to yelling at me calling me a bitch again, and
that I should hide my head in the sand, he kept yelling that he
knew me and that I was corrupt and he was going to take me down. He
turned to look at Connie and started addressing her-still yelling
u1 see you Cam, I see you Cam Lacy'' ''You're just as corrupt as
that other bitch" Danell told him to calm down and stated "that is
not Cam Lacy" he responded i,,, saying "well she looks like her,
and rm sure she's just as crooked as the rest of you"
At this point I left my desk to go to Sheryls' desk and push the
panic button. He again yelled at me specifically "go ahead and make
a phone call bitch, see what happens'' I pressed and held the
button on Sheryls' desk for a few seconds as we have been told to
do. I then went back to my desk and sat down, I was trying to move
slowly and calmly and not address him or the convnents he was
making. -has a very lengthy criminal history in Antrim County and
is known for having a volatile temper.
After pressing the panic button and hoping it was working, -
trailed off on his tangent and left out the doors next to our
office headed towards the courthouse. It had probably been 2-3
minutes since I pressed the panic button. At this point he was
intercepted on the sidewalk by Officer Johnson. He still appeared
to be agitated and yelling at the officer. He was walked i,,, the
officer towards the front of the building where he was met by
County Deputy Ocansky, and Vilage Officer McBee.
The three officers spoke with him briefly in the front of our
building then he walked off. The officers then came in to speak
with us for a couple of minutes and make sure we were alright. When
we left the building at 5pm Deputy Johnson was standing outside the
courthouse watching to make sure we made it to our cars without any
issues.
I have been dealing with- off and on for almost 10 years now
while working in the Oerk's office. Every time we see him he is
more detached from reality, he seems to have an explosive temper,
with little thought to the consequences of his actions. He often
appears to be under the influence of alcohol or drugs. I was
honestly scared for the safety of myself and my coworkers, I took
the long way home with a few extra turns because no one was sure if
he had driven away from the courthouse or if he had walked
somewhere.

Just as in 2014 and 2016, North Country CMH would like to set up
the statewide traveling art show, Creative Minds Changing Minds,
sponsored by the Community Mental Health Association of Michigan,
in the Antrim County Building from Thursday, November 1 until
Thursday, November 8, 2018.
This show is brand new. There are about 20 easels and artworks
professionally framed, including an uplifting piece entitled Happy,
from a woman from the North Country CMH service area. In addition,
we plan to supplement the show with “Photovoice” posters created by
North Country consumers, which are comprised of one photo and words
which highlight experiences of the person with disabilities.

I did manage to find a communication between you and Tina
Schrader, the Administrative Assistant here in the office (see
attached). I see that the communication served as your formal
request for use of the Antrim County Building. For the sake of any
new Board members we’ve had take office since that time, I am going
to ask that you make a similar “formal request.” Please include
what you would like to use the building for, when you would like to
use the building, and why. If you want to just update the 2016
request, that would be fine. I will be sure to include it in the
agenda packet
for the October 2nd meeting.

RE: Snow Plowing/Removal Bids – Antrim County Facilities
On Friday, September 21, 2018 we opened and inspected bids for
snow plowing and snow removal at Antrim County Facilities for the
seasonal year beginning on November 1, 2018 and ending on October
31, 2019 and for the seasonal year beginning on November 1, 2019
and ending on October 31, 2020 (2-year bid). Bert’s Excavating was
the only company to submit a bid, with the bid for each seasonal
year being $28,500 per year. The total bid amount submitted was for
$57,000.
If approved the two year commitment will cover the
following:
Areas to be plowed and for snow to be removed: • County
Building, Courthouse, Sheriff Department, and Jail Parking lot on
the north side of Broad
Street.• Parking lot on the east side of Grove Street adjacent
to the Grove Street Annex building.• Parking lot on the west side
of Depot Street adjacent to the Grove Street Annex building.•
Parking area on the east side of Grove Street adjacent to the
former Huntington Bank building
(Derman & Turkelson side).
Areas to be plowed only: • Animal Shelter on M-88.• Access to
the old Animal Shelter at the Airport off of Derenzy Road.• Antrim
County Transportation Building on M-88.
Please consider the following actions:

____________________________ to recommend the Board of
Commissioners approve the bid for $57,000 from Bert’s Excavating
for snow plowing and removal at County facilities for the seasonal
years beginning November 1, 2018 and ending October 31, 2019 and
November 1, 2019 and ending October 31, 2020.
