09/18/2019 BUSINESS UPDATES AB 1475, Construction Manager/General Contractor method: transportation projects Existing law authorizes the Department of Transportation to engage in a Construction Manager/General Contractor project delivery method (CM/GC method), as specified, for projects for the construction of a highway, bridge, or tunnel that has construction costs greater than $10,000,000. Existing law defines “construction manager” for that purpose to mean a partnership, corporation, or other legal entity that is able to provide appropriately licensed contracting and engineering services as needed pursuant to a CM/GC method contract. This bill would revise that definition to mean such an entity that is a licensed contractor pursuant to the Contractors’ State License Law and that is able to provide, or that contracts with entities that are able to provide, appropriately licensed contracting or engineering services, or both appropriately licensed contracting and engineering services, as needed pursuant to a CM/GC method contract. Existing law authorizes regional transportation agencies, as defined, to use the CM/GC method, as specified, to design and construct certain projects, if there is an evaluation of the traditional design-bid-build method of construction and of the CM/GC method and the board of the regional transportation agency adopts the procurement strategy in a public meeting. Existing law defines “construction manager” for these purposes in the same manner as described for the department’s CM/GC method authorization. Existing law defines the term “project” for these purposes to include expressways that are not on the state highway system and specified bridges that are not on the state highway system. Existing law requires specified information submitted under the CM/GC method to be verified under oath. This bill, with regard to regional transportation agencies, would revise the definition of “construction manager” in the same manner as described for the department’s CM/GC method authorization. The bill would also expand the authorization to use the CM/GC method under these provisions by expanding the definition of the term “project” to include any other transportation project that is not on the state highway system. By expanding the scope of the crime of perjury, the bill would impose a state-mandated local program. AB 1607, Gender discrimination: notification Existing law prohibits a business establishment from discriminating against a person because of the person’s gender with respect to the price charged for services of similar or like kind. Existing law also requires specified business establishments to disclose in writing the pricing for each standard service, as defined, to display, in a specified manner, a sign stating that it is illegal to base pricing on gender and that a complete price list is available upon request, and to display, in a specified manner, a price list, and to provide the customer with a copy of the complete price list upon request. Existing law requires the Department of Consumer Affairs to develop a pamphlet or other informational materials to explain a business establishment’s rights and obligations under these provisions. Existing law requires the department to provide the pamphlet or other informational materials to affected business establishments at specified times and to make the pamphlet or other informational materials available on the department’s internet website. This bill would, commencing January 1, 2021, require a city, county, or city and county that issues local business licenses to provide written notification in English, Spanish, Chinese, Tagalog, Vietnamese, and Korean of the above provisions to the licensee at the time the business license is issued or renewed. The bill would declare that it addresses a matter of statewide concern rather than a municipal affair and, therefore, apply to all cities, including charter cities. By requiring local agencies to comply with these requirements, this bill would impose a state-mandated local program. The bill would require the Department of Consumer Affairs to develop, by October 1, 2020, a written notification of the above provisions in English, Spanish, Chinese, Tagalog, Vietnamese, and Korean and would require the notification to be available for download from the department’s internet website. The bill would authorize a city, county, or city and county to provide the department’s written notification to a business and to increase the fee for a business license to cover the reasonable cost of providing the notice. The bill would, commencing October 1, 2020, require the department to provide the pamphlet and other informational materials in English, Spanish, Chinese, Tagalog, Vietnamese, and Korean. The bill would require the department to subsequently revise the pamphlet and notice, as necessary.

Let’s jet! An interesting question will require an additional expert in creating this ‘structure’ change. A sudden loss will prompt a need for change in license status. While it’s not good advice to argue with the law, sometimes it’s a ‘singular’ point to be made… Q: If a company water jets a septic/sewage line, is a Contractor’s License required? A: As long as there are no alterations or repairs done to the sewer line it is acceptable to hydro jet lines without a Contractor’s license. Q: If we want to change from an ‘S’ Corp to a ‘C’ Corp, what would that entail? Can we keep the same Contractor’s License number? A: The CSLB doesn’t concern themselves with whether you are ‘S’ or a ‘C’ corp. While we do handle corporate registrations with the Secretary of State, we also don’t get involved in whether you are ‘S’ or ‘C’ corp. It is my understanding that it’s a tax election so each file taxes differently. The corporation stays intact therefore the Contractor’s License would as well. From my brief research, you can change your filing status at any time but if you want it effective for a particular year, you must revoke your ‘S’ election by the 15th day of the 3rd month of that tax year. Not a tax expert, you’ll want to contact a CPA for more information on corporate tax structure. Q: My husband recently passed away and he had an active Contractor’s License. I’m not even sure when it’s up for renewal but I don’t want to keep paying for it so is there a way to cancel it? A: Sorry to hear about your loss. Yes, there is a license cancellation request form that you can complete. Since your husband is the only one with signing authority on the license, you would need to sign it and submit with a Death Certificate. I
looked up the license and it expires at the end of this year. The CSLB doesn’t automatically charge you so you really aren’t paying for anything at this point. You may decide rather than bother with the cancellation, just let it expire. I’m sure you have enough on your plate anyway. Q: I am an Oregon contractor and I started a business years ago that is highly specialized. I have called the CSLB several times and I’ve been told I need a “C-8” Concrete license, or a “C-61”/”D-12” (Synthetic Products) license. I don’t agree with either of those. I believe the “C-61”/”D64” (Non-Specialized) would be more appropriate. How do I go about obtaining that license being that it doesn’t really have a “title”? A: Anytime anyone applies for a “D-64” license, the CSLB requires that they answer four questions: 1. What are you performing, installing, replacing, and/or repairing? 2. How is it being performed, installed, replaced, and/or repaired? 3. What materials, tools, and/or equipment are being used? 4. What does the contract say you will do for the customer? Or, what is the scope of work to be performed? Based on the answers to these, the CSLB will determine the appropriate classification and if they determine the “D-64”, they will assign it a “title” specific to the type of work you are doing. Part 2 of 3 Wearing a back belt does not make you super strong, or allow you to lift anything heavier that you would normally be able to lift. We have to use proper lifting techniques while wearing the belt. Here are the five RULES OF LIFTING. (1) Assess the object you are about to lift. Be certain of how you intend to lift the object. If the object is heavy, get someone to help you lift. Think before you lift. Not only do you have to consider the load you will carry, but you need to plan how you will carry the load. Is the path you are going clear and passable? Are there hazards that may cause you to trip or stumble. All these factors need to be considered before you lift. (2) Bend at your knees, not your waist. Bend down with your knees and straddle the load you are about to lift. Avoid bending at the waist and keep your back straight. (3) Tuck your pelvis under and firm-up your stomach muscles just before you lift. Tightening the stomach muscles helps support your back. (4) Hug the object you are lifting close to your body. Unnecessary and potentially dangerous amounts of stress and strain are placed on your back when objects are held away from your body. If your elbows are more than two inches from your side when you squat to pick something up, than you should not make the lift. Stop and get some help. (5) Lift with your leg muscles. Once you have a firm grip on the object, slowly straighten your legs and FEEL the leg muscles doing the actual work of the lift. You do not need to have your back belt tight constantly while you are working. Wear your belt loose when you are not lifting, then when you go to lift, tighten the belt down. By wearing your belt loose when you are not lifting, you will allow your back muscles to be used normally without any restrictions. Lifting anything, no matter what the weight or size can cause you to hurt your back. Using proper lifting techniques will help you to always lift safely. Use your legs and not your back.
