1.01 Intheseregulations,unlessthecontextotherwiserequires:

"Adolly"meansatrailerconverterdollythatistowedfromasinglehitchlocatedonthecentrelineofthetowingvehicle

"Atrain"meansacombinationofvehiclescomposedofatrucktractor,asemitrailerandeither

(a)anAdollyandasemitrailer,or

(b)afulltrailer

"Act"meanstheCommercialTransportAct

"airdeflector"meansadeviceattachedtothefrontofavehicledesignedtoreduceairresistancearoundthevehicleorloadbutnopartofwhichisusedtocarryaload

"antisplashandspraydevice"meansadevicethatisattachedtoavehicleandisdesignedtocontrolorreducetheamountofwaterthrownupbythemovingwheelsofthevehicle

"articulationpoint"means

(a)theverticalaxisofthekingpininafifthwheelcouplerandkingpinassembly,

(b)theverticalaxisthroughthecentreofalunetteeyeinapintlehookandlunetteeyeassembly,or

(c)theverticalaxisthroughthecentreofrotationofaturntableorothersimilardevice

"automaticaxleliftdevice"meansadevicethatisdesigned

(a)toliftorotherwiseremovethetiresofanunloadedtrailer'saxlefromcontactwiththeroadsurface,and

(b)toautomaticallylowerthetirestotheroadsurfaceifaloadisplacedinthetrailer

"axle"meansastructurethatiswhollyinthesameorapproximatelythesametransverseplaneandthatissupportedbywheelsonwhichorwithwhichitrevolves

"axlespread"meansthelongitudinaldistancebetweentheextremeaxlecentresoftheaxleunit

"axletrackwidth"meanstheoverallwidthofanaxleacrosstheoutsidefacesofthetiresmeasuredatanypointabovethelowestpointoftherim

"axleunit"means

(a)asingleaxle,

(b)atandemaxle,or

(c)atridemaxle

"axleunitweight"meanstheweighttransmittedtothehighwaybyanaxleunit

"Btrain"meansacombinationofvehiclescomposedofatrucktractorandasemitrailer,followedbyanothersemitrailerattachedtothefirstsemitrailerbymeansofafifthwheelcouplermountedonthefirstsemitrailer,withintheaxlespreadofthefirstsemitrailerornotlocatedmorethan0.3mbehindthecentreofthelastaxle

"bedtruck"meansatrucktractorequippedwithacargocarryingdeckandawinchthatisusedforselfloadingandthatislocatedbehindthecab

"boxlength"meansthelongitudinaldimensionfromthefrontofthecargocarryingunittoitsrear,exclusiveofanyextensioninthelengthcausedbyauxiliaryequipmentormachineryatthefrontthatisnotdesignedforthetransportationofgoods

"Cdolly"meansatrailerconverterdollywhichisnotanAdolly

"Cconverterdolly"meansatrailerconverterdollythathasarigidframeinthehorizontalplaneandistowedfrom2hitcheslocatedinahorizontaltransverselineonthetowingunit,whichprecludeanyrotationinthehorizontalplaneaboutthehitchpoints,andthatsatisfy



allrequirementsoftheCanadianMotorVehicleSafetyStandardsapplicabletosuchdevices

"Ctrain"meansacombinationofvehiclescomposedofatrucktractorandasemitrailer,followedbyanothersemitrailerattachedtothefirstsemitrailerbythemeansofaCdollyorCconverterdolly

"clearancelamp"meansaclearancelamprequiredunderDivision4oftheMotorVehicleActRegulations,B.C.Reg.26/58

"dangerousgoodsplacard"meansaplacardrequiredundertheTransportofDangerousGoodsActortheTransportationofDangerousGoodsAct(Canada)andincludesaholderforthatplacard

"daylight"meansthetimebetween1/2hourbeforesunriseand1/2houraftersunset

"doglogger"meansavehicleordevicewhichisattachedtotherearofapoletrailerandsharestheloadthroughanarticulationpoint

"drawbar"meansastructuralmemberofafulltrailerortrailerconverterdollythatincludesadeviceforthepurposeofcouplingwithatrailerhitchorfifthwheel

"drawbarlength"meansthelongitudinaldistancefromthecentreoftheholeinthefifthwheelofaconverterdollyorturntablecentertothecenterofthehitchingdeviceonthetowingvehicle

"driveaxle"meansanaxlethatisormaybeconnectedtothepowersourceofamotorvehicleandtransmitstractivepowertothewheels

"effectiveoverhang"meansthelongitudinaldistancefromtheturncentreofthefulltrailer,ponytrailer,semitrailer,truckorintercitybustotherearmostpointofthevehicleincludingload

"farmvehicle"meansacommercialvehicleownedandoperatedbyafarmer,rancherormarketgardener,theuseofwhichisconfinedtopurposesconnectedwithhisfarm,ranchormarketgarden,includinguseforpleasureandisnotusedinconnectionwithanyotherbusinessinwhichtheownermaybeengaged

"fifthwheelcoupler"meansadevicethatismountedonthevehiclechassisandthatconsistsofaskidplate,associatedmountingbracketsandlatchingmechanismthatcouplesorconnectstoakingpinlocatedontheothervehicleorcomponent

"fulltrailer"meansavehiclewithoutmotivepowerthatisdesignedtobetowedbyanothervehicleandissodesignedthatthewholeofitsweightandloadiscarriedonitsownaxlesandincludesacombination




consistingofasemitrailerandtrailerconverterdolly

"grossweight,singleaxle"meansthegrossweightcarriedbyasingleaxleandtransmittedtotheroadbythewheelsofthataxle

"grossweight,groupofaxles"meansthesumofthegrossaxleweightsofalltheaxlescomprisingthegroupofaxles

"grossweight,allaxles"meansthesumoftheindividualaxleweightsofalltheaxlesofavehicleorcombinationofvehicles

"groupofaxles"meansany2ormoresuccessiveaxlesonavehicleorcombinationofvehicles

"highway"includeseveryhighwaywithinthemeaningoftheTransportationAct,andeveryroad,street,laneorrightofwaydesignedorintendedfororusedbythegeneralpublicforthepassageofvehicles,andeveryprivateplaceorpassagewaytowhichthepublic,forthepurposeofparkingorservicingofvehicles,hasaccessorisinvited

"hitchoffset"meansthelongitudinaldistancefromthetruckortrailerturncentretothearticulationpointofthehitchusedtotowthefollowingvehicle

"horsepower"meansthegrosshorsepoweroftheenginesofthetowingvehicleascustomarilyratedbythemanufacturer

"interaxlespacing"meansthelongitudinaldistanceseparating2axleunitsasdeterminedfromthecentresofeachoftheaxlesthatistheclosesttotheotheraxleunit

"intercitybus"meansavehicledesignedtocarrymorethan15passengersandequippedwithfacilitiestoallowextendedtravelwithoutstopping

"jeep"meansasemitrailerthatisdesignedtobeattachedbetweenatrucktractorandanothersemitrailer,soastodistributetheloadoftheothersemitrailerbetweentheaxlesofthejeepandaxlesofthetrucktractor

"length(fulltrailer)"meansthelongitudinaldimensionfromthefrontofthefulltrailertoitsrearmostpointanddoesnotincludethedrawbar

"length(ponytrailer)"meansthelongitudinaldimensionfromthecentreofthehitchingdeviceoftheponytrailertoitsrearmostpoint

"liftaxle"meansanaxleequippedordesignedwithanydevicetoraiseorlocktheaxleinaraisedposition




"loadsecurementdevice"means

(a)atiedown,binder,lock,chain,cable,belt,rope,winch,cinch,hookorcovering,or

(b)adoorhandle,doorlock,doorhingeorbunkcableguiderequiredunderDivision35oftheMotorVehicleActRegulations

"loggingtruck"meansatruckortruckandtrailercombinationusedtohaul,intheirnaturalstate,greenfelledorbuckedlogsorpoles

"lowbedsemitrailer"meansasemitrailerthathasadepresseddeckarea

"manufacturer"means

(a)inthecaseofavehicle,thecompanywhosenameappearsonthestatementofcomplianceandtowhichaNationalSafetyMarkhasbeenissued,and

(b)inthecaseofatire,thecompanywhosenameappearsinthesidewallofthetire

"overalllength"meansthegreatestoveralllongitudinaldimensionofavehicleorcombinationofvehiclesincludingload

"permanentlymountedequipment"meansa

(a)heavydutycranemountedonatrucktractorortruck,

(b)hydraulicormainenginewinch,powerdrivenofftheengine,

(c)chassismountedrotatingreadymixconcretedrum,

(d)dumpboxwithtiltcylindersoramultistagetiltcylindermountedbehindthecab,

(e)liquidtankif100%ofaliquidtankerstraighttruck'spayloadandcapacityconsistsofaliquidload,or

(f)liquidtankassociatedwithhydrovacequipmentifitisdesignedandusedtoexcavatetrenchesandholeshydraulicallyandvacuumtheloosenedmaterialintotheliquidtank,butdoesnotincludeconventionalvacuumtruckequipment

"steeringaxle"meansanaxleonwhichthewheelsturnleftandrightononeormoreessentiallyverticalaxesandtheirturningiscontrolledby,andindirectproportionto,therotationofthesteeringwheelintheoperator'scompartment

"supersingletire"meansanonsteeringtirethathasatirewidthof445mmorlargerandabeaddiameterof49.5cmorlargerandthatmeetstherequirementsoftheMotorVehicleTireSafetyRegulations(Canada)

"tandemaxle"means2ormoreequallyspacedconsecutiveaxles,havinganaxlespreadofnotlessthan1.0mnormorethan1.85m

"tandemdriveaxle"meansatandemaxlethatisconnectedtothepowersourceofamotorvehicleandthattransmitstractivepowertoallwheels

"trailerwheelbase"meansthelongitudinaldistancefromthecentreofthekingpinofasemitrailer,orthecentreoftheturntableofafulltrailer,orthecentreofthehitchingdeviceonaponytrailer,tothetrailerturncentre



"tridemaxle"means3equallyspacedconsecutiveaxles,havinganaxlespreadofnotlessthan2.4mnormorethan3.7monTACsemitrailersandtrailersorhavinganaxlespreadofnotlessthan2.4mnormorethan2.5monTACponytrailers

"tridemdriveaxle"means3equallyspacedconsecutiveenginedrivenaxleshavinganaxlespreadofnotlessthan2.4mandnotmorethan2.8m,andanaxletrackwidthofnotlessthan2.4mandnotmorethan2.6mforaxlesthatareequippedwitheitherdualwheelsortires,oranaxletrackwidthofnotlessthan2.5mandnotmorethan2.6mforaxlesthatareequippedwithsupersingletiresoneachtrack

"trucktractorwheelbase"meansthelongitudinaldistancefromthecentreofthefrontsteeringaxletothegeometriccentreofthedriveaxleunit

6.01 InthisDivision:

"authorizedperson"means

(a)theInsuranceCorporationofBritishColumbia,

(b)apersonwhoisdesignatedinwritingbythecorporationbynameorposition,or

(c)apersonwhoisemployedintheministryofaministerwhoisresponsibleinwholeorinpartforadministrationoftheAct




"interjurisdictionalmovement"means,inrespecttoacommercialvehicle,oneormoreofthefollowing:

(a)thedeliveryofgoodsorpersonsfromaplaceoutsideBritishColumbiatoaplaceinBritishColumbia

6.02 (1)AnauthorizedpersonmayissueapermitunderthisDivisionforacommercialvehicleregisteredorlicensedoutsideBritishColumbia

(a)onapplicationintheformrequiredbytheInsuranceCorporationofBritishColumbia,

(b)onreceiptofproofoffinancialresponsibilitythatissatisfactorytothecorporation,

(c)onpaymentofthefeereferredtoinsection6.03,and

(d)ifthecommercialvehicleisrequiredtohavealicenceortemporaryoperatingpermitunderthePassengerTransportationAct,withtheapprovaloftheRegistrarofPassengerTransportationappointedunderthatAct.

(2)IfapermitunderthisDivisionisissuedinrespectofacommercialvehicle,thecommercialvehiclemaybeoperatedforoneormoreofthefollowingpurposes,asapplicable:

7.02 (1)Theminister,oranypersonauthorizedbytheminister,may,bygeneralauthorityorbytheissuanceofapermitnumberorwrittenpermit,authorizethedrivingoroperationonahighwayofacommercialvehiclethatdoesnotconformtotheweightanddimensionspecificationsofthisDivision,andthefeeforthepermitisthatspecifiedintheCommercialTransportFeesRegulation.

(2)Apersonwhoisissuedapermitnumberundersubsection(1)withoutawrittenpermitmustreporttoaninspectionstationtoobtainawrittenpermitatthefirstopportunity.

(3)Theministerorapersonauthorizedbyhimmay,byageneralauthorityorbyawrittenpermit,authorizethecrossingbyacommercialvehicleof

(a)ahighwayinunorganizedterritoryoranarterialhighwayinamunicipality,or

(b)ifanofficerofthemunicipalityhasgivenwrittenapprovaltoanapplicationforcrossing,ahighway,otherthananarterialhighway,inthemunicipality,

andthefeemustbeinaccordancewiththeCommercialTransportFeesRegulation.

(4)Anydriver,operatororownerofanyvehicleorotherpersonwhoviolatesanyoftheconditionscontainedinanypermitissuedundersubsection(1)or(3)isguiltyofanoffenceandisliable,onsummaryconviction,toafineofnotmorethan$500ortoatermofimprisonmentnotexceeding3months,orboth.

(5)Theministeroranypersonauthorizedbytheminister,oranypeaceofficer,mayamend,varyorrescindpermitsissuedundersubsection(1)or(3).

(6)Asaprerequisitetotheissuanceofapermitundersubsection(1)or(3),theministermayrequiretheapplicantforthepermittodepositwiththeministerchargedwiththeadministrationoftheTransportationAct,orapersonactingonthatminister'sbehalf,asumofmoneyinanamountsufficient,intheopinionofthatminister,topaythecostofrepairinganydamagethatmaybedonetothehighway,apublicstructureorabridgebyreasonofthedrivingoroperationofthevehicleonthehighway,publicstructureorbridge.

(7)Ifthetermofthepermitissuedundersubsection(1)or(3)extendsbeyondasinglejourney,theapplicantmustdeposit,onaccountofthe




feeprescribedintheCommercialTransportFeesRegulation,asumofmoneyequaltotheestimatedchargesforthepermit.

(8)ThefeetobechargedforasingletripoverloadpermitundertheCommercialTransportFeesRegulationmustbebasedonthetotalnumberofkilometresofoperationoftheoverloadedvehicleduringthetermofthepermit.

(9)Anapplicantforanoversize,overloadorhighwaycrossingpermitmaydepositwiththeminister,orwithapersondesignatedbytheminister,asumofmoneyconsideredbytheministertobesufficienttosecurethepaymentofthefeesforsuchpermitsasmayberequiredbytheapplicant,andtheapplicantmustpaythepermitfeeonreceiptofabillfromtheministry.

(10)Ifanapplicantfailstopaythefeeschargedundersubsection(9),theminister,orapersonauthorizedbytheminister,mayrefuseanyfurtherapplicationsforpermits,andmaycancelanyexistingpermitsuntilthedelinquentfeesarepaid.

(11)Apersonmustnotuseapermitforthedrivingoroperationofavehicleotherthanthevehicleforwhichthepermitwasissued.

(12)Ifthetermofanoverloadpermitextendsbeyondasinglejourney,amonthlyfeemustbechargedaccordingtotheCommercialTransportFeesRegulation.

(13)ApermitorpermitnumberissuedundertheActandtheseregulationsmustbecarriedinthevehicleatalltimeswhenitisoperatingonahighway.

(14)Nopermitistransferablefromonevehicletoanother,butifavehiclehasbeensold,destroyedorexportedfromtheProvince,asubstitutepermitcontainingthesameconditionsastheoriginalpermitmaybeissuedwithoutfeeandvalidatedforthetermoftheoriginalpermit.

(15)Unlessexpresslypermittedbytheconditionsofapermit,apersonmustnotdriveoroperateanoversizevehicleorloadonaSundayorageneralholiday.

(16)Apersonmustnot,withoutapermitorgeneralauthorityissuedundersubsection(1),driveoroperateavehicleorcombinationofvehiclesonahighwayunlessthevehicleorcombinationofvehicles,includingitsload,conformstotheweight,configuration,equipmentanddimensionspecificationsofthisDivision,includingAppendicesB,C,D,E,F,G,HandI.

Scales

7.03 (1)Thedriverofavehicleonahighway,whensorequiredbyapeaceofficerorbyanypersonauthorizedbytheminister,must

(a)stopthevehicleatthetimeandplacespecifiedbythepeaceofficerorauthorizedpersonforthepurposeofweighingthewholeorpartofthevehiclebymeansofstationaryorportablescales,measuringthedimensionsofthevehicleandload,measuringandinspectingthetires,inspectingtheloadcarried,orforanyotherpurposeundertheActortheseregulations,

(b)stopthevehicleifthevehicleortheloaditiscarryingis,intheopinionofthepeaceofficerortheinspector,unsafeforoperationonthehighwaysandfixthedefectinthevehicleorsecuretheload,asthecasemaybe,beforeproceeding,

(c)drivethevehicleontothenearestpublicstationaryorportablescalesforthepurposeofweighingthevehicleandload,or

(d)rearrangetheloadonthevehicleorremovethewholeorpartoftheloadfromthevehicleinordertocomplywiththeprovisionsoftheAct,regulationsorpermitbeforecontinuingtodriveoroperatethevehicle.

(2)Thedriverofavehicleonahighway,whendirectedbyatrafficsignonthehighwaytoreporttoscales,mustdrivethevehicleontothescalesforthepurposeofweighingthewholeorpartofthevehiclebymeansofstationaryorportablescales,measuringthedimensionsofthevehicleandload,measuringandinspectingthetires,inspectingtheloadcarried,orforanyotherpurposeundertheActortheseregulations.

(3)Subsection(2)doesnotapplytothedriverofacommercialvehicleofalicensedgrossvehicleweightnotexceeding5500kg.
