You may have noticed new signs around town. The signs say Brinnon Collective Garden
and include a green cross with medical insignia. The green cross signifies medical
marijuana. A collective garden is a place where patients share the resources, expenses,
and responsibility of securing medical marijuana. In order to partake in the activities of
a collective garden you must have proof of medical authorization from a qualified
Doctor and show state issued identification. Once registered with the collective you may enter the facility, and review the various types of medication currently offered, as well
as, volunteer and assist with delivery to home-bound patients. At this time we carry
approximately 25 different strains of medical cannabis. We also carry oils, edibles, and
tea. Over the next few months inventory growth will be dictated by patient demand.
Many people are asking if I received an I502 license for retail marijuana sales. The an-
swer is no. The retail licenses have not been issued. However… rumor has it they are
holding the lottery at end of April. Other people have asked if I get my retail license will
I continue to operate a collective. Yes. I will try but I502 has some distinct differences
then RCW 69.51 (Medical Marijuana Law). The most serious of these distinctions is the
tax rate. Retail store tax rate will be 75% while collective gardens operate as a tax free
non-profit. The result of this disparity means patients will be forced to pay more for medicine. A recent bill was introduced at the legislature (SB 5887) that would grant
medical patients a tax exemption at retail stores but only if they show proof that they
are registered with a proposed state register. The bill also called for expiration of the
affirmative defense for possession of medical marijuana. This proposal caused much
dispute amongst the medical marijuana community and ultimately the bill failed to
pass. So…at the moment…medical marijuana exists as its own law under 69.51 and has
not been merged with I502.
As a result of SB 5887 failure the long range plan for collective gardens is unknown.
The bill proposed that existing collective gardens satisfying the 1000 ft requirement of
I502 would be grandfathered in as retail stores and given a medical endorsement. This
is best case scenario. But…like I said…the bill failed. However…I suspect this particular
section will reappear in similar legislation next year.
Until more is known we will continue operating as a non for profit collective garden. If
you have questions or would like more information please give me a call. I’m happy to
explain things and address concerns you may have about the newest addition to our
