5. Committee Reports
Public Safety and Building & Code Enforcement: Mazzocco stated that there was a meeting on January 18. Discussions included Lexipol and the Complaint Policy. Also discussed updating procedures for dealing with snow removal and grass height. Chief Davis is working on wording for an ordinance.
The next meeting will be February 15.
There was a meeting on the 21st for a discussion on the Healthy Streets for this year.
Business District Relations and Development: Abel stated there was a meeting in January. They discussed the Vacant Property Ordinance. There were a couple of CDC updates and a reorganization meeting last week. There will be a CDC meeting tomorrow to discuss some events during covid.
The Library has been hosting a food drive for the Free Pantry. There were some funds left over from the Holiday Fund Drive; it was used to purchase two more cabinets for downstairs.
Planning, Sustainability, and Inclusion: Bouldin stated that the committee met on January 19th. Discussion included the Strategic Plan and the possibility of a non-discrimination ordinance.
The next meeting will February 16th.

Finance and Legal: Moore stated that the committee met last Tuesday. Hilary Taylor from Papernick and Gefsky gave a presentation on the eviction moratorium for leases in Allegheny County.
There was also a discussion on the opening of the Dormont Pool for 2021.
Recreation and Community Affairs: Ventresca stated that the committee met on January 11th. There was discussion on opening the pool this year and recreation events for the year.
The next meeting will be on February 8th at 6pm.
Lehman spoke about Black History Month and its origin.
Property, Supplies, and Public Works: Fabus stated that there was a meeting and discussion of the Dormont Stormwater Authority proposal to add a rain garden.
6. Comments from the Mayor
Mayor Walsh stated he attended a couple MRTSA meetings, they are still searching for a new chief.
Permit Parking will be addressed at the March meeting.
Walsh thanked Council for the police department's new car which was approved last year. It was picked up a couple of weeks ago.
Walsh discussed the passing of James "Big Jim" Harrod. He was a Life Member of the Fire Department, and member of the Historical Society, VFW, and Parade Committee. He will be missed by many.
7. Junior Council Report
Ethan VonHedemann stated that the KOSD teachers announced that they will be going on strike this month.
8. Council President's Report
Fabus stated that the numbers for covid seem to be dropping in Allegheny County. The vaccine is starting to get around to the public.

Fabus asked that residents help their neighbors if they need help with the snow removal on their sidewalks.
Fabus asked that residents please shop local for Valentine's Day gifts.
Fabus stated that the borough lost a true ambassador last month, Rich Zange. He was a member of DABA for over 30 years, he was known as Mr. 50/50. He has a couple family members that work for the borough. He will be missed.
9. Borough Manager's Report
Estell briefed on his meetings involving the Martial Plan and Climate Action within our region. One of the Connect Interns was able to collect usage from the local utilities.
Estell stated that there is planning for the next Glass Recycling Event which hopefully will be held in the Dormont Pool Parking Lot in late February.
Estell briefed on the new borough app Access Dormont. Estell asked residents to not use Dormont Delivers app, we can't access it to change anything in there.
Estell stated that he will be meeting with other managers in the area to discuss operations for pools this season.
Estell stated that the zoning rewrite is almost complete. As soon as there is a completed document, he will notify Council and the Planning Commission. Then the document will become available for public review.
Estell is submitting an award application for the borough and Mt. Lebanon for the Neighborhood Aid Project which helped greatly during the pandemic.
Estell stated that he will participate in Representative Dan Miller's next Economic Development Forum. Discussions will include the new zoning ordinance and TOD opportunities.

Lehman had a question regarding the striping of parking spaces on the roads. Estell stated that the Traffic and Parking Planning Commission will develop a policy regarding the issue.

a. 2021 Open Cut Spot Repair Project Project
Award contract in the amount of $84,039.00 to NIANDO Construction,

Award contract in the amount of $329,738.75 to Independent Enterprises,

2. ENGINEERING IN PROGRESS
a. ALCOSAN Sewer Regionalization Implementation
ALCOSAN has provided a transfer agreement to the Borough for subject
Contract was awarded at the February 1, 2021 council meeting. Notice of
award was issued February 3, 2021. Contracts have been executed.
Contract start date will be February 26, 2021. CCTV began on February
23, 2021.
d. 2021 Road & Alley Resurfacing Project
Project design was finished in December 2020. Bids were received on
February 25, 2021. See my February 26, 2021 Review of Bids.

Project is complete being closed out.

General Terms and Conditions
Invoicing and Payment Invoicing for this project will occur monthly as work is performed. Payment is due thirty (30) days after receipt of the invoice. The
Gateway Engineers, Inc. (hereinafter referred to as “Gateway”) must be notified in writing of any questions concerning an invoice within ten (10) days. Failure to
do so within the prescribed time frame constitutes acceptance of the invoice. Gateway reserves the right to stop work immediately on any project and hold work
in progress (if applicable), if an invoice is 60 days past due or older. If Gateway initiates legal proceedings to collect delinquent invoices, Gateway shall be
permitted to recover all legal fees and costs associated with collecting such delinquent invoices.
Rate Escalation If the attached scope of work is performed on a time and materials basis and work extends beyond the calendar year of the acceptance of this
contract, Gateway will adjust the hourly billing rates to its newly-adopted standard hourly rate schedule.
Additional Work If any additional work is required beyond the scope of the agreement, the cost for the additional work will be presented for your approval prior
to commencement of work. Additional work may be completed under this contract upon receipt of an Additional Work Authorization Form signed by the Client.
Additional work will be invoiced monthly as work is performed in accordance with the standard hourly rate schedule in force at that time.
Direct Expenses Printing/plotting costs for the project are not included in the proposal price. The cost for these services is $0.20 per 8½x11 color laser copy,
$0.35 per 11x17 color laser copy, $0.12 per square foot for prints, $0.75 per square foot for color prints and $0.95 per square foot for mylars.
Subconsultants In the completion of this contract, Gateway may use subconsultants at its discretion in order to complete the scope of work in a timely and
efficient manner. The costs of these subconsultants are included in the estimated fee of the project, if provided.
Work Product All plans, specifications, letters, reports and other products provided by Gateway are intended to satisfy the scope of this project only. Gateway is
not liable for the use of its work product by anyone for any purpose other than by the Client for this project and in accordance with this contract.
Changed Conditions Gateway will promptly notify the Client in writing if it discovers conditions or circumstances that were not contemplated at the
commencement of this contract, which in Gateway’s judgment significantly affect or may affect the services or the recommended scope of services. Subsequent
to that notification, the Client and Gateway will either negotiate a revised scope and estimated fee or terminate the contract.
Assumptions, Services and Information Provided By Others This contract assumes the base conditions to be true as set forth in the proposal, and likewise
assumes that services and/or information provided by the Client or their agents is accurate and in a useable form. If these assumptions are found to be untrue, an
additional fee may be required to compensate Gateway for any extra work.
Hazardous Materials The Client agrees to advise Gateway about the presence of any known hazardous substances or any known condition existing in, on, or near
the site presenting a potential danger to human health or the environment. Gateway does not have any responsibility to locate, identify, evaluate, treat or
otherwise consider or deal with hazardous materials.
Access/Right of Entry Unless otherwise agreed, the Client will provide access to the land and/or facilities for Gateway and its subconsultants. Gateway will take
reasonable precautions to minimize damage to said land or facilities by its personnel and/or equipment.
Termination This contract may be terminated by either party upon fourteen (14) days prior written notice. In the event of termination, Gateway shall be
compensated by the Client for all costs incurred and services performed up to and including the termination date.
Limitation of Liability Gateway, its shareholders, directors, officers, employees and agents, shall not be liable to the client for any special, consequential,
incidental or penal losses or damages.
Indemnification Gateway agrees to indemnify and hold harmless the Client and its officers, directors, and employees from and against any and all claims, suits,
liability, damages, injunctive or equitable relief, expenses including reasonable attorneys’ fees, or other loss to the extent caused by Gateway’s negligent
performance of services. The Client agrees to indemnify and hold harmless Gateway and its agents, subcontractors, directors, officers and employees from and
against any and all claims, suits, liability, damages, injunctive or equitable relief, expenses including reasonable attorneys’ fees, or other loss arising from
damage to subterranean structures or utilities unless correctly shown on plans furnished by the Client, or arising from any negligence, gross negligence or willful
misconduct by the Client and/or its officers, directors, employees and agents.
Insurance During the terms of any contract which might result from this proposal, Gateway will have in force the following types of minimum insurance
coverages: A) professional liability – $4,000,000 per claim/$4,000,000 aggregate limit, B) workman’s compensation – statutory limits, C) general liability –
bodily injury/property damage $1,000,000 per occurrence, D) automobile liability – bodily injury/property damage $1,000,000 combined; uninsured and under
insured motorist $35,000, and E) excess liability $8,000,000.
Laws and Severability This contract shall be subject to, interpreted, and enforced according to the laws of the Commonwealth of Pennsylvania. If any part of this
contract shall be held illegal, unenforceable, void, or voidable by any court of competent jurisdiction, each of the remainder of the provisions shall nevertheless
remain in full force and effect and shall in no way be affected, impaired, or invalidated.
Assignment The Client and Gateway respectively bind themselves, their successors, assigns and legal representatives to the other party to this agreement and to
the partners, successors, assigns and legal representatives of such parties with respect to all covenants of this contract. Neither the Client nor Gateway shall
assign, sublet or transfer any interest in this contract without the consent of the other.

In February the Borough advertised for bids for the 2019 Open Cut Repair Contract. On
Wednesday, February 27, 2019, the Borough received bids for the project. Three sets of bid
documents were issued/sold and two bids were received. The following are the results of the bids
received. A bid tabulation for project is attached:

My review of the bids indicates that all totals are mathematically correct and do contain all required
documentation properly executed in accordance with the requirements of the bid specifications.
The Borough is familiar with the work of the low bidder, NIANDO Construction, Inc., having
worked with them in the past, most recently on the 2019 Open Cut Spot Repair Project and the
Comprehensive Sewer Rehabilitation Project. My experience with this contractor is that they
compete the projects within budget in a timely professional manner.
After review of the bids, I find the apparent low bidder, NIANDO Construction, Inc., to be the
lowest responsive and responsible bidder. Based upon the Borough’s experience with this bidder
and the value of the bid, I would recommend award of the Contract to NIANDO Construction,
Inc. in the amount of $84,039.00.

VACANT PROPERTY ORDINANCE
AN ORDINANCE OF THE BOROUGH OF DORMONT, ALLEGHENY COUNTY, STATE OF PENNSYLVANIA, ENACTING REGULATIONS RELATING TO VACANT BUILDINGS IN THE CENTRAL BUSINESS DISTRICT, IN ADDITION TO THE
PROVISIONS SET FORTH IN THE ADOPTED INTERNATIONAL PROPERTY MAINTENANCE CODE.
The Borough finds as follows: A. The central business district (contained in the C Zoning District) is the most publicly visible area in this
community. The condition of this district has significant economic and social impact on the community. B. When the owner of a vacant property in the central business district (C Zoning District) fails to actively
maintain its condition and appearance, and does not strive to keep the property occupied with legally permitted uses, the building can become a major cause of blight to this community. Vacant buildings discourage economic development and negatively impact appreciation of property values.
C. It is the responsibility of property ownership to prevent their property from becoming a burden to this
community and to the public health, safety, or welfare. D. One vacant property that is not well maintained and managed can be the core and cause of spreading
blight. Section 1. Applicability and Scope: The requirements of this ordinance shall be applicable to every property in the “C” zoning district in the Borough of Dormont, and to each owner of any property in the “C” zoning district that has a vacant “ground floor” space, as defined by this ordinance.
Section 2. Definitions: As used in this Ordinance the following words and phrases shall have the meanings indicated unless the context clearly indicates a different meaning: Property: Improved real estate including buildings or structures. Vacant: A building or structure space shall be deemed to be vacant if no person or persons
currently conduct a lawfully licensed use in said space. Ground Floor: Any floor of a building with direct access to grade, that is located less than one story
above, or less than one story below grade, provided that no portion of a floor that constitutes a cellar (as defined in this article) shall constitute a “ground floor”.

Cellar: A room typically used for storage and mechanical equipment that is located in the basement of a building and is not used for commercial or residential purposes.
Section 3. Vacant Property Monitoring Fee: During each calendar year, the municipality will identify ground-floor spaces in the “C” Zoning District that are deemed vacant as defined by this ordinance. The vacancy “Start Date” shall be the date of mailing of a written notification by the municipality that the subject property’s ground-floor space has been identified as vacant. On the 45th day after the “Start Date”, should said ground floor space remain vacant as defined in this ordinance, the owner of the building in which said vacant space is present shall be required to pay a vacant property monitoring fee, to be established by resolution of the municipal government. There shall be no pro-ration of the monitoring fee. The monitoring fee shall not be imposed on vacant properties, as defined in this ordinance, that are the subject of an active building permit for repair or rehabilitation, and the owner is progressing diligently to complete said repair or rehabilitation.
Section 4. Vacant Property Monitoring Fee Waiver: The monitoring fee, as required herein, shall be waived in full by the municipality if, by the 45th day after written notification as described in Section 3 herein, all of the following conditions are present: 1. The street-level exterior building components in which said ground-floor vacancy is identified are clean (including glass inside and out). A minimum of 70% window transparency must be maintained. 2. The property is not in violation of any provision of the Township’s property maintenance code(s), or any other municipal ordinance. 3. A professionally produced legal sign is prominently displayed promoting the vacant space for sale and/or for lease, providing (at least) a contact phone number for information and showings. Said sign must be incompliance with applicable sign ordinance(s), and at minimum it’s font size must be reasonably readable from the adjacent roadway. Handwritten signs are not permitted relative to this requirement. 4. All local real estate taxes are paid in full. The monitoring fee waiver may be revoked by the municipality if any of the above required conditions is not in place continuously until the vacant condition no longer exists. Section 5. Severability: If any section, subsection, sentence, or clause of this Ordinance is held, for any reason, to be invalid, such decision or decisions shall not affect the validity of the remaining portions of this Ordinance.

MEMORANDUM OF AGREEMENT BETWEEN THE INTERNATIONAL ASSOCIATION
OF FIRE FIGHTERS, LOCAL NO. 3584 AND THE BOROUGH OF DORMONT
Whereas, I.A.F.F., Local No. 3584 (“Local 3584”) and the Borough of Dormont
(“the Borough”) are parties to a collective bargaining agreement that became effective
January 1, 2020 and remains effective until December 31, 2023 ("CBA");
Whereas, within the CBA, Local 3584 and the Borough agreed that they would
reopen the CBA for the purpose of implementing a cost neutral Deferred Retirement
Option Plan (“Drop Plan”) and that the pension calculation shall be based upon the
highest 36 months of consecutive earnings;
Whereas, in preparation for the re-opener, the Borough requested an actuarial
study from the Borough’s pension actuary and both parties have reviewed and relied
upon such actuarial study in reaching an agreement as to the terms and conditions of
the Drop Plan that will be implemented;
Whereas, the Borough and Local 3584 were able to agree upon the following
terms to resolve the outstanding issues with regard to the Drop Plan reopener and
agree to add the following provision into Article V, Section E. of the CBA as follows:
E. The Borough and the Union agree to implement a Deferred Retirement Option Plan, here in referred to as a DROP Plan on January 1, 2021. The Borough will amend the Borough’s Pension Plan to provide the following Drop Plan for all bargaining unit employees and the Fire Chief who qualify and voluntarily elect to participate:
1. Eligibility: A member may become a participant in the DROP after attainment of Age 57 and completion of 20 years of service. 2. Election of Participation: Election to participate in the DROP is irrevocable. The member shall make the election by using forms and procedures prescribed by the Borough’s Non-Police Employee Pension Board.
3. DROP Pension Payments: Upon entry into the DROP; a member's service and average applicable compensation shall be frozen and his/her DROP pension payment shall be calculated as if he/she actually retired on the date he/she entered the DROP. The monthly DROP pension payment shall be credited to the member's individual DROP account. No assets shall be segregated due to the establishment of individual DROP accounts. There shall be no additional costs other than administrative costs to the Borough’s Non-Police Employee Pension Plan. 4. Individual DROP Account: A member's individual DROP account at any time is equal to the sum of the monthly DROP pension payments credited to the

account, accumulated with interest at the rates of a minimum of 0% to a maximum of 4% compounded monthly, based on the performance of the investments in the fund.
5. Maximum Participation: The maximum participation in the DROP is thirty-six (36) months. Once the maximum participation has been achieved, the member must terminate employment and separate from service. Upon separation from service, the monthly payments shall be paid directly to the member and will no longer be credited to the member’s individual DROP account. 6. Minimum Participation: There shall be no minimum participation in the DROP. The member may terminate employment and separate from service with no restriction. Upon separation from service, the monthly payments shall be paid directly to the member and no longer credited to the member's individual DROP account. 7. Distribution Options: Commensurate with DROP participation, a member shall make an election, on forms designated by the Borough’s Non-Police Employee Pension Board, of the payout option(s) he/she wishes at the termination of the DROP period. This election may be changed at any time prior to termination. The distribution Options are as follows:
1) A full lump sum distribution; 2) Rollover to another qualified retirement plan (as permitted by law) or to an IRA; or 3) Any other distribution provided by the Borough’s Non-Police Employee Pension Board/Third Party Administrator.
8. Beneficiary Designation: Commensurate with DROP participation, a member shall make an election, on forms designated by the Borough’s Non-Police Employee Pension Board, of the beneficiaries he/she wishes to receive the monies in his/her individual DROP account in the event of his/her death before all monies have been distributed.
9. Disability: A member who becomes permanently disabled during the DROP
period and retires from service shall revert to his/her normal retirement pension and to directly receive these pension payments which were being deposited into his/her individual DROP account.
10. Employee Pension Contribution: Effective January 1, 2021, if the total number of firefighters and the Fire Chief exceeds the number seven (7), any such newly hired employee shall pay $27.47 per pay (26 pays during a year) into the pension plan. Effective January 1, 2023, all of the employed firefighters and the Fire Chief shall each pay $27.47 per pay (26 pays during a year) into the pension plan. The employee pension contributions shall be a pre-tax deduction

and the pay stubs and all other applicable payroll documentation shall designate the deduction as a “Drop Pension Contribution.” 11. All firefighters shall continue to receive compensation increases while participating in the drop, however no such increases shall be factored into pension calculations once they have formally entered into the Drop Program.
Whereas, as a matter of housekeeping, the Borough and Local 3584 agree to move the pension calculation language (highest 36 months of consecutive earnings) to Article V, B, which shall be amended to provide as follows: B. Said pension is to be calculated on the basis of the highest thirty-six (36) months of consecutive earnings said employee worked or was paid prior to retirement. Whereas, all other terms and conditions within the CBA shall remain as is.

AMEND BOROUGH FEE SCHEDULE A RESOLUTION OF THE BOROUGH OF DORMONT IN THE COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA, AMENDING RESOLUTION NO 01-2021.
WHEREAS, the various ordinances and codes of the Borough of Dormont require that fees be established from time to time by the Dormont Borough Council for services, permits and licenses; and

Borough of Dormont COVID-19 LEAVE POLICY
DEFINITIONS:
• Quarantine keeps someone who might have been exposed to the virus away from others. • Quarantine time period is typically 10-14 days from the date of last exposure to a COVID-
19 positive person, but can vary based on the facts of the individual case. • Quarantine periods are determined based on CDC/Pennsylvania Department of
Health/Allegheny County Health Department guidance and the health circumstances of each individual.
• COVID-19 Leave shall be up to ten (10) days of administrative leave. Said leave shall be in addition to an employee's sick leave.
ELIGIBILITY The COVID-19 Leave is available to all full-time staff as outlined below.
The staff member must contact the Borough Manager immediately regarding COVID-19 exposure, symptoms, positive COVID-19 tests, or quarantine orders. Eligible staff members who meet the following criteria will qualify for the COVID-19 Leave: • A staff member who is diagnosed with the COVID-19 virus and is unable work remotely
or too ill to work; • A staff member who is experiencing symptoms of COVID-19 as defined by the Centers
for Disease Control, has been tested and is awaiting test results in quarantine at home; • A staff member who has been advised by Borough Manager, local health authority, or
their medical provider to quarantine due to concerns related to possible COVID-19 exposure, and is waiting for the test result and is unable to work remotely or too ill to work;
• A staff member who is subject to a federal, state, or local quarantine or isolation order related to COVID-19 and is unable to work remotely or is too ill to work; or,
• A staff member who is advised by a household member's medical provider to quarantine due to concerns related to COVID-19 and is unable to work remotely or is too ill to work.
PROCESS Staff members eligible for COVID-19 Leave shall:
1. Make a request to the Borough Manager to use COVID-19 Leave. 2. Staff must provide documentation supporting their request. Documentation may take the
form of a doctor's note, other similar medical documentation, or the employee's attestation.
EXPIRATION This policy shall expire on December 31, 2021.

RESOLUTION NO. 4, 2021
RESOLUTION OF THE COUNCIL OF THE BOROUGH OF DORMONT ESTABLISHING RATES OF PAY FOR NON-UNION BOROUGH OF DORMONT CROSSING GUARDS FOR THE YEAR 2021. Whereas, the Borough of Dormont employs both union and non-union employees; and Whereas, non-union pay rates and benefits are required to be annually approved by Council of the Borough of Dormont; and NOW, THEREFORE, BE IT RESOLVED, that the Council of the Borough of Dormont approves the following monthly salaries for non-union Borough of Dormont employees for the year 2021, to begin on January 1, 2021, with compensation payable in bi-weekly installments in a manner identical to all Borough employees: Position Hourly Salary Crossing Guard-Less than One Year of Service $14.00 Crossing Guard-More than One Year of Service $15.00 Guards shall be paid a minimum of four hours for each day worked. AND BE IT FURTHER RESOLVED, that the Council of the Borough of Dormont approves the following benefits for non-union Borough of Dormont crossing guards for the year 2021, to begin on March 1, 2021:
A. PERSONAL LEAVE
All crossing guards are entitled to three (3) days (four hours per day) of personal leave per year. These days do not accumulate and cannot be sold back.
B. BEREAVEMENT All crossing guards are entitled to three (3) days of bereavement leave for the death of: spouse, children, parents.
