Approval of the Previous Minutes – February 7, 2019
The Vice Chair asked if there were any corrections to the minutes of the February 7, 2019 meeting. There being no substantive amendments, upon a motion by Ms. Boyer, seconded by Ms. Kodama, it was voted on and unanimously carried to approve the minutes of the February 7, 2019 meeting as circulated.
Executive Officer’s Announcements Report: The EO announced that Daria Loy-Goto is no longer the CEO with the Regulated
Industries Complaints Office.
Conferences/Seminars/Meetings NCSBN Midyear Meeting, March 26-28, 2019, San Antonio, Texas The EO announced that the Chair and Ms. Kodama will be attending.
2019 Legislative Session The EO reported on the following legislative measures:
Aspiration Abortions SB 415 Relating to Health – This bill crossed over to the House. Nurse Licensure Compact HB 1363, HD2 Relating to Nurses – This bill crossed over to the Senate. 2019 Renewal Continuing Competency Updates to Continuing Competency Booklet - The 2019 Nursing License Renewal
Requirements and FAQs, February 2019 that was posted on the Board’s web page on February 19, 2019, was distributed to the Board members for their information.
The EO reported that this new information includes updates to the Continuing
Competency Booklet as well as FAQs that was gathered from the HSCFN, HNA and HAH.
Dissertation from Kelly J. Collins – Deferred from January, February and March
2019 Meetings The EO was concerned that perhaps the Board should not be reviewing
dissertations to determine if it meets the continuing competency requirement and recommended that the Ms. Collins determine if her dissertation meets one of the learning activity options and if/when requested by way of the random audit, to submit her dissertation, if she determines that it does meet one of the learning activity options.
Hilopa’a Family to Family Inc. – Request for Continuing Education Credit
The Board discussed the following email inquiry: “Hilopa‘a Family to Family, Inc. would like to offer Nursing Continuing Competency
Credits for our upcoming No Wrong Door E Komo Mai training. I have attached a document with further information, for review by the Board. The document provides details of the training, including: the training provider, instructor, course content, objectives, and dates of the trainings.”
The Board reviewed the information that was provided, including but not limited to
the summary of the course, training provider(s), course content, learning objectives and course content description and determined that this course did not contain nursing related content and there was no indication that this course was approved/accredited by a Board approved provider therefore the Board was not able to approve this course for continuing education credit.

Request from Patrick Mulholland, Clinicals and Lab Instruction Count Towards CEU Hours?
The Board discussed the following email inquiry: “My name is Patrick Mulholland, RN# 68434. I worked as a University of Phoenix
clinical instructor in 2014 and 2015, prior to working private duty. I am inquiring if this 2 year time spent doing clinicals and lab instruction can count for the CEU hours required for license renewal for this year. I spoke with your staff this morning regarding this question and was given this email address to respond to. My job title was clinical instructor/preceptor, my role changed depending on the level of skill of the class and location we were assigned with the students. I was also assigned to the simulation laboratory, with electronic mannequin, where the students were given Medical-Surgical nursing scenarios to navigate and create a dialogue about best practice while being recorded and critiqued by both peers and instructors. Critical thinking and decision making were evaluated and discussed as a group after each scenario was played and recorded. My role was to guide and participate in the student evaluations and discussions. I was a reference for current best practice in medical surgical nursing from my experience with working at HPH Straub Hospital and Queens Med Center. I worked as the primary clinical instructor at Tripler, Castle, Kaiser and Ann Pearl nursing home with Medical Surgical nursing 1 and 2 classes. I also volunteered at the Kidney Foundation as a RN reading urinalysis test results at community screenings in Kaneohe and Moiliili. My bosses that I reported to were Glenda Tali, and Juanito Torres at the University of Phoenix nursing program during 2014 and 2015. I worked well over the 120 hrs for UOP during that time.”
Based on the information contained in Mr. Mulholland’s email, the Board
determined that he appears to be an instructor and wants credit for teaching his students.
The Board determined that this does not meet the preceptor learning activity
option. Criminal History Record Check The Board discussed the percentage of nurses to be audited for the upcoming
renewal. The EO reported that those professions under PVL with continuing education audit
5% of the total number of licensees who renew. She stated that if the Board chooses to do the 5%, the estimated number of nurses to be audited with the 2-4 years from July 1, 2019 would be approximately 1,250 if 25, 000 nurses renew which breaks down to approximately 52 nurses per month over 2 years or 26 nurses over 4 years. She also stated that when the new rules went into effect last October, the Board now has the authority to audit APRNs’ with prescriptive authority for compliance with the continuing education requirement.

After some discussion, it was the consensus of the Board to audit 5% for LPNs
and RNs and 5% for APRNs with prescriptive authority. the list was posted on the Board’s web page and have triggered phone calls on
how and why and is hoping that the memo she is preparing will answer some of the questions, but that nurses should go to the Board’s web page to read at least the Important Announcement as well as the Renewal and Restoration requirements.

• 3/1/19 Recess: The Vice Chair called for a recess at 9:59 a.m. The Vice Chair resumed the meeting at 10:07a.m. Scope of Practice Survey of Health Maintenance Tasks Delegated to Unlicensed Personnel
The Board discussed a list of tasks that may be performed by a “qualified” unlicensed person to perform health maintenance tasks.
The Board determined that an unlicensed assistive personnel may administer
“other injectable medication” that is “prefilled”, i.e. epi pens, but drawing up injectable medications is prohibited and that they may also perform tracheostomy suctioning provided they have received the appropriate training and have shown competency to perform this procedure.
In accordance with HAR § 16-201-90, the above interpretation is for informational and explanatory purposes only and based solely on the information provided. It is not an official opinion or decision and therefore not binding on the Board.
Nurse “Prescribed” Medical Marijuana
The Board discussed the following email inquiry: “I am emailing the Board of Nursing to inquire about medicinal marijuana. If a nurse is prescribed medicinal marijuana for chronic pain, is this allowable if taken as prescribed outside of work? Or are the regulations different for medical providers?”

After some discussion, the Board determined that the nurse should check with the policies of the practice setting/facility and also notes the following section that authorizes the Board to take disciplinary action again a nurse for being impaired when practicing nursing, HAR §16-89-60(7)(B) states:
§16-89-60 Types of unprofessional conduct. The types of unprofessional conduct shall include, but are not limited to, the following:
(7) Engaging in any act inconsistent with the practice of nursing as
defined in section 457-2, HRS, for that of a licensed practical nurse or a registered nurse including: (B) Practicing nursing when physical or mental ability to
practice is impaired by alcohol or drugs, or because of other physical, psychological, or mental impediment;
Hawaii State Center Ms. Reichhardt reported that they will be sending reminders about the new for Nursing: renewal requirements and about completing the workforce survey. In addition, Ms.
Reichhardt reported that the Center conducted a review of clinical placements access and learned that the decline of placements is due to several factors including shorter hospital stays which in turn requires fewer staff; and closure of hospital floors and units. Ms. Reichhardt stated that if Hawaii sees a decrease in the capacity for learning then it will cause a decrease output of nurses in the future. She noted that their clinical partners have been very forward in thinking and innovated in ensuring no nursing student is without placement.
Ms. Reichhardt stated that the Center will be hosting an Evidence Based Practice Workshop in April. In November, the center will be hosting a Leadership in Action Conference that includes EBP training.
American Nurses Dr. Beechinor reported on the following for their organization: Association – Hawaii - Solid Leadership Group including: Katie Kemp, Aggie Pigao-Cadiz, Andrea Chapter: Montgomery-Kylie, Jailua Navarette, Nancy Atmosphera-Walch, Joan Parker-
Diaz, Marion Poirier, Claudine Tomasa, Denise Cohen, and Stacey Kracher; - They have entered the ANA Standards for Excellence program in their
commitment to ethical and effective governance; - They are currently surveying their 300+ members and need 50% by 5/1/2019; - Another survey for no-members to find an additional 200+ members who are
interested in May 2019; - They have been actively filing testimony supporting bills for preceptor tax credits
and issues relating to homelessness, mental illness, keiki and Kupuna health and also working with the HSCFN to respond to other bills of interest; and
- They are participating in various community activities such as the Harm Reduction Conference, Annual AIDS Day, NAMI Walk, Opening Day of the 2019 Legislature and other nursing organizations activities.
